Coastal Management within a maximum of 30 days prior to the start of construction. Failure to
initiate construction within 30 days, or erosion of the shoreline by adverse weather conditions, will
require the alignment to be restaked by DCM within a maximum of 30 days prior to the new
expected start of construction.

The enclosed permit constitutes authorization under the Coastal Area Management Act, and where applicable,
the State Dredge and Fill Law, for you to proceed with your project proposal. The original (buff -colored form) is
retained by you and it must be available on site when the project is inspected for compliance. Please sign both the
original and the copy and return the copy to this office in the enclosed envelope. Signing the permit and proceeding
means you have waived your right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS I I3A-121.1
or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of
Administrative Hearings, P.O. Drawer 11666, Raleigh, NC 27611, (919) 733-2698 within twenty (20) days of this
decision on your permit. You should also be aware that if another qualified party submits a valid objection to the
issuance of this permit within twenty (20) days, the matter must be resolved prior to work initiation. The Coastal
Resources Commission makes the final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be
carried out in accordance with your application. Modifications, time extensions, and future maintenance require
additional approval. Please read your permit carefully prior to starting work and review all project plans, as approved.
If you are having the work done by a contractor, it would be to your benefit to be sure that he fully understands all
permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we request that
you complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise concerning
permit conditions, environmental safeguards, or problem areas, you may contact Department personnel at any time for
assistance. By working in accordance with the permit, you will be helping to protect our vitally important coastal
resources.

9. PROJECT DESCRIPTION September 10, 1996
The project site is an undeveloped residential lot (Lot 25, Blk 40E), located at 507 North Shore
Drive, on Sunset Beach, NC, in southeastern Brunswick County. The lot is bordered on it's
north side by a large expanse of salt marsh ,which runs from the backside of Sunset Beach to the
Atlantic Intracoastal Waterway (approx. 3300 ft.). The lot is fifty (50) feet wide and
approximately 130 feet in depth, from North Shore Drive. The southern and central portions
of the lot consists of a high sand ridge, 10-19 feet elevation at mean sea level (MSL), and the
vegetation is primarily Wax Myrtle. The, elevation drops _sharply at the shoreline and the
northern third (1/3) of the lot consists of high coastal marsh and "404 type" wetlands. The
applicant has had the wetland line delineated and approved by the US Army Corps of Engineers,
Regulatory Branch. The wetland. delineation survey shows a forger -like pocket of wetlands
jutting into the highground adjacent to the shoreline. Due to shading from a dense overstory of
Wax Myrtle, this area is unvegetated and also, clearly landward of normal tidal activity. Along
the reminder of the shoreline, a steep slope transitions highground to tidal marsh. Vegetation
includes; Groundsel-tree (Baccharis halimifolia), Marsh -elder (Iva frutescens) and Sea Ox-eye
Borrichia frutescensl, intermixed with coastal wetlands species; Salt Meadow Grass (Snartina
paten s , Spike Grass (Distichlas spicata), Black Needle -rush (Juncus roemarianus), and Sea
Lavender (I.imomun. W.. Preceding waterward, the frequency_ and dominance of coastal
wetland species increases, until reaching the vast Smooth Cordgrass (Soartina alternifloral marsh
behind the island.
The waters adjacent to the project site are classified SA, by the NC Division of Environmental
Management, and are CLOSED to the harvest of shellfish. These waters have also been
designated as'a primary nursery area (PNA) by the NC Division of Marine.Fisheries.
The applicant and his neighbor (Nelson, Lot 26) have both submitted CAMA Major Permit
applications to construct straight line bulkheads along the irregular shaped shoreline of their lots.
Both are requesting this bulkhead alignment to accommodate the design of subsequent residential
construction. The applicant's proposed bulkhead would be approximately sixty (60) feet long
and four (4) feet high. It would be located at or landward of the coastal wetland line, but would
cross the mouth of the wetland indention into the center of the lot. Backfrll material for the
bulkhead would be obtained from the highground portion of the lot during clearing and grading.
The applicant would subsequently obtain other required permits for the construction of his
residence.
10. ANTICIPATED IMPACTS
The construction of the proposed bulkhead would incorporate approximately 560 square feet of
federally regulated wetlands.

Recommendations for State Permit - Joe Lynch
I have no objection to the proposed project, provided that the project is eligible for applicable USACOE
Nationwide permits. I recommend the following conditions be included in any subsequent issuance of
a CAMA permit:
[1] The alignment of the proposed bulkhead must be staked by a representative of the Division of
Coastal Management (DCM) within a maximum of thirty (30) days prior to the start of
construction. Failure to initiate construction within thirty (30) days, or erosion of the shoreline
by adverse weather conditions, will require the alignment to be re -staked by DCM within a
maximum of thirty (30) days prior to the new expected start of construction.
[2] The bulkhead must be constructed prior to any bac filling activities.
[3] The bulkhead must be structurally tight so as to prevent seepage of backfill materials through
the structure.
[4] The bulkhead must be solid and constructed of treated wood, concrete slabs, metal sheet piles,
or other suitable materials approved by Department personnel. No excavation is permitted,
except for that which may be required for the construction of the bulkhead wall, riprap, deadmen
cables, etc. This permit does not authorize any excavation waterward of the approved
alignment.
[5] The fill material will be clean and free of any pollutants, except in trace quantities. Metal
products, organic materials, or unsightly debris will not be used.
[6] All backfill material will be obtained from a highground source and confined behind the
permitted bulkhead.

This permit consistency opinion is based on my review of the Lynch permit application, the
Field Investigation Report (EF Brooks, 9/10/96), and my understanding and interpretation
of the policies presented in the Town of Sunset Beach Land Use Plan.
The applicant proposes construction of a bulkhead along the waterward side of his
property. The bulkhead will facilitate residential construction and would incorporate
approximately 560 square feet of "404" wetlands and no coastal marsh. The location and
complete description of the project are in the Field Investigation Report. Note: This project
is adjacent to a lot owned by D. Nelson, who is also requesting a bulkhead permit. It is my
opinion that Mr. Nelson's permit is inconsistent because of coastal marsh wetland rill.
LAND USE CLASSIFICATION: Developed; Conservation (estuarine shoreline AEC)
CLASSIFICATION DESCRIPTION: 713.0204 (d)(7) "...and the primary intent of the
conservation class is to provide protection for the resources included therein."
RELATED POLICIES AND IMPLEMENTATION MEASURES:
A. Resource Protection
1 a. (1) Coastal Wetlands (p.52)It shall be the policy of Sunset Beach to restrict land uses
in coastal wetlands to those that guarantee wetlands conservation and which do not affect
their delicate balance. Sunset Beach shall permit water dependent uses such as docks,
boat ramps, piers, ... Each proposed use will be evaluated for water dependency.
Unacceptable land uses may include, but would not be limited to restaurants,
businesses, residences,...
1.a.(4) Estuarine Shorelines (p.53)Suitable land uses within the estuarine shorelines are
those compatible with both the dynamic nature of the estuarine shoreline and the value of
the estuarine system...
Within the Estuarine Shoreline Area, the Town of Sunset Beach believes that certain
developed uses should only be allowed to take place which are consistent with 15 NCAC
7H and as further defined by the Town's building and development ordinances, and which
satisfy the following requirements:

1) natural barriers to erosion are not weakened or eliminated; ...3) the amount of runoff is
unchanged; ...6) the construction of impervious surfaces and areas not allowing natural
drainage is limited to that necessary for development.
2.d. Wooded Swamps and 404 Wetlands (p.58) The Town supports the preservation of
wetlands through the enforcement of 404 regulations [by the US Army Corps of Engineers].
7. Marina Bulkhead, and Floating Structure Development (p.62) The development of
bulkheads and private boat slips in Sunset Beach are permitted uses in the Town's zoning
ordinance and must meet CAMA regulations. Damage to existing marshes or beaches
by bulkhead installation or replacement, groins, or seawalls will not be permitted.
CONSISTENCY OPINION:
The Town of Sunset Beach policy does not permit damage to existing marshes or beaches
by bulkhead installation. The Town's policy on 404 wetlands relies on the US COE for
"preservation" of these wetlands. The Plan contains numerous references to its desire to
protect estuarine water quality and to protect the natural resources. In consultation with
the Town of Sunset Beach, policy #7 as quoted above was intended to apply to both
coastal marsh and freshwater marsh. However, the language does not clearly state the
intent.
There is sufficient high ground available to place both septic tank and a dwelling, albeit
a small one, without compromising the natural estuarine system of mixed coastal marsh
and delineated "404" wetlands. No demonstration has been made that there is "...no
suitable alternative site or location outside of the AEC ... for the use and development and,
further, that the applicant has selected a combination of sites and design that will have a
minimum adverse impact upon the productivity and biological integrity of coastal
marshland,... nursery areas..., and natural erosion barriers (cypress fringes, marshes...).

Based on conversation with the Town of Sunset Beach about the Lynch application, the
Town Administrator indicated that the Town's intent was to have prohibited fill which would
compromise the natural function of the AEC. However, the issue of filling "404" is not
clearly addressed in the Land Use Plan text or by policy. There is insufficient information
in the Plan to determine the consistency of the fill of "404" wetlands adjacent with coastal
marsh along the estuarine shoreline AEC.

side of his property. The proposed straight alignment of the bulkhead to facilitate residential
construction would incorporate approximately 560 square feet of "404 type" wetlands.

9. PROJECT DESCRIPTION September 10, 1996
The project site is an undeveloped residential lot (Lot 25, Blk 40E), located at 507 North Shore
Drive, on Sunset Beach, NC, in southeastern Brunswick County. The lot is bordered on it's
north side by a large expanse of salt marsh which runs from the backside of Sunset Beach to the
Atlantic Intracoastal Waterway (approx. 3300 ft.). The lot is fifty (50) feet wide and
approximately 130 feet in depth, from North Shore Drive. The southern and central portions
of the lot consists of a high sand ridge, 10-19 feet elevation at mean sea level (MSL), and the
vegetation is primarily Wax Myrtle. The elevation drops sharply at the shoreline and the
northern third (1/3) of the lot consists of high coastal marsh and "404 type" wetlands. The
applicant has had the wetland line delineated and approved by the US Army Corps of Engineers,
Regulatory Branch. The wetland delineation survey shows a finger -like pocket of wetlands
jutting into the highground adjacent to the shoreline. Due to shading from a dense overstory of
Wax Myrtle, this area is unvegetated and also, clearly landward of normal tidal activity. Along
the reminder of the shoreline, a steep slope transitions highground to tidal marsh. Vegetation
includes; Groundsel-tree Baccharis halimifolial, Marsh -elder (Iva frntescens) and Sea Ox-eye
Borrichia frutescensl, intermixed with coastal wetlands species; Salt Meadow Grass S artina
paten s ,Spike Grass (Distichlas spicata), Black Needle rush (Juncos memarianusl, and Sea
Lavender (Limoniun. W.. Preceding waterward, the frequency and dominance of coastal
wetland species increases, until reaching the vast Smooth Cordgrass (Spartina alternifloral marsh
behind the island.
The waters adjacent to the project site are classified SA, by the NC Division of Environmental
Management, and are CLOSED to the harvest of shellfish. These waters have also been
designated as a primary nursery area (PNA) by the NC Division of Marine Fisheries.
The applicant and his neighbor (Nelson, Lot 26) have both submitted CAMA Major Permit
applications to construct straight line bulkheads along the irregular shaped shoreline of their lots.
Both are requesting this bulkhead alignment to accommodate the design of subsequent residential
construction. The applicant's proposed bulkhead would be approximately sixty (60) feet long
and four (4) feet high. It would be located at or landward of the coastal wetland line, but would
cross the mouth of the wetland indention into the center of the lot. Backfill material for the
bulkhead would be obtained from the highground portion of the lot during clearing and grading.
The applicant would subsequently obtain other required permits for the construction of his
residence.
10. ANTICIPATED IMPACTS
The construction of the proposed bulkhead would incorporate approximately 560 square feet of
federally regulated wetlands.
