The enclosed permit constitutes authorization under the Coastal Area Management Act, and where
applicable, the State Dredge and Fill Law, for you to proceed with your project proposal. The original (buff
colored form) is retained by you and it must be available on site when the project is inspected for compliance.
Please sign both the original and the copy and return the copy to this office in the enclosed envelope. Signing
the permit and proceeding means you have waived your right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-
121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the ---
Office of Administrative Hearings, P.O. Drawer 11666, Raleigh, NC 27611, (919) 733-2698 within twenty (20)
days of this decision on your permit. You should also be aware that if another qualified party submits a valid
objection to the issuance of this permit within twenty (20) days, the matter must be resolved prior to work
initiation. The Coastal Resources Commission makes the final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must
be carried out in accordance with your application. Modifications, time extensions, and future maintenance require
additional approval. Please read your permit carefully prior to starting work and review all project plans, as
approved. If you are having the work done by a contractor, it would be to your benefit to be sure that he fully
understands all permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we request
that you complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise
concerning permit conditions, environmental safeguards, or problem areas, you may contact Department personnel
at any time for assistance. By working in accordance with the permit, you will be helping to protect our vitally
important coastal resources.

• A copy of the deed (with state application only) or
other instrument under which the applicant claims title
to the affected properties. If the applicant is not
claiming to be the owner of said property, then
forward a copy of the deed or other instrument under
which the owner claims title, plus written permission
from the owner to carry out the project.
• An accurate, dated work plat (including plan view
and cross -sectional drawings) drawn to scale in black
ink on an 8 1/2" by 11" white paper. (Refer to
Coastal Resources Commission Rule 7I.02031 for a
detailed description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue -line
prints or other larger plats are acceptable only if an
adequate number of quality copies are provided by
applicant. (Contact the U.S. Army Corps of
Engineers regarding that agency's use of larger
drawings.) A site or location map is a part of plat
requirements and it must be sufficiently detailed to
guide agency personnel unfamiliar with the area to the

site. Include highway or secondary road (SR)
numbers, landmarks, and the like.
• A Stormwater Certification, if one is necessary.
• A list of the names and complete addresses of the
adjacent waterfront (riparian) landowners and
signed return receipts as proof that such owners

by certified mail. Such landowners must be advised
that they have 30 days in which to submit comments
on the proposed project to the Division of Coastal
Management. Upon signing this form, the applicant

8. PROJECT SUMMARY: The applicants propose to excavate a 16' X 52' boat basin out of high
ground and to bulkhead the resulting shoreline.

9. NARRATIVE DESCRIPTION:
Project Setting
The applicants own lot #18 in Mainsail Point Subdivision near Oriental, adjacent
a manmade canal off Greens Creek in Pamlico County. A single-family dwelling and
storage shed are located on the .5-acre high ground lot. A 200'-long X 25'-wide X -
4'-deep access channel/canal provides access to Greens Creek. This canal adjoins the
northeast comer of the property and flows in a northerly direction. As it approaches
the applicants' property, the canal turns to the east and widens to 30'. It continues
past the applicants' property for another 200' where it ends. Approximately 80' of the
northern property line adjacent the canal is bulkheaded and about 70' of the eastern
property line. An extensive black needlerush Juncus roemerianusl and giant cord
grass S artina cynosuroidesl marsh is located along much of the northern and western
property lines. A concrete boatramp adjoins the property to the east while a wooded
area adjoins the property to the south.
Greens Creek and the adjoining canal are designated Primary Nursery Areas.

Project Description

The applicants propose to excavate the corner of there bulkheaded lot to create a
16' X 52' private boat basin. The proposed depth of excavation would be -4' below
NWL or the same as the controlling water depth of the adjacent canal. The shoreline
created by the 16' X 52' cut would then be re-bulkheaded. Excavation behind the old
bulkhead would be completed and the new bulkhead installed before the old bulkhead is
removed. The spoils would remain on the site but would be placed on high ground
near the western property line. Silt fences would be utilized to prevent any
sedimentation/runoff problems.
Anticipated Impacts
The excavation of the basin would convert approximately 832 fP of high ground
area into public trust waters and shallow estuarine habitat. The excavation project
would remove approximately 100 yds3 of sandy material from high ground and another
125 yds3 from below the NWL. Approximately 70 W of high ground would be
disturbed by the installation of the bulkhead tie -backs. Another 3,750 ft2 of high
ground area would be consumed by the resultant spoils. Limited increases in turbidity
would be anticipated as a result of the timing and methodologies used during the
construction/excavation.

DATE: December 18, 1995
The applicants propose to excavate a high ground boat basin and to bulkhead the
resulting shoreline. And although the applicant could have made minor changes in the size
of the basin to fall within the criteria for the General Permit for high ground basin
excavation, the fact that the canal adjacent to Greens Creek is a Primary Nursery Area
prevented use of the GP. Consequently, the applicant applied for a permit through the
CAMA Major Permit process. The proposed development is consistent with the General and
Specific Use Standards for both 7H.0208 and 7H.0209. Therefore, I have no objections to
the project as proposed but do offer the following conditions:
1. In order to protect juvenile shrimp d fmfish populations"excavation filling
will be permitted between D andof any
year without the prior approval of the Division of Coastal Management, in
consultation with the Division of Marine Fisheries.
2. Excavation will be conducted below the normal water level and will not exceed -4 feet
below the normal water level.
3. To prevent siltation into the adjacent water body, the existing bulkhead shall remain
in place during the high ground excavation and the new bulkhead installed before the
old bulkhead is removed.
4. The bulkhead must be constructed prior to any backfilling activities.
5. The bulkhead must be structurally tight so as to prevent seepage of backfill materials
through the structure.
6. The bulkhead must be solid and constructed of treated wood, concrete slabs, metal
sheet piles, or other suitable materials approved by Department personnel. No
excavation is permitted, except in the area shown on the 10-18-95 work plat and that
necessary for the construction of the bulkhead wall and deadmen cables, etc.
7. All backfill material will be obtained from a highground source and confined behind

the permitted bulkhead. Material excavated from the high ground basin would be
suitable backfill material.
8. All excavated materials will be confined above mean high water and landward of
regularly or irregularly flooded marsh behind adequate dikes or other retaining
structures to prevent spill -over of solids into any marsh or surrounding waters.
9. All disturbed areas as well as the spoil area will be properly graded and provided a
ground cover sufficient to restrain erosion within thirty (30) working days of project
completion.

County Land Use Plan (LUP) Update and offer the following comments.
The general area of the project is classified as Rural with
Services, while the AECs impacted by the work are classified as
Conservation I (Estuarine Shoreline) and Conservation IV (Public
Trust Areas and Estuarine Waters).
The Pamlico LUP establishes a permanent conservation zone within
seventy-five feet of the mean high water level for all shorelines
bordering Primary Nursery Areas and other estuarine and public
trust waters. Development activities in this zone (which
corresponds to the Estuarine Shoreline AEC impacted by this
proposal) are strictly limited for properties subdivided pursuant
to the County's Subdivision Ordinance after January 26, 1990.
According to the Pamlico County Inspections Office, this
subdivision predates the effective date, and therefore these
restrictions do not apply to the Millers' property.
Pamlico County allows all uses which are consistent with the 15A
NCAC 7H Use Standards in the Conservation IV classification.
Applicable LUP policies include Resource Production and Management
Policies for Marine Resource Areas (Page IV-14). These policies
restate Pamlico County's support for the use standards for
Estuarine and Public Trust Waters as specified in 15A NCAC 7H.
Bulkhead policies are included on Page IV-10 of the LUP and also
state support for bulkheads which are constructed in accordance
with the state minimum standards and the North Carolina State
Building Code.
The Pamlico County LUP also places density restrictions on
properties located in the Rural with Services classification.
However, the LUP exempts subdivisions and platted lots in existence
prior to the adoption of this plan (July 20, 1992) from the Rural
with Services density requirements. Since the Mainsail Point
Subdivision predates the effective date of these requirements, no
determination of consistency with these particular policies is
required.
Based on the above policies and land classifications, this proposal
appears to the-consiaftnt with the 1992 Pamlico County Land Use
Plan, provided all state requirements are met.

The primary adverse impact anticipated to result from the project is turbidity associated
with dredging. Elevated turbidity could reduce water quality in this area and stress marine
organisms. Excessive turbidity is particularly damaging to egg and larval life stages of marine
organisms. The project site is located in high quality waters and a primary nursery area; therefore,
we recommend that excavation be prohibited between April 1 and September 30. We also
recommend that silt booms be placed across the canal during excavation to contain turbidity. Silt
booms should remain for 72 hours after project completion. I

9. NARRATIVE DESCRIPTION:
Project Setting
The applicants own lot #18 in Mainsail Point Subdivision near Oriental, adjacent
a manmade canal off Greens Creek in Pamlico County. A single-family dwelling and
storage shed are located on the .5-acre high ground lot. A 200'-long X 25'-wide X -
4'-deep access channel/canal provides access to Greens Creek. This canal adjoins the
northeast corner of the property and flows in a northerly direction. As it approaches
the applicants' property, the canal turns to the east and widens to 30'. It continues
past the applicants' property for another 200' where it ends. Approximately 80' of the
northern property line adjacent the canal is bulkheaded and about 70' of the eastern
property line. An extensive black needlerush Juncus roemerianusl and giant cord
grass S artina cynosuroidesl marsh is located along much of the northern and western
property lines. A concrete boatramp adjoins the property to the east while a wooded
area adjoins the property to the south.
Greens Creek and the adjoining canal are designated Primary Nursery Areas.
Greens Creek is classified as SC NSW HQ waters. The area is closed to shellfishing.
Project Description

The applicants propose to excavate the corner of there bulkheaded lot to create a
16' X 52' private boat basin. The proposed depth of excavation would be -4' below
NWL or the same as the controlling water depth of the adjacent canal. The shoreline
created by the 16' X 52' cut would then be re-bulkheaded. Excavation behind the old
bulkhead would be completed and the new bulkhead installed before the old bulkhead is
removed. The spoils would remain on the site but would be placed on high ground
near the western property line. Silt fences would be utilized to prevent any
sedimentation/runoff problems.
Anticipated Impacts
The excavation of the basin would convert approximately 832 ftZ of high ground
area into public trust waters and shallow estuarine habitat. The excavation project
would remove approximately 100 yds3 of sandy material from high ground and another
125 yds3 from below the NWL. Approximately 70 ftZ of high ground would be
disturbed by the installation of the bulkhead tie -backs. Another 3,750 ftZ of high
ground area would be consumed by the resultant spoils. Limited increases in turbidity
would be anticipated as a result of the timing and methodologies used during the
construction/excavation.

projected deadline for making a decision is January 15, PPW.. An additional 75-day review
period is provided by law when such time is necessary to complete the review. If you have not
been notified of a final action by the initial deadline stated above, you should consider the
review period extended. Under those circumstances, this letter will serve as your notice of an
extended review. However, an additional letter will be provided on or about the 75th day.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which must
be posted at the property of your proposed development. You should post this notice at a
conspicuous point along your property where it can be observed from a public road. Some
examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-
way fronting your property; or at a point along the road right-of-way where a private road would
lead one into your property. Failure to post this notice could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be
contacted by the appropriate State or Federal agency. Please contact me if you have any

Said lot is also shown on a map entitled "A SURVEY FOR
PAUL J. MILLER and wife, NANCY M. MILLER', prepared by
A. Hugh Harris, Jr., PE-RLS, dated June 23, 1995, copy
of which is attached hereto and incorporated herein by
reference.
Said land was conveyed to Joe C. McIntosh by Joseph E.
Rhodes and Arthur H. Rosen, d/b/a Mainsail Point
Associates by deed dated July 22, 1983 and recorded in
Book 222 at Page 77, Pamlico County Registry.
TO HAVE AND TO HOLD the aforesaid lot or parcel of
land, together with all privileges and appurtenances thereunto
belonging, to the said Paul J. Miller and wife, Nancy M. Miller,
and their heirs and assigns, in fee simple forever.
And grantors, for themselves, their executors and
administrators, covenant with grantees and their heirs and
assigns, that they are seized of said premises in fee; that they
have a perfect right to convey the same in fee simple; that the
same are free and clear of all encumbrances whatsoever, except
