be subject to a farce, imprisonment or civil action; or may cause the permit to be null and void.
Pier and Docking Facility Construction
1) In order to ensure compliance with federal regulations concerning the Atlantic Intercoastal Waterway
(AIWW), the proposed pier and docking facility shall be redesigned so that no portion of the
structure extends closer than eighty (80) feet from the edge of the AIW W channel.
2) The proposed docking facility, consisting of the "L" head, gazebo and two floats, shall be redesigned
so that the total area of these structures does not exceed 500 square feet. This redesign must be
approved by a representative of the Division prior to the initiation of construction.
3) The portions of the pier which cross coastal wetlands must have a minimum elevation of 48 inches
above the marsh substrate.

other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not
covered hereunder requires further Departmental approval.
All work must cease when the permit expires on
December 31, 1999
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina
Coastal Management Program.

NOTE: The permittee is advised that under the current rules of the Coastal Resources Commission,
dredging at or adjacent to the proposed docking facility is not allowable.
Docking Facility Operation
5) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
docking facility. Any sewage discharge at the docking facility shall be considered a violation of
this permit for which the permittee is responsible. This prohibition shall be applied and enforced
throughout the entire existence of the permitted structure.
6) This permit authorizes only the docks, piers, and other structures and uses located in or over the
water that are expressly and specifically set forth in the permit application. No other structure,
whether floating or stationary, may become a permanent part of this docking facility without
permit modification. No non -water dependent uses of structures may be conducted on, in or over
public trust waters without permit modification.
General
7) No attempt will be made by the permittee to prevent the free and full use by the public of all
navigable waters at or adjacent to the authorized work. Use of the permitted activity must not
interfere with the public's right to free navigation on all navigable waters of the United States.
8) The permittee will maintain the authorized work in good condition and in conformance with the
terms and conditions of this permit. The permittee is not relieved of this requirement if he
abandons the permitted activity without having it transferred to a third parry.
9) This permit does not authorize the interference with any existing or proposed Federal Project,
and the permittee shall not be entitled to compensation for damage or injury to the authorized
structure'or work which may be caused from existing or future operations undertaken by the
United States in the public interest.
10) Approval of the structure was based on a determination that there would be no obstruction to
navigation. Under conditions existing within the AIWW, a possibility exists that the structure
may be damaged by wave wash from passing vessels. Unreasonable slowing down of vessel
traffic can not be required because such an action would tend to nullify the navigational benefits
on which the AIW W was justified. Issuance of this permit should not be construed as relieving
the permittee of taking proper steps to ensure the structure and moored boats will not be damaged
by wave wash normally to be expected in the AIWW. The permittee shall not hold the United
States liable for any such damage.

Dear Mr. Jackson:
Reference your application for a Department of the Army permit to
construct a 797-foot-long by 6-foot-wide pier on Myrtle Grove Sound, ending
approximately 65 feet from the AIWW, at 1821 Avalon Drive, in Wilmington,
New Hanover County, North Carolina.
Your proposal has been reviewed and found to be consistent with the
provisions and objectives of general permit No. 198000291. Therefore, you may
commence construction activity in strict accordance with applicable State
authorization, associated conditions, and the enclosed plan. Please be aware
this permit is conditioned so that no portion of the structure may extend
closer than eighty (80) feet from the near edge of the Atlantic Intracoastal
waterway. Failure to comply with the State authorization or conditions of the
general permit could result in civil and/or administrative penalties.
If any change in your work is required because of unforeseen or altered
conditions or for any other reason, plans revised to show the change must be
sent promptly to this office and the North Carolina Division of Coastal
Management prior to performing any such change or alteration. Such action is
necessary as revised plans must be reviewed and the authorization modified.

I am writing with regard to the modification you propose to the application and permit issued to Mr.
Bruce Jackson, k 150-96. These modifications are necessary to bring the project into compliance with
the permit.
The reduction in size of the gazebo from 16' x 16' to 14' x 14' is acceptable to bring the project into
compliance with the square footage allowance. The reduction in overall pier length to terminate 80'
from the AIWW satisfies the navigation concern.
By way of this letter, the Division accepts that the proposed modifications dated 11/6/96, and stamped
into this office on 11/12/96, as stated above, are sufficient to bring the proposed project into compliance
with the permit.

Pier and Docking Facility Construction
1)✓ In order to ensure compliance with federal regulations concealing the Atlantic Intercoasial War erwav
(.AIWN4), the proposed pier and docking facility shall be redesigned so that no portion of the
structure extends closer than eighty (80) feet from the edge of the AIWtiV channel.
2) The proposed docking facility. consisting of the "L" head, gazebo and two floats, shall be redesigned
so that the total area of these structures does not exceed 500 square feet. This redesign must be
approved by a representative of the Division prior to the initiation of construction.
3) The portions of the pier which cross coastal wetlands must have a minimum elevation of 48 inches
above the marsh substrate.

other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on -site to Deparmlent
personnel when the project is inspected for compliance.
Any maintenance work or project modification not
covered hereunder requires further Departmental approval.
All work must cease when the permit expires on
December 31. 1999

Please note that original drawings are preferred and
only high quality copies will be accepted. Blue -line
prints or other larger plats are acceptable only if an
adequate number of quality copies are provided by
applicant. (Contact the U.S. Army Corps of
Engineers regarding that agency's use of larger
drawings.) A site or location map is a part of plat
requirements and it must be sufficiently detailed to
guide agency personnel unfamiliar with the area to the

• A Stormwater Certification, if one is necessary
• A list of the names and complete addresses of the
adjacent waterfront (riparian) landowners and
signed return receipts as proof that such owners

by certified mail. Such landowners must be advised
that they have 30 days in which to submit comments
on the proposed project to the Division of Coastal
Management. Upon signing this form, the applicant
further certifies that such notice has been provided.

Reference the application of Bruce Jackson for a Department of the Army
permit to construct a 797 foot long by 6 foot wide pier on Myrtle Grove Sound,
Atlantic Intracoastal Waterway (AIWW), at 1821 Avalon Drive, in Wilmington,
New Hanover County, North Carolina.
The Federal agencies have completed review of the proposal as presented
by the application and your field investigation report.
We recommend that the following conditions be included in the State
authorization:
1. All work authorized by this permit must be performed in strict
compliance with the permit plans.
2. No portion of the structure will extend closer than 80 (eighty) feet
to the near edge of the AIWW channel.
3. No excavated or fill materials will be placed at any time in any
vegetated wetlands or waters.
4. This permit does not authorize the interference with any existing or
proposed Federal project, and the permittee will not be entitled to
compensation for damage or injury to the authorized structure or work which
may be caused from existing or future operations undertaken by the United
States in the public interest.
5. No attempt will be made by the permittee to prevent the full and
free use by the public of all navigable waters at or adjacent to the
authorized work. Use of the permitted activity must not interfere with the
public's right to free navigation on all navigable waters of the United
States.
6. It is possible that the authorized structure may be damaged by
wavewash from passing vessels. The issuance of this permit does not relieve
the permittee from taking all proper steps to ensure the integrity of the
permitted structure and the safety of moored boats. The permittee will
hold the United States liable for any such damage.

7. The permittee will maintain the authorized work in good condition
and in conformance with the terms and conditions of this permit. The
permittee is not relieved of this requirement if he abandons the permitted
activity without having it transferred to a third party.
S. If possible, under applicable law, the permittee will incorporate
this permit as part of the documents reflecting title to or interest in the
real property affected.
9. This Department of the Army permit does not obviate the need to
obtain other Federal, State, or local authorizations required by law.
10. In issuing this permit, the Federal Government does not assume any
liability for:
a. Damages to the permitted project or uses thereof as a result of
other permitted or unpermitted activities or from natural causes.
b. Damages to the permitted project or uses thereof as a result of
current or future Federal activities initiated on behalf of the general
public.
C. Damages to other permitted or unpermitted activities or
structures caused by the authorized activity.
d. Design and construction deficiencies associated with the
permitted work.
e. Damage claims associated with any future modification,
suspension, or revocation of this permit.
11. Approval of the structure was based on determination that there
would be no obstruction to navigation. Under conditions existing in the AIWW,
a possibility exists that the structure may be damaged by wave wash from
passing vessels. Unreasonable slowing down of vessel traffic cannot be
required because it would tend to nullify the navigational benefits on which
the Alww was justified. Issuance of this permit should not be construed as
relieving the permittee of taking proper steps to insure the structure and
moored boats will not be damaged by wave wash normally to be expected in the
AIWW.

Dear Colonel Youngbluth:
The U.S. Fish and Wildlife Service (Service) has reviewed the Field
Investigation Report (FIR) and permit application for Action I.D.
No. 199603765. The applicant, Bruce Jackson, proposes to construct
a 797' x 6' pier from an upland area into Myrtle Grove Sound. The
pier will include docking facilities (two 28' x 4' floating docks,
two mooring piles, and two 14' x 21' boatlifts) and a 16' x 16'
gazebo at the waterward end of the pier. The pier is designed so
that it has two turns, creating an "L" shaped terminus. It
transects 627' of jurisdictional wetlands, and 170' of open water.
The activities are proposed for a tract at 1821 Avalon Road in
Myrtle Grove Sound, North Carolina.
This is the report of the Service submitted pursuant to, and in
accordance with, provisions of the Fish and Wildlife Coordination
Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.) and the
Endangered Species Act of 1973 (87 Stat. 884, as amended; 16 U.S.C.
1531 et seq.).
We do not object to the proposed activities provided that the
surface area of the proposed dock is minimized to protect valuable
fish and wildlife habitat. The dock width should be reduced, the
dock configuration should be altered, and the terminal gazebo, a
non -water dependant feature, should be eliminated from the proposed
activities.
The waterways in and around the site of the proposed activities
have been substantially altered by human activities. There has
been, and continues to be a net loss of nearshore and transitional
wetland habitat in Myrtle Grove Sound. This loss is caused
directly by human activities (such as bulkheading, channelization,
and, pier and dock construction). Other human activities have
indirect impacts which also contribute to the local loss .and
degradation of fish and wildlife habitat (such as stormwater runoff
associated with dense upland and shoreline development,
recreational boating and support activities, etc.). Therefore, we
believe that the areal extent of the proposed docking facilities
(about 5,850 ftz) is excessive for it's location and should be
reduced.
Our concerns are based on the extensive surface area covered by the
proposed pier and dock system. Relative to the length of
shoreline, a significant amount of wetland and open water habitat
will be shaded or otherwise impacted by the pier and gazebo. Such
structures have a number of adverse impacts to fish and wildlife
resources. One observable impact is the paucity of vegetative
biomass underneath docks and piers. These structures create shaded
areas where productivity is low, and further compound that form of
habitat degradation by creating high energy impact zones, where
water from rainfall or other sources repeatedly drips. This high
energy impact area quickly loses it's ability to support vegetation
or other organisms, and these areas expand to include most wetland
areas under docks not continuously inundated. The proposed pier
and dock system is likely to fragment the valuable wetland habitat
it transects with a six foot wide partial barrier underneath the
proposed facilities.
Another, more subtle (and controversial) adverse impact that
extensive piers and docks have is to the health and integrity of
local populations of aquatic organisms. Many species of fish, for
example, at certain life stages, are behaviorally cued to seek
shelter in areas with complex horizontal and vertical covers.
Docks, piers, and piles apparently trigger that cue, and abnormally
high numbers of fish seek cover under and around such structures.
This phenomena can be observed by comparing catch rates when
fishing off of such structures versus catch rates off shorelines
without docks or piers.
These structures have an effect similar to that of artificial
reefs. They attract a high density of aquatic organisms to a
concentrated area, but do not appreciably affect the local
recruitment of those organisms. From a population perspective,
artificial structures may be more detrimental than beneficial to
the local ecosystem.
The concern arises because such cover is overhead only, and the
complex of horizontal and vertical structures that are associated
with, say, submerged trees or aquatic beds of vegetation is non-
existent. The organisms cued to find cover in such environments
are over -abundant under docks and piers, and are extremely
susceptible to environmental stresses such as disease, thermal
shock, or anthropogenic contamination. This exaggerated
vulnerability is a concern of the Service, and we believe that
locally large areas of dockage pose an unquantified risk to aquatic
organisms. This risk can and should be reduced by limiting the
areal size of docks over open water habitat.
The Service is also aware of the argument that certain dock
configurations and/or waterward extensions may create a perception
of limited access to public waters. If this argument is correct,
then the proposed activities will effectively remove not just the
filled wetlands now considered high ground and the area under the
docking facility, but also the tidal zone and submerged areas
within the pier head line. The cumulative public trust waters
directly removed from productivity and indirectly removed from
public access are extensive.
Additionally, we note that the gazebo is generally not considered
a water -dependant facility.
Therefore, we recommend the District Engineer include the following
Special Conditions if the subject permit is approved:
1. The gazebo should be relocated to an upland location.
2. The length of the pier should be minimized by terminating
the facility at the waterward end of the second section (just
before the first proposed lift slip). The floating docks and
lift slip facilities should be relocated to that angled
portion of the pier.
3. The pier width should be minimized to the extent
practicable by the applicant. We recommend four feet.
The Service acknowledges that this recommendation exceeds the six
(6) feet width for docks and piers allowed under the current
Regional General Permit (RPGP). However, we believe that the RPGP
establishes maximal width and waterward extension limits. These
maximal values should be modified (reduced) based on local
conditions. We believe that sufficient biological justification
exists to limit dock and pier areal extent in and around Myrtle
Grove Sound, and to condition the subject proposal with the
language suggested above.
Finally, we recommend that the permit include language prohibiting
refueling, sewage disposal, or other activities which can
reasonably be expected to contaminate the aquatic environment.

Recommendations for State Permit - Bruce Jackson
Giving credit for the northern lift and float as a boat house, the remainder of the deck, gazebo and float
area exceeds the 500 square allotment by 48 square feet. I recommend the project be approved based
on the following conditions:
1) The docking system must be reduced in size by 48 square feet, such as in reducing the gazebo
to 12' x 16'.
2) If the US Army Corps of Engineers authorization is not obtained for constructing within 65' of
the AIWW, the project length must be reduced to comply with current regulations.
3) This permit does not authorize the interference with any existing or proposed Federal project,

This permit consistency opinion is based on my review of the permit application submitted by Bruce
Jackson 1821 Avalon Ave, the Field Investigation Report (T. Barrett, 9/17/96), and my understanding
and interpretation of the policies presented in the Wilmington/New Hanover County Land Use Plan.
The applicant proposes construction of a single family residential pier with gazebo and floats
providing four slips. The waters are classified SA-ORW. The location and complete description of
the project are in the Field Investigation Report.
LAND USE CLASSIFICATION: Conservation
RELATED POLICIES AND IMPLEMENTATION MEASURES:
The Wilmington/New Hanover County Land Use Plan supports construction of docks and piers to
increase both private and public access to the water. The Plan also emphasizes the jurisdiction's
desire to protect high quality waters from any source of degradation.

This project will be consistent when all comments submitted by state review agencies have been
considered and all permit requirements met. If any agency finds that this project will result in water
quality deterioration or damage to nursery areas, those comments should be fully considered in light
of the County's interest in maintaining water quality. In addition, no permit should be granted until
the US Army Corps of Engineers has agreed that the proximity of this project to the Federal channel
will pose no hazard to navigation.

The subject permit application has been reviewed by this agency. The following
recommendations and modifications are provided for your consideration pursuant to General
Statute 113-131.
Because the project area is in a Primary Nursery area, dredging will be adamantly opposed
during construction or in the future. The present depth at the end of the project area is 1.6 feet
mean low water and should not be changed. Recommend that a no dredging clause be placed as
one of the conditions of this permit.
To reduce the impacts on public trust areas we recommend that the size of the project area
be reduced to accommodate only what is needed for Mr. Jackson's use. ie. Reduce the number
of boat slips to the number of boats owned by Mr. Jackson: reduce the size of the boat slips to
accommodate boat size.

9. PROJECT DESCRIPTION 09/17/96
The project site is located at 1821 Avalon Road, adjacent to Myrtle Grove Sound in New Hanover
County. The tract is approximately 1.65 acres in size, and averages 6' above mean high water in
elevation. This is a residential area with a residence and storage building existing on the property. The
tract is vegetated with high ground grasses and typical landscaping. The vegetation transitions to a
fringe of Iva frutescens before dropping off to the coastal marsh of Myrtle Grove Sound. The marsh
is predominately Spartina altemiflora, with intermittent Juncus roemerianus.
The New Hanover County land Use Plan classifies the area as Conservation; the waters are classified
SA-ORW by the Division of Water Quality; the Division of Marine Fisheries has designated Myrtle
Grove Sound as a Primary Nursery Area, and has closed the waters to the taking of shellfish for
consumption.
The applicant is proposing a 797' x 6' pier, extending approximately 627' over coastal marsh, and
approximately 170' into the body of water. Only the first 10' - 15' of the project will be above mean
high water. The body of water is approximately 640' across at the project site. The proposed pier
angles 45 degrees south for 20' and turns 90 degrees south for the last 30', acting as an "L-Head".
There are two floats, 4' x 28', connected to this structure. At the southern end, there is a 16' x 16'
gazebo. The structure supports 4 mooring spaces. There are two 14' x 21' boatlifts, to the north and
middle of the northern float, and 2 mooring pilings south of the southern float. The water depth at the
project end is -1.6' mean low water. The proposed project terminates approximately 65' from the
AIWW. The applicant has spoken with representatives from the US Army Corps of Engineers about
the possibility of locating a structure within this proximity of the federal channel. He was told to
submit the request and the project would be scrutinized for any potential hazard to navigation.
The residents in this area have agreed to utilize property line extensions as riparian corridors, due to
the existing pier to the north. This has been accepted by the Division of Coastal Management, because
it effects no other property owners. Using these lines, the project is 33' from the corridor to the south,
and 15' from the corridor to the north.
10. ANTICIPATED IMPACTS
The project as proposed will shade approximately 3762 square feet of coastal wetlands and incorporate
approximately 3196 square feet of Public Trust Waters. Temporary turbidity impacts can be expected
during construction.
