Upland Development 1) No wetlands may be excavated or filled below the "100 year flood line", as indicated on the 1/12/96 survey plat. 2) No excavated or fill material will be placed at any time in any vegetated wetlands or surrounding waters outside of the alignment of the fill area indicated on the workplans, with the exception of the fill deleted by Condition 1. 3) The fill material will be clean and free of any pollutants except in trace quantities. Metal products, organic materials, or unsightly debris will not be used. (See attached sheet for Additional Conditions) This permiLaction may be appealed by the pennittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit expires on December 31, 1999 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Pier 5) The pier must be elevated to a level of at least 6 feet above the mean high water level for a span of 10 feet across the most navigable portion of the water body between the marsh islands (approximately 80' into the structure). The exact location of the elevated portion of the pier must be approved by a representative of the Division prior to initiation of construction. 6) All portions of the pier shall be elevated a minimum of 4 feet above the marsh substrate. 7) The pier may not exceed a width of 6 feet, with the exception of the 12' x 16' pavilion. 8) No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 9) The permittee shall maintain. the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the project without having the permit transferred to a third party. NOTE: The permittee is advised that, based on the Primary -Nursery Area designation of the proposed docking area, no dredging or excavation, either in the present or future, will be authorized. Stormwater Management 10) The Division of Environmental Management approved the project under stormwater management rules of the Environmental Management Commission on 4/4/96. Any violation of or deviation from the plan approved by the DEM will be considered a violation of this CAMA permit. Sedimentation and Erosion Control 11) In order to protect water quality, runoff from construction must not visibly increase the amount of suspended sediments in adjacent waters. Carol H. NOTE: The permittee is advised that a Sedimentation and Erosion Control Plan must be submitted to and approved by New Hanover County prior to initiation of any land -disturbing activity. PROJECT SUMMARY: Applicant proposes to subdivide his 2.3 acre tract into four lots for sale. PROJECT DESCRIPTION 1/23/96 The project site is located at 2701 Middle Sound Loop Rd., adjacent to the north side of Howe Creek in the Ogden area of New Hanover County. This is a 2.3 acre tract, averaging 11' above mean sea level. There is an existing residence on the property serviced by a well and septic tank. The tract is vegetated with pines, bays, and oaks on the high ground. It has two ravines of delineated 404 wetlands that contain Ilex s,�., Ma ng olia vir iniaana, and Liquidambar Ltyraciflua at the upper ends. Toward Howe Creek, the wetland area transitions to grass species - Cladium jamaicense, Borrichia frutescens, and Spa patens, transitioning to Snartina alterniflora at the water's edge. Howe Creek is designated SA-ORW by the Division of Environmental Management. It is designated as Primary Nursery Area by the Division of Marine Fisheries, and is closed to the taking of shellfish for consumption. New Hanover County classifies the area below the 100 year floodplain as Conservation and the area above as Resource Protection. The applicant proposes to subdivide the tract into four lots; one lot is occupied by his residence and the three remaining are to be sold. The applicant proposes to improve the tract with a drive from Middle Sound Loop Rd. into the lots, and graded house pads. Individual applicants would be required to obtain all permits for home construction, driveways, and installation of septic tanks and wells. The grading of lots 1 and 2 would be on high ground, (40' x 50) while lot 3 requires the fill of a 404 wetland area. The proposal is to fill 10, x 130' of this wetland area. The house pad on this lot is approximately 40' x 60'. Approximately 2350 square feet of the proposed wetland fill is outside of the house pad. The depth of fill required to bring the area to existing grade is approximately 3.5'. The roadway is proposed to be approximately 30' x 160', terminating in a cul-de-sac with a diameter of 60'. The applicant proposes to construct a pier with a gazebo and floating dock to serve the residences. Proposed is a 10' wide pedestrian easement straddling the property lines of lots 3 and 4. The pier will be located on this easement. The applicant has submitted a letter of intent to eliminate the riparian rights of these lots outside of the community pier. This structure will extend 220, x 6' in width. This crosses approximately 57' of Spaartina alterniflora, approximately 70' of mud flat, and 23' of marsh island S artina alternifloral that would define the body of water. The body of water is approximately 200' across at this point. From this point the pier extends 70'. There is a 12' x 16' gazebo located approximately 16' landward of the pier terminus. There is a floating dock (6' x 50') proposed to extend from the end of the pier in a westward position to be situated in a tidal pool. This structure has no mooring piles associated with it. The structure is intended to provide dockage for four small vessels. Soundings in the area of the mud flat indicates a depth of +.5' mlw, with a high tide water depth of 3.5' mlw. The tidal pool proposed for mooring shows depths of approximately -2' m1w, with an access channel of -.5' mlw. The channel of Howe Creek on the north side has been staked by the field representative of the Division of Coastal Management. The pier terminates approximately 45' from the channel edge. The pier is proposed with an elevation of approximately 6' above the marsh substrate. The riparian corridors are located greater than 50' from the proposed pier and associated structures. 10. ANTICIPATED IMPACTS The project as proposed will cause to be graded approximately 6200 square feet of high ground. The grading of lot 3 will require the filling of approximately 2550 square feet of delineated 404 wetlands. Approximately 2350 square feet of this is outside of the house pad. These wetlands are adjacent to, and contribute to the functioning of, the Howe Creek ORW system. Construction of the pier, gazebo, and floating dock will incorporate approximately 480 square feet of Spartina alterniflora, 420 square feet of unvegetated coastal wetland area, and 840 square feet of open water. It is my opinion that, in consideration of the numerous policies which directly address protection of estuaries and creeks in the County, the filling of wetlands adjacent to outstanding resource waters and within a 100-year flood area is inconsistent with the New Hanover County Land Use Plan. The City/County Land Use Plan clearly supports the protection of estuarine watersheds from degradation. Howe Creek is classified as an Outstanding Resource Water, the highest quality designation. Any disturbance in the Howe Creek watershed which would degrade the Creek would be inconsistent with the land use plan. In addition, development on Class IV soils (see Policy 1.1(5) above) is prohibited. The Soil Conservation Service indicates the presence of the following class IV soils in this area: Johnston(Jo) and Tidal Marsh(TM). The proposed docking facility will be consistent with the Land Use Plan when all requirements of 15A NCAC 7H are met. It is my opinion that, in consideration of the numerous 400 policies which directly address protection of estuaries and creeks in the County, the filling of wetlands adjacent to outstanding resource waters and within a 100-year flood area is inconsistent with the New Hanover County Land Use Plan. The City/County Land Use Plan clearly supports the protection of estuarine watersheds from degradation. Howe Creek is classified as an Outstanding Resource Water, the highest quality designation. Any disturbance in the Howe Creek watershed which would degrade the Creek would be inconsistent with the land use plan. In addition, development on Class IV soils (see Policy 1.1(5) above) is prohibited. The Soil Conservation Service indicates the presence of the ..,flowing class IV soils in this area: Johnston(Jo) and Tidal Marsh(TM). The proposed ducking facility will be consistent with the Land Use Plan when all requirements of 15A NCAC 7H are met.
