Dockine Facility 1) Unless specifically altered herein, this permit authorizes only the construction of the docking facility with associated boatlifts and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application and workplan drawings. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. The perminee is not relieved of this requirement if he abandons the permitted activity without having, it transferred to a third party. 6) This pemrit does not authorize the interference with any existing or proposed Federal project, and the permittee will not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 7) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. CoastfuarA-through-regulation or -otherwise, ton -the authorized facilities - At -a -minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 8) This permit authorizes a maximum of six formalized boat slips. Shoreline Stabilization 9) Unless, specifically altered herein, this permit authorizes the construction of the riprap that are expressly and specifically set forth in the permit application and workplan drawings. 10) The authorized riprap shall adhere to the alignment depicted on the attached workplan drawings. 11) The riprap material shall be free from loose dirt or any pollutant. Hudgins Jr. ADDITIONAL CONDITIONS Sedimentation and Erosion Control Permit # 45-14 Page 3 of 3 13) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 14) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, etc.). General 15) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. 16) No open water areas or vegetated wetlands shall be excavated or filled. 17) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 18) The permittee and/or his contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 808-2808 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: The N.C. Division of Water Resources has assigned the proposed project DWR Project No. 2014-0296. NOTE: The U.S. Army Corps of Engineers authorized the proposed project under General Permit No. SAW- 2014-00588. This subdivision is located by traveling east along Island Rd. and turning north onto Old Ferry Dock Rd. West Bay Subdivision is near the end of Old Ferry Dock Rd. on Westbay Circle. Mr. Hudgins owns property on both sides of Westbay Cir. His property is bordered on both sides by unimproved residential lots within the subdivision. Mr. Hudgins property is .442 acres in its entirety, has a shoreline length of 100' and is an average of 3' above NHW. Presently there is an existing bulkhead along this tract. The bullheaded area is experiencing erosion due to wave action. There are no coastal wetlands on this tract. The high ground vegetation consists of various grasses and woody vegetation. Mr. Hudgins's residence is located on a separate lot located on the south side of Westbay Circle. The Carteret County Land Use Plan classifies this property as Limited Transition, with all AEC's classified Conservation. This section of the West Mouth Bay is not designated as Primary Nursery Area, is open to the taking of shellfish and carries a water classification of SA/HQW. The substrate in this area is mostly sand and silt. Water depths along the shoreline are shallow (<1') but increase to 3' around 300' offshore. No SAV's or shellfish beds were observed within the proposal project area. There is no channel within the project vicinity and the width of the waterbody in this area is — .5mi. 10. Proiect Description: Mr. Robert Hudgins is proposing to construct a 6-slip private residential docking facility. Extending off of an existing bulkhead would be a 5'X300' dock. Mean High Water is along the bulkhead alignment. Constructed at the end of the dock would be an 11'X36'platform and two 5'X20' finger piers. Four 12'X12' boatlifts would be placed along the offshore side of the platform and two 12'X12' boatlifts would be placed along the inshore side of the platform creating a total of 6 slips. Water depths in the area of the 6 slips range from -2.5' to -.3' at mean low water. There are no SAV or shellfish beds in the area of the slips. Mr. Hudgins also proposes to place large granite rip rap along the existing bulkhead in order to prevent erosion from wave action. The rip rap would be placed along the entire length of the 100' shoreline and would extend an average and maximum of 8' into the water body. A 2:1 slope (4'heightX8'base) of the rip rap will be maintained. There are no Coastal Wetlands, SAV or shellfish beds within the proposed rip rap location. The setting of pilings would cause temporary turbidity. There would be no hindrance to navigation due to the fact that there are no official designated navigation routes or channels in this area and near shore shallow water depths(<-2') would discourage boating traffic. The total pier length, which includes the platform and finger piers, would be a distance of 331'offshore within a .5mi wide waterbody. Mr. Hudgins property is .442 acres in its entirety, has a shoreline length of 100' and is an average of 3' above NHW. Presently there is an existing bulkhead along this tract. The bullheaded area is experiencing erosion due to wave action. There are no coastal wetlands on this tract. The high ground vegetation consists of various grasses and woody vegetation. Mr. Hudgins's residence is located on a separate lot located on the south side of Westbay Circle. The Carteret County Land Use Plan classifies this property as Limited Transition, with all AEC's classified Conservation. This section of the West Mouth Bay is not designated as Primary Nursery Area, is open to the taking of shellfish and carries a water classification of SA/HQW. The substrate in this area is mostly sand and silt. Water depths along the shoreline are shallow (<1') but increase to 3' around 300' offshore. No SAV's or shellfish beds were observed within the proposal project area. There is no channel within the project vicinity and the width of the waterbody in this area is — .5mi. 10. _ Project Description: Mr. Robert Hudgins is proposing to construct a 6-slip private residential docking facility. Extending off of an existing bulkhead would be a 5'X300' dock. Mean High Water is along the bulkhead alignment. Constructed at the end of the dock would be an ll'X36'platform and two 5'X20' finger piers. Four 12'X12' boatlifts would be placed along the offshore side of the platform and two 12'X12' boatlifts would be placed along the inshore side of the platform creating a total of 6 slips. Water depths in the area of the 6 slips'range from -2.5' to -.3' at mean low water. There are no SAV or shellfish beds in the area of the slips. Mr. Hudgins also proposes to place large granite rip rap along the existing bulkhead in order to prevent erosion from wave action. The rip rap would be placed along the entire length of the 100' shoreline and would extend an average and maximum of 8' into the water body. A 2:1 slope (4'heightX8'base) of the rip rap will be maintained. There are no Coastal Wetlands, SAV or shellfish beds within the proposed rip rap location. Narrative Description The Robert Hudgins project is located at Lot #4 in West Bay Subdivision on Harkers Island. This subdivision is located by traveling east along Island Rd. and turning north onto Old Ferry Dock Rd. West Bay Subdivision is near the end of Old Ferry Dock Rd. on Westbay Circle. Mr. Hudgins owns property on both sides of Westbay Cit. His property is bordered on both sides by unimproved residential lots within the subdivision. Mr. Hudgins property is .442 acres in its entirety, has a shoreline length of 100' and is an average of 3' above NHW. Presently there is an existing bulkhead along this tract. The bullheaded area is experiencing erosion due to wave action. There are no coastal wetlands on this tract. The high ground vegetation consists of various grasses and woody vegetation. Mr. Hudgins's residence is located on a separate lot located on the south side of Westbay Circle. The Carteret County Land Use Plan classifies this property as Limited Transition, with all AEC's classified Conservation. This section of the West Mouth Bay is not designated as Primary Nursery Area, is open to the taking of shellfish and carries a water classification of SA/HQW. The substrate in this area is mostly sand and silt. Water depths along the shoreline are shallow (<V) but increase to 3' around 300' offshore. No SAV's or shellfish beds were observed within the proposal project area. There is no channel within the project vicinity and the width of the waterbody in this area is — .5mi. 10. Proiect Description: Mr. Robert Hudgins i4,pro osin to construct a 6-slip private residential docking facility. Extending off of an existing bulkhead wou along the bulkhead alignment. Constructed at the end is of the dock would bWater an 11'X36'platform and two 5'X20' finger piers. Four 12'X12' boatlifts would be placed along the offshore side of the platform and two 12'X12' boatlifts would be placed along the inshore side of the platform creating a total of 6 slips. Water depths in the area of the 6 slips'range from -2.5' to -.3' at mean low water. There are no SAV or shellfish beds in the area of the slips. Mr. Hudgins also proposes to place large granite rip rap along the existing bulkhead in order to prevent erosion from wave action. The rip rap would be placed along the entire length of the 100' shoreline and would extend an average and maximum of 8' into the water body. A 2:1 slope (4'heightX8'base) of the rip rap will be maintained. There are no Coastal Wetlands, SAV or shellfish beds within the proposed rip rap location. I fail to understand how a single homeowner in this subdivision would need dockage to accommodate 6 boats. If I do the same on my 2 adjoining lots there will be 18 spaces in about 300 feet. And other property owners could follow suit and build up to the max as well. This will prove to be unsightly and surely difficult to navigate in that shallow water. PDA covenants prohibit any commercial activity and therefore someone would have to monitor the use of each dock for compliance. I am not in favor of this permit as presented here. O.K.
