NOTE: The N.C. Division of Water Resources has assigned the proposed project DWR Project No. 15-0672. NOTE: The U.S. Army Corps of Engineers has assigned the proposed project SAW Action Id. No. 2012-0039. NOTE: A permit renewal application processing fee of $100 was received by DCM for this project. This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2024 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. This permit was originally issued on 10/26/2015 for shoreline stabilization at Brunswick Town/ Fort Anderson State Historic Site (BTFA). The property is located at 8884 St Philip's Rd SE Winnabow, North Carolina. The property is adjacent the Cape River in Brunswick County. Project implementation has occurred in a phased approach as it has been dependent upon the funding availability. Permit History. Permit #121-15 was renewed on 12/10/2020 with an expiration date of 1213112022. There have been several refinements/ modifications related to the NCDNCR's efforts to stabilize the shoreline at BTFA. These refinements/ modifications include May 1, 20217, May 21, 2018, June 14, 2021, May 18, 2022 and November 10, 2022, There have not been any changes to the ownership of the adjacent properties. The project is in compliance With all conditions of the current permit. Brunswick Town Historic Site Shoreline Stabilization Proiect 1) Unless specifically.altered herein, the offshore living sill, riprap placement and marine mattress relocation shall be constructed in the accordance with the designs and alignments depicted on the attached workplan drawings. 2) The aligtlment of the authorized living sill, riprap placement and relocated marine mattress shall be staked by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of construction. Failure to initiate construction within 30 days, or erosion of the shoreline by adverse weather conditions; shall require the alignment to be restaked by DCM within a maximum of 30 days prior to the new expected statt'of construction. Signature ofPermittee NC Dept. of Naturaf& Cultural Resources Permit No.121-15 Page 2 of 3 AbDYTIONAL CONDITIONS 2) This permit does not authorize the backlilling of any of the authorized shoreline stabilization structures: 3) The temporary placement or double handling of fill materials within waters or vegetated wetlands is not authorized. 4) The riprap material shall be free from loose dirt or any pollutant., It shall be of a size sufficient to prevent its movement from the approved alignment by. wave or curienf action. 5) The riprap material shall consist of clean• rock or masonry materials such as but not limited to granite or broken concrete. 6) . Each individual offshore sill section shall be marked with a minimum of three yellow reflectors (one at each end of the section and one in the middle). The reflectors shall extend at least three feet above normal high water level. Sedimentation and Erosion Control 5) In order to protect water quality, runoff from construction shall not visibly increise'the amount of suspended "sediments in adjacent waters: - 6) A ground' cover sufficient to restrain erosion shall be provided within 30 calendar days of completion of any phase'. -of grading on cut or tilled slopes. The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or:other alteration of the structure or -work authoriz6d.l* this permit, or if in the opinion of the Secretary of.the_Anny or his authorized representative, said strccture or work shall cause unreasonable obstntction to free navigation of the navigable waters, the permittee shall be required, upon due notice from the Corps of Engineers, to remove• relocate or. alter the structural work or obstructions caused thereby, without expense to the United. States. 10) Apprdval of the structure was based on a determination that there would be no. obstruction to navigation. Under conditions existing within the AIWR;_a possibility exists* that the authorized structures may be damaged by wave wash from passing vessels. Issuance of this permit should not be. construed as relieving the permittee of taking proper steps to ensure the structure will not be damaged by wave wash. NC Dept. of Natural & CuItural Resources Permit No.12145 Page 3 of 3 ADDITIONAL CONDITIONS 11) No attempt shall be made by the permittee to prevent the full and free use by the public.of all navigable waters at or adjacent to the authorized work. 12) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 13) The pemuttee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this. determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: The N.C. Division of Water Resources has authorized the proposed project under DWR Project No. 15-0672. NOTE: The U.S. Army Corps of Engineers assigned the authorized project Action ID No. SAW-2012- 00739. NOTE: An. application processing fee of $400 was received by DCM for this project. This feealso satisfied the Section 401 application processing fee requirements of the Division of Water Resources.
