This correspondence is with reference to the request submitted by you to modify State Permit No. 93-
14, which was originally issued to the NC Division of Marine Fisheries on October 27, 2014. State Permit 93-
14 authorized placement of additional material to enhance and expand existing artificial reef sites AR-364, AR-
370, AR 372, AR 378 and AR 378E located offshore of New Hanover County within the Atlantic Ocean. State
Permit No. 93-14 expires on December 31, 2017. The action proposed in your submittal consists of the
addition of concrete manhole bases/risers and 30 in. by 8 ft. concrete pipe as authorized materials to be used
for artificial reef enhancements.
Upon review of the information provided the Division of Coastal Management has determined that the
proposed action continues to be consistent with existing State rules and regulations and is in keeping with the
original purpose and intent of the permit. I hereby submit this Letter of Refinement authorizing the modification
of State Permit #93-14, as described in your request dated December 23, 2014. Please note that this Letter of
Refinement does not authorize additional expansion of the reef sites. By copy of this letter we are also
notifying the US Army Corps of Engineers of our action. Please note this refinement does not alleviate the
need to obtain any other local, state or federal permits.

Artificial Reef Program
The NC Division of Marine Fisheries obtained permit # 93-14 (expiration date December 31,
2017), to expand and enhance artificial reefs AR364,370,372 and 378 near Wilmington, NC in Onslow
Bay. Materials identified in the CAMA documentation include concrete pipe and a prefabricated reef
module known as an "Atlantic Pod". Concrete manhole sections are identified as a possible material of
use as well. Materials of opportunity are those materials not originally intended for artificial reef
enhancements. These materials are commonly concrete pipe, manhole sections, etc. used in
construction projects. It is difficult to assess the availability of these materials, and in this case requires
an adjustment.
The NC DMF artificial reef program intends to refine the original permit augmenting the types of
precast concrete materials noted in Figures 4b,4c, 5b, 5c, 6b, 6c, 7c, and 7d of the CAMA permit.
Additional materials not described in the CAMA permit are available. These materials include concrete
manhole bases and risers, and 30"x8' concrete pipe. Consistent with all NC Artificial Reef Program
enhancements, all materials are free of toxins and comply with USACE general permit #198500194.
Disturbed footprint and tonnage will not exceed the limitations noted in the permit, only the types and
amounts of concrete materials of opportunity. The prefabricated "Atlantic Pods' numbers have not
changed.

Concrete precast materials will consist of rectangular units known as waffle boxes, risers, catch basins or solid boxes,
and piling cutoffs. These rectangular units vary in size and shape, with no units greater than 5 feet in height and no
more than 6,000lbs (3 tons). Approximately 900 tons of the precast units will be deployed in 4.575 acres.
Material will cover the entire acreage of each patch reef totaling 4.575 acres. Legend

Dear Mr. Bodnar:
Reference your application for a Department of the Army (DA) permit to modify State
Permit No. 93-14. The action proposed in your submittal consists of the addition of concrete
manhole bases/risers and 30" by 8' concrete pipe as authorized materials to be used for artificial
reef enhancements (AR364, 370 & 378) with no expansion of footprints, located offshore of
New Hanover County within the Atlantic Ocean, near Wilmington, North Carolina.
Your proposal has been reviewed and found to be consistent with the provisions and
objectives of the CAMA-Corps Programmatic Permit process (copy attached) for construction
activities that receive authorization from the State of North Carolina. Therefore, you may
commence construction activity in strict accordance with applicable State authorization and the
approved plan. Failure to comply with the State authorization or conditions of the Federal permit
could result in civil and/or administrative penalties.
If any change in your work is required because of unforeseen or altered conditions or for
any other reason, plans revised to show the change must be sent promptly to this office and the
North Carolina Division of Coastal Management prior to performing any such change or
alteration. Such action is necessary as revised plans must be reviewed and the authorization
modified. Your Department of the Army permit will expire on December 31, 2016.
