Permit Class NEW Permit Number 71-14 STATE OF NORTH CAROLINA Department of Environment and Natural Resources and s for X Major Development in an Area of Environmental Concern pursuant to NCGS 113A-118 X Excavation and/or filling pursuant to NCGS 113-229 Issued to NC Wildlife Resources Commission,1718 NC Hwy. 56 W, Creedmoor, NC 27522 Authorizing development in Onslow, County at Turkey Creek, 619 Turkey Point Road, Holly Ridge , as requested in the permittee's application dated /5 15/14, including the attached workplan drawings (15) 8 dated 8/13/13 and 7 dated 7/30/13 This permit, issued on August 6, 2014 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may )e subject to lines, imprisonment or civil action; or may cause the permit to ne min anc voia. Upland Development 1) Unless specifically altered herein, this permit authorizes the grading and other land disturbing activities associated with the development of the above referenced property, including the associated driveways and parking areas, all as expressly and specifically set forth in the attached permit application and workplan drawings. Any additional land disturbing activities and/or construction may require a modification of this permit. Contact a Division of Coastal Management representative at (252) 808-2808 for this determination. (See attached sheets for Additional Conditions) This permit action'may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. Signature of Permittee NC Wildlife Resources Commission Permit #71-14 r Page 2 of 4 ADDITIONAL CONDITIONS Boat Launch Pier 2) This permit authorizes only the pier, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this pier without permit modification. No non -water dependent uses of structures shall be conducted on, in or over public trust waters without permit modification. 3) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the pier. Any sewage discharge at the pier shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 4) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 5) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 6) _ This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 7) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 8) The applicant shall place a Primary Nursery Area education poster in the existing kiosk, to educate users of the facility on the importance of a Primary Nursery Area. 9) This permit does not authorize any formalized boatslips. Boat Ramp 10) The boat ramp shall either be poured at an upland location and pushed into place once hardened, or poured entirely within a watertight containment structure. Live concrete shall not be allowed to contact waters of the State or waters that will enter waters of the State. 11) Excavation and ground disturbing activities, associated with the placement of the boatramp, above and below the normal high water line shall be limited to that absolutely necessary to establish adequate ramp slope and provide a ramp no greater in size than specified in the attached permit application and workplan drawings. NC Wildlife Resources Commission Permit #71-14 Page 3 of 4 ADDITIONAL CONDITIONS 12) The authorized project is located within a primary nursery area (PNA). Therefore, in accordance with T15A:07H.0208 of the Rules of the Coastal Resources Commission, no new dredging or excavation within the PNA shall be permitted with the exception of those authorized impacts necessary for the construction of the boat ramp. New dredging in any manner, including "kicking" with boat propellers, is not authorized. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 13) In order to protect juvenile finfish resources, no excavation shall be permitted between April 1 and September 30 of any year, unless a turbidity curtain is used, without priorapproval of the Division of Coastal Management. Spoil Disposal 14) All excavated materials shall be confined above normal water and landward of regularly or irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surrounding waters. 15) The spoil area shall be inspected and approved by the Division of Coastal Management prior to the beginning of any dredge activities. Sedimentation and Erosion Control NOTE: An Erosion and Sedimentation Control Plan will be required for this project. This plan shall be filed at least thirty (30) days prior to the beginning of any land disturbing activity. Submit this plan to the Department of Environment and Natural Resources, Land Quality Section, 127 Cardinal Drive Extension, Wilmington, NC 28405. 16) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 17) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, etc.). Free Standing Bulkhead 18) The new freestanding bulkhead. shall be placed in the same alignment as the existing, deteriorated bulkhead. 19) The freestanding bulkhead shall be solid and constructed of treated wood, metal or vinyl sheet piles, or other suitable materials approved by Department personnel. 20) The permit does not authorize the placement of back fill material, tie backs, deadmen, cables, etc. in association with the freestanding bulkhead. NC Wildlife Resources Commission Permit #71-14 Page 4 of 4 a ADDITIONAL CONDITIONS General 21) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. 22) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 23) The permittee and/or his contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 808-2808 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: The N.C. Division of Water Resources has authorized the proposed project under DWR Project No. 14-0567. NOTE: The U.S. Army Corps of Engineers authorized the proposed project under COE Action Id. To get to the site from Wilmington, take NC Highway 17 north toward Jacksonville. Turn right onto Old Folkstone Road (approximately 28 miles from Wilmington) and continue approximately 2.5 miles. Turn right onto Turkey Point Road and travel approximately 1.7 miles. Bear right to stay on Turkey Point Road and the project site will be located at the terminal end. The project site is owned by the NC Wildlife Resources Commission and is approximately 2.48 acres in size, with approximately 386 linear feet of shoreline frontage along Turkey Creek. Elevations at the site range from 2'-4' above normal high water (NHW) and water depths average approximately -2.5' deep at Normal Low Water (NLW). The property is bordered by Turkey Creek to the south and west, and by vacant and residential properties to the north, and east. There is an existing paved road (Turkey Point Road) that leads to the gravel parking area of the ramp. Two boat ramps (+/- 12-15' in width) are located along the southern shoreline which are accessible by two (2) fixed docks (3' x 30'). The ramps and the fixed dock are severely degraded and in need of replacement. As for the natural conditions at the site, the majority of the coastal wetlands are located to the south, along the southern and eastern sides of the property; however, there is a small patch of coastal wetlands that is located along the northern side of the existing boat ramp. Coastal Wetland vegetation in the vicinity of the existing boat ramp include Glasswort (salicornia spp.), Spike Grass (Distichlis Spicata), Black Needlerush (Juncus roemarianus), Salt Meadow Grass (Spartina patens) and Salt Marsh Cordgrass (Spartina alternii fora). The coastal wetlands on site range in width from 2' to 50'. The Onslow Land Use Plan classifies the upland areas of this project as conservation. The waters of the project site are classified as SA-ORW by the NC Division of Water Quality. The NC Division of Marine Fisheries HAS designated this area of Stump Sound as a Primary Nursery Area, and the waters adjacent to the proposed project are CLOSED to the harvesting of shellfish. PROPOSED PROJECT: The applicant is proposing to replace the existing boat ramp (and dock) and improve the existing parking area. In short, the applicant is proposing to remove the two existing concrete boat ramps, and fixed docks, and replace the ramps in kind (two ramps each measuring 15' x 92'). The two existing fixed docks would be demolished and replaced with one (8' x 60') floating dock, which would be located in between the two proposed ramps. In addition, the applicant is proposing to stabilize the "ramp basin" by installing two vertical breakwater walls (vinyl), each measuring 68' in length (as measured from the high ground, or +/- 50' from the NHW line). The two vertical wall structures would be located along the outside edges of the new 15' x 92' concrete ramp pads, one on each side of the ramp structure (approximately 34' apart). In order to accomplish this task, the applicant is requesting approval to fill approximately 64 square feet of coastal wetlands (primarily Smooth Marsh Cordgrass) along the northwestern side of the ramp. The vegetation here is sparse and 64 sq. ft. of impact is quite liberal as far as impacts are concerned. In addition to the filling of coastal wetlands, the applicant would also need to remove a minimal amount of material within the footprint of the existing ramp, below the normal high water (NHW) level. In total, approximately 81 cubic yards of material would be removed (38' x 43' x -3') from the ff sing the concrete pads. The connecting waters along the outboard side of the proposed ramp average -2.5' to -3.0' at NLW, which would leave a temporary depressing along the toe of the ramp, until the material below the ramp stabilized. No additional excavation activities would take place as there is sufficient water for navigation beyond the edge of the boat ramp. Similarly, no additional wetland impacts are anticipated. The upland development would consist of re -grading and paving the existing driveway and parking areas to delineate parking for trailers, single vehicles and ADA access. According to the application package, the total amount of earth work would be minimal, and limited only to what is necessary to re-level/grade and pave the driveway and parking areas. In total, the current amount of impervious coverage at this site is +/- 29.56%, or 25,563 sq. ft., with the vast majority being allocated to the existing gravel driveway and parking areas. The redevelopment plans (including paving the site) would result in a very small decrease in the amount of built upon area, reducing the amount of impervious coverage to 29.35%, or 25,377 sq. ft. As stated, no new concentrated outlets are proposed at this time as well as no new built upon areas. In total, approximately 53,000 sq. ft. of high ground disturbance would be anticipated as a result of the proposed work. 10. ANTICIPATED IMPACTS The proposed boat ramps would fill approximately 1,600 ft.' of Shallow Bottom. The proposed vinyl breakwater walls, boat ramp and floating dock would incorporate approximately 2,795 ft.2 of open water area (Public Trust area). The proposed ramp installation would result in the filling of approximately 64 ft.2 of coastal wetlands and the proposed approach and spoil disposal area would disturb approximately 53,000 ft.2 of highground. Skvarla, III Secretary A North Carolina Division of Coastal Management (DCM) Fisheries Resource Specialist has reviewed the subject document for proposed actions that impact fish and fish habitats. The purpose of the project is to make improvements at an existing WRC boat ramp. Turkey Creek is designated Primary Nursery Area (PNA) by the North Carolina Marine Fisheries Commission. Primary Nursery Areas are essential for post -larval and juvenile species of finfish, crabs and shrimp because they afford food and protection during a vulnerable period of their life cycle. To protect such sensitive areas, Coastal Resources Commission rules prohibit most new dredging in PNA. Operating vessels in shallow water can result in "prop dredging". To reduce prop dredging in the shallow PNA areas surrounding the ramp, additional channel markers should be included in the approach to the ramp from the Turkey Creek channel to encourage boaters to avoid those areas. Also, an existing PNA educational poster should be included at the kiosk to educate boaters on PNAs. All dredging must occur either outside the in -water work moratorium of April 1 to September 30 or within turbidity curtains. PROJECT SUMMARY: Applicant is proposing to rehabilitate the existing boat ramps (2) and parking area. NCWRC — Turkey Point Boat Ramp Page Two 9. PROJECT DESCRIPTION: The project site is located at 619 Turkey Point Road, adjacent to Turkey Creek, in Onslow County. To get to the site from Wilmington, take NC Highway 17 north toward Jacksonville. Turn right onto Old Folkstone Road (approximately 28 miles from Wilmington) and continue approximately 2.5 miles. Turn right onto Turkey Point Road and travel approximately 1.7 miles. Bear right to stay on Turkey Point Road and the project site will be located at the terminal end. The project site is owned by the NC Wildlife Resources Commission and is approximately 2.48 acres in size, with approximately 386 linear feet of shoreline frontage along Turkey Creek. Elevations at the site range from 2'-4' above normal high water (NHW) and water depths average approximately -2.5' deep at Normal Low Water (NLW). The property is bordered by Turkey Creek to the south and west, and by vacant and residential properties to the north, and east. There is an existing paved road (Turkey Point Road) that leads to the gravel parking area of the ramp. Two boat ramps (+/- 12-15' in width) are located along the southern shoreline which are accessible by two (2) fixed docks (3' x 30'). The ramps and the fixed dock are severely degraded and in need of replacement. As for the natural conditions at the site, the majority of the coastal wetlands are located to the south, along the southern and eastern sides of the property; however, there is a small patch of coastal wetlands that is located along the northern side of the existing boat ramp. Coastal Wetland vegetation in the vicinity of the existing boat ramp include Glasswort (salicornia spp.), Spike Grass (Distichlis Spicata), Black Needlerush (Juncus roemarianus), Salt Meadow Grass (Spartina patens) and Salt Marsh Cordgrass (Spartina alternii lora). The coastal wetlands on site range in width from 2' to 50'. The Onslow Land Use Plan classifies the upland areas of this project as conservation. The waters of the project site are classified as SA-ORW by the NC Division of Water Quality. The NC Division of Marine Fisheries HAS designated this area of Stump Sound as a Primary Nursery Area, and the waters adjacent to the proposed project are CLOSED to the harvesting of shellfish. PROPOSED PROJECT: The applicant is proposing to replace the existing boat ramp (and dock) and improve the existing parking area. In short, the applicant is proposing to remove the two existing concrete boat ramps, and fixed docks, and replace the ramps in kind (two ramps each measuring 15' x 92'). The two existing fixed docks would be demolished and replaced with one (8' x 60') floating dock, which would be located in between the two proposed ramps. In addition, the applicant is proposing to stabilize the "ramp basin" by installing two vertical breakwater walls (vinyl), each measuring 68' in length (as measured from the high ground, or +/- 50' from the NHW line). The two vertical wall structures would be located along the outside edges of the new 15' x 92' concrete ramp pads, one on each side of the ramp structure (approximately 34' apart). In order to accomplish this task, the applicant is requesting approval to fill approximately 64 square feet of coastal wetlands (primarily Smooth Marsh Cordgrass) along the northwestern side of the ramp. The vegetation here is sparse and 64 sq. ft. of impact is quite liberal as far as impacts are concerned. In addition to the filling of coastal wetlands, the applicant would also�need to remove a minimal amount of material within the footprint of the existing ramp, below the normal high water (NHW) level. In total, approximately 81 cubic yards of material would be removed (38' x 43' x -3') from the area comprising the concrete pads. The excavated material would be transported to the upland portion of the site and would be NCWRC — Turkey Point Boat Ramp Page Three spread through the site in preparation of the grading and resurfacing of the existing parking area. The applicant states that the final depth at the end of the boat ramp (proposed final depth of -6.0', at normal low water (NLW)) is necessary to achieve the appropriate slope for ramp use. The connecting waters along the outboard side of the proposed ramp average -2.5' to -3.0' at NLW, which would leave a temporary depressing along the toe of the ramp, until the material below the ramp stabilized. No additional excavation activities would take place as there is sufficient water for navigation beyond the edge of the boat ramp. Similarly, no additional wetland impacts are anticipated. The upland development would consist of re -grading and paving the existing driveway and parking areas to delineate parking for trailers, single vehicles and ADA access. According to the application package, the total amount of earth work would be minimal, and limited only to what is necessary to re-level/grade and pave the driveway and parking areas. In total, the current amount of impervious coverage at this site is +/- 29.56%, or 25,563 sq. ft., with the vast majority being allocated to the existing gravel driveway and parking areas. The redevelopment plans (including paving the site) would result in a very small decrease in the amount of built upon area, reducing the amount of impervious coverage to 29.35%, or 25,377 sq. ft. As stated, no new concentrated outlets are proposed at this time as well as no new built upon areas. In total, approximately 53,000 sq. ft. of high ground disturbance would be anticipated as a result of the proposed work. 10. ANTICIPATED IMPACTS The proposed boat ramps would fill approximately 1,600 ft.2 of Shallow Bottom. The existing parcel is approximately 2.49 acres and currently consists of an existing boat ramp and associated parking lot owned by the NC Wildlife Resources Commission. This project will involve the renovation of the existing ramp and parking lot. This will include the removal of the existing concrete ramp and fixed docks. Two new 15' wide concrete ramps with an 8' wide floating dock will be installed in its place. Vinyl breakwater walls are proposed to minimize the impacts on the adjacent shoreline and wetlands. In addition, the existing gravel parking lot will be renovated and paved to formalize and delineate parking for trailer and single vehicles and ADA accessible parking will be added. Turkey Creek adjacent to the site is classified as SA;ORW. A stormwater redevelopment exclusion will applied for on this site. Impervious Surface Calculations: The total site area above the normal water elevation and excluding CAMA wetlands is approximately 1.99 ac (86,475 st). As the site currently exists, there is approximately 25,563. sf (29.56%) of impervious surface on the site. The majority of this impervious surface is a gravel parking lot. The stone that makes up the lot consists of well -graded material with lots of fines similar to ABC or crusher run. The stone is also well compacted since it has been in place for several years. As such, this parking lot is considered to be impervious since the in -place stone does not match the current definition of gravel. The current rule that considers gravel to be pervious defines it as clean, uniformly -graded aggregate. All of the impervious surface on the site has been in place for many years based on aerial photos. The parking lot and ramp were constructed around 1970, so it was in place prior to the effective year for stormwater treatment, 1988. Following development of the site, we are proposing to install 25,377 sf (29.35%) of impervious surface. As a result, the proposed development results in a net decrease in impervious area of 186 sf. Dredging: No dredging is proposed for this project outside of the boat basin (between the breakwater walls). Grading: The total amount of earthwork for this project will be minimal. Minimal elevation changes will be needed to provide positive drainage. Spoil from the ramp excavation will either be used on site (if suitable) or hauled to an offsite spoil area. We are planning to use the Onslow County Landfill unless another site is found prior to the start of construction. If another site is found, we will inform DCM and submit the necessary information to obtain approval to use the site. The total disturbed area of this project is yet to be determined. Upland Excavation and Earthwork: The upland excavation is to reach the proposed subgrade for the drive aisles and parking lot. Additional excavation may be required due to unsuitable soils. However, this will not be known until construction begins. Excavation quantities are unknown at this point. Excavated soil will be used on the site if possible. Off -site soil may need to be transported to the site to bring it up to the proposed grades and to provide positive drainage. Biologists with the North Carolina Wildlife Resources Commission (NCWRC) reviewed the permit application with regard to impacts on fish and wildlife resources. The project site is located at 619 Turkey Point Road, adjacent to Turkey Creek in Holly Ridge, NC. Our comments are provided in accordance with provisions of the Coastal Area Management Act (G.S. 1I3A- 100 through 113A-128), as amended, Sections 401 and 404 of the Clean Water Act, as amended, and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.). The applicant proposes to rehabilitate the existing Turkey Creek Boating Access Area (Turkey Creek BAA) by removing the existing double ramps and fixed docks and regrading / repaving the existing drive and parking area. The new double ramp facility will have a centered floating dock and vinyl sheet pile breakwater walls on either side of the ramps. Water depths at the terminus of the ramp are proposed to be -6' NLW to achieve adequate ramp slope. It has been noted that this depth will eventually fill to the adjacent connecting water depths of -2.5' to - 3' NLW as the material stabilizes. Turkey Creek in this location is classified SA ORW by the Environmental Management Commission and is designated a primary nursery area (PNA) by the NC Division of Marine Fisheries. Our agency participated in an April 15, 2014 scoping meeting where the applicant presented the proposed project to state and federal agencies. At this time we discussed the project's location within a PNA and how new dredging in PNAs is not an allowable activity. It is staff s recommendation that the proposal to fill coastal wetlands is CONSISTENT with the Rule in 15 NCAC 7H.0205 (a) (d) which states "Use Standards. Suitable land uses are those consistent with the management objective in this Rule. Highest priority of use is allocated to the conservation of existing coastal wetlands. Second priority of coastal wetland use is given to those types of development activities that require water access and cannot function elsewhere." The justification for considering the proposed coastal wetlands fill as consistent with the above mentioned Ruling is due in part to the site setting, as well as the historical use of the facility. Based on the plans submitted the applicant is planning to roughly stay within the same footprint as the existing facility, with the only expansion being the proposed breakwater walls. It is the staffs recommendation that the proposal to construct a public boating access area with driveways, parking area, boat ramp with stabilization walls (breakwaters) and floating access pier appears to be CONSISTENT with the Rules of 15 NCAC 7H.0208 (b) (6) (A) Specific Use Standards for Piers and Docking Facilities states "Piers shall not exceed six feet in width. Piers greater than six feet in width shall be permitted only if the greater width is necessary for safe use, to improve public access, or to support a water dependent use that cannot otherwise occur." The applicant has stated that the need for piers wider than six feet is to aid both boaters with disabilities and the general public; the width of the piers is consistent with previously permitted boating access area improvements. It is the staff s recommendation that the proposal to construct a public boating access area with driveways, parking areas, boat ramp with stabilization walls (breakwaters) and floating access pier appears to be CONSISTENT with the Rules of 15 NCAC 71-1.0208 (b)(6)(B) Specific Use Standards for Piers and Docking Facilities states "the total square footage of shaded impact for docks and mooring facilities (excluding the pier) allowed shall be eight square feet per linear foot of shoreline with a maximum of 2,000 square feet. In calculating the shaded impact, uncovered open water slips shall not be counted in the total. Projects requiring dimensions greater than those stated in this Rule shall be permitted only if the greater dimensions are necessary for safe use, to improve public access, or to support a water dependent use that cannot otherwise occur. Size restrictions shall not apply to marinas." The proposed project is the development of a public boating access area and the applicant has stated that the proposed dimensions are necessary to provide access to both boaters with disabilities and the general public. It is the staff s recommendation that the proposal to construct a public boating access area with driveways, parking areas, boat ramp with stabilization walls (breakwaters) and floating access pier appears to be CONSISTENT with the Rules of 15 NCAC 7H.0208 (b)(6)(G) Specific Use Standards for Piers and Docking Facilities states, "pier and docking facility length shall be limited by: (i) not extending beyond the established pier or docking facility length along the same shoreline for similar use; (This restriction does not apply to piers 100 feet or less in length unless necessary to avoid unreasonable interference with navigation or other uses of the waters by the public); (ii) not extending into the channel portion of the water body; and (iii) not extending Recommendations for State Permit — NCWRC Turkey Point Boat Ramp — Page Two more than one-fourth the width of a natural water body, or human -made canal or basin. Measurements to determine widths of the water body, canals or basins shall be made from the waterward edge of any coastal wetland vegetation that borders the water body. The one-fourth length limitation does not apply in areas where the U.S. Army Corps of Engineers, or a local government in consultation with the Corps of Engineers, has established an official pier head line. The one-fourth length limitation shall not apply when the proposed pier is located between longer piers or docking facilities within 200 feet of the applicant's property. However, the proposed pier or docking facility shall not be longer than the pier head line established by the adjacent piers or docking facilities, nor longer than one-third the width of the water body." The proposed access pier would extend approximately 80 feet waterward of the proposed NHW boundary and does not appear to extend beyond the established pier head line of the piers immediately to the north. It is the staffs recommendation that the proposal to construct a public boating access area with driveways, parking areas, boat ramp with stabilization walls (breakwaters) and floating access pier appears to be CONSISTENT with the Rules of 15 NCAC 7H.0209 (d)(2) which states "within the Coastal Shorelines category (estuarine and public trust shoreline AECs), new development shall be located a distance of 30 feet landward of the normal water level or normal high water level, with the exception of the following: (A)Water- dependent uses as described in Rule 07H .0208(a)(1) of this Section." The proposed boat ramp approach is considered a water -dependant use and would be located within 30 feet of the NHW boundary. The proposed kiosk would be installed consistent with other pile supported information signs through the State, and as seen at multiple public boat ramps. This office has no objections to the proposal construct a public boating access area with driveways, parking areas, kiosk, boat ramp with stabilization walls (breakwaters) and floating access piers. Any permit issued should include the following conditions: The alignment of the proposed breakwater and ramp shall be staked by a representative of the Division of Coastal Management (DCM) within a maximum of thirty (30) days prior to the start of construction. Failure to initiate construction within thirty (30) days, or erosion of the shoreline by adverse weather conditions, will require the alignment to be re -staked by DCM within a maximum of thirty (30) days prior to the new expected start of construction. 2. The Division of Environmental Management (DEM) approved this project under stormwater management rules of the Environmental Management Commission on . Any violation of or deviation from the plan approved by the DEM will be considered a violation of this CAMA permit. 3. The boat ramp stabilization walls must be constructed prior to any backfilling activities. 4. The boat ramp stabilization walls must be structurally tight so as to prevent seepage of backfill materials through the structure. 5. The boat ramp stabilization walls must be solid and constructed of treated wood, concrete slabs, metal sheet piles, or other suitable materials approved by Department personnel. No excavation is permitted, except for that which may be required for the construction of the boat ramp stabilization was, boat ramp, piers, etc. 6. The fill material shall be clean and free of any pollutants, except in trace quan�ties. No sewage, whether treated or untreated, shall be discharged at any time from boats using the facility. Any sewage discharge at the facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 11. This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structures, whether floating or stationary, may become a permanent part of this facility without permit modification. No non -water dependent uses of structures may be conducted on, in, or over public trust waters without permit modification. 12. No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 13. The authorized structure and associated activity must not cause an unacceptable interference with navigation. 14. The permittee must install and maintain, at his expense, any signal lights and signals prescribed by the U.S. Coast Guard, through regulations or otherwise, on authorized facilities. 15. This permit does not authorize the interference with any existing or proposed Federal project, and, the pemuttee will not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 16. In order to protect water quality, runoff from the construction must not visibly increase the amount of suspended sediments in adjacent waters. The existing parcel is approximately 2.49 acres and currently consists of an existing boat ramp and associated parking lot owned by the NC Wildlife Resources Commission. This project will involve the renovation of the existing ramp and parking lot. This will include the removal of the existing concrete ramp and fixed docks. Two new 15' wide concrete ramps with an 8' wide floating dock will be installed in its place. Vinyl breakwater walls are proposed to minimize the impacts on the adjacent shoreline and wetlands. In addition, the existing gravel parking lot will be renovated and paved to formalize and delineate parking for trailer and single vehicles and ADA accessible parking will be added. Turkey Creek adjacent to the site is classified as SA;ORW. A stormwater redevelopment exclusion will applied for on this site. Impervious Surface Calculations: The total site area above the normal water elevation and excluding CAMA wetlands is approximately 1.99 ac (86,475 sf). As the site currently exists, there is approximately 25,563 sf (29.56%) of impervious surface on the site. The majority of this impervious surface is a gravel parking lot. The stone that makes up the lot consists of well -graded material with lots of fines similar to ABC or crusher run. The stone is also well compacted since it has been in place for several years. As such, this parking lot is considered to be impervious since the in -place stone does not match the current definition of gravel. The current rule that considers gravel to be pervious defines it as clean, uniformly -graded aggregate. All of the impervious surface on the site has been in place for many years based on aerial photos. The parking lot and ramp were constructed around 1970, so it was in place prior to the effective year for stormwater treatment, 1988. Following development of the site, we are proposing to install 25,377 sf (29.350/0) of impervious surface. As a result, the proposed development results in a net decrease in impervious area of 186 sf. In addition, no new concentrated outlets are proposed, and no RECEIM DECEIVED DGM WILMINGTON. Minimal elevation changes will be needed to provide positive drainage. Spoil from the ramp excavation will either be used on site (if suitable) or hauled to an offsite spoil area. We are planning to use the Onslow County Landfill unless another site is found prior to the start of construction. If another site is found, we will inform DCM and submit the necessary information to obtain approval to use the site. The total disturbed area of this project is yet to be determined. Upland Excavation and Earthwork: The upland excavation is to reach the proposed subgrade for the drive aisles and parking lot. Additional excavation may be required due to unsuitable soils. However, this will not be known until construction begins. Excavation quantities are unknown at this point. Excavated soil will be used on the site if possible. Off -site soil may need to be transported to the site to bring it up to the proposed grades and to provide positive drainage. Existing Stormwater Conditions: The existing site has no existing stormwater controls. The runoff currently sheet flows into the wetlands on the south and east sides of the site. Proposed Stormwater Conditions: No stormwater BMP's, pipes, or concentrated outfalls are proposed with this project.
