Permit # 38-14 Page 2 of 3 ADDITIONAL CONDITIONS Ocean Hazard Area Prior to the initiation of construction within the Ocean Hazard AEC, a representative of the Division of Coastal Management shall stake the first line of stable, natural vegetation and the appropriate graduated setback in accordance of the total floor area of the structure. These setback determinations shall replace those done at the time the permit application was processed and approved. Construction shall begin within sixty days of this determination or the measurement is void and shall be re-established. In the case of a major shoreline change within that period, a new setback determination shall be required before construction begins. All buildings in the Ocean Hazard Area of Environmental Concern shall be on pilings not less than 8 inches in diameter if round, or 8 inches to a side if square. All foundations shall be adequately designed to be stable during applicable fluctuations in ground elevation and wave forces during a 100-year storm. All pilings shall have a tip penetration greater than eight feet below the lowest ground elevation under the structures. Any structure authorized by this permit shall be relocated or dismantled when it becomes imminently threatened by changes in shoreline configuration. The structure(s) shall be relocated or dismantled within two (2) years of the time when it becomes imminently threatened, and in any case, upon its collapse or subsidence. However, if natural shoreline recovery or beach re -nourishment takes place within two (2) years of the time the structure becomes imminently threatened, so that the structure is no longer imminently threatened, then it need not be relocated or dismantled at that time. This condition shall not affect the permit holder's right to seek authorization of temporary protective measures allowed under CRC Rules. 7)`- All construction within the Ocean Hazard AEC shall comply with all applicable requirements of the N.C. Building Code and the local flood damage prevention ordinance as required by the National Flood Insurance Program. If any provisions of the building code or the flood damage prevention ordinance are inconsistent with any of the following AEC standards, the more restrictive standard shall apply. Sedimentation and ]Erosion Control :); Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, etc.). All disturbed areas shall be properly graded and provided a ground cover sufficient to restrain erosion within thirty days of project completion. Frazier Investing I.I.C. NOTE: Future development of the permittee's property may require a modification of this permit. NOTE: The U.S. Army Corps of Engineers authorized the proposed project under General Permit No. SAW-2013-01230. .P Project Narrative Frazier Investing, LLC 1415 Ocean Pearl Road — Ocean Beach Sub Currituck County — North Carolina The applicant proposes to construct a 4,000 square foot 4-bedroom home on the +/- 3.65 acre tract in the 4- wheel drive area of the Currituck Outer Banks. The proposed building will meet the construction standards as contained in T15 NCAC 07H.0308(d). The project will require fill in wetlands in order to provide access to the oceanfront portion of the site. The home will be nestled behind the dunes and landward of the setback required for this structure. Proposed fill in wetlands have been minimized by placing the access driveway to the south of the property and adjacent to the upland areas on the adjoining property. Construction will require some clearing of the vegetative portion of the property on the west. Impacts to dunes will be minimal by placing the structure landward of toe of dunes. Please note that this decision does not assure that participation in the NCEEP will be approved by the permit issuing agencies as mitigation for project impacts. It is the responsibility of the applicant to contact these agencies to determine if payment to the NCEEP will be approved. You must also comply with all other state, federal or local government permits, regulations or authorizations associated with the proposed activity including SL 2009-337: An Act to Promote the Use of Compensatory Mitigation Banks as amended by S.L.2011-343. This acceptance is valid for six months from the date of this letter and is not transferable. If we have not received a copy of the issued 404 Permit/401 Certification/CAMA permit within this time frame, this acceptance will expire. It is the applicant's responsibility to send copies of the permits to NCEEP. Once NCEEP receives a copy of the permit(s) an invoice will be issued based on the required mitigation in that permit and payment must be made prior to conducting the authorized work. The amount of the In - Lieu Fee to be paid to NCEEP by an applicant is calculated based upon the Fee Schedule and policies listed at www.nceep.net. Based on the information supplied by you in your request to use the NCEEP, the impacts that may require compensatory mitigation are summarized in the following table. PROJECT SUMMARY: The applicant proposes to place fill material within USACE jurisdictional 404-wetlands for an access driveway aad then construct a 4-bedroom single-family dwelling with a septic system and well. Protect Setting The site of the proposed development is an undeveloped Lot platted in 1976 and addressed as 1415 Ocean Pearl Road (Ocean Beach S/D Lot #12A), Corolla, within the four-wheel drive area of the Outer Banks portion of Currituck County, adjacent to the Atlantic Ocean. The site is accessed by taking NC-12 north through Corolla to the point where NC-12 exits onto the 4x4 beach sand roadway and driving north on the beach for t1.65 miles. The property is located within the Ocean Erodible & High Hazard Flood Areas of Environmental Concern (AEC's) and is platted as being ±158,893 sf (t3.65 acres) in size with ±130' of oceanfront; however, the portion of the parcel that is landward of the First Line of Natural Vegetation (FLSNV) is t123,760 sf (2.84 acres) in size. Base Flood Elevation for this area is 12' above sea level creating a primary dune height of 18'. A primary dune runs the width of this property and, according to Currituck County GIS LIDAR, hds a crest of 18' that is located just landward of the FLSNV. Primary dune width ranges from t115' to 150'. Dune vegetation consists of sea oats (Uniola paniculata), American beach grass (Ammophila breviligulata) and various herbaceous plants. The seaward side of the dune line is a steep escarpment from the FLSNV that is sloughing off to the flat beach profile. Elevations drop to t5' above sea level on the landward side of the primary dune and maintains a flat profile for ±50'. A secondary dune line is located to the west of the low area with a crest height of t18' and a width of t100'. On the west side of the secondary dune, elevations significant) drop and the majority of the area has been delineated as USACE 404-wetlands (t74,208 sf). Additional vegetation growing densely within this area includes, but is not limited to, southern live oak (Quercus virginiana), red maple (Acerrubrum), catbrier (Smilax bona-nox) and marsh elder (Iva frutescens). Access to the property will be via Ocean Pearl Road, which is an unimproved road located immediately to the west of the property. According to available information, there are no archaeological sites on or near this site. The adjacent property to the north is undeveloped and is similar in appearance and vegetation. The adjacent property to the south is also similar in appearance and vegetation, but contains a portion of a large man-made pond that stretches to the south. According to the 2011 long term erosion rate and setback factors, the erosion rate for this area is 6 ft/yr. The Ocean Erodible AEC extends 385' landward of the FLSNV and the High Hazard Flood AEC extends t438' landward of the FLSNV. The waters of the Atlantic Ocean in this area are classed as SB by the Division of Environmental Management, and are open to shellfish taking. '" Development Proposal The applicant proposes to fill USACE 404-wetlands to create a soil driveway off of Ocean Pearl Road to access the highground area of the secondary dune where a 4-bedroom single-family dwelling will be constructed with a septic system and well. lY Frazier Investing, LLC Field Investigation Report Page 3 The proposed driveway will be ±720' in length, will have a base width of 24' and a top width of 12'. The 'driveway surface ,will have an elevation of 3' above the wetland substrate. Approximately 10,181 .sf of USACE 404-wetlands will be filled to create the driveway. A 12" culvert is proposed to be placed across the driveway to allow water flow between the wetlands to the north and to the south. A silt fence will be placed along the edge of the fill area to prevent sedimentation into the adjacent wetland areas. 1W. A two-story single family dwelling, septic and well is proposed to be constructed within the secondary dune system..The dwelling will be constructed ±230' landward of the FLSNV and have ±4,000 sf of total floor area with a first floor elevation of 12'. The ocean hazard setback on this property for dwelling with less than 5,000 sf of total floor area .is 180' landward of the FLSNV. There is no proposed work seaward of the 180' ocean hazard setback. Anticioated Impacts The project as proposed will result in a permanent disturbance area of ±27,880 sf (0.64 acres). This area includes the driveway and house footprint. • It is anticipated that the project as proposed will result in additional temporary disturbances of ±6,353 sf (0.15 acres) associated with the construction of the dwelling, septic and well. .This area includes disturbances outside of the house footprint that will be disturbed for construction purposes and the installation of the septic and well. • The project as proposed will result in ±21,252 sf (0.49 acres) of total disturbances within the Ocean Erodible & High Hazard Flood AEC's. • The project as proposed will result in the filling of ±10,181 sf (0.23 acres) of USACE 404- wetlands. I have reviewed the Rules of the Coastal Resources Commission (CRC) as they pertain to this project and my findings are as follows: 15A NCAC 07H 0203 Management Obiective of the Estuarine and Ocean System It is the objective of the Coastal Resources Commission to conserve and manage estuarine waters, coastal wetlands, public trust areas, and estuarine and public trust shorelines, as an interrelated group of AECs, so as to safeguard and perpetuate their biological, social, economic, and aesthetic values and to ensure that development occurring within these AECs is compatible with natural characteristics so as to minimize the likelihood of significant loss of private property and public resources. Furthermore, it is the objective of the Coastal Resources Commission to protect present common-law and statutory public rights of access to the lands and waters of the coastal area. Consistent: The proposed development is consistent with the intent of this rule. 07H. 0303 MANAGEMENT OBJECTIVE OF OCEAN HAZARD AREAS (a) The CRC recognizes that absolute safety from the destructive forces indigenous to the Atlantic shoreline is an impossibility for development located adjacent to the coast. Therefore, it is the CRC's objective to provide management policies and standards for ocean hazard areas that serve to eliminate unreasonable danger to life and property and achieve a balance between the financial, safety, and social factors that are involved in hazard area development. (b) The purpose of these Rules shall be to further the goals set out in G.S. 113A-102(b), with particular attention to minimizing losses to life and property resulting from storms and long-term erosion, preventing encroachment of permanent structures on public beach areas, preserving the natural ecological' conditions of the barrier dune and beach systems, and reducing the public costs of inappropriately sited development. Furthermore, it is the objective of the Coastal Resources -,Commission to protect present common-law and statutory public rights of access to and use of the lands and waters of the coastal area. Consistent: The proposed development is consistent with the intent of the management objectives. 07H. 0306 GENERAL USE STANDARDS FOR OCEAN HAZARD AREAS (a) In order to protect life and property, all development not otherwise specifically exempted or allowed by law or elsewhere in the CRC's Rules shall be located according to whichever of the following is applicable: (1) The ocean hazard setback for development is measured in a landward direction from the vegetation line, the static vegetation line or the measurement line, whichever is applicable. The setback distance is determined by both the size of development and the shoreline erosion rate as defined in 15A NCAC 07H .0304. Development size is defined by total floor area for structures and buildings or total area of footprint for development other than structures and buildings. Total floor area includes the following: (A) The total square footage of heated or air-conditioned living space; (B) The total square footage of parking elevated above ground level; and (C) The total square footage of non -heated or non -air-conditioned areas elevated above ground level, excluding attic space that is not designed to be load bearing. Decks, roof -covered porches and walkways are not included in the total floor area unless they are enclosed with material other than screen mesh or are being converted into an enclosed space with material other than screen mesh. (2) With the exception of those types of development defined in 15A NCAC 07H .0309, no development, including any portion of a building or structure, shall extend oceanward of the ocean hazard setback distance. This includes roof overhangs and elevated structural components that are cantilevered, knee braced, or otherwise extended beyond the support of pilings or footings. The proposed residential structure is less than 5,000 square feet and meets the mini 0l1Y setback. (3) If a primary dune exists in the AEC on or landward of the lot on which the development is proposed, the development shall be landward of the crest of the primary dune or the ocean hazard setback, whichever is farthest from vegetation line, static vegetation line or measurement line, whichever is applicable. For existing lots, however, where setting the development landward of the crest of the primary dune would preclude any practical use of the lot, development may be located oceanward of the primary dune. In such cases, the development may be located landward of the ocean hazard setback but shall not be located on or oceanward of a frontal dune. The words "existing lots" in this Rule shall mean a lot or tract of land which, as of June 1, 1979, is specifically described in a recorded plat and which cannot be enlarged by combining the lot or tract of land with a contiguous lot(s) or tract(s) of land under the same ownership. Consistent: The Lot was platted in 1976 and the proposed development is consistent with the intent of this rule. (4) If no primary dune exists, but a frontal dune does exist in the AEC on or landward of the lot on which the development is proposed, the development shall be set landward of the frontal dune or landward of the ocean hazard setback whichever is farthest from the vegetation line, static vegetation line or measurement line, whichever is applicable. Consistent: The proposed development is consistent with the intent of this rule. (7) Established common-law and statutory public rights of access to and use of public trust lands and waters in ocean hazard areas shall not be eliminated or restricted. Development shall not encroach upon public accessways nor shall it limit the intended use of the accessways. Consistent: The proposed development is consistent with the intent of this rule. (b) In order to avoid weakening the protective nature of ocean beaches and primary and frontal dunes, no development is permitted that involves the removal or relocation of primary or frontal dune sand or vegetation thereon which would adversely affect the integrity of the dune. Other dunes within the ocean hazard area shall not be disturbed unless the development of the property is otherwise impracticable, and any disturbance of any other dunes is allowed only to the extent allowed by 15A NCAC 07H .0308(b). Consistent: The proposed development is consistent with the intent of this rule. (c) Development shall not cause irreversible damage to historic architectural or archaeological resources documented by the Division of Archives and History, the National Historical Registry, the local land -use plan, or other sources. Consistent: The proposed development is consistent with the intent of this rule. (f) Development shall comply with general management objective for ocean hazard areas set forth in 15A NCAC 07H .0303. Consistent: The proposed development is consistent with the intent of this rule. (g) Development shall not interfere with legal access to, or use of, public resources nor shall such development increase the risk of damage to public trust areas. Consistent: The proposed development is consistent with the intent of this rule. (h) Development proposals shall incorporate measures to avoid or minimize adverse impacts of the project. These measures shall be implemented at the applicant's expense and may include actions that: (1) minimize or avoid adverse impacts by limiting the magnitude or degree of the action, (2) restore the affected environment, or (3) compensate for the adverse impacts by replacing or providing substitute resources. Potentially Consistent: The proposed development is consistent with the intent of this rule pending any mitigation payment or other requirement of the US Army Corp. of Engineers. (i) Prior to the issuance of any permit for development in the ocean hazard AECs, there shall be a written acknowledgment from the applicant to DCM that the applicant is aware of the risks associated with development in this hazardous area and the limited suitability of this area for permanent structures. By granting permits, the Coastal Resources Commission does not guarantee the safety of the development and assumes no liability for future damage to the development. Consistent: The applicant's have submitted a signed Ocean Hazard AEC Notice form that acknowledged the special risks and conditions associated with development within these areas. 07H. 0308 SPECIFIC USE STANDARDS FOR OCEAN HAZARD AREAS (d) Building Construction Standards. Any building constructed within the oceI DM-MHDO1rV hazard area shall comply with relevant sections of the North Carolina Building Code including the Coastal and Flood Plain Construction Standards and the local flood damage prevention ordinance as required by the National Flood Insurance Program. If any provision of the building code or a flood damage prevention ordinance is inconsistent with any of the following AEC standards, the more restrictive provision shall control. All building in the ocean hazard area shall be on pilings not less than eight inches in diameter if round or eight inches to a side if square. All pilings shall have a tip penetration greater than eight feet below the lowest ground elevation under the structure. For those structures so located on or seaward of the primary dune, the pilings shall extend to five feet below mean sea level. (4) All foundations shall be adequately designed to be stable during applicable fluctuations in ground elevation and wave forces during a 100-year storm. Cantilevered decks and walkways shall meet this standard or shall be designed to break -away without structural damage to the main structure. Consistent: The proposed development is consistent with the intent of these rules. 15A NCAC 07H.0601 No Violation ofAny Rule No development shall be allowed in any AEC which would result in a contravention or violation of any rules, regulations, or laws of the State of North Carolina or of local government in which the development takes place. DATE: March 4, 2014 Consistency Determination: The request is consistent with/not in conflict with the Currituck County 2006 Core Land Use Plan (LUP) certified by the CRC on May 18, 2007; as amended through June 24, 2009. Overview: The subject property is an undeveloped 3.65 acre lot with 130 linear feet of oceanfront shoreline. The lot is located in the "off -road" area and is accessed from Ocean Pearl Road, a sand roadway, at the western property line. Approximately 2.84 acres of the property are landward of the First Line of Stable Natural Vegetation (FLSNV). A primary dune with a crest of 18 feet runs the length of the shoreline, is located just landward of the FLSNV, and ranges in width from 115 feet to 150 feet. Base Flood Elevation (BFE) for this area is 12 feet above sea level, for a primary dune height of 18 feet. Dune vegetation consists of sea oats, American beach grass, and various herbaceous plants. The oceanward side of the dune line consists of a steep escarpment from the FLSNV that is sloughing off to the flat beach profile. On the landward side of the dune, elevations drop to 5 feet above sea level and maintain a flat profile for 50 feet. A secondary dune line with a crest of 18 feet and a width of 100 feet is located west of the low area. On the west side of the secondary dune, elevations significantly drop and the majority of the area, 1.7 acre, is Section 404 wetlands. The eastern side of the property is within the VE Floodzone and the western side is within the AE Floodzone. The property lies within the Coastal Barriers Resource Act (COBRA) Zone, where no structure is eligible for Federal flood insurance and no Federal money may be spent to stimulate development. Protect Setting The site of the proposed development is an undeveloped Lot platted,in 1976 and addressed as 1415 Ocean Pearl Road (Ocean Beach S/D Lot #12A), Corolla, within the four-wheel drive area of the Outer Banks portion of Currituck County, adjacent to the Atlantic Ocean. The site is accessed by taking NC-12 north through Corolla to the point where NC-12 exits onto the 44 beach sand roadway and driving north on the beach for±1.65 miles. The property is located within the Ocean Erodible.& High Hazard Flood Areas of Environmental Concern (AEC's) and is platted as being ±158,893 sf (±3.65 acres) in' -size, with ±1 30' of oceanfront; however, the portion of the parcel that is landward of the First Line of Natural Vegetation (FLSNV) is ±123,760 sf (2.84 acres) in size. Base Flood Elevation for this area is 12' above sea level creating a primary dune height of 18'. A primary dune runs the width of this property and, according to Currituck County GIS LIDAR, has a crest of 18' that is located just landward of the FLSNV. Primary dune width ranges from ±115' to 150'. Dune vegetation consists of sea oats (Uniola paniculata), American beach grass (Ammophila breviligulata) and various herbaceous plants. The seaward side of the dune line is a steep escarpment from the FLSNV that is sloughing off to the flat beach profile. Elevations drop to ±5' above sea level on the landward side of the primary dune and maintains a flat profile for ±50'. A secondary dune line is located to the west of the low area with a crest height of ±18' and a width of ±100'. On the west side of the secondary dune, elevations significantly drop and the majority of the area has been delineated as USACE 404-wetlands (±74,208 sf). Additional vegetation growing densely within this area includes, but is not limited to, southern live oak (Quercus virginiana), red maple (Acerrubrum), catbrier (Smilax bona-nox) and marsh elder (Iva frutescens). Access to the property will be via Ocean Pearl Road, which is an unimproved road located immediately to the west of the property. According to available information, there are no archaeological sites on or near this site. The adjacent property to the north is undeveloped and is similar in appearance and vegetation. The adjacent property to the south is also similar in appearance and vegetation, but contains a portion of a large man-made pond that stretches to the south. According to the 2011 long term erosion rate and setback factors, the erosion rate for this area is 6 ft/yr. The Ocean Erodible AEC extends 385' landward of the FLSNV and the High. Hazard Flood AEC extends ±438' landward of the FLSNV. The waters of the Atlantic Ocean in this area are classified as SB by the Division of Environmental Management, and are open to shellfish taking. Protect Setting The site of the proposed development is an undeveloped Lot platted in 1976 and addressed as 1415 Ocean Pearl Road (Ocean Beach SID Lot #12A), Corolla, within the four-wheel drive area of the Outer Banks portion of Currituck County, adjacent to the Atlantic Ocean. The site is accessed by taking NC-12 north through Corolla to the point where NC-12 exits onto the 4x4 beach sand roadway and driving north on the beach for ±1.65 miles. The property is located within the Ocean Erodible & High Hazard Flood Areas of Environmental Concern (AEC's) and is platted as being ±158,893 sf (±3.65 acres) in' -size -with ±130' of oceanfront; however, the portion of the parcel that is landward of the First Line of Natural Vegetation (FLSNV) is ±123,760 sf (2.84 acres) in size. Base Flood Elevation for this area is 12' above sea level creating a primary dune height of 18'. A primary dune runs the width of this property and, according to Currituck County GIS LIDAR, has a crest of 18' that is located just landward of the FLSNV. Primary dune width ranges from ±115' to 150'. Dune vegetation consists of sea oats (Uniola paniculata), American beach grass (Ammophila breviligulata) and various herbaceous plants. The seaward side of the dune line is a steep escarpment from the FLSNV that is sloughing off to the flat beach profile. Elevations drop to ±5' above sea level on the landward side of the primary dune and maintains a flat profile for ±50'. A secondary dune line is located to the west of the low area with a crest height of ±18' and a width of ±100'. On the west side of the secondary dune, elevations significantly drop and the majority of the area has been delineated as USACE 404-wetlands (±74,208 sf). Additional vegetation growing densely within this area includes, but is not limited to, southern live oak (Quercus virginiana), red maple (Acerrubrum), catbrier (Smilax bona-nox) and marsh elder (Iva frutescens). Access to the property will be via Ocean Pearl Road, which is an unimproved road located immediately to the west of the property. According to available information, there are no archaeological sites on or near this site. The adjacent property to the north is undeveloped and is similar in appearance and vegetation. The adjacent property to the south is also similar in appearance and vegetation, but contains a portion of a large man-made pond that stretches to the south. According to the 2011 long term erosion rate and setback factors, the erosion rate for this area is 6 ft/yr. The Ocean Erodible AEC extends 385' landward of the FLSNV and the High Hazard Flood AEC extends ±438' landward of the FLSNV. The waters of the Atlantic Ocean in this area are classified as SB by the Division of Environmental Management, and are open to shellfish taking. Development Proposal The applicant proposes to fill USACE 404-wetlands to create a soil driveway off of Ocean Pearl Road to'eccess the highground area of the secondarydune where a 4-bedroom single-family dwelling will be constructed with a septic system and well. The driveway surface will have an elevation of 3' above the wetland substrate. Approximately 10,181 sf of USACE 404-wetlands will be filled to create the driveway. A 12" culvert is proposed to be placed across the driveway to allow water flow between the wetlands to the north and to the south. A silt fence will be placed along the edge of the fill area to prevent sedimentation into the adjacent wetland areas. A two-story single family dwelling, septic and well is proposed to be constructed within the secondary dune system. The dwelling will be constructed ±230' landward of the FLSNV and have ±4, 000 sf of total floor area with a first floor elevation of 12'. The ocean hazard setback on this property for a dwelling with less than 5,000 sf of total floor area is 180' landward of the FLSNV. There is no proposed work seaward of the 180' ocean hazard setback. Anticipated Impacts The project as proposed will result in a permanent disturbance area of ±27,880 sf (0.64 acres). This area includes the driveway and house footprint. • It is anticipated that the project as proposed will result in additional temporary disturbances of ±6,353 sf (0.15 acres) associated with the construction of the dwelling, septic and well. This area includes disturbances outside of the house footprint that will be disturbed for construction purposes and the installation of the septic and well. • The project as proposed will result in ±21,252 sf (0.49 acres) of total disturbances within the Ocean Erodible & High Hazard Flood AEC's. • The project as proposed will result in the filling of ±10,181 sf (0.23 acres) of USACE 404- wetlands.
