Any violation of these terms may be subiect to fines. imprisonment or civil action; or may cause the permit to be null and void. Upland Development 1) Unless specifically altered herein, this permit authorizes the grading and other land disturbing activities associated with the development of the above referenced property, all as expressly and specifically set forth in the attached permit application and workplan drawings. Any additional land disturbing activities and/or construction may require a modification of this permit. Contact a Division of Coastal Management representative at (252) 946-6481 for this determination. (See attached sheets for Additional Conditions) RECEIVED DEC 31 2014 This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. Spoil Disposal 4) All excavated materials shall be confined above normal water and landward of regularly or irregularly flooded wetlands behind adequate dikes or other retaining structures to prevent spillover of solids into any wetlands or surrounding waters. 5) The spoil area shall be inspected and approved by the Division of Coastal Management prior to the initiation of any dredge activities. Boat Ramn 6) Unless specifically altered herein, this permit authorizes the boat ramp, all as indicated on the attached workplan drawings. 7) The boat ramp shall either be poured at an upland location and pushed into place once hardened, or poured entirely within a watertight containment structure. Live concrete shall not be allowed to contact waters of the State or waters that will enter waters of the State. Dockin¢ Facility/Fishing Platform 8) Unless specifically altered herein, this permit authorizes the construction of the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this reconfigured docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over public trust waters without permit modification. 9) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable water at or adjacent to authorized work. 10) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 11) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. RECEIVED DEC 31 20N '-)CM-MHD CITY North Carolina Wildlife Resources Commission Permit # 115-14 Page 3 of 4 ADDITIONAL CONDITIONS 12) The pemtittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structures in order to make them more visible during hours of darkness or inclement weather. 13) This permit does not authorize any formalized boat slips. Shoreline Stabilization 14) The authorized riprap shall adhere to the alignment depicted on the attached workplan drawings. 15) The riprap material shall be free from loose dirt or any pollutant. It must be of a size sufficient to prevent its movement from the approved alignment by wave or current action. 16) The riprap material shall consist of clean rock or masonry materials such as but not limited to granite, marl, or broken concrete. Sedimentation and Erosion Control NOTE: An Erosion and Sedimentation Control Plan may be required for this project. This plan shall be filed at least thirty (30) days prior to the beginning of any land disturbing activity. Submit this plan to the Department of Environment and Natural Resources, Land Quality Section, 127 Cardinal Drive Extension, Wilmington, NC 28405. 17) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 18) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, etc.). General 19) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. 20) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. River bank will be excavated to create boat ramp. Stone fill will be placed in river to extend ramp once out of cut. Rip rap will be placed to armor ramp slopes. PROJECT SUMMARY: The applicant proposes construct a public boat ramp and fishing pier on the Roanoke River off Weeping Mary Road in Lewiston. Lewiston BAA NCWRC Bertie County PROJECT SETTING The North Carolina Wildlife Resources Commission (WRC) has submitted a Major CAMA request to construct a public boating access area on the Roanoke River. The 3.3 acre project site is located at 838 Weeping Mary Road (SR 1128) Lewiston Woodville in Berrie County. The project site is on Weeping Mary Road approximately 2 miles after the road becomes gravel. The site is down an existing access easement that runs parallel to a wire fence. The project site is currently used for hunting and has a thinned forest to the west, an agricultural field and sand pit to the southwest and forest to the east. There is a relic flood berm that bisects the property that runs parallel to the Roanoke River. The 263ft shoreline is forested (hardwoods and shrubs) with a steep sloping bank to an elevation 25ft above NWL. The Roanoke River at the project site is classified as C by the Environmental Management Commission and as a joint Anadromous Fish Spawning Area by the Marine Fisheries Commission (NEC) and the WRC. The Roanoke River is 270ft wide at this location. PROJECT DESCRIPTION The WRC proposes to Pict a 195ft byJJWncrete double boat ramp that extends to -5ft below Normal Water Level (NWL). Above NWL there will be rr260ft by 30ft concrete ramp that provides access to4he ramp. Upstream and adjacent to the boatramp the applicant is proposing to construct an *ft by 7ft floating dock for, assisting in the launching and recovery of boats. This portion of the floating dock will be accessed by an 8ft by73ft dock above NWL. During the grading process 2,580 cubic yards of high ground will be excavated. There will be a 60ft by 5ft concrete sidewalk that connects to a 11Oft by 7ft finch boardwalk above NWL that provides access to the fishing platform. The WRC also proposes to create 18 gravel truck and trailer parking spaces, 1 concrete truck and trailer handicap accessible parking space, 5 gravel car parking spaces, I concrete handicap accessible parking space, and gravel the existing access drive. In total the project will disturb 4.8 acres (including the access easement). This construction will create 13% of impervious surface in the Division of Coastal Management 75ft Coastal Shoreline AEC. The WRC has stated that they will be submitting a stormwater permit application and a sediment and erosion control plan to the Division of Land Quality. In total, including the access easement there will be 4.8 acres of land disturbance associated with this project. Unless otherwise authorized by this permit, all fill material placed in waters or wetlands shall be generated from an upland source and will be clean and free of any pollutants except in trace quantities. Metal products, organic materials (including debris from land clearing activities), or unsightly debris will not be used. 6. The authorized structure and associated activity must not interfere with the public's right to free navigation on all navigable waters of the United States. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work for reason other than safety. 7. The permittee shall advise the Corps in writing at least two weeks prior to beginning the work authorized by this permit and again upon completion of the work authorized by this permit. 8. The permittee shall require its contractors and/or agents to comply with the terms and conditions of this permit in the construction and maintenance of this project, and shall provide each of its contractors and/or agents associated with the construction or maintenance of this project with a copy of this permit. A copy of this permit, including all conditions, shall be available at the project site during construction and maintenance of this project. 9. The permittee shall employ all sedimentation and erosion control measures necessary to prevent an increase in sedimentation or turbidity within waters and wetlands outside the permit area. This shall include, but is not limited to, the immediate installation of silt fencing or similar appropriate devices around all areas subject to soil disturbance or the movement of earthen fill, and the immediate stabilization of all disturbed areas. Additionally, the project must remain in full compliance with all aspects of the Sedimentation Pollution Control Act of 1973 (North Carolina General Statutes Chapter 113A Article 4). 10. The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction -related discharge. Increases such that the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not considered significant. 11. The AFSA classification includes a moratorium from Feb 15 — June 30 on work such as dredging and excessive pile driving that would prevent the upstream movement of spawning fish. In this case adherence to the moratorium is not necessary as noise disturbance and sedimentation should be minimal, but avoidance of these dates would greatly reduce the chance of spawning fish disturbance. Due to the grade of the riparian area, sedimentation and erosion control measures should be implemented and monitored during construction. The project site is located off a gravel farm road at the end of Weeping Mary Road in Lewiston / Woodville, NC adjacent the Roanoke River. Our comments are provided in accordance with provisions of the Coastal Area Management Act (G.S. I I3A-100 through I I3A-128), as amended, Sections 401 and 404 of the Clean Water Act, as amended, and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.). The applicant proposes to construct a boating access area and public fishing pier. The site includes a 195' by 30' double ramp that will terminate at -5' NWL, a 8' by 7' floating launch dock, a 7' by 74' fishing platform with 8' by 7' pier to access the platform, associated sidewalks, and a parking area with 25 various parking spaces. Total impervious surface within the AEC is 13%. To accommodate the ramp, 125 if of material will be removed to install the apron. The Roanoke River at this location is classified C by the Environmental Management Commission and is designated an anadromous fish spawning area (AFSA) by the NCWRC and NC Division of Marine Fisheries. The NCWRC has reviewed the permit application to assess impacts to aquatic resources. The Roanoke River is designated an AFSA which means it provides important spawning habitat for various anadromous species. One means of protection for these resources is an in -water work moratorium from February 15 — June 30. Activities such as dredging and significant pile driving that would prevent upstream spawn would need to adhere to these dates. Date: October 29, 2014 Consistency Determination: The request is consistent with/not in conflict with the Bertie County 1998 Land Use Plan certified by the CRC on September 8, 1999. Overview: The project site consists of a 3.3 acre lot with 263 linear feet of shoreline on the Roanoke River and an approximately 3 acre abutting area fronting onto Weeping Mary Road. The shoreline lot is owned by the state. An access easement crosses the other area, which is owned by EWM, LLC. The shoreline is situated 25 feet above the Normal Water Level (NWL) of the river. The project site is currently a thinned forest with grass and shrub understory. A flood control berm of undetermined age crosses the middle of the area, parallel to the river. An access road generally follows the access easement from the state owned lot to the public road. The site is primarily within Floodzone AE, with a small area of access road in the Shaded X zone. Water and septic services are not proposed. Approximately 260 feet of the boat ramp will be above NWL. Uplands will be graded to allow the boat ramp to be constructed at a safe slope. Any spoil material will be used on -site for the berm. Riprap will be placed along the edge of the ramp and extended below NWL. All parking will be gravel, with the exception of concrete handicapped spaces. The parking area will include one (1) handicapped accessible trailer parking space and one (1) handicapped parking space. Surface runoff will drain to the river. The flood control berm will be relocated south of the parking area. The waters of the Roanoke River are classified as C in this area and are closed to shellfishing. The waters are designated as a joint Anadromous Fish Spawning Area (AFSA). A review of archaeological resources was not provided. Anticipated impacts: resulting from this project are expected to include: the filling of 3,250 sq. ft. of Public Trust Area/Estuarine Waters Areas of Environmental Concern (AEC); the shading of 593 sq. ft. of Public Trust Area/Estuarine Waters AEC, and; the disturbance of 4.8 acres of uplands. A portion of upland disturbance will occur within the Public Trust Shoreline AEC. Basis for Determination: The Bertie County Future Land Use Map identifies the project site as "Conservation. The Roanoke River is also considered "Conservation", per narrative on Page 94 that includes Public Trust Waters and Estuarine Waters in the classification. The following LUP policies may be applicable to this request: A. RESOURCE PROTECTION 2. Areas of Environmental Concern, a. Estuarine Waters and Estuarine Shorelines: Page 61. "...In order to promote the quality of estuarine waters, Bartle County officials will consider land use controls which protect the values of the estuarine system. Residential, recreational, and commercial uses would also be controlled within the estuarine shoreline provided that: • A significant change of pollution occurring from the development does not exist. • Development does not have a significant adverse impact on estuarine resources. • Development does not significantly interfere with existing public rights or access to, or use of, navigable waters or public resources." PROJECT SUMMARY: The applicant proposes construct a public boat ramp and fishing pier on the Roanoke River off Weeping Mary Road in Lewiston. Lewiston BAA NCWRC Bertie County PROJECT SETTING The North Carolina Wildlife Resources Commission (WRC) has submitted a Major CAMA request to construct a public boating access area on the Roanoke River. The 3.3 acre project site is located at 838 Weeping Mary Road (SR 1128) Lewiston Woodville in Bertie County. The project site is on Weeping Mary Road approximately 2 miles after the road becomes gravel. The site is down an existing access easement that runs parallel to a wire fence. The project site is currently used for hunting and has a thinned forest to the west, an agricultural field and sand pit to the southwest and forest to the east. There is a relic flood berm that bisects the property that runs parallel to the Roanoke River. The 263ft shoreline is forested (hardwoods and shrubs) with a steep sloping bank to an elevation 25ft above NWL. The Roanoke River at the project site is classified as C by the Environmental Management Commission and as a joint Anadromous Fish Spawning Area by the Marine Fisheries Commission (1vTC) and the WRC. The Roanoke River is 270ft wide at this location. PROJECT DESCRIPTION The WRC proposes to construct a 195ft by 30ft concrete double boat ramp that extends to -5ft below Normal Water Level (NWL). Above NWL there will be a 260ft by 30ft concrete ramp that provides access to the ramp. Upstream and adjacent to the boatramp the applicant is proposing to construct an 8ft by 7ft floating dock for assisting in the launching and recovery of boats. This portion of the floating dock will be accessed by an 8ft by 73ft dock above NWL. The uplands will be graded to allow the boat ramp to be constructed at a slope that will allow boats to be launched and recovered safely. During the grading process 2,580 cubic yards of high ground will be excavated. In order to stabilize the proper slopes, rip rap will be placed along the edge of the ramp and extend below NWL to the end of the ramp. For proper installation of the ramp the WRC proposes excavation below the bottom substrate (125 cubic yards). The spoil material will be used on site to reconstruct the existing berm further landward of its current location. Upstream of the boat ramps the WRC is proposing to construct a fixed handicap accessible 8ft by 7ft pier with a 7ft by 74ft fixed fishing platform. The 8ft pier is to allow for fishermen to safely pass other fishermen without conflict. There will be a 60ft by 5ft concrete sidewalk that connects to a 11Oft by 7ft finch boardwalk above NWL that provides access to the fishing platform. The WRC also proposes to create 18 gravel truck and trailer parking spaces, 1 concrete truck and trailer handicap accessible parking space, 5 gravel car parking spaces,1 concrete handicap accessible parking space, and gravel the existing access drive. In total the project will disturb 4.8 acres (including the access easement). This construction will create 13% of impervious surface in the Division of Coastal Management 75ft Coastal Shoreline AEC. The WRC has stated that they will be submitting a stormwater permit application and a sediment and erosion control plan to the Division of Land Quality. In total, including the access easement there will be 4.8 acres of land disturbance associated with this project. The project will provide public access to the Roanoke River for fishing and boating. The improvements are proposed to be constructed on a 3.3 acre parcel of land owned by the State of North Carolina. Access to the site is provided by a Weeping Mary Road and an access easement across property owned by EWM LLC. The site is currently a thinned forest, with a grass and shrub understory. There is an existing access road that generally follows the access easement to the site. A flood control berm of undetermined age crosses through the middle of the site, parallel to the Roanoke River. The Roanoke River experiences large fluctuations in river level. The flood control berm will be relocated to the south on the site, allowing the parking lot to be constructed on the river side of the berm. The proposed access road will ramp up and over the relocated berm. Gravel parking spaces for vehicles with trailers and single cars will be constructed. Concrete handicap parking areas will also be provided. Concrete ADA sidewalks are planned from the trailer parking space to the top of the boat ramp and from the single car parking to the fishing pier. The boat ramp is 30' wide to allow simultaneous launching/recovery of two boats. A floating courtesy dock will be installed on the upstream side of the ramp. We request that the floating courtesy dock be allowed to have an 8' width. The 8' width is requested to allow users traveling in opposite direction to pass easily on the dock. The additional width also creates a much more stable dock for users to walk on. It is the NCWRC's experience that floating dock sections narrower than 8' are not as stable as our users desire. The proposed fishing pier is approximately 8' wide and 60' long. The 8' width is proposed to allow room for users to pass behind active fishermen without conflict. The elevated walkway to the fishing pier is approximately 7' wide. This width is proposed to allow easy access to the pier by disabled fishermen and allow users to pass one another easily. The project will provide public access to the Roanoke River for fishing and boating. The improvements are proposed to be constructed on a 3.3 acre parcel of land owned by the State of North Carolina. Access to the site is provided by a Weeping Mary Road and an access easement across property owned by EWM LLC. The site is currently a thinned forest, with a grass and shrub understory. There is an existing access road that generally follows the access easement to the site. A flood control berm of undetermined age crosses through the middle of the site, parallel to the Roanoke River. The Roanoke River experiences large fluctuations in river level. The flood control berm will be relocated to the south on the site, allowing the parking lot to be constructed on the river side of the berm. The proposed access road will ramp up and over the relocated berm. Gravel parking spaces for vehicles with trailers and single cars will be constructed. Concrete handicap parking areas will also be provided. Concrete ADA sidewalks are planned from the trailer parking space to the top of the boat ramp and from the single car parking to the fishing pier. The boat ramp is 30' wide to allow simultaneous launching/recovery of two boats. A floating courtesy dock will be installed on the upstream side of the ramp. We request that the floating courtesy dock be allowed to have an 8' width. The 8' width is requested to allow users traveling in opposite direction to pass easily on the dock. The additional width also creates a much more stable dock for users to walk on. It is the NCWRC's experience that floating dock sections narrower than 8' are not as stable as our users desire. The proposed fishing pier is approximately 8' wide and 60' long. The 8' width is proposed to allow room for users to pass behind active fishermen without conflict. The elevated walkway to the fishing pier is approximately 7' wide. This width is proposed to allow easy access to the pier by disabled fishermen and allow users to pass one another easily.
