The foundation piling of the structure must be located at least 60' landward of the first line of stable natural vegetation. This line must be established by Division of Coastal Management representatives immediately prior to any structure piling placement. The line must be re-established if construction is not initiated within sixty days and/or if there is a major shoreline change prior to commencement of construction. 2. All structures in the ocean hazard area shall be on pilings not less than 8" in diameter if round, or 8" to a side if square, and the first floor level of the sills and joists must meet or exceed the 100 year flood level elevation of 13'. (See attached sheet for Additional Conditions) This permiCaction may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. PROJECT SUMMARY: Applicant proposes to fill approximately 1445 square feet of isolated wetlands in the middle of his residential lot for the construction of a private residence and pool. Fenton Hord Page 2 9. 2/06/96 The project site is the located on north end of Figure 8 Island. This lot is landlocked, but within the ORW Estuarine Shoreline AEC of 575' from mean high water. The Inlet Hazard line also crosses the lot on the northeast corner. This is a residential area. The lot is approximately 27,631 square feet is size, and ranges from 5' to 15' above mean sea level in elevation. Vegetation on the tract was oaks, pines, yaupons, and wax myrtle prior to the contractor removing essentially all vegetation. There is an isolated wetland pocket roughly 83' into the lot, approximately 97' x 16' in size. This has been delineated and determined to be Section 404 wetlands by the US Army Corps of Engineers. This area contained Ilex vomitoria and Mydca cerifera prior to clearing. The lot is presently. vacant. The waters of Middle Sound within 575' of this lot are classified SA-ORW by the Division of Environmental Management. The area is a designated Primary Nursery Area, and is open to the taking of shellfish for consumption. The New Hanover County Land Use Plan classifies the area as Conservation. The applicant is proposing to grade essentially the entire lot, or 27,443 square feet. This will include approximatley 1,445 square feet of the above mentioned wetlands. The intent is to construct a private residence, with septic tank, driveway, and pool. The applicant proposes to bring in fill material and grade the lot to an average of 10' above mean sea level. A retaining wall will be constructed around the fill material at the base of the house, creating the facade of an additional floor. The home will utilize a septic tank to be installed on the west side of the lot. The island has a community water system. The structure and all amenities will create approximately 25 % of impervious area. This was calculated by removing the pool from the pervious allowance and not including it in the impervious percentage, as is the Division policy. The proposed structure is in the flood zone All. In New Hanover County this requires a first floor elevation of 13'. The first floor elevation of the proposed porch is 13'; the first floor elevation of the house is 13.2'. 10. ANTICIPATED IMPACTS The project as proposed will fill and remove from jurisdiction approximately 1,445 square feet of isolated Section 404 wetlands. This area is essentially a sink, and has no direct surface link to the Middle Sound system. The elevation of the lot increases on the west side of the wetland. The wetlands to be filled by this project are unavoidable if the lot is to be developed. This area is limited in its interaction with the Middle Sound ORW system, and minimal in amount. I recommend the project be authorized as requested based on the following conditions: 1) All structures in the ocean hazard area shall be on pilings not less than 8" in diameter if round, or 8" to a side if square, and the first floor level of the sills and joists must meet the 100 year flood level elevation of 13'. 2) All construction within the ocean hazard area must comply with building requirements in Chapter 34, Volume 1 and/or Section 39, Volume 1B of the N.C. Building Code, and, the local flood damage prevention ordinance as required by the National Flood Insurance Program. 3) All foundations and structures must be designed to be stable during applicable fluctuations in ground elevation and wave force during a 100-year storm. 4) All pilings shall have a tip penetration greater than eight feet below the lowest ground elevation under the structure. For those structures so located on the primary dune or nearer to the ocean, the pilings must extend to five feet below mean sea level. 5) The foundation piling of the structure must be located landward of the first line of stable natural vegetation a distance of 60' feet. This must be established by Division of Coastal Management representatives from the Morehead City District Office immediately prior to any structural piling placement. The line must be re-established if construction is not initiated within sixty (60) days and/or if there is a major shoreline change prior to commencement of construction. LAND USE PLAID' CONSI.SIT.NCY OPINION: The Policies in the Land Use Plan look to enforcement of State and federal regulations for protection of wetlands and estuarine waters and for approval of construction in hazardous areas (although only a portion of applicant's lot is in the current Ocean Hazard Area, the entire lot is within 57,5' of the Outstanding Resource Waters and within the 100-year flood zone). Residential development is permitted by the Plan in areas designated Conservation as long as the project is exceptionally designed "so as to harmonize with the site's natural features." Any development of the applicant's lot would require fill of some of the Section 404 designated wetlands, further diminishing the function of the isolated wetland. The Field Investigation Report indicates that the lot is land -locked, and that the wetland pocket is a "sink" with no direct surface link to the ORW. The Report also indicates that the lot has been entirely but the dune elevation remains. dft This project will be consistent with the land use plan if it meets the regulations as set forth in 15A NCAC 7H and if it meets regulations of other state and federal review agencies.
