NOTE: The U.S. Army Corps of Engineers has assigned the proposed project SAW Action Id. No. 2014-00559. NOTE: A permit renewal application processing fee of $100 was received by DCM for this project. This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. State Permit No. 56-14 was issued on June 26, 2014 and is due to expire on December 31, 2017. Mr. Peters states that to date, 34 of the 150 authorized reef balls have been deployed, and that no modification to State Permit No. 56-14 is requested. Wilmington, NC 28405 Re: CAMA Major Permit 56-14 Renewal (Amended letter) Dear Ms. Simpson, The North Carolina Division of Marine Fisheries Artificial Reef Program requests a renewal of CAMA Major Permit 56-14 for artificial reef enhancement. The permit, issued on June 26, 2014 and expiring on December 31, 2017, authorized placement of up to 150 reef balls on site at AR-360 near Topsail Island. Since 2014, the division has overseen deployment of only 34 of the authorized 150 reef balls. It is our intent to continue placing a small number of reef balls annually, until the total has reached 150 (as originally permitted). We do not request any modification to the total number of units or impacted acreage originally authorized under 56-14. Please contact me if you have any questions regarding this letter or our intent. The material shall be of a size sufficient to prevent their movement from the approved alignment by wave or current action. 3) No fill material shall be placed at any time in any waters outside of the alignment of the fill areas indicated on the attached workplan drawings. U.S. Army Corps of Engineers (USAGE) Requirements 4) Construction shall not proceed until the North Carolina Division of Marine Fisheries (NCDMF)`has obtained approval from the Fifth U.S. Coast Guard District, Portsmouth, Virginia, for the location and clearance depth and all necessary navigational aid permits required by the U.S. Coast Guard and furnished copies to the Wilmington District. 5) This permit does not authorize the placement of material within any rock outeroppings/hard bottoms. 6) The permittee will notify the NOAA/National Ocean Service, in writing, at least two weeks before work begins and upon completion of the work. General 7) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. 8) This permit shall not be assigned; transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 9) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development may require a modification of this permit. Contact a representative of the Division of Coastal Management at (910) 796-7215 prior to the commencement of any such activity for this determination. The original (buff -colored form) is retained by you and it must be available on site when the project is inspected for compliance. Please sign both the original and the copy and return the copy to this office in the enclosed envelope. Signing the permit and proceeding means you have waived your right of appeal described below. If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, (919) 733-2698 within twenty (20) days of this decision on your permit. You should also be aware that another qualified party may submit an objection to the issuance of this permit within twenty (20) days. The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be carried out in accordance with your application. If you are having the work done by a contractor, it would be to your benefit to be sure that he fully understands all permit requirements.
