between February 15 and September 30 of any year without the prior approval of the Division of
Coastal Management, in consultation with the Division of Marine Fisheries.
3) Excavation will not exceed 10 feet below the elevation of normal water level.

This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not
covered hereunder requires further Departmental approval.
All work must cease when the permit expires on
December 31,1999
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina
Coastal Management Program.

ADDITIONAL CONDITIONS
4) All excavated materials will be confined above mean high water and landward of regularly or
irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of
solids into any marsh or surrounding waters.
5) The disposal area effluent will be contained by pipe, trough, or similar device to a point at or below
the normal water level to prevent gully erosion and unnecessary siltation.
6) The terminal end of the pipeline will be positioned at or greater than fifty (50) feet from any part of
the dike and a maximum distance from spillways to allow settlement of suspended solids.
7) A water control structure will be installed at the intake end of the effluent pipe to assure compliance
with water quality standards.
8) The dike will be properly graded and provided a ground cover sufficient to restrain erosion within
thirty (30) working days of project completion.
9) No vegetated wetlands will be excavated or filled.
10) The temporary placement or double -handling of excavated or fill materials within waters or
vegetated wetlands is not authorized.
11) The activity will be conducted in such a manner as to prevent a significant increase in turbidity
outside the area of construction or construction -related discharge. Increases such that the turbidity
in the water body is 25 NTUs or less in all saltwater classes are not considered significant.
12) If, during the course of the excavation, submerged archaeological materials are encountered, such
as shipwreck remains, the permittee will immediately cease work and contact the DCM at 919/269-
3901 and the Corps of Engineers at 919/975-1616.
NOTE: An Erosion and Sedimentation Control Plan will be required for this project. This plan must
be filed at least thirty (30) days prior to the beginning of any land -disturbing activity.
Submit this plan to the Dept. of Environment, Health and Natural Resources, Land Quality
Section, 1424 Carolina Avenue, Washington, NC 27889.
NOTE: The Division of Water Quality approved this project on November 26, 1996 under General
Water Quality Certification No. 2668.
NOTE: The permittee should contact the Division of Environmental Health at 919/726-8970 for
advice on the prevention of mosquito breeding in the spoil area.

The applicant proposes to dredge an existing 36' x 960' access channel to a depth of 10
feet and an existing 140' x 470' boat basin to a depth of 10 feet. I recommend the proposal be
permitted with the following conditions:
1) In order to protect juvenile shrimp and finfish populations, no excavation or
filling will be permitted between February IS and September 30 of any year
without the prior approval of the Division of Coastal Management, in consultation
with the Division of Marine Fisheries.
2) Excavation will not exceed 10 feet below the normal water level.

DATE. December 13, 1996
The applicant proposes to deepen an existing 140'x 470' Boat Basin and 36'x 960' Access
Channel to a depth of ten. (10) feet. The Boating Facility was constructed per CAMA Major
Permit ti52-91, The access is to Roland River, a tributary to the Pasquotank River. The
applicant proposes to also remove existing hazards to navigation at the entrance of the access
channel and in the process straighter, the channel. Anticipated impacts are only temporary
siltation during dredging of about 2.3 acres of Public Trust Waters. An upland area will be
used for the spoils.
Consistency Determination: The project is consistent with and not in conflict with the
Camden County Land Use Plan.
Comments: Camden County 1994 Land Use Plan certified by the CRC on July 29. 1994 was
re -dewed for the determination. Land Classification Map identifies area as "Community".
Camden's mapping does not delineate all AEC's and other wetland areas qualifying for the
"Conservation" designation. The following is applicable:
2. from AEC's policy implementation strategy: "The County will rely on the North
Carolina Department of Environment, Health, and Natural Resources, Division of
Coastal Management, to regulate development in coastal wetlands and alone
estuarine shorelines and to protect estuarine waters through the CAA4A permitting
process. Also, it will rely on the regulations of other state and federal agencies
with regulatory authority, as well as on existing local development regulations to
mitigate threats to AEC's." (pp.39 and 40)

You have our approval to discharge return water from a dredgin at Lamb's Boating Facility,
as you described in your application dated 29 October 1996. After r g yo lication, we have
decided that this fill is covered by General Water Quality Certificatio tuber 2668.
This approval is only valid for the purpose and design that you desgn our tip lication. If you
change your project you must notify us and you may be required to send us a new app radon. If total
wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be
required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must
follow the conditions listed in the attached certification. In addition, you should get any other federal, state
or local permits before you go ahead with your project. Also this approval will expire when the
accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicamry
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a
written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its
conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean

The following continents by the North Carolina Division of Marine Fisheries are
provided pursuant to General Statute 113-131.
Pasquotank River and Rowland Creek function as spawning and nursery areas for
blueback herring and alewife. Other commercially and recreationally important species also
utilize the area.
The Division is concerned with the proposed maintenance dredging of the access
channel (34560 sq. ft.) and the basin (65,800 sq. ft.). This agency is concerned with
circulation and flushing problems that may result from this excavation. Designs of this type
have resulted in dissolved oxygen level problems, which may result in fish kills and
degradation of water quality to the adjoining waters. The proposed excavation would allow
access to larger vessels which may increase the degradation of water quality due to gas, oil
and other spills.
The Division approves of this project with the following modifications.
V A dredging moratorium is requested 15 February through 30 September. This will
ensure the environmental integrity of the area is protected during critical times of usage by the
previously mentioned species.
y This agency recommends that the proposed access channel alignment be shifted to the
left, following the existing alignment with a straightening out (see p a wtll reduce the
amount of dredging required. Even though the Bio-report states that the connecting depth is

23 ft., discussions with Mr. Frank Jennings, DCM Field Consultant indicate that the depth is
actually —14 ft. According to the plat the connecting • depth with the current alignment is 9-11
ft. with the DMF recommended access channel alignment the majority of the dredging in the
river would be eliminated.

SUBJECT: CAMA major development permit and State dredge and fill permit application
review for Lamb's Boating Facility, Pasquotank River, Camden County.
Biologists on the Wildlife Resources Commission staff have reviewed this permit
application and are familiar with habitat values of the project area. In order to further assess
project impacts on fish and wildlife resources, an onsite inspection was conducted on November
6, 1996. Our comments are provided in accordance with provisions of the Coastal Area
Management Act (G.S. 113A-100 through 113A-128), as amended, and the Fish and Wildlife
Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.).
The applicant proposes to dredge an existing 360 ft x 960 ft access channel to a depth of
10 ft, and an existing 140 ft x 470 ft boat basin to a depth of 10 ft. Approximately 12,431 yd3 of
spoil material will be removed from the access channel and boat basin. The material will be
contained onsite within a diked disposal area.
Although this project has the potential to adversely affect fish and wildlife habitat in
Rowland Creek and the Pasquotank River, we will not object to the project as proposed if the
following modifications are implemented:
1) Dredging on the project site will adversely effect water quality by significantly increasing
turbidity. All in -water work should be avoided from March 1 through September 31 to
minimize the destruction of fisheries habitat during the spawning and fry -rearing period.
2) All dredging should be done with a hydraulic dredge to minimize sedimentation.
3) Construction of a high ground spoil disposal site should be adequate to insure no sediment
entry into the adjacent basin. In addition to the construction of a spoil disposal dike,
silt fencing should be placed around the perimeter of the disposal site and routinely
ne maintained. A water shut-off valve should be included, and should remain closed while
\ the sediment/water slurry is pumped into the spoil disposal area. In order to allow settling
of suspended sediments, the shut-off valve should remain closed for a minimum of 72
hours before release of effluent water into the basin.
4) The Division of Coastal Management should routinely monitor the water depths during
r y _ n the dredging process.

As an agency involved in the Division of Coastal
Management's major permit application review process, we have
determined that more than one acre will be disturbed by the
activities as described. Therefore, in addition to a permit from
the Division of Coastal Management, an erosion and sedimentation
control plan must be submitted to and approved by this office
before development begins.
The requiring of an erosion and sedimentation control plan
is based on a mandatory standard for land -disturbing activity of
the Sedimentation Pollution Control Act of 1973 [NCGS 113A-57(4)
and 113A-54(d)(4)], which states:
No person shall initiate any land -disturbing activity, if at
least one acre is to be uncovered, unless an erosion and
sedimentation control plan for the activity is filed with
the agency having jurisdiction and approved.
The plan must be submitted at least thirty (30) days prior
to project commencement. The plan must include, but is not
limited to, the following:
1. A scaled plat plan of the site, showing the affected
areas as well as adjacent properties which may be
affected. Include contours if available.
2. Indicate critical areas such as wetlands, creeks,
streams, drainageways, marsh,. etc.
3. Include a brief narrative describing the activities to
be undertaken and a construction schedule.

4. Indicate on the plat the measures to be utilized to
prevent sediment from entering adjacent properties,
such as location of silt fences, silt basins, diversion
ditches, areas to be seeded, etc.
5. Include seeding and mulching specifications for both
temporary and permanent stabilization.
6. Include any other pertinent information directed at
controlling_offsite sedimentation, slope degradation,
and erosion.
Please be advised that the plan will be considered
incomplete, and the statutory review period will not begin,
unless a non-refundable=plan review processing fee, payable by
check or money order made out to the Department of Environment,
Health and Natural Resources, is included. The amount of the fee
is based on $30 for the first disturbed or affected acre, plus
$20 for each additional whole or fractional acre of land to be
disturbed (including offsite borrow or waste areas).
To begin this project without the approval of an erosion/
sedimentation control plan will be considered a violation of the
Act and may lead to the assessment of a civil penalty of up to
$500.00 per day for each day the project is deemed in violation.
For your convenience, we are enclosing a guideline for
developing a plan. If you should have any questions, feel free

We have reviewed the permit application for the above project.
In our underwater research files we have references to extensive maritime activities
and shipwreck losses in the general project vicinity; therefore, much of the project
area holds a high potential for containing submerged cultural resources. However,
since this project concerns maintenance dredging within controlled and previously
dredged channels, we recommend no archaeological investigation be conducted.
We would like to notify you that this project should be undertaken with caution. If
during construction submerged archaeological materials are encountered, such as
shipwreck remains, it is the responsibility of the Army Corps of Engineers -
Wilmington District to notify this office immediately, pursuant to Section 106 of
the National Historic Preservation Act of 1966. In addition, the area is protected by
North Carolina legislation (G.S. 121-22 to 28, Article 3: salvage of Abandoned
shipwrecks and other underwater archaeological materials on all bottoms from low
water to one marine league seaward, and bottoms of other navigable waters). This
law is supported by the Abandoned Shipwreck Act of 1987 (P.L. 100-298) which
gives the state jurisdiction over a broad range of living and nonliving resources in
state waters and submerged lands, including certain abandoned shipwrecks, which
have been deserted and to which the owner has relinquished ownership rights with
no retention.

The applicant proposes to deepen an existing 140'x 470' Boat Basin and 36'x 960' Access
Channel to a depth often (10) feet. The Boating Facility was constructed per CAMA Major
Permit #52-91. The access is to Roland River, a tributary to the Pasquotank River. The
applicant proposes to also remove existing hazards to navigation at the entrance of the access
channel and in the process straighten the channel. Anticipated impacts are only temporary
siltation during dredging of about 2.3 acres of Public Trust Waters. An upland area will be
used for the spoils.
Consistency Determination: The project is consistent with and not in conflict with the
Camden County Land Use Plan.
Comments: Camden County 1994 Land Use Plan certified by the CRC on July 29, 1994 was
reviewed for the determination. Land Classification Map identifies area as "Community".
Camden's mapping does not delineate all AEC's and other wetland areas qualifying for the
"Conservation" designation. The following is applicable:
2. from AEC's policy implementation strategy: "The County will rely on the North
Carolina Department of Environment, Health, and Natural Resources, Division of
Coastal Management, to regulate development in coastal wetlands and along
estuarine shorelines and to protect estuarine waters through the CAMA permitting
process. Also, it will rely on the regulations of other state and federal agencies
with regulatory authority, as well as on existing local development regulations to
mitigate threats to AEC's." (pp.39 and 40)

Dear Mr. Upton:
In September of this year, you commented in writing to Mr. Richard Watts of the Division's
Elizabeth City office concerning the proposed maintenance excavation by Lamb's Marina. Although
you did not actually object, you expressed concern about accelerated erosion. In approving the
proposed project, the Division concludes that the actual dredging under the restriction of the permit
should not cause high ground erosion.
Boat wake can increase erosion. However, I am advised by DCM staff that most boaters
using the marina do reduce speed. If this is not the case, Mr. Lamb may wish to seek approval from
the Wildlife Resources Commission for an official "No Wake" zone. Once approved and posted,
the zone can be enforced by WRC protectors.

Site Description
The applicant owns a 9.1 acre tract of land located on the north side of U.S. Highway
158 in Camden, Camden County. The property lies off Roland Creek, which is a tributary of
the Pasquotank River, and is developed with manmade features including a 140' x 470' boat
basin, a convenience store, a commercial seafood store, a trailer park, a boating facility with
47 slips, a fuel dock, a portable sewage pump -out device, and a large grassed parking/yard
area. The boating facility was permitted by CAMA Major Permit #52-91. The existing water
depths in the Roland Creek entrance channel vary from 51h feet to 8 feet. The boat basin lies
800 feet from the Pasquotank River and its' water depths vary from 41h feet of 10 feet. For
the most part, the access channel is either straight or easy to navigate with the exception of
200' near the entrance. To navigate this section requires a 60' turn to starboard for 80 feet, a
65 ° tam to port for 80 feet and a 45 ° turn to starboard for 60 feet to stay in the channel. The
area the,channel avoids has a water depth of 2 feet and has several stumps.
The Pasquotank River water classification in this area is C SW and the connecting water
depth is 23 feet.
Development Proposal
In order to provide safer navigational access for his customers, and increase the draft
size of the vessels he can accommodate, the applicant proposes to dredge the access channel to
a depth of 10 feet, remove the existing hazards to navigation at the entrance of the access
channel and in the process, straighten the access channel. The applicant also proposes to
dredge the boat basin to a depth of 10 feet. The applicant proposes to contain the dredged
material in an area approximately 270' x 220' x 210' x 160' with a 10' berm. This area is to
be located in a large grassed parking area adjacent to the boat basin.
Anticipated Impacts
Approximately 5,120 cubic yards of dredge material will be removed from the bottom of
the access channel and approximately 7,311 cubic yards of dredged material will be removed
from the boat basin. Increased siltation will increase temporarily during dredging.
Approximately 100,360 square feet (2.3 acres) of Public Trust will be disturbed during
dredging.

We recommend that the following..condition(s) be included in the State
authorization: --
1. All maintenance excavation activities will take place within the
existing access channel and boat basin in accordance with the revised access
channel alignment.
2. All excavated materials will be confined landward of the mean high
water (MHW) elevation contour and any regularly or irregularly flooded
vegetated wetlands.
3. No vegetated wetlands will be excavated or filled.
4. Excavation will not exceed 10 feet below the elevation of mean low
water (MLW).
5. The temporary placement or double handling of excavated or fill
materials within waters or vegetated wetlands is not authorized.
6. No excavated or fill material will be placed in any location or in
any manner so as to impair surface water flow into or out of any wetland area.
7. The permittee will maintain the authorized work in good condition.and
in conformance with the terms and conditions of this permit. The permittee is
not relieved of this requirement if he abandons the permitted activity without
having it transferred to a third party.

9. The activity will be conducted in such a manner as to prevent
a significant increase in turbidity outside the area of construction or
construction -related discharge. Increases such that the turbidity in the
waterbody is 50 NTU's or less in all rivers not designated as trout waters
by the North Carolina Division of Environmental Management (NCDEM), 25 NTU's
or less in all saltwater classes and in all lakes and reservoirs, and 10 NTU's
or less in trout waters, are not considered significant.

Dear Colonel Youngbluth:
The U.S. Fish and Wildlife Service (Service) has reviewed the Field Investigative
Report for Action I.D. No. 199703293. The applicant, Lamb's Boating Facility,
proposes to straighten and deepen an access channel located between the boating
facility and Roland Creek. Spoil will be disposed of onsite in an elevated diked
area. The applicant believes that completing the proposed activities will allow
larger and/or deeper draft boats to use the facilities. Roland Creek is a
tributary of the Pasquotank River. The facility is located off U.S. 158 in the
Town of Camden, Camden County, North Carolina.
This is the report of the Service submitted pursuant to, and in accordance with,
provisions of the Fish and Wildlife Coordination Act (48 Stat. 401, as amended;
16 U.S.C. 661 et seq.) and the Endangered Species Act of 1973 (87 Stat. 884, as
amended; 16 U.S.C. 1531 et seq.).
We recommend the District Engineer seek modification of the proposed activities.
The channel alignment should remain somewhat sinuous to ensure that wake -related
damages to adjacent shoreline is minimized. We do not object to deepening the
channel, nor to straightening the channel somewhat for safety reasons.
In most riverine waters, there is a positive correlation between boat speed,
draft, and wake. wakes disturb adjacent shoreline vegetation and sediments. The
integrity of vegetative communities and associated organic sediments are very
important to the local shoreline's ecological structure and functions. Limiting
the magnitude and periodicity of wakes protects the riparian/marsh community in
the vicinity of the proposed activities.
The Service believes that the magnitude and periodicity of wakes are likely to
increase in the channel based on the portions of the proposed activities we do
not object to. These anticipated adverse impacts are probably insignificant
based on current conditions. However, straightening the channel to the proposed
degree is likely to cause wakes which irreversibly and significantly damage the
ecological integrity of adjacent shoreline. Therefore, we believe it prudent to
maintain some physical deterrents to high speed boating in the channel.
Sinuous channels are an effective deterrent to boat operators who might otherwise
operate their boats in a manner which increases wake damage to the shoreline.
Further, sinuous channels tend to minimize wake wave magnitude by interfering
with each other. The applicant should revise the proposed activities to ensure
that the shoreline is not adversely impacted by increased wake magnitude and
periodicity.

Dear Mr. Lamb:
On February 11, 1991, we renewed General Permit No. 198000291 (copy
enclosed), which provides Federal authorization for construction activities
that receive authorization from the State of North Carolina.
A review of your application received October 18, 1996, for Department
of the Army (DA) authorization to undertake maintenance excavation activities
within an existing access channel and boat basin, on property identified as
Lamb's Marina and Grocery, located off the north side of U.S. Highway 158,
adjacent Roland Creek and the Pasquotank River, in Camden, Camden County,
North Carolina, indicates it to be a candidate for Federal authorization under
this general permit. Accordingly, the administrative processing of your
application will be accomplished by the North Carolina Division of Coastal
Management. Comments from Federal review agencies will be furnished to the
State.
If your application must be withdrawn from this general permit process
for any reason, you will be informed regarding its further management. If
there are no unresolved differences in State -Federal positions or policies,
the final action taken on your application by the State will result in your
receiving written notice from us that your application is consistent with the
general permit and you may commence your activity. Only after receiving such
confirmation should you begin work.
Your application, pursuant to Section 10 of the River and Harbor Act and
Section 404 of the Clean Water Act, has been assigned Action ID No. 199703293.

River, in Camden, Camden County, North Carolina. Your receipt of this letter
verifies your acceptance of a valid request for certification in accordance
with Section 325.2(b)(ii) of our administrative regulations.
We are considering authorizing the proposed activity pursuant to
Section 404 of the Clean Water Act, and we have determined that a water
quality certification is required under the provisions of Section 401 of
the same law. A Department of the Army permit will not be granted until
the certification has been obtained or waived.
According to our administrative regulations, 60 days is reasonable
for State action. Therefore, if you have not acted on the request, or asked
for an extension of time, by December 23, 1996, the District Engineer will
deem that waiver has occurred.

Site Description
The applicant owns a 9.1 acre tract of land located on the north side of U.S. Highway
158 in Camden, Camden County. The property lies off Roland Creek, which is a tributary of
the Pasquotank River, and is developed with manmade features including a 140' x 470' boat
basin, a convenience store, a commercial seafood store, a trailer park, a boating facility with
47 slips, a fuel dock, a portable sewage pump -out device, and a large grassed parking/yard
area. The boating facility was permitted by CAMA Major Permit #52-91. The existing water
depths in the Roland Creek entrance channel vary from 51/2 feet to 8 feet. The boat basin lies
800 feet from the Pasquotank River and its' water depths vary from 41/2 feet of 10 feet. For
the most part, the access channel is either straight or easy to navigate with the exception of
200' near the entrance. To navigate this section requires a 60' turn to starboard for 80 feet, a
65' tam to port for 80 feet and a 45' turn to starboard for 60 feet to stay in the channel. The
area the channel avoids has a water depth of 2 feet and has several stumps.
The Pasquotank River water classification in this area is C SW and the connecting water
depth is 23 feet.
Development Proposal
In order to provide safer navigational access for his customers, and increase the draft
size of the vessels he can accommodate, the applicant proposes to dredge the access channel to
a depth of 10 feet, remove the existing hazards to navigation at the entrance of the access
channel and in the process, straighten the access channel. The applicant also proposes to
dredge the boat basin to a depth of 10 feet. The applicant proposes to contain the dredged
material in an area approximately 270' x 220' x 210' x 160' with a 10' berm. This area is to
be located in a large grassed parking area adjacent to the boat basin.
Anticipated Impacts
Approximately 5,120 cubic yards of dredge material will be removed from the bottom of
the access channel and approximately 7,311 cubic yards of dredged material will be removed
from the boat basin. Increased siltation will increase temporarily during dredging.
Approximately 100,360 square feet (2.3 acres) of Public Trust will be disturbed during
dredging.
