BULKHEAD CONSTRUCTION
1. The existing bulkhead shall be repaired or replaced along the existing alignment except
that the bulkhead shall be located behind the area of marsh located on the northeast
comer of the property, as delineated on the 11/17/95 workplan.
2. The bulkhead alignment must be staked by a representative of the Division of Coastal
Management (DCM) within a maximum of thirty (30) days prior to the start of
construction. Failure to initiate construction within thirty (30) days, or erosion of the
shoreline by adverse weather conditions, will require the alignment to be re -staked by
DCM within a maximum of thirty (30) days prior to the new expected start of
construction.
(See attached sheet for Additional Conditions)
This permiLaction may be appealed by the permittee or
other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not
covered hereunder requires further Departmental approval.
All work must cease when the permit expires on
December 31, 1999
In issuing this permit, the State of North Carolina agrees

S. ADDITIONAL INFORMATION
In addition to the completed application form, the
following items must be submitted:
• A copy of the deed (with state application only) or
other instrument under which the applicant claims title
to the affected properties. If the applicant is not
claiming to be the owner of said property, then
forward a copy of the deed or other instrument under
which the owner claims title, plus written permission
from the owner to carry out the project.
• An accurate, dated work plat (including plan view
and cross -sectional drawings) drawn to scale in black
ink on an 8 1/2" by 11" white paper. (Refer to
Coastal Resources Commission Rule 7J.0203 for a
detailed description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue -line
prints or other larger plats are acceptable only if an
adequate number of quality copies are provided by
applicant. (Contact the U.S. Army Corps of
Engineers regarding that agency's use of larger
drawings.) A site or location map is a part of plat
requirements and it must be sufficiently detailed to
guide agency personnel unfamiliar with the area to the

9. NARRATIVE DESCRIPTION:
Project Setting
The applicants own a 1-acre lot in the Community of Pamlico adjacent Broad and
Gideon Creeks in Pamlico County. The high ground lot is located on a point of land -at
the -confluence of the -two creeks. - - A bulkheaded, undeveloped high ground lot is
located along Broad Creek immediately to the east while a wooded, undeveloped lot
abuts the property to the south adjacent Gideon Creek. A single family dwelling, short
pier, and approximately 400' of deteriorated bulkhead (partially refaced) exist on the
property. Because of the poor condition of the bulkhead, Estuarine Waters ebb and
flow with the wind driven tides. Some erosion is occurring behind the bulkhead and
coastal wetland vegetation has become established along several stretches of the
shoreline. Pieces of rock rip rap/concrete can be found along a 100' stretch of
shoreline landward of the wetlands. Basically two wetlands patches exist on the
property. At the eastern end of the bulkhead, the wetland area measures approximately
80' in length and 10' in width and is vegetated primarily with Spar ina alterniflora and
S. cynosuroides. The second area is a 3' wide by 60' long fringe of S. alterniflora
exists near the point. Scattered plants, can be found along the 60' of shoreline in
between the two wetland areas. Erosion behind the rest of the bulkhead averages
approximately 2'. Gideon Creek and this section of Broad Creek are designated
Primary Nursery Areas. Both creeks are SA NSW waters and open to shellfishing.
Project Description
The applicants propose to repair 400' of deteriorating bulkhead by refacing the
bulkhead, placing filter fabric behind the bulkhead, installing tie -backs where needed
and then backfilling.
Anticipated Impacts
Refacing the bulkhead and backfilling the area adjacent to Gideon Creek would
remove approximately 440 fO of Estuarine Waters and shallow water habitat (160' X 2'
and 40' X Y). And as proposed, the project would result in the loss of approximately
1,010 ftz of Coastal Wetlands (80' X 10', 60' X 3', and scattered area of 60' X .5').
High ground disturbance as a result of tie -back installation and backfilling activities
would be approximately 1,500 ft2 (150' X 10').

The applicants propose to repair/reface an old deteriorated bulkhead and to backfill,
ultimately filling approximately 1,010 ftz of coastal wetlands. As proposed, the development
is inconsistent with 07H.0205(d) Use Standards for Coastal Wetlands and 07H.0208(7)(B)
Specific Use Standards for Bulkheads and Shore Stabilization Measures. However, if the
permit were conditioned so as to restrict the bulkhead to an alignment located behind the two
wetland areas depicted on the workplat, it would be consistent with the aforementioned
regulations, and I would not be opposed to the issuance of the permit. Therefore, I have no
objections to issuance of the permit with the following conditions.
The existing bulkhead is to be repaired/replaced along the existing alignment except
for the two areas of marsh delineated on the November 17, 1995 workplat. The
bulkhead alignment along these two areas shall be located landward of all marsh.
The bulkhead alignment must be staked by a representative of the Division of Coastal
Management (DCM) within a maximum of thirty (30) days prior to the start of
construction. Failure to initiate construction within thirty (30) days, or erosion of the
shoreline by adverse weather conditions, will require the alignment to be re -staked by
DCM within a maximum of thirty (30) days prior to the new expected start of
construction.
No excavated or fill material will be placed at any time, in any marsh or surrounding
waters, outside of the alignment of the fill area indicated on the workplat and in
accordance with Conditions #1 & #2 of this permit.
The bulkhead must be constructed prior to any backfilling activities.
The bulkhead must be structurally tight so as to prevent seepage of backfill materials
through the structure.
6. The bulkhead must be solid and constructed of treated wood, concrete slabs, metal
sheet piles, or other suitable materials approved by Department personnel. No
excavation is permitted, except for that which may be required for the construction of

the bulkhead wall, riprap, deadmen cables, etc. This permit does not authorize any
excavation waterward of the approved alignment.
7. The fill material will be clean and free of any pollutants, except in trace quantities.
Metal products, organic materials, or unsightly debris will not be used.
8. All backfill material will be obtained from a highground source and confined behind
the permitted bulkhead.

The Lorenzo property is located in Pamlico County, off SR 1317, in
the Community of Pamlico, adjacent to Broad and Gideon Creeks. They
propose to repair/reface an old deteriorated bulkhead and backf ill.
AECs impacted by the work include Public Trust Areas, Estuarine
Waters, the Estuarine Shoreline and Coastal Wetlands. Waters at the
site are classified as SA NSW and are open to the harvesting of
shellfish. The area is a Primary Nursery Area.
I have reviewed this proposal for consistency with the 1992 Pamlico
County Land Use Plan (LUP) Update and offer the following comments.
The general area of the project is classified as Rural with
Services, while the AECs impacted by the work are classified as
Conservation I (Estuarine Shoreline), Conservation III (Coastal
Wetlands) and Conservation IV (Public Trust Areas and Estuarine
Waters) .
Allowed uses in the various Conservation classifications are
discussed in Section III, Land Classification System of the LUP.
Pamlico County has established a permanent conservation zone
located within seventy-five (75) feet of the natural mean high
water level for all shorelines bordering Primary Nursery Areas,
Estuarine and Public Trust Waters. This zone, which corresponds to
the Estuarine Shoreline AEC, is classified as Conservation I.
Development activities in these areas are strictly limited,
although allowed uses include shoreline stabilization activities
and structures allowed by LAMA permitting requirements.
Uses which comply with the state's minimum standards are allowed in
areas classified as Conservation III (Coastal Wetlands). Similarly,
Pamlico County allows all uses in Public Trust and Estuarine Waters
(Conservation IV) as allowed by 15A NCAC 7H.
These development policies are reiterated elsewhere in the Plan.
Policies for Residential, Commercial and Industrial Development
Impacts on Resources (Pages IV-12 through IV-14) and Marine
Resource Areas (Page IV-14) repeat the County's intentions
regarding development in the Estuarine Shoreline, Coastal Wetlands,
Public Trust Areas and Estuarine Waters AECs as described above.
r Bulkhead Construction policies are found on Page IV-10 and state
the County's approval of bulkhead construction in all areas,
provided the construction complies with the 7H Use Standards and
the North Carolina State Building Code.
The Pamlico County LUP also places density restrictions on
properties located in the Rural with Services classification.
However, the Plan exempts subdivisions and platted lots in
existence prior to the July 20, 1992 adoption date of this LUP from
these density requirements. The Lorenzos' lot is believed to have
been platted prior to Plan adoption and therefore is exempted.
Provided all state and local requirements can be satisfied, this
proposal appears to be consistent with the 1992 Pamlico County Land
Use Plan.

The following comments by the North Carolina Division of Marine Fisheries (NCDMF)
on the subject permit are offered pursuant to G.S. 113-131. The NCDMF objects to the
placement of the bulkhead and proposed backf ill that would eliminate the significant wetland
areas along Broad and Gideon Creeks (the 80'x10' and the 60'x3' patches). Broad and
Gideon Creeks are designated by the Marine Fisheries Commission as Primary Nursery Areas.
These areas are critical for the development of numerous estuarine species of fish and
shellfish. Organisms utilize these areas during the period when they are very sensitive to
water quality.
Loss of wetlands has an impact on fishery resources. Wetlands play an important role
in modifying hydrologic events. For example, wetlands moderate stormwater runoff, trap
sediments dropped from suspension as the water flow is slowed, and fix mineral nutrients in
plant tissues which are later released as detritus. Wetlands act as a sponge soaking up and
filtering pollutants that would otherwise run into sensitive coastal water. All of these
functions are beneficial to the "health" of associated estuarine systems.
The NCDMF approves the project only if the following changes are incorporated:

of repairing a bulkhead at your lot off of SR 1317, as you described in your application dated 22
December 1995. After reviewing your application, we have decided that this fill is covered by
General Water Quality Certification Number 3025.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and you may be required to send us a new application.
For this approval to be valid, you must follow the conditions listed in the attached certification. In
addition, you should get any other federal, state or local permits before you go ahead with your
project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section

Reference the application of Frwderick and Fran Lozanzo for a Department
of the Army (DA) permit to reconstruct a bulkhead in front of their property,
located off State Road 1317, adjacent to Broad Creek and Gideon Creek, in the
Community of Pamlico, Pamlico County, North Carolina.
The Federal agencies have completed review of the proposal as presented
by the application and your field investigation report.
We recommend the following conditions for inclusion in the State
authorization.
1. The bulkhead will be positioned landward of the coastal wetland area
oiWnvironmental concern in the 80' X 10' area located adjacent to the
northeast property line.
2. All backfill materials will be obtained from a highground source and
confined landward of the permitted bulkhead.
3. No vegetated wetlands will be excavated or filled outside of the
permitted fill area.
4. The temporary placement or double handling of excavated or fill
materials within waters or vegetated wetlands is not authorized.
5. The fill material will be clean and free of any pollutants except in
trace quantities. Metal products, organic materials, or unsightly debris will
not be used.

On February 11, 1991, we renewed General Permit No. 198000291 (copy
enclosed), which provides Federal authorization for construction activities
that receive authorization from the State of North Carolina. -
A review of your application received December 27, 1995, for Department
of the Army (DA) authorization to reconstruct a bulkhead in front of your
property, located off State Road 1317, adjacent to Broad Creek and Gideon
Creek, in the Community of Pamlico, Pamlico County, North Carolina, indicates
it to be a candidate for Federal authorization under this general permit.
Accordingly, the administrative processing of your application will be
accomplished by the North Carolina Division of Coastal Management. Comments
from Federal review agencies will be furnished to the State.
If your application must be withdrawn from this general permit process
for any reason, you will be informed regarding its further management. If
there are no unresolved differences in State -Federal positions or policies,
the final action taken on your application by the State will result in your
receiving written notice from us that your application is consistent with the
general permit and you may commence your activity. Only after receiving such
confirmation should you begin work.
Your application, pursuant to Section 10 of the River and Harbor Act and
Section 404 of the Clean Water Act, has been assigned Action ID No. 199601154.
It will be coordinated by Mr. Raleigh Bland in the Washington Regulatory Field
Office at telephone (919)975-1616, extension 23.

This is in response to your request for an explanation regarding authorization for
repair to the existing bulkhead on our property along Gideon and Broad Creeks
in Pamlico County.
In the fall of 1991, my husband spoke with a gentleman in the Bayboro County
courthouse responsible for issuing permits. We do not recall the name of that
man. At that time we were embarking on a do-it-yourself project to repair a
deteriorating dock and bulkhead. My husband was told that no permits were
needed as we were not adding or replacing pilings.
We completed work on the dock in the spring of 1992 and began work on the
bulkhead. Work proceeded very slowly as we are not permanent residents and
chose to work only some of the times we were able to get to N.C.
Work was halted on the bulkhead in the summer of 1994 when we learned we
would need a permit to backfill the area behind the bulkhead. At this point, we
are in the process of submitting the required information in order to obtain the
necessary permit.

The Division of Coastal Management hereby acknowlWps receipt of your application
for State approval for development of your property located in the Community of Pamlico,
adjacent to Broad and Gideon Creeks in Pamlico County. It was received on December 18,
1995, and appears to be adequate for processing at this time. The projected deadline for making
a decision is AQ 1996. An additional 75-day review period is provided by law when such
time is necessary to complete the review. If you have not been notified of a final action by the
initial deadline stated above, you should consider the review period extended. Under those
circumstances, this letter will serve as your notice of an extended review. However, an
additional letter will be provided on or about the 75th day.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which must
be posted at the property of your proposed development. You should post this notice at a
conspicuous point along your property where it can be observed from a public road. Some
examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-
way fronting your property; or at a point along the road right-of-way where a private road would
lead one into your property. Failure to post this notice could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be
contacted by the appropriate State or Federal agency. Please contact me if you have any
questions and notify me in writing if you wish to receive a copy of my field report and/or
comments from reviewing agencies.
