Materials n 'nt ed to be taken to a shore support site shall be repositioned (unburied) as close to its original position as possible. 4) No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 5) This permit does not authorize the alteration of the shoreline when removing logs and cribbing piles. 6) This permit does not authorize the removal or salvage of any object or material other than submerged logs and cribbing piles. 7) The permittee shall maintain a comprehensive listing of the number of logs and cribbing piles removed sizes of such logs and general location of where the logs were recovered. Copies of this report shall be submitted to the Division of Coastal Management by March I't of each year that this permit is active. Failure to provide this report by the March ls` deadline may result in a violation of this permit. Cultural Resource Protection 8) As required by N.C.G.S. 121 Article 3, prior to the commencement of any log salvage operations, the permittee shall apply for and receive an underwater archaeology permit from the N.C. Department of Cultural Resources. NOTE: Failure to adhere to the requirements of the permit referenced in Condition No. 6 of this permit may result in a violation of this permit. 9) The permittee shall under no circumstances remove or otherwise disturb the remains of any submerged watercraft or contents thereof as described in G.S. 121-22 10) No vegetated wetlands or open water areas shall be filled, even temporarily. 11) The permittee and/or his contractor shall meet with a representative of the Division prior to project initiation in order to discuss the conditions set forth in this permit. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. Logs of 10" in diameter or greater are my target for retrieval from a depth of 6' to 30' deep and at least 100' from the navigational channel center line. All work on sites is to be done between July 1 and February 14. Location of operations of sunken growth logs to be carried out only in approved site locations. We plan to locate logs by the use of Hi Def side scan sonar. If logs are in the shallow areas I plan to use a pole with an ice screw type attachment to connect the boat wench to log and slowly put tension on the logs. Cables; if needed will attach air lifting (flotation) device. If logs are in deeper water will have a diver go down and attach necessary lifting devices. At Site 2 there are a number of crib pilings. I plan on removing these by placing a strap around them about half way down the pile and putting strain upward with a wench. I may have to use a pump and jet water down alongside to release the pressure. If jet pump is used, I will not remove more than 4 piles a day with this method to decrease sediment disturbance. I feel these methods will have the lowest impact on the sediment and turbidity of the sites. I also plan to alternate sites so that the same site is not worked on two consecutive days. After a log is brought to the surface it will be strapped to the pontoon boat. Depending on the sizes of the logs raised will determine how often we return to our landing station. I will always have at least one extra boat on site that is not being used in log retrieval so that we have a means of exit for emergencies or weather. As this is mostly a wind tide river because the northern end is controlled by the COE locks at South Mill, I feel that most sediment will fall close to the location where the log was lifted. All salvaged logs will be attached and/or secured to the pontoon or work boats. We do not plan on towing behind boats. All boats are to be up to date with all safety regulations as recommended by Coast Guard requirements. Required safety equipment will be on all boats at all times; to include rWD jacket, fire extinguisher, safety ring, radios, etc. All safety precautions will be in place to pr employees, the environment, the public and navigation. 2014 7SEp 10 DCM-MHD MY PGs025 Of course all rules and regulations that are placed on these permits and also BMP (Best Management Practices) will be followed at all times. I will report monthly, all work and what was harvested by type and dimension. I also plan to keep a photo record. I know that there are some ship or boat wrecks in this area that we will not work on. Also if new artifacts are found, we will cease work at that site and notify Department of Cultural Resources. As I am staying over 600' in all directions from WWTP outfall pipe, I do not plan on a sediment analysis. Please see attached a picture of sonar taken from each site. It shows the depths recorded in meters. Please note that the morning these pictures were taken it was obvious the water was at least one foot below normal as evidenced by the water line on all trees and other objects around the water line. PROJECT SUMMARY: The applicant proposes to salavage submerged logs and existing submerged cribbing piles from the Knobbs Creek area in the Pasquotank River. The site of the proposed development is on the Pasquotank River in P 5 UMiUounty; in the Knobbs Creek area. SEP 18 2014 ACM-10DCfrY Development Proposal The applicant proposes to salvage submerged logs and existing submerged cribbing piles from the Pasquotank River bottom at five specified sites. The five specified sites account for 5,798,534 square feet of river area. Site number two of five is the only site that contains cribbing piles. The cribbing piles exist from a historic lumber yard that was in business in the 1920's and 1930's. The lumber company would store the floating logs inside the cribbing piles while waiting to process the logs in the lumberyard. Elizabeth City between the years of 1890 and 1930 had at least eighteen lumber companies in business and the Pasquotank River played a very important role in the transport of raw uncut lumber to the lumber mills. During transport of the raw uncut logs some logs were lost and eventually became saturated and sank to the bottom. The sunken logs will be identified by sonar and then a diver will dive down to a log and screw an eyelet into the log so there will be an attachment point. Once there is a secure attachment point on the log it will tied to a winch mounted on the applicants pontoon boat and be winched to the surface. In some cases air bags may also be used to help float the log to the surface. If a log is partially submerged in the river bottom a pump would be used to jet water around the log to help loosen it from the river bottom. If a pump is used to loosen sediment around the logs the applicant will not salvage more than four logs a day to decrease the amount turbidity in the water. Once the log has been pulled or floated to the surface it will be tied off to a boat and transported to one of two designated offload sites. The two designated offload sites are both on Knobbs Creek. Once at the offload site the logs will be lifted from the water using a boom truck and temporarily stored on site awaiting transport to market. Logs of 10" in diameter or greater are my target for retrieval from a depth of 6' to 30' deep and at least 100' from the navigational channel center line. All work on sites is to be done between July 1 and February 14. Location of operations of sunken growth logs to be carried out only in approved site locations. We plan to locate logs by the use of Hi Def side scan sonar. If logs are in the shallow areas I plan to use a pole with an ice screw type attachment to connect the boat wench to log and slowly put tension on the logs. Cables; if needed will attach air lifting (flotation) device. If logs are in deeper water will have a diver go down and attach necessary lifting devices. At Site 2 there are a number of crib pilings. I plan on removing these by placing a strap around them about half way down the pile and putting strain upward with a wench. I may have to use a pump and jet water down alongside to release the pressure. If jet pump is used, I will not remove more than 4 piles a day with this method to decrease sediment disturbance. I feel these methods will have the lowest impact on the sediment and turbidity of the sites. I also plan to alternate sites so that the same site is not worked on two consecutive days. After a log is brought to the surface it will be strapped to the pontoon boat. Depending on the sizes of the logs raised will determine how often we return to our landing station. I will always have at least one extra boat on site that is not being used in log retrieval so that we have a means of exit for emergencies or weather. As this is mostly a wind tide river because the northern end is controlled by the COE locks at South Mill, I feel that most sediment will fall close to the location where the log was lifted. All salvaged logs will be attached and/or secured to the pontoon or work boats. We do not plan on towing behind boats. All boats are to be up to date with all safety regulations as recommended by Coast Guard requirements. Required safety equipment will be on all boats at all times; to include appr Qv�e life jacket, fire extinguisher, safety ring, radios, etc. All safety precautions will be in place to pr RECEIVE employees, the environment, the public and navigation. Furthermore, it is the objective of the Coastal Resources Commission to protect present common-law and statutory public rights of access to the lands and waters of the coastal area. (d) Use Standards. Acceptable uses shall be those consistent with the management objectives in Paragraph (c) of this Rule. In the absence of overriding public benefit, any use which jeopardizes the capability of the waters to be used by the public for navigation or other public trust rights which the public may be found to have in these areas shall not be allowed. The development of navigational channels or drainage ditches, the use of bulkheads to prevent erosion, and the building of piers, wharfs, or marinas are examples of uses that may be acceptable within public trust areas, provided that such uses shall not be detrimental to the public trust rights and the biological and physical functions of the estuary. Projects which would directly or indirectly block or impair existing navigation channels, increase shoreline erosion, deposit spoils below normal high water, cause adverse water circulation patterns, violate water quality standards, or cause degradation of shellfish waters are considered incompatible with the management policies of public trust areas. In every instance, the particular location, use, and design characteristics shall be in accord with the general use standards for coastal wetlands, estuarine waters, and public trust areas. Uses that are water dependent include: utility crossings, wind energy facilities, docks, wharves, boat ramps, dredging, bridges and bridge approaches, revetments, bulkheads, culverts, groins, navigational aids, mooring pilings, navigational channels, access channels and drainage ditches; Consistent: The proposed development is consistent with the intent of this rule. (2) Before being granted a permit, the CRC or local permitting authority shall find that the applicant has complied with the following standards: (A) The location, design, and need for development, as well as the construction activities involved shall be consistent with the management objective of the Estuarine and Ocean System AEC (Rule .0203 of this subchapter) and shall be sited and designed to avoid significant adverse impacts upon the productivity and biologic integrity of coastal wetlands, shellfish beds, submerged aquatic vegetation as defined by the Marine Fisheries Commission, and spawning and nursery areas; RECEIVED Consistent: The proposed development is consistent with the intent of this rule. (G) Development shall not jeopardize the use of the waters for navigation or for other public trust rights in public trust areas including estuarine waters. (3) When the proposed development is in conflict with the general or specific use standards set forth in this Rule, the CRC may approve the development if the applicant can demonstrate that the activity associated with the proposed project will have public benefits as identified in the findings and goals of the Coastal Area Management Act, that the public benefits outweigh the long range adverse effects of the project, that there is no reasonable alternate site available for the project, and that all reasonable means and measures to mitigate adverse impacts of the project have been incorporated into the project design and shall be implemented at the applicant's expense. Measures taken to mitigate or minimize adverse impacts shall include actions that: (A) minimize or avoid adverse impacts by limiting the magnitude or degree of the action; (B) restore the affected environment; or (C) compensate for the adverse impacts by replacing or providing substitute resources. Consistent: The proposed development is consistent with the intent of this rule. (4) Primary nursery areas are those areas in the estuarine and ocean system where initial post larval development of finfish and crustaceans takes place. They are usually located in the uppermost sections of a system where populations are uniformly early juvenile stages. They are designated and described by the N.C. Marine Fisheries Commission (MFC) and by the N.C. Wildlife Resources Commission (WRC); RECEIVED Consistent: The proposed development is consistent with the intent of this rule. OCT 0 0 7014 DCM-MHD CITY (5) Outstanding Resource Waters are those estuarine waters and public trust areas classified by the N.C. Environmental Management Commission (EMC). Any rules relating to SAVs shall not apply to non - development control activities authorized by the Aquatic Weed Control Act of 1991 (G.S. 113A- 220 et seq.). Date: September 23, 2014 Consistency Determination: The request is consistent with/not in conflict with the Pasquotank County/Elizabeth City 2004 Land Use Plan (LUP) certified by the CRC on February 9, 2012 and the Camden County LUP certified by the CRC on June 17, 2005, as amended through August 30, 2012. Overview: The project area consists of five (5) sites in the Pasquotank River totaling 133.11 acres and two (2) properties with approximately 2,190 linear feet of combined shoreline along Knobbs Creek. The project area is located within three (3) jurisdictions: Camden and Pasquotank counties and Elizabeth City. In the Pasquotank River, the sites extend along an approximately 7.6 mile stretch of river from Knobbs Creek north to Shipyard Road. Site 1 is located in Pasquotank and Elizabeth City, at Knobbs Creek; Site 2 is located in Pasquotank County, just north of the sewage treatment plant; Site 3 is located in Camden, west of Havenwood Drive; Site 4 is located in Pasquotank and Camden surrounding Goat Island, and; Site 5 is located in Camden, just south of Shipyard Road. Two (2) properties along Knobbs Creek are also included: a 4 acre property with approximately 890 linear feet of shoreline along Knobbs Creek near its intersection with the Pasquotank River and a 5.6 acre property with approximately 1,300 linear feet of shoreline along Knobbs Creek. The 4 acre property, according to aerial photographs available on the Pasquotank GIS, consists of cleared area to the south and forested areas to the north. Aerial photographs suggest existing shoreline stabilization along portions of the cleared area. The river is approximately 175 feet wide at the property. According to the Pasquotank County GIS, the property is owned by W.W. Owens and Sons Moving and Storage, Inc. and Ladicon Corporation. The 5.6 acre property, according to aerial photographs available on the Pasquotank GIS, consists of cleared area to the southwest and forested areas to the northeast. The cleared area includes two (2) buildings and a gravel road leading to a broken gravel parking area that extends to the shoreline. The property is accessed from North Road Street at its intersection with the railroad. Aerial photographs suggest existing shoreline stabilization along portions of the cleared area. The river is approximately 234 feet wide at the property. According to the Pasquotank County GIS, the property is owned by W.W. Owens and Sons Moving and Storage, Inc. Salvage of submerged logs and cribbing piles within the five (5) Pasquotank River sites and extraction from the banks of Knobbs Creek at the two (2) subject properties are proposed. Logs of 10 inch diameter or greater are targeted for retrieval from a depth of 6 feet to 30 feet deep at least 100 feet from the navigational channel center line. Sunken logs will be identified by sonar. A diver will select logs and secure a lag screw into the logs to be salvaged. Logs will then be tied to a winch mounted on the applicant's pontoon boat and pulled to the surface. Air bags or barrels may be used to help float logs to the surface. Partially submerged logs may require a pump to jet water and loosen them from the water bottom. No more than four (4) logs a day will be salvaged if a pump is required. The method of transporting logs is unclear, with narrative suggesting all salvaged logs will be attached and/or strapped to the pontoon boat and a drawing depicting a floating log towed behind a boat from a 10 foot nylon tow rope. Salvage work will occur between July let and February 14t". No salvage work will occur within 600 feet of the wastewater treatment plant outfall pipe. At the extraction site properties, logs will be lifted from the water using a boom truck. The logs will be temporarily stored on the properties while awaiting transport to market. Designated locations for on -site log storage were not indicated in the application. No disturbance activities at the extraction site properties are proposed. The Pasquotank River in the project area is classified as SW and is closed to shellfishing. A review of Submerged Aquatic Vegetation (SAV) was not provided. A review of identified archaeological and cultural resource sites was not provided. The permit application indicates that a professional archaeological assessment has been done by the INC Department of Cultural Resources, however a letter of review from NCDCR was not included in the permit application. Anticipated impacts: resulting from this project are expected to include: the disturbance of 133.11 acres of river bottom Public Trust Area of Environmental Concern (AEC). Biologists with the North Carolina Wildlife Resources Commission (NCWRC) reviewed the permit application with regard to impacts on fish and wildlife resources. The project site is located within Knobbs Creek and the Pasquotank River area of Pasquotank and Camden Counties. Our comments are provided in accordance with provisions of the Coastal Area Management Act (G.S. 113A-100 through 113A-128), as amended, Sections 401 and 404 of the Clean Water Act, as amended, and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.). The applicant proposes to salvage submerged logs and existing submerged cribbing piles from the Pasquotank River bottom at five specified sites within the application package. These five sites encompass 5,798,534 square feet of river bottom. Site 2 is the only site that contains cribbing piles. A scoping meeting was conducted on July 9, 2014 to discuss the applicant's proposal. As identified within the permit application, sunken logs are to be identified by sonar and then winched from above via an attachment point secured by a diver. In some cases air bags may be used to help lift the log since the overall size of the logs is unknown. Logs covered with river sediment will be cleared by jetting water. Two designated offloading sites have been identified within Knobbs Creek. Knobbs Creek and the Pasquotank River at these locations are classified Sw by the Environmental Management Commission and are designated an anadromous fish spawning area (AFSA) by the NC Wildlife Resources Commission. The NCWRC has reviewed the permit application to assess impacts to aquatic resources. Submerged woody debris provides habitat to resident and anadromous fish species. If whole trees or exposed logs are accidentally removed, we recommend that they be restored to their original position to the best of the operators ability, to ensure that as little bottom habitat is disturbed. In addition to the above specification, a February 15 — June 30 moratorium should be included as a permit condition to minimize elevated turbidity and noise levels associated with log removal. Proiect Setting The site of the proposed development is on the Pasquotank River in Pasquotank County; in the Knobbs Creek area. RECEIVED SEP 10 2014 DCV-N::xDcTIY Development Proposal The applicant proposes to salvage submerged logs and existing submerged cribbing piles from the Pasquotank River bottom at five specified sites. The five specified sites account for 5,798,534 square feet of river area. Site number two of five is the only site that contains cribbing piles. The cribbing piles exist from a historic lumber yard that was in business in the 1920's and 1930's. The lumber company would store the floating logs inside the cribbing piles while waiting to process the logs in the lumber yard. Elizabeth City between the years of 1890 and 1930 had at least eighteen lumber companies in business and the Pasquotank River played a very important role in the transport of raw uncut lumber to the lumber mills. During transport of the raw uncut logs some logs were lost and eventually became saturated and sank to the bottom. The sunken logs will be identified by sonar and then a diver will dive down to a log and screw an eyelet into the log so there will be an attachment point. Once there is a secure attachment point on the log it will tied to a winch mounted on the applicants pontoon boat and be winched to the surface. In some cases air bags may also be used to help float the log to the surface. If a log is partially submerged in the river bottom a pump would be used to jet water around the log to help loosen it from the river bottom. If a pump is used to loosen sediment around the logs the applicant will not salvage more than four logs a day to decrease the amount turbidity in the water. Once the log has been pulled or floated to the surface it will be tied off to a boat and transported to one of two designated offload sites. The two designated offload sites are both on Knobbs Creek. Once at the offload site the logs will be lifted from the water using a boom truck and temporarily stored on site awaiting transport to market. The Pasquotank River in the area where the applicant is proposing to salvage logs is 3-12 feet deep and has a soft muddy bottom. The appearance of the water is very dark and stained with tannins. The water in this area of the river classified as SW and is closed to shellfish harvest. Anticipated Impacts 1. There will be up to 5,798,534 square feet of river bottom disturbed. The mechanical pulling of logs from the bottom will cause sediment disturbance, as well as, short term turbidity. 2. The offload sites will not incur any additional disturbance as they are on previously disturbed sites with bulkhead or riprap present.
