The original (buff - colored form) is retained by you and it must be available on site when the project is inspected for compliance. If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A- 121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of Administrative Hearings, P.O. Drawer 11666, Raleigh, NC 27611, (919) 733-2698 within twenty (20) days of this decision on your permit. You should also be aware that if another qualified party submits a valid objection to the issuance of this permit within twenty (20) days, the matter must be resolved prior to work initiation. If the applicant is not claiming to be the owner of said property, then forward a copy of the deed or other instrument under which the owner claims title, plus written permission from the owner to carry out the project. • An accurate, dated work plat (including plan view and cross -sectional drawings) drawn to scale in black ink on an 8 1/2" by 11" white paper. (Refer to Coastal Resources Commission Rule 7J.0203 for a detailed description.) Please note that original drawings are preferred and only high quality copies will be accepted. Blue -line prints or other larger plats are acceptable only if an adequate number of quality copies are provided by applicant. (Contact the U.S. Army Corps of Engineers regarding that agency's use of larger drawings.) A site or location map is a part of plat requirements and it must be sufficiently detailed to guide agency personnel unfamiliar with the area to the Revised 03/95 Form DCM-MP-1 site. Include highway or secondary road (SR) numbers, landmarks, and the like. • A Stormwater Certification, if one is necessary. • A list of the names and complete addresses of the adjacent waterfront (riparian) landowners and signed return receipts as proof that such owners have received a copy of the application and plats by certified mail. Such landowners must be advised that they have 30 days in which to submit comments on the proposed project to the Division of Coastal Management. Natural forces of water and wind collide with tons of force, even on calm days. Man-made structures cannot be guaranteed to survive the force of a hurricane. Long-term erosion (or barrier island migration) may take from two to ten feet of the beach each year and, sooner or later, will threaten oceanfront struc- tures. These are the facts of life for oceanfront property owners. The Coastal Resources Commission (CRC) has adopted rules for building along the oceanfront. The rules are in- tended to avoid an unreasonable risk to life and property and to limit public and private losses from storms and Ion — term erosion. These rules lessen but do not eliminate the element of risk in oceanfront development. As you consider building along the oceanfront, the CRC wants you to understand the rules and the risks. With this knowledge you can make a more informed decision about where and how to build in the coastal area. The Rules When you build along the oceanfront, coastal manage- ment rules require that the structure be sited to fit safely into the beach environment. Structures along the oceanfront must be behind the frontal dune, landward of the crest of the primary dune and set back from the first line of natural stable vegetation a dis- tance equal to 30 times the annual erosion rate (a minimum of 60 feet). If the erosion rate is greater than 3.5 feet/year, the setback is 30 times the erosion rate plus 105 feet. The Reasons The beachfront is an ever -changing landform. The beach and the dunes are natural "shock absorbers", taking the beatings of the winds and waves and protecting the inland areas. By setting back 30 or 60 times the annual long-term erosion rate, you have a good chance of enjoying the full life of the structure. At first, it seems very inviting to build your dream house as close to the beach as possible, but in five years you could find the dream has become a nightmare as high tides and storm tides threaten your investment. The Exception The Coastal Resources Commission recognized that these rules, initially passed in June of 1979, might prove a hardship for some property owners. Therefore, they estab- lished an exception for lots which cannot meet the setback requirement. The exception allows buildings in front of the setback line if the following conditions apply: (1) the lot must have been platted as of June 1, 1979, and not capable of being enlarged by combining with adjoining land under the same ownership, (2) development must be as far back on the property as possible and in no case less than 60 feet landward of the vegetation line, (3) no development can take place on the frontal dune (4) special construction standards on piling depth and square footage must be met and (5) all other CAMA, state and local regulations must be met. The exception is not available in the Inlet Hazard Area. By granting permits, the Coastal Resources Commission does not guarantee the safety of the development and assumes no liability for future damage to the development. The best available information, as accepted by the Coastal Resources Commission, indicates that the annual ocean erosion rate for the area where your property is located is feet per year. The rate was established by careful analysis of aerial photographs of the coastline taken over the past 50 years. Studies also indicate that the shoreline could move as much as _ feet landward in a major storm. The flood waters in a major storm are predicted to be about _ feet deep in this area. Preferred oceanfront protection measures are beach nourishment and relocation of threatened structures. Hard erosion control structures such as bulkheads, seawalls, revetments, groins, jetties and breakwaters are prohibited. Temporary devices, including sand bags, may be allowed under certain conditions. This structure shall be relocated or dismantled within two years of becoming imminently threatened. The overall tract built -upon area percentage or lot sizes for the project must be maintained at levels at least as stringent as the low density levels specified in the stormwater rules. No piping shall be allowed except: a. That minimum amount necessary to direct runoff beneath an impervious surface such as a road. b. That minimum amount needed under driveways to provide access to lots. 7. Projects covered by this permit will maintain a minimum 30 foot wide vegetative buffer between all impervious areas and surface waters. 8. The tract will be limited to the amount of built -upon area indicated in the approved plans and consistent with item 1 above. Any lot inside the AEC subject to CAMA regulations may have the built -upon area reduced due to additional CAMA requirements. 9. The permittee is responsible for verifying that the proposed built -upon area does not exceed the allowable built -upon area for the lot. 10. The Engineer/Owner/Developer/Permittee must certify in writing that the project's stormwater controls, and impervious surfaces have been constructed within substantial intent of the approved plans and specifications. The permittee shall comply with the following schedule for construction and maintenance of the Low Density Option stormwater systems: a. Swales and other vegetated conveyances shall be constructed in their entirety, vegetated, and be operational for their intended use prior to the construction of any built -upon surface except roads. b. LAND USE PLAN CONSISTENCY OPINION: The Policies in the Land Use Plan look to enforcement of State and federal regulations for protection of wetlands and estuarine waters and for approval of construction in hazardous areas (although only a portion of applicant's lot is in the current Ocean Lazard Area, the entire lot is within 575' of the Outstanding Resource Waters and within the 100-year flood zone). Residential development is permitted by the Plan in auras designated Conservation as long as the project is exceptionally designed "so as to harmonize with the site's natural features." Any development of the applicant's lot would require fill of some of the Section 404 designated wetlands, further diminishing the function of the isolated wetland. The Field Investigation Report indicates that the lot is land -locked, and that the wetland pocket is a "sink" with no direct surface link to the ORW. The Report also indicates that the lot has been entirely but the dune elevation remains. This project will be consistent with the land use plan if it meets the regulations as set forth in 15A NCAC 7H and if it meets regulations of other state and federal review agencies. The Wildlife Resources Commission has reviewed the project for impacts to wildlife and fishery resources. A site visit was made on March 11, 1996. Our comments are provided in accordance with provisions of the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et. seq.) and the Coastal Area Management Act (G.S. 113A-100 through 113A-128). The applicant proposes to construct a circular asphalt jogging track, grass athletic field, and marl parking area on a 4.1 acre site. The southern portion of the property is within a designated Area of Environmental Concern (2 blocks from the ocean). A tidal ditch with narrow (2-3 ft. wide) fringe of coastal wetlands occurs on the north side of the property. Recent construction appears to have encroached on the wetland fringe. The primary adverse environmental impact we anticipate resulting from the project is water quality decline in the tidal ditch and downstream estuary due to increased stormwater runoff. Very little vegetated buffer remains between the construction area and ditch. Storm events will r transport sediments from road and parking areas, and fertilizers and possibly pesticides from grassed areas, into W�.t the ditch and associated estuary. Therefore, we recommend ' that the permit be conditioned to require establishment and maintenance of a buffer of natural vegetation adjacent to the tidal ditch a minimum of 20 ft. in width. PROJECT SUNNMARY: The Town proposes to fill and grade a 4.1 acre tract to establish a grass athletic field. The project includes the construction of a parking lot and installation an asphalt jogging track around the field's perimeter. Town of Long Beach Page 2 9. The Town of Long Beach is one of three municipalities located on Oak Island, in Brunswick County, NC. Oak Island is accessed from the mainland by a high-rise bridge over the Atlantic Intracoastal Waterway, off of NC 211, on NC 133 (Beach Road). The project site is located within the Long Beach town limits, between Pelican and Dolphin Drives, and S.E. 46th and 49th Streets, on the north, south, west, and east, respectively. The tract is 651 feet long, east to west, and 310 feet wide, north to south, which includes the unimproved Pelican Drive right-of-way. There is a large drainage ditch along the north side of the property. Although the site is two blocks off the ocean front, the southern portion of the property is within the Ocean Hazard Area, a designated Area of Environmental Concern by the Coastal Resources Commission. The site originally existed as a grassed field, elevation 4.32 ft. MSL, however the applicant had begun hauling in excess fill material from a nonassociated Town road project. Work was stopped, and the Town was directed to stabilize the fill material and obtain applicable permits from the N. C. Divisions of Coastal Management, Land Quality, and Environmental Management, Stormwater Section. The Town proposes to fill and grade the area to a finish elevation of approximately 8.5 feet MSL, to establish a public athletic field. The area to be disturbed would be 651 feet long and 275 feet wide, to include half of the Pelican Drive road right-of-way. A marl parking lot, 275 feet long and 65 feet wide, is proposed for the western side of the facility, and an asphalt jogging track, 1370 feet long and six (6) feet wide, is proposed around the perimeter of the athletic field. 10. ANTICIPATED DdPACTS The proposed project would create 179,025 square feet (4.1 acres) of ground disturbance and raise the property elevation approximately three (3) feet. The athletic field would incorporate one half of the unimproved Pelican Drive right-of-way. Construction of the parking lot and jogging track would create 26,095 square feet of impervious surface.
