9. PROJECT DESCRIPTION 1/23/96
The project site is located at 2701 Middle Sound Loop Rd., adjacent to the north side of Howe
Creek in the Ogden area of New Hanover County. This is a 2.3 acre tract, averaging 11' above
mean sea level. There is an existing residence on the property serviced by a well and septic tank.
The tract is vegetated with pines, bays, and oaks on the high ground. It has two ravines of
delineated 404 wetlands that contain Ilex s,., Ma ng olia vir iniaana, and Liquidambar Ltyraciflua at
the upper ends. Toward Howe Creek, the wetland area transitions to grass species - Cladium
jamaicense, Borrichia frutescens, and Spa patens, transitioning to Snartina alterniflora at the
water's edge.
Howe Creek is designated SA-ORW by the Division of Environmental Management. It is
designated as Primary Nursery Area by the Division of Marine Fisheries, and is closed to the taking
of shellfish for consumption. New Hanover County classifies the area below the 100 year
floodplain as Conservation and the area above as Resource Protection.
The applicant proposes to subdivide the tract into four lots; one lot is occupied by his residence and
the three remaining are to be sold. The applicant proposes to improve the tract with a drive from
Middle Sound Loop Rd. into the lots, and graded house pads. Individual applicants would be
required to obtain all permits for home construction, driveways, and installation of septic tanks and
wells.
The grading of lots 1 and 2 would be on high ground, (40' x 50) while lot 3 requires the fill of a
404 wetland area. The proposal is to fill 10, x 130' of this wetland area. The house pad on this lot
is approximately 40' x 60'. Approximately 2350 square feet of the proposed wetland fill is outside
of the house pad. The depth of fill required to bring the area to existing grade is approximately
3.5'. The roadway is proposed to be approximately 30' x 160', terminating in a cul-de-sac with a
diameter of 60'.
The applicant proposes to construct a pier with a gazebo and floating dock to serve the residences.
Proposed is a 10' wide pedestrian easement straddling the property lines of lots 3 and 4. The pier
will be located on this easement. The applicant has submitted a letter of intent to eliminate the
riparian rights of these lots outside of the community pier. This structure will extend 220, x 6' in
width. This crosses approximately 57' of Spaartina alterniflora, approximately 70' of mud flat, and
23' of marsh island S artina alternifloral that would define the body of water. The body of water
is approximately 200' across at this point. From this point the pier extends 70'. There is a 12' x
16' gazebo located approximately 16' landward of the pier terminus. There is a floating dock (6' x
50') proposed to extend from the end of the pier in a westward position to be situated in a tidal
pool. This structure has no mooring piles associated with it. The structure is intended to provide
dockage for four small vessels.
Soundings in the area of the mud flat indicates a depth of +.5' mlw, with a high tide water depth of
3.5' mlw. The tidal pool proposed for mooring shows depths of approximately -2' m1w, with an
access channel of -.5' mlw. The channel of Howe Creek on the north side has been staked by the
field representative of the Division of Coastal Management. The pier terminates approximately 45'
from the channel edge. The pier is proposed with an elevation of approximately 6' above the marsh
substrate. The riparian corridors are located greater than 50' from the proposed pier and associated
structures.
10. ANTICIPATED IMPACTS
The project as proposed will cause to be graded approximately 6200 square feet of high ground.
The grading of lot 3 will require the filling of approximately 2550 square feet of delineated 404
wetlands. Approximately 2350 square feet of this is outside of the house pad. These wetlands are
adjacent to, and contribute to the functioning of, the Howe Creek ORW system.
Construction of the pier, gazebo, and floating dock will incorporate approximately 480 square feet
of Spartina alterniflora, 420 square feet of unvegetated coastal wetland area, and 840 square feet of
open water. The structure will provide dockage for four vessels.

'Recommendations for State Permit - Carol Johnson
I recommend the project be authorized contingent on the following conditions:
1) The pier must be elevated to a level of 6' above the mean high water level for a span of 10'
across the most navigable portion of the water body between the marsh islands (approximately 80'
into the structure).
2) The wetland area to be filled and removed from jurisdiction by the preparation of lot 3 must be
restricted to the area above the 100 year flood plane, or 55' x 10'.
3) The fill material will be clean and free of any pollutants, except in trace quantities. Metal
products, organic materials, or unsightly debris will not be used.
4) No excavated or fill material will be placed at any time, in any marsh or surrounding waters,
outside of the alignment of the fill area indicated on the workplats.
5) All portions of the pier are to be elevated a minimum of 4' above the marsh substrate.
•.,=m ncy rcovrew
SHOULD BE DESIGNED AND OPERATED MINIMIZE TO THE EXTENT REASONABLE, NUTRIENT
AND PESTICIDE LOADINGS. THE CITY AND COUNTY SHALL MONITOR TECHNOLOGICAL
ADVANCES AND ONGOING SCIENTIFIC STUDIES TO DETERMINE WHETHER ESTUARINE
SHORELINE SETBACKS AND BUFFER REGULATIONS SHOULD BE ADOPTED.
1.1(8) THE CITY AND COUNTY SHALL SEEK TO PRESERVE AND RESTORE SHELLME NG IN ALL
SA WATERS AND TO BRING ALL COASTAL WATERS DESIGNATED OR FORMERLY DESIGNATED
SA TO THE HIGHEST QUALITY POSSIBLE.
Implementation:
4. All land areas falling within the 100 year floodphtin will be designated Conservation on the Land
Classification Map.
Resource protection implementation measures 8, 9 and 10 (page 24 of the Policy section)
reinforce the County and City's concerns about the effect of development on the area's estuarine
watersheds. The County is the recipient of a 1994-95 grant from DCM which funds a
Watershed Management Plan for Futch's Creek, thereby implementing one of the steps outlined
for resource protection and underscoring the local government commitment to protecting its
creeks.
1.2(1) ESTUARINE WATERS, ESTUARINE SHORELINES AND PUBLIC TRUST AREAS SHALL BE
PROHIBITED FROM USE BY DEVELOPMENT ACTIVITY WHICH WOULD RESULT INSIGNIFICANT
ADVERSE IMPACT TO THE NATURAL FUNCTION OF THESE AREAS.
1.2(3) DRAINAGE FROM LAND USE ACTIVITIES SHALL HAVE A RATE OF FLOW AND VOLUME
CHARACTERISTICS AS NEAR TO NATURAL CONDITIONS AS REASONABLE.
1.2(8) THE COUNTY AND CITY SHALL TAKE ALL NECESSARY ACTIONS TO PREVENT FURTHER
DETERIORATION OF ESTUARINE WATER QUALITY AND LOSS OF PUBLIC TRUST USES IN THE
CREEKS AND SOUNDS AND TO BRING ALL COASTAL WATERS UP TO THE HIGHEST QUALITY
POSSIBLE.
Implementation
10. All coastal wetlands, estuarine waters, estuarine shorelines, and public trust waters shall be
designated Conservation on the Land Classification Map.
It is my opinion that, in consideration of the numerous policies which directly address protection
of estuaries and creeks in the County, the filling of wetlands adjacent to outstanding resource
waters and within a 100-year flood area is inconsistent with the New Hanover County Land Use
Plan.
The City/County Land Use Plan clearly supports the protection of estuarine watersheds from
degradation. Howe Creek is classified as an Outstanding Resource Water, the highest quality
designation. Any disturbance in the Howe Creek watershed which would degrade the Creek
would be inconsistent with the land use plan. In addition, development on Class IV soils (see
Policy 1.1(5) above) is prohibited. The Soil Conservation Service indicates the presence of the
following class IV soils in this area: Johnston(Jo) and Tidal Marsh(TM).
The proposed docking facility will be consistent with the Land Use Plan when all requirements
of 15A NCAC 7H are met. Construction must comply with permit conditions as required by the
Division of Coastal Management and other review agencies.

Major Permits Processing Coordinator 1

(ff
Gp+SiAlSUBJECT: CAMA/DREDGE & FILL Permit Application ReI, MEMENtCarol Johnson, 2710 Middle Sound Loop, NHC
DATE: February 21, 1996
This permit consistency opinion is based on my review of Carol Johnson's permit application,
the Field Investigation Report (T. Barrett, 1/23/96), and my understanding and interpretation of
the policies presented in the Wilmington/New Hanover County 1993 Land Use Plan.
The applicant proposes to subdivide his 2.3 acre tract into four lots for sale. He intends to
improve the subdivision with a roadway into the lots, graded house pads, and a community
docking system. Fill of delineated wetlands will be required on Lot 3. The location and complete
description of the project are in the Field Investigation Report.
LAND USE CLASSIFICATION:Conservation
Generally, estuarine areas of environmental concern (AEC's), as defined by the State of North
Carolina, and adjacent lands within the 100-year floodplain have been classified as Conservation.
Conservation areas should be preserved in their natural state. Woodland, grassland and recreation
areas not requiring filling am the most appropriate uses. Exceptions to this standard are limited to water -
dependent uses..., shared industrial corridors, and those exceptional developmentproposals which are sensitively
designed so as to effectively preserve the natural functions of the site.
3. Exceptional developments preserving natural features are projects which are sensitively designed so as to
harmonize with the site's natural features. Such projects minimire erosion, impervious surfaces, runoff and
siltation; do not adversely impact estuarine resources; do not interfere with access to or use of navigable
waters;...
The proposed fill of wetlands is within the Area of Environmental Concern of an Outstanding
Resource Water, and this project is therefore proposed on land classified in the Plan as
Conservation.
1.1(3) DEVELOPMENT ACTIVITIES WITHIN THE 100 YEAR FLOODPLAIN SHALL BE CAREFULLY
CONTROLLED TO MINEvME DEVELOPMENT, ENCOURAGE LOW INTENSITY USES SUCH AS

SUBJECT: CANWDREDGE & FILL Permit Application Review
Carol Johnson, 2710 Middle Sound loop, NHC
DATE: February 21, 1996
This permit consistency opinion is based on my review of Carol Johnsons's permit application,
the Field Investigation Repon (T. Barrett, 1/23196), and my understanding and interpretation of
the policies presented in the Wilmington/New Hanovcr County 1993 land Use Plan.
The applicant proposes to subdivide his 2.3 acre tract into four lots for We. He intends to
improve the subdivision with a roadway into the lots, graded house pads, and a community
docking system. Fill of delineated wetlands will be required on Lot 3. The location and complete
description of the project are in the Field Investigation Report,
LAND USE CLASSIFICATION:Conservation
Generally, estuarine areas of environmental concern (AFC's), as defined by the State of North
Carolina, and adjacent lands within the, 100•year floodplain bave been classified as Conservation.
Conservation areas should be preserved in their natural state. Woodland, grassland and recreation
areas not requiring f4liog are the most appropriate uses. Exception to this standard arc limited to water-
depeodentuses..., shared industrial corridors, andthose exceptionaldowlopment proposals which aresensitively
designed so as to effectively proserve the natural functions of the site.
3. Exceptional developments nreservinr natural features are Projects which are sensitively designed so as to
harmonize, with the site's natural features. Such projects minimize erosion, impervious surfaces. runoff and
siltation; do not adversely impact estuarine resources; do not interfere with access to or use of navigable
waters;...
The proposed fill of wetlands is within the Area of Environmental Concern of an Outstanding
Resource Water, and this project is therefore proposed on land classified in the Plan as
Conservation.
RELATED POLICIES AND IMPLEMENTATION MEASURES:
1.1(3) DEVELOPMENT ACTrWr1PS WITHIN THE 100 YEAR FLOODPLAIIN SHALL BE CAREFULLY
CONTROLLED TO MINIMIZE DEVELOPMENT, ENCOURAGE LOW INTENSITY USES SUCH AS
OPEN SPACE AND RECREATION. AND ENSURE STRICT COMPLIANCE WITH STATE AND
FEDERAL REGULATIONS CONCERNING WETLAND PROTECTION.
1.1(5) DEVELOP,VIENT ON CLASS 1V SOILS AS DEFINED IN THE 1981 TECHNICAL REPORT,
CLASSIFICATION OF S II.S IN WEW HANOVER COUNTY FOR SEPTIC TANK SUIKABILITX SHALL
BE LIMITED AND SEPTIC TANKS SHALL NOT BE ALLOWED.
1.1(6) DEVELOPMENT ACTIVITIES WITHIN THE ESTUARINE WATERSHEDS SHALL BE
CAREFULLY CONTROLLED TO PREVENT THE DEGRADATION OF WATER QUALITY IN THE
CREEKS AND SOUNDS, AND TO ENSURE THE PROTECTION OF THESE VITAL NATURAL
RESOURCES. AGRICULTURE USES, GOLF COURSE CONSTRUCTION AND MAINTENANCE

1.1(8) THE CITY AND COUNTY SHALL SEEK TO PRESERVE AND RESTORE SHELLFISHING IN ALL
SA WATERS AND TO BRING ALL COASTAL WATERS DESIGNATED OR FORMERLY DESIGNATED
SA TO IHE HIGHEST QUALITY POSSIBLE.
Implementation:
4. All land areas falling within the 100 year floodplain will be designated Conaervatiotk on the Land
Classification Map.
Resource protection implementation measures 8, 9 and 10 (page 24 of the Policy section)
reinforce the County and City's concerns about the effect of development on the area's estuarine
watersheds. The County is the recipient of a 1994-95 grant from DCM which funds a
Watershed Management Plan for Futch's Creek, thereby implementing one of the steps outlined
for resource protection and underscoring the local government commitment to protecting its
creeks.
1.2(1) ESTUARINE WATERS, ESTUARINE SHORELINES AND PUBLIC TRUST AREAS SHALL BE
PROHIBITED FROM USE BY DEVELOPMENT ACTIVITY WHICH WOULD RESULT IN SIGNIFICANT
ADVERSE IMPACT TO THE NATURAL FUNCTION OF THESE AREAS.
1.20) DRAINAGE FROM LAND USE ACTIVITIES SHALL HAVE A RATE OF FLOW AND VOLT MF
CHARACTERISTICS AS NEAR TO NATURAL CONDITIONS AS REASONABLE.
1.2(8) THE COUNTY AND CITY SHALL TAKE ALL NECESSARY ACTIONS TO PREVENT FURTHER
DETERIORATION OF ESTUARINE WATER QUALITY AND LOSS OF PUBLIC TRUST USES IN THE
CREEKS AND SOUNDS AND TO BRING ALL COASTAL WATERS UP TO THE HIGHEST QUALrrY
POSSIBLE.
Implementation
10. All coastal wetlands, estuarine waters, estuarine shorelines, and public trust waters shall be
designated Conservation on the Land Classification Map.
It is my opinion that, in consideration of the numerous 400 policies which directly address protection
of estuaries and creeks in the County, the filling of wetlands adjacent to outstanding resource
waters and within a 100-year flood area is inconsistent with the New Hanover County Land Use
The Soil Conservation Service indicates the presence of the
..,flowing class IV soils in this area: Johnston(Jo) and Tidal Marsh(TM).
The proposed ducking facility will be consistent with the Land Use Plan when all requirements
of 15A NCAC 7H are met. Construction must comply with permit conditions as requited by the
Division of Coastal Management and other review agencies.

Dear Mr. Johnson:
The Division of Coastal Management hereby acknowledges receipt of your application for State
approval for development of your property located at 2701 Middle Sound Loop Rd. It was received
on 1/22/96, and appears to be adequate for processing at this time. The projected deadline for making
a decision is 4/06/96. An additional 75-day review period is provided by law when such time is
necessary to complete the review. If you have not been notified of a final action by the initial deadline
stated above, you should consider the review period extended. Under those circumstances, this letter
will serve as your notice of an extended review. However, an additional letter will be provided on or
about the 75th day.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which must be
posted at the property of your proposed development. You should post this notice at a conspicuous
point along your property where it can be observed from a public road. Some examples would be:
Nailing the notice card to a telephone pole or tree along the road right-of-way fronting your property;
or at a point along the road right-of-way where a private road would lead one into your property.
Failure to post this notice could result in an incomplete application.
A field report has been prepared and is in the process of being circulated to the various state and
federal review agencies for their comments. If additional information is required based on this review,
the agencies may contact you directly.
Sincerely,
