This permit, issued on _August 5, 2014 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Docking Facility
1) Prior to the occupancy of any new slips authorized under this permit, the on -site pump -out shall be
operable and maintained for the life of the facility.
2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
facility.

ADDITIONAL, CONDITIONS
3) Unless specifically altered herein, this permit authorizes only the docking facility, and other structures
and uses located in or over the water that are expressly and specifically set forth in the permit
application. No other structure, whether floating or stationary, shall become a permanent part of this
docking facility without permit modification. No non -water dependent uses of structures may be
conducted on, in or over public trust waters without permit modification.
4) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
5) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
6) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee will not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
7) This permit authorizes a maximum of.nine formalized boat slips

8) Unless specifically altered herein, this permit. authorizes the land disturbing activities associated with the
development of the above referenced property, all as expressly and specifically set forth in the attached
permit application and workplan drawing. Any additional land disturbing activities and/or construction
may require a modification of this permit. Contact a Division of Coastal Management representative at
(252) 264-3901 for this determination.
General
9) The permittee understands and agrees that, if future operations by the United States requires the
removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause
unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon
due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions
caused thereby, without expense to the United States or the state of North Carolina. No claim shall be
made against the United States or the state of North Carolina on account of any such removal or
alteration.
10) No open water areas shall be excavated or filled, even temporarily.
11) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
12)' The permittee and/or his contractor shall meet with a representative of the Division prior to project
initiation.

NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 264-3901 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high water level.
NOTE: The U.S. Army Corps of Engineers has assigned the proposed project COE Action Id. No.
201401029.
a. A project narrative.
Chartered in 1758, Hertford has a rich colonial and maritime history tied to the Perquimans River
and Albemarle Sound. Hertford is the seventh oldest town in North Carolina. It is also the Seat of
Perquimans County.
In 2010 Hertford was accepted into the NC Rural Center STEP (Small Town Economic
Prosperity) grant program, which helps the town to identify and prioritize economic development
and revitalization. The strategic planning portion of the STEP process has identified waterfront
development as a priority, specifically the construction of slips for boaters who wish to visit the
town. Currently, visiting boaters do not have a place to dock their boats, many in the forty feet
range, at a public facility. These visitors must anchor away from the town boat ramps and use
their tenders or dinghies to access the small dock that is adjacent to the ramps. During the week
and especially on weekends, the town boat ramps are crowded with fisherman, which can make
access difficult for visiting boaters.
Prior to being selected for STEP, the town participated in the Creative Communities Initiative
with the UNC School of Business to develop a waterfront development plan. Over a three-year
period, graduate students in the business school at UNC worked with the town to develop a
waterfront revitalization plan, which includes boat slips and a public/private partnership for a
mixed use waterfront development that includes outfitters, a hotel, fuel service, and other
amenities on the water. The waterfront plan uses the attraction of the Perquimans River to help
spur economic development and re-establish Hertford as a vibrant waterfront town. The town
dock and boat slips are the critical fast step in the town's long -tern plan for revitalizing
Hertford's historic waterfront.
Project Objectives
The Town of Hertford, Waterfront Access Improvement Project seeks to accomplish the
following objectives:
• Provide safe harbor dock space for transient boaters, recreational boaters and
visitors with the construction of nine slips.
• Increase transient boater and visitor traffic to help spur economic development and
revitalization of the Historic Waterfront.
Expected Results and Benefits
The addition of the town dock to the Municipal Park will be the critical first step in
implementing the town's Waterfront Development Plan. The new town dock will help reconnect
the town's 63 historic points of interest to the water, which will help attract boaters looking for a
charming, southern waterfront town. The town is able to offer a rich history and many amenities
within a 20-block area around the town dock. Locations of amenities close to the town dock
include the Post Office, Missing Mill Park and Restrooms, Convenience Mart, Restaurant, and
Gas Station, Senior Center and Tennis Courts, Hardware Store, Public Library, Internet Cafd,

Historic Hertford Visitors Center, and County Government Building
The layout of the town dock and water depths behind Municipal Park is shown on the attached
Site Plan Detail. The town dock will extend 170 feet due north from the Municipal Park
boardwalk. The main walkway and T pier on the end of the walkway will be six feet wide. The
four forger piers for boat slips will be four feet wide. The T walkway will be able to
accommodate an 80 foot boat. The four adjacent berths will be 36 feet long and 13 feet wide
with a mooring pile at the entrance of the berths. The T pier and four adjacent berths are in six
feet of water. The four berths closest to shore will be 30 feet long and 10 feet wide, with a
mooring pile at the entrance. These four berths are in five to six feet of water. Water, electric
service and pump -out lines will be provided along the main six foot wide walkway.
Construction details are shown in the attached engineer's plans, Sheets 14.
An information kiosk with maps and brochures will be installed at the entrance to Municipal
Park from the town dock to provide information on amenities and points of interest. For safety,
the town dock will be located directly behind the town police station.
7. Compliance with N.C. Environmental Policy Act (N.C.G.S.113A 1-10)
The Town of Hertford is using public grant funds and its own funds to construct the town dock
and boat slips. It is aware of and will comply with the N.C. Environmental Policy Act as it
implements the project.

you and it must be available on site when the project is inspected for compliance. Please sign both the original and the
copy and return the copy to this office in the enclosed envelope. Signing the permit and proceeding means you have
waived your right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-121.1 or
113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of
Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, (919) 733-2698 within twenty (20) days
of this decision on your permit. You should also be aware that if another qualified party submits a valid objection to the
issuance of this permit within twenty (20) days, the matter must be resolved prior to work initiation. The Coastal
Resources Commission makes the final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work'must be carried
out in accordance with your application. Modifications, time extensions, and future maintenance requires additional
approval. Please read your permit carefully prior to starting work and review all project plans, as approved. If you are
having the work done by a contractor, it would be to your benefit to be sure that he fully understands all permit
requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we request that you

8. PROJECT SUMMARY: The project includes a 6' x 170' pier with (2) 40' x 6' finger piers, (2) 4' x 36' finger piers, (2) 4' x 30'
finger piers, four tie pilings, one electric/water pedestal, and one pump -outstation located at the end of the pier. The pump -
out and electrical installation will involve minor high ground disturbance and connect to existing service facilities. A holding
tank will be installed in association with the pump -out, and will be located greater than 75' from normal water level.

Project Setting
The property in question is located in the Town of Hertford behind the Police Department and the Town Managers
Office, adjacent to Punch Alley and the Perquimans River, Perquimans County, North Carolina. The project site abuts a
public boat ramp to the west along Punch Alley; the Police Department to the south, a residential lot to the west and the
Perquimans River to the north. Located at the adjacent access boat ramp is a dock used to moor the Periauger, a
reconstructed colonial boat work boat used for historical reenactments. Adjacent to the Periauger are two floating drive
on personal water craft docks placed by the Town of Hertford as a kayak launch.
The property is approximately .48 acres, with 105' fronting on the Perquimans River. There is an existing 12' x 105'
boardwalk paralleling the shoreline, with an 8' access walkway leading from a parking lot located 1 00'from normal water
level. While there are no identified archeological sites on the property is located within the Hertford Historic District.
There is a small variety of vegetation on the property and it includes, but is not limited to bald cypress (Taxodium
distichum),,a domestic grasses and a dense population of water lily (Nymphaea odorata) extending from the existing
boardwalk to a distance of approximately 40' into the Perquimans River.
Average elevation of the property is approximately 4' above normal water level. Flood designation for the property is
AE, which indicates a susceptibility to flooding. Shoreline stabilization consists of riprap that is located under the existing
boardwalk. Water depths extend from 1.5' at the watenvard side of the boardwalk to 6.5' at the distance of 176'
waterward of normal water level (NWL). The property is located in the Public Trust Shoreline Area of Environmental
Concern (AEC) and the waters immediately adjacent to the property are within Public Trust Waters.
Currently there is only one marina operating in Perquimans County located at Albemarle Plantation, approximately 23
miles from the Town of Hertford by boat. Albemarle Plantation has a 158 slip marina exclusively for the residents of the
subdivision. Fuel and pump -out facilities are available to the public for a fee.
Development Proposal
The Town of Hertford is requesting a CAMA Major Permit to construct a nine slip docking facility including a 6' x 170' pier
with (2) 40' x 6' finger piers, (2) 4' x 36' finger piers, (2) 4' x 30' finger piers, one electric/water pedestal and one pump -
out station located at the end of the pier. The ninth mooring will be on the outside of "T" created by the two 40' finger
piers and the end of the main access pier.

The installation of the lines for water, electrical and sewer are estimated to be 1,OOOsf

In addition to the pier and finger piers, the Town proposes to install four tie pilings as depicted on the enclosed site
plan drawings. A pump -out will be located at the end of the main pier along with an electric and water pedestal.
Effluent from the pump -out facility will be piped to the Town's existing sewer system_
As proposed, all slips within the proposed docking facility will be for transient dockage by boaters visiting the
of Hertford.
Anticipated Impacts
1) Shading of 2,028sf of water bottom from docking facility.
2) Temporary disturbance of approximately 1,000sf of high ground.
3) Construction impacts may result in a small reduction in water lily density between the finger piers and the
existing boardwalk.
4) An anticipated increase in boating traffic may in increased wave action along adjacent shoreline, and may
increase the risk for shoreline erosion along adjacent properties.
5) Jetting pilings for the marina will result in temporally suspending sediments in the water.
6) Along the shallower waters within the proposed docking facility, prop wash may cause resuspension of
sediments within the water column.

Chartered in 1758, Hertford has a rich colonial and maritime history tied to the Perquimans River
and Albemarle Sound. Hertford is the seventh oldest town in North Carolina. It is also the Seat of
Perquimans County.
In 2010 Hertford was accepted into the NC Rural Center STEP (Small Town Economic
Prosperity) grant program, which helps the town to identify and prioritize economic development
and revitalization. The strategic planning portion of the STEP process has identified waterfront
development as a priority, specifically the construction of slips for boaters who wish to visit the
town. Currently, visiting boaters do not have a place to dock their boats, many in the forty feet
range, at a public facility. These visitors must anchor away from the town boat ramps and use
their tenders or dinghies to access the small dock that is adjacent to the ramps. During the week
and especially on weekends, the town boat ramps are crowded with fisherman, which can make
access difficult for visiting boaters.
Prior to being selected for STEP, the town participated in the Creative Communities Initiative
with the UNC School of Business to develop a waterfront development plan. Over a three-year
period, graduate students in the business school at UNC worked with the town to develop a
waterfront revitalization plan, which includes boat slips and a public/private partnership for a
mixed use waterfront development that includes outfitters, a hotel, fuel service, and other
amenities on the water. The waterfront plan uses the attraction of the Perquimans River to help
spur economic development and re-establish Hertford as a vibrant waterfront town. The town
dock and boat slips are the critical first step in the town's long-term plan for revitalizing
Hertford's historic waterfront.

The Town of Hertford, Waterfront Access Improvement Project seeks to accomplish the
following objectives:
• Provide safe harbor dock space for transient boaters, recreational boaters and
visitors with the construction of nine slips.
• Increase transient boater and visitor traffic to help spur economic development and
revitalization of the Historic Waterfront.
Expected Results and Benefits
The addition of the town dock to the Municipal Park will be the critical first step in
implementing the town's Waterfront Development Plan. The new town dock will help reconnect
the town's 63 historic points of interest to the water, which will help attract boaters looking for a
charming, southern waterfront town. The town is able to offer a rich history and many amenities
within a 20-block area around the town dock. Locations of amenities close to the town dock
include the Post Office, Missing Mill Park and Restrooms, Convenience Mart, Restaurant, and
Gas Station, Senior Center and Tennis Courts, Hardware Store, Public Library, Internet Cafd,

The layout of the town dock and water depths behind Municipal Park is shown on the attached
Site Plan Detail. The town dock will extend 170 feet due north from the Municipal Park
boardwalk. The main walkway and T pier on the end of the walkway will be six feet wide. The
four finger piers for boat slips will be four feet wide. The T walkway will be able to
accommodate an 80 foot boat. The four adjacent berths will be 36 feet long and 13 feet wide
with a mooring pile at the entrance of the berths. The T pier and four adjacent berths are in six
feet of water. The four berths closest to shore will be 30 feet long and 10 feet wide, with a
mooring pile at the entrance. These four berths are in five to six feet of water. Water, electric
service and pump -out lines will be provided along the main six foot wide walkway.
Construction details are shown in the attached engineer's plans, Sheets 14.
An information kiosk with maps and brochures will be installed at the entrance to Municipal
Park from the town dock to provide information on amenities and points of interest. For safety,
the town dock will be located directly behind the town police station.
7. Compliance with N.C. Environmental Policy Act (N.C.G.S.113A 1-10)
The Town of Hertford is using public grant funds and its own funds to construct the town dock
and boat slips. It is aware of and will comply with the N.C. Environmental Policy Act as it
implements the project.

May, 1991 by ONEITA H. HOLLOWELL, widow, Grantor to the TOWN OF
HERTFORD, a municipal corporation organized and existing under the
laws of the State of North Carolina, Grantee;
W I T N R 8 S E T H:
THAT WHEREAS, by Lease with Option to Purchase dated 1
December 1978. Joel F. Hollowell, Jr. and wife, Oneita H. Hollowell
leased the hereinafter described property to the Grantee with an
option to purchase; and whereas, said lease was assigned by Joel
F. Hollowell, Jr. and wife, Oneita H. Hollowell to Bank of North
Carolina, N.A. (now NCNB, National Bank of North Carolina); and
whereas, said Bank of North Carolina, N.A. had a deed of trust lien
against said property; and whereas, the Grantee herein agreed to
make payments on the note secured thereby to Bank of North
Carolina, N.A. and that when same was satisfied the property
hereinafter described would be deeded by Joel F. Hollowell, Jr. and
wife, Oneita H. Hollowell to the Grantee herein; and whereas, said
loan was paid in full and the note and deed of trust were marked
paid and satisfied in full and the deed of trust was cancelled of
record; and whereas, no deed was ever given by Joel F. Hollowell,

docking facility consisting of a 6 foot wide by 170 foot long pier with two (2) 6
foot by 40 foot finger piers, two (2) 4 foot by 36 foot finger piers, two (2) 4 foot
by 30 foot finger piers, four (4) tie pilings, an electric/water pedestal and a
pump -out station on the Perquimans River, at 208 Perquimans Street, in the
Town of Hertford.

Land Use Plan certified by the CRC on March
Overview: The .48 acre subject property has approximately 105 linear feet of shoreline along
the Perquimans River. Water depths extend from 1.5 feet at the shoreline to 6.5 feet a
distance of 176 feet waterward of Normal Water Level (NWL). Average elevation of the
property is 4 feet above NWL. The property is within the AE floodzone. Existing site
improvements consist of paved parking on the southern half of the property with an 8 foot
wide by 90 foot long concrete walkway extending from the parking area, through a grassed
lawn, to the shoreline. Existing shoreline improvements consist of riprap shoreline
stabilization covered by a 12 foot wide boardwalk that runs parallel to the entire shoreline.
Installation of a nine (9)-slip boat docking facility consisting of a 6 foot wide by 170 foot long
pier with two (2) 6 foot by 40 foot finger piers, two (2) 4 foot by 36 foot finger piers, two (2) 4
foot by 30 foot finger piers, four (4) tie pilings, an electric/water pedestal and a pump -out
station is proposed. The pump -out will be located at the end of the main pier along with the
electric and water pedestal. Effluent from the pump -out will be piped to the Town's existing
sewer system. Installation of water, electrical and sewer lines and a holding tank associated
with the pump -out will result in upland disturbance.
Slips within the docking facility will be for transient dockage.
The waters of the Perquimans River in this area are classified as SC and are closed to
shellfish taking. A dense population of water lily extends from the existing boardwalk to a

distance of approximately 40 feet into the river. There are no archaeological sites identified.
The property is located within the historic district.
The Town is using public grant funds and its own funds to construct the town dock and boat
slips.
Anticipated impacts resulting from this project are expected to include: the shading of 2,028
sq. ft. of Public Trust Area of Environmental Concern (AEC) and the disturbance of 1,000 sq.
ft. of Highground.
Basis for Determination:
The Town of Hertford Land Classification Map identifies the site area as "Developed".
The following policies from the Town of Hertford 1991 Land Use Plan certified by the CRC on
March 27, 1992 may be applicable to this request:
Areas of Environmental Concern (AEC) and Appropriate Land Uses in AECs:
Policy, Page 31.
"The Town of Hertford contains four types of AEC's which are Estuarine
Waters, Estuarine Shorelines, Public Trust Waters, and Coastal Wetlands.
Each of these AEC's is currently regulated either by the local CAMA Permit
Office for minor developments or by the State CAMA Office for Major Permits.
Local officials will continue to have a policy of allowing those developments
that meet current zoning regulations and all other applicable local, State or
federal regulations affecting the AEC area."
Other Hazardous or Fragile Land Areas:

Land uses near man-made hazards and cultural/historic resources shall
be permitted based on the Hertford Zoning Ordinance."

the ETJ area."
Marina and Floating Home Development and Dry Stack Facilities:

"Floating homes shall not be permitted inside the Town's area of responsibility.
The Town's Zoning Ordinance shall be amended to not permit floating homes
on any water bodies in Hertford's planning jurisdiction. Town officials wish to
establish a marina along the Perquimans River as part of the Town's
Waterfront Access Plan. As in the 1986 Plan, Town officials shall continue to
have a policy to allow marinas which are developed in accordance with the
Division of Coastal Management standards and guidelines.
Restriction of Development in Areas Up to Five Feet Above Mean High Water:

"Hertford policy shall be to not restrict development in areas up to five feet
above mean high water (the potential area of impact from rising sea level)
other than as currently regulated by CAMA, zoning or the Flood Insurance
Program."
Commercial and Recreational Fisheries:

"To protect the river's aesthetic and water quality and fisheries found in the
area, Hertford policy shall be to do everything in its power to work with State,
federal and local agencies to maintain and improve water quality in the River
to insure the river's continued use as a spawning and nursery area."

Proiect Setting
The property in question is located in the Town of Hertford behind the Police Department and the Town Managers
Office, adjacent to Punch Alley and the Perquimans River, Perquimans County, North Carolina. The project site abuts a
.public boat ramp to the west along Punch Alley; the Police Department to the south, a residential lot to the west and the
Perquimans River to the north. Located at the adjacent access boat ramp is a dock used to moor the Periauger, a
reconstructed colonial boat work boat used for historical reenactments. Adjacent to the Periauger are two floating drive
on personal water craft docks placed by the Town of Hertford as a kayak launch.
The property is approximately .48 acres, with 105' fronting on the Perquimans River. There is an existing 12' x 105'
boardwalk paralleling the shoreline, with an 8' access walkway leading from a parking lot located 100' from normal water
level. While there are no identified archeological sites on the property is located within the Hertford Historic District.
There is a small variety of vegetation on the property and it includes, but is not limited to bald cypress (Taxodium
distichum), a domestic grasses and a dense population of water lily (Nymphaea odorata) extending from the existing
boardwalk to a distance of approximately 40' into the Perquimans River.
Average elevation of the property is approximately 4' above normal water level. Flood designation for the property is
AE, which indicates a susceptibility to flooding. Shoreline stabilization consists of riprap that is located underthe existing
boardwalk. Water depths extend from 1.5' at the waterward side of the boardwalk to 6.5' at the distance of 176'
waterward of normal water level (NWL). The property is located in the Public Trust Shoreline Area of Environmental
Concern (AEC) and the waters immediately adjacent to the property are within Public Trust Waters.
Currently there is only one marina operating in Perquimans County located at Albemarle Plantation, approximately 23
miles from the Town of Hertford by boat. Albemarle Plantation has a 158 slip marina exclusively for the residents of the
subdivision. Fuel and pump -out facilities are available to the public for a fee.
Development Proposal
The Town of Hertford is requesting a CAMA Major Permit to construct a nine slip docking facility including a 6' x 170' pier
with (2) 40' x 6' finger piers, (2) 4' x 36' finger piers, (2) 4' x 30' finger piers, one electriclwater pedestal and one pump -
out station located at the end of the pier. The ninth mooring will be on the outside of "T" created by the two 40' finger
piers and the end of the main access pier.

a. A project narrative.
Chartered in 1758, Hertford has a rich colonial and maritime history tied to the Perquimans River
and Albemarle Sound. Hertford is the seventh oldest town in North Carolina. It is also the Seat of
Perquimans County.
In 2010 Hertford was accepted into the NC Rural Center STEP (Small Town Economic
Prosperity) grant program, which helps the town to identify and prioritize economic development
and revitalization. The strategic planning portion of the STEP process has identified waterfront
development as a priority, specifically the construction of slips for boaters who wish to visit the
town. Currently, visiting boaters do not have a place to dock their boats, many in the forty feet
range, at a public facility. These visitors must anchor away from the town boat ramps and use
their tenders or dinghies to access the small dock that is adjacent to the ramps. During the week
and especially on weekends, the town boat ramps are crowded with fisherman, which can make
access difficult for visiting boaters.
Prior to being selected for STEP, the town participated in the Creative Communities Initiative
with the UNC School of Business to develop a waterfront development plan. Over a three-year
period, graduate students in the business school at UNC worked with the town to develop a
waterfront revitalization plan, which includes boat slips and a public/private partnership for a
mixed use waterfront development that includes outfitters, a hotel, fuel service, and other
amenities on the water. The waterfront plan uses the attraction of the Perquimans River to help
spur economic development and re-establish Hertford as a vibrant waterfront town. The town
dock and boat slips are the critical first step in the town's long-term plan for revitalizing
Hertford's historic waterfront.
Project Objectives
The Town of Hertford, Waterfront Access Improvement Project seeks to accomplish the
following objectives:
• Provide safe harbor dock space for transient boaters, recreational boaters and
visitors with the construction of nine slips.
• Increase transient boater and visitor traffic to help spur economic development and
revitalization of the Historic Waterfront.
Expected Results and Benefits
The addition of the town dock to the Municipal Park will be the critical first step in
implementing the town's Waterfront Development Plan. The new town dock will help reconnect
the town's 63 historic points of interest to the water, which will help attract boaters looking for a
charming, southern waterfront town. The town is able to offer a rich history and many amenities
within a 20-block area around the town dock. Locations of amenities close to the town dock
include the Post Office, Missing Mill Park and Restrooms, Convenience Mart, Restaurant, and
Gas Station, Senior Center and Tennis Courts, Hardware Store, Public Library, Internet Cafe,

The layout of the town dock and water depths behind Municipal Park is shown on the attached
Site Plan Detail. The town dock will extend 170 feet due north from the Municipal Park
boardwalk. The main walkway and T pier on the end of the walkway will be six feet wide. The
four finger piers for boat slips will be four feet wide. The T walkway will be able to
accommodate an 80 foot boat. The four adjacent berths will be 36 feet long and 13 feet wide
with a mooring pile at the entrance of the berths. The T pier and four adjacent berths are in six
feet of water: The four berths closest to shore will be 30 feet long and 10 feet wide, with a
mooring pile at the entrance. These four berths are in five to six feet of water. Water, electric
service and pump -out lines will be provided along the main six foot wide walkway.
Construction details are shown in the attached engineer's plans, Sheets 14.
An information kiosk with maps and brochures will be installed at the entrance to Municipal
Park from the town dock to provide information on amenities and points of interest. For safety,
the town dock will be located directly behind the town police station.
7. Compliance with N.C. Environmental Policy Act (N.C.G.S.113A 1-10)
The Town of Hertford is using public grant funds and its own funds to construct the town dock
and boat slips. It is aware of and will comply with the N.C. Environmental Policy Act as it
implements the project.

The Town of Hertford is proposing to construct a 6' x 170' pier with (2) 40' x 6' finger piers, (2) 4' x 36'
finger piers, (2) 4' x 30' finger piers, four tie pilings, one electric/water pedestal, and one pump -out station
located at the end of the pier. Pump -out and electrical installation will involve minor high ground
disturbance to connect to existing land based services. The number of proposed slips will be nine, with four
along finger piers and one located on the outside of the docking facility adjacent to the electric/water
pedestal and the pump -out. See site plan provided.
I have reviewed the rules as they pertain to Piers and Docking Facilities and would like to offer the
following:
15 NCAC 07H .0208 Use Standards
(b)Special Use Standards
(6) Piers and Docking Facilities.
(A) Piers shall not exceed six feet in width. Piers greater than six feet in width shall be permitted
only if the greater width is necessary for safe use, to improve public access, or to support a
water dependent use that cannot otherwise occur;
Consistent: Proposed pier is six feet in width and the finger piers are 6' and 4' in width.
(B) The total square footage of shaded impact for docks and mooring facilities (excluding the pier)
allowed shall be eight square feet per linear foot of shoreline with a maximum of 2,000 square
feet. In calculating the shaded impact, uncovered open water slips shall not be counted in the
total. Projects requiring dimensions greater than those stated in this Rule shall be permitted
only if the greater dimensions are necessary for safe use, to improve public access, or to
support a water dependent use that cannot otherwise occur. Size restrictions shall not apply to
marinas;
Consistent: The total area of shading by the proposed finger pier will be 1,008sf.
(C) Piers and docking facilities over coastal wetlands shall be no wider than six feet and shall be
elevated at least three feet above any coastal wetland substrate as measured from the bottom

(D) A boathouse shall not exceed 400 square feet except to accommodate a documented need for
a larger boathouse and shall have sides extending no farther than one-half the height of the
walls and covering only the top half of the walls. Measurements of square footage shall be
taken of the greatest exterior dimensions. Boathouses shall not be allowed on lots with less
than 75 linear feet of shoreline. Size restrictions do not apply to marinas;
Consistent: No boat house proposed.
(E) The total area enclosed by an individual boatlift shall not exceed 400 square feet except to
accommodate a documented need for a larger boat lift;
Consistent: No boatlifts proposed.
(F) Piers and docking facilities shall be single story. They may be roofed but shall not be designed
to allow second story use;
Consistent: Single story proposed.
(G) Pier and docking facility length shall be limited.
Consistent: The length has been limited to minimum necessary to grant funding to the
Town to facilitate large boat mooring.
(H) Piers or docking facilities longer than 400 feet shall be permitted only if the proposed length
gives access to deeper water at a rate of at least 1 foot each 100 foot increment of length
longer than 400 feet, or, if the additional length is necessary to span some obstruction to
navigation.
Consistent: The pier will be less than 400'.
(1) Piers and docking facilities shall not interfere with the access to any riparian property and shall
have a minimum setback of 15 feet between any part of the pier or docking facility and the
adjacent property owner's areas of riparian access.
Consistent: The docking facility will be set back greater than the minimum 15'
requirement.
(J) Applicants for authorization to construct a pier or docking facility shall provide notice of the
permit application to the owner of any part of a shellfish franchise or lease over which the
proposed dock or pier would extend. The applicant shall allow the lease holder the opportunity
to mark a navigation route from the pier to the edge of the lease.
Consistent: The pier location does not involve any shellfishing franchise.
Land based development associated with this project is to connect electric, water and waste to existing
services and will include a small holding tank. The proposed tank will be located 75' landward of normal
water level. Consistent with the Division's rules.
Based on the above review I would like to recommend that the request be approved
subject to the standard applicable conditions.

Permit when the Division of Coastal Management issues it. In addition, you should obtain
or otherwise comply with any other required federal, state or local permits before you go ahead

8. PROJECT SUMMARY: The project includes a 6' x 170' pier with (2) 40' x 6' finger piers, (2) 4' x 36' finger piers, (2) 4' x 30'
finger piers, four tie pilings, one electric/water pedestal, and one pump -out station located at the end of the pier. The pump -
out and electrical installation will involve minor high ground disturbance and connect to existing service facilities. A holding
tank will be installed in association with the pump -out, and will be located greater than 75' from normal water level.

Project Setting
The property in question is located in the Town of Hertford behind the Police Department and the Town Managers
Office, adjacent to Punch Alley and the Perquimans River, Perquimans County, North Carolina. The project site abuts a
public boat ramp to the west along Punch Alley; the Police Department to the.south, a residential lot to the west and the
Perquimans River to the north. Located at the adjacent access boat ramp is a dock used to moor the Periauger, a
reconstructed colonial boat work boat used for historical reenactments. Adjacent to the Periauger are two floating drive
on personal water craft docks placed by the Town of Hertford as a kayak launch.
The property is approximately .48 acres, with 105' fronting on the Perquimans River. There is an existing 12' x 105'
boardwalk paralleling the shoreline, with an 8' access walkway leading from a parking lot located 100' from normal water
level. While there are no identified archeological sites on the property is located within the Hertford Historic District.
There is a small variety of vegetation on the property and it includes, but is not limited to bald cypress (Taxodium
distichum), a domestic grasses and a dense population of water lily`(Nymphaea odorata) extending from the existing
boardwalk to a distance of approximately 40' into the Perquimans River.
Average elevation of the property is approximately 4' above normal water level. Flood designation for the property is
AE, which indicates a susceptibility to flooding. Shoreline stabilization consists of riprap that is located under the existing
boardwalk. Water depths extend from 1.5' at the waterward side of the boardwalk to 6.5' at the distance of 176'
waterward of normal water level (NWL). The property is located in the Public Trust Shoreline Area of Environmental
Concern (AEC) and the waters immediately adjacent to the property are within Public Trust Waters.
Currently there is only one marina operating in Perquimans County located at Albemarle Plantation, approximately 23
miles from the Town of Hertford by boat. Albemarle Plantation has a 158 slip marina exclusively for the residents of the
subdivision. Fuel and pump -out facilities are available to the public for a fee.
Development Proposal
The Town of Hertford is requesting a CAMA Major Permit to construct a nine slip docking facility including a 6' x 170' pier
with (2) 40' x 6' finger piers, (2) 4' x 36' finger piers, (2) 4' x 30' finger piers, one electriciwater pedestal and one pump -
out station located at the end of the pier. The ninth mooring will be on the outside of "T" created by the two 40' finger
piers and the end of the main access pier.
High Ground Disturbance:
The; installation of the lines for water, electrical and sewer are estimated to be 1,OOOsf

In addition to the pier and finger piers, the Town proposes to install four tie pilings as depicted on the enclosed site
plan drawings. A pump -out will be located at the end of the main pier along with an electric and water pedestal.
Effluent from the pump -out facility will be piped to the Town's existing sewer system.
As proposed, all slips within the proposed docking facility will be for transient dockage by boaters visiting the Town
of Hertford.
Anticipated Impacts
1) Shading of 2,028sf of water bottom from docking facility.
2) Temporary disturbance of approximately 1,000sf of high ground.
3) Construction impacts may result in a small reduction in water lily density between the finger piers and the
existing boardwalk.
4) An anticipated increase in boating traffic may in increased wave action along adjacent shoreline, and may
increase the risk for shoreline erosion along adjacent properties.
5) Jetting pilings for the marina will result in temporally suspending sediments in the water.
6) Along the shallower waters within the proposed docking facility, prop wash may cause resuspension of
sediments within the water column.

The NC Division of Coastal Management hereby acknowledges receipt of your
application for State approval for development of the Town's property located adjacent
Punch Alley in Hertford, Perquimans County. It was received complete on May 23,
2014, and appears to be adequate for processing at this time. The projected deadline
for making a decision is August 6, 2014. An additional 75-day review period is provided
by law when such time is necessary to complete the review. If you have not been
notified of a final action by the initial deadline stated above, you should consider the
review period extended. Under those circumstances, this letter will serve as your notice
of an extended review. However, an additional letter will be provided on or about the
75th day.
If this agency does not render a permit decision within 70 days from May 23, 2014, you
may request a meeting with the Director of the Division of Coastal Management and
permit staff to discuss the status of your project. Such a meeting will be held within five
working days from the receipt of your written request and shall include the property
owner, developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at ttie location of
the proposed development. Enclosed you will find a "Notice of Permit Filing" postcard
which must be posted at the property of your proposed development. You should post
this notice at a conspicuous point along your property where it can be observed from a
public road. Some examples would be: Nailing the notice card to a telephone pole or
tree along the road right-of-way fronting your property, or at a point along the road right-
of-way where a private road would lead one into your property. Failure to post this
notice could result in an incomplete application.

HERTFORD, a municipal corporation organized and existing under the
laws of the State of North Carolina, Grantee;

THAT WHEREAS, by Lease with Option to Purchase dated 1
December 1978, Joel F. Hollowell, Jr. and wife, Oneita H. Hollowell
leased the hereinafter described property to the Grantee with an
option to purchase; and whereas, said lease swag assigned by Joel
F. Hollowell, Jr. and wife, Oneita H. Hollowell to Bank of North
Carolina, N.A. (now NCNB, National Hank of North Carolina); and
whereas, said Bank of North Carolina, N.A. had a deed of trust lien
against said property; and whereas, the Grantee herein agreed to
make payments on the note secured thereby to Bank of North
Carolina, N.A. and that when acme was satisfied the property
hereinafter described would be deeded by Joel F. Hollowell, Jr. and
wife, Oneita H. Hollowell to the Grantee herein; and whereas, said
loan was paid in full and the note and deed of trust were marked
