Any violation of or deviation from the plan approved by the D.W.Q. will be considered a violation of this CAMA permit NOTE: Development of individual lots may be authorized under Coastal Area Management Act Minor Development Permits. Contact the Local Permit Officer at (910) 341-7118 or a representative of the Division at (910) 395-3900 prior to the commencement of any such activity for this determination. Marina Expansion 5) The marina will display a sign prohibiting "live aboard" docking. 6) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the marina. Any sewage discharge at the marina shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 7) This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, may become a permanent part of this marina without permit modification. No non -water dependent uses of structures may be conducted on, in or over public trust waters without permit modification. 8) No attempt will be made by the permittee to prevent the free and full use by the public of all navigable waters at or adjacent to the authorized work. Use of the permitted activity must not interfere with the public's right to free navigation on all navigable waters of the United States. Sedimentation and Erosion Control 9) In order to protect water quality, runoff from construction must not visibly increase the amount of suspended sediments in adjacent waters. 10) All disturbed areas shall be properly graded and provided a ground cover sufficient to restrain erosion within thiity days of project completion. NOTE: An Erosion and Sedimentation Control Plan will be required for this project. This plan must be filed at least thirty (30) days prior to the beginning of any land disturbing activity. Submit this plan to Department of Environment, Health and Natural Resources, 127 Cardinal Drive Extension, Wilmington, N.C. 28405. The issuance of this permit does not relieve the permittee from taking all proper steps to ensure the integrity of the permitted structure and the safety of moored boats. The permittee shall not hold the United States liable for any such damage. 13) The Federal Government does not assume any liability for: A. Damages to the permitted project or uses thereof as a result of other permitted or unpermitted activities or natural causes. B. Damages to.the permitted project or uses thereof as a result of current or future Federal activities initiated on the publics behalf. C. Damages to other permitted or unpermitted activities or structures caused by the authorized activity. D. Design and construction deficiencies associated with the permitted work. E.
