This permit, issued on Apri12, 2014 , is subject to compliance with the application (where consistent with the
permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be
subiect to fines, imprisonment or civil action; or may cause the permit to be null and void.
Upland Development
1) Unless specifically altered herein, this permit authorizes the land disturbing activities associated with the
grading,and filling of Lot 14 Blk. B, DEL -MAR Beach (Rev.) and the construction of a single family
residence and associated development, as expressly and specifically set forth in the permit application
dated 2/10/14 and depicted on the attached work -plat drawings. Any additional land disturbing activities
not referenced in the permit application may require a modification of this permit. Contact a
representative of the Division at (910) 790-721.5 prior to the commencement of any such activity for this
determination.

This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date. An appeal requires resolution prior to work initiation or
continuance as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
]December 31, 2017
in issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

Additional Conditions
2) The temporary placement or double handling of fill materials within waters or vegetated wetlands is not
authorized.
3) No Coastal Wetlands or open water area shall be excavated or filled, even temporarily.
Ocean Hazard Development
4) Prior to the initiation of construction within the Ocean Hazard AEC, a representative of the Division of
Coastal Management shall determine the first line of stable, natural vegetation and corresponding
structure setbacks. These setback determinations shall replace those done at the time the permit
application was processed and approved. Construction shall begin within sixty days of this
determination or the measurement is void and shall be re-established. In the case of a major shoreline
change within that period, a new setback determination shall be required before construction begins.
5) Any structure authorized by this permit shall be relocated or dismantled when it becomes imminently
threatened by changes in shoreline configuration. The structure(s) shall be relocated or dismantled
within two (2) years of the time when it becomes imminently threatened, and in any case, upon its
collapse or subsidence. However, if natural shoreline recovery or beach re -nourishment takes place
within two (2) years of the time the structure becomes imminently threatened, so that the structure is no
longer imminently threatened, then it need not be relocated or dismantled at that time. This condition
shall not affect the permit holder's right to seek authorization of temporary protective measures allowed
under CRC Rules.
6) All residential structures in the ocean hazard area shall be elevated on pilings with a diameter of at least
eight (8) inches and shall have a tip penetration greater than eight (8) feet below the lowest ground
elevation under the structure.
7) In order to avoid unreasonable danger to life and property, all development shall be designed and placed
so as to minimize damage due to fluctuations in ground elevation and wave action in a 100 year storm.
Cantilevered decks and walkways shall meet this standard or shall be designed to breakaway without
structural damage to the main structure.
Stormwater Management
8) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
9) The Division of Water Resources' approval of this project under stormwater management rules of the
Environmental Management Commission is covered by way of Stormwater Permit No. SWG010023,
submitted on 3/20/14, which is currently under review. Any violation of the permit approved by the
Division of Water Resources will be considered a violation of this CAMA permit.

Sedimentation and Erosion Control
10) All disturbed areas shall be properly graded and provide a ground cover sufficient to restrain erosion
within thirty days of project completion.
11) Appropriate sedimentation and erosion control devices, measures or structures (e.g. silt fence, diversion
swales or berms, etc.) shall be implemented to ensure that eroded materials do not enter adjacent
wetlands, watercourses and/or properties.
General
12) The permittees and/or their contractor shall meet with a representative of the Division prior to project
initiation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: Any building constructed should comply with the North Carolina Building Code and the local
flood damage prevention ordinance as required by the National Flood Insurance Program.
NOTE: The building code or flood damage prevention ordinance may impose additional more restrictive
requirements than the Division's standards for development in areas of environmental concern
(AECs).
NOTE The U.S. Army Corps of Engineers has assigned the proposed project COE Action Id. No. SAW-
2001-00236.

Recommendations for State Permit — Craig Edwards
I have no objections to the proposed project. Any permit issued should include the following conditions:
1. In order to protect water quality, runoff from the construction must not visibly increase the amount of
suspended sediments in adjacent waters.
2. Appropriate sedimentation and erosion control devices, measures or structures must be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence,
diversion swales or berths, sand fence, etc.).
3. All construction shall comply with building requirements of the N.C. Building Code, and the local flood
damage prevention ordinance as required by the National Flood Insurance Program. If any provision of the
building code or a flood damage prevention ordinance is inconsistent with any AEC standards, the more
restrictive provision shall apply.
4. All structures authorized by this permit shall be relocated or dismantled when they become imminently
threatened by changes in shoreline configuration. All structure(s) shall be relocated or dismantled within
two (2) years of the time when it becomes imminently threatened, and in any case, upon its collapse or
subsidence. However, if natural shoreline recovery or beach re -nourishment takes place within two (2)
years of the time the structure becomes imminently threatened, so that the structure is no longer
imminently threatened, then it need not be relocated or dismantled at that time. This condition shall not
affect the permittee's right to seek authorization of temporary measures allowed under CRC Rules.
5. All buildings must be elevated on pilings with a diameter of at least 8 inches in diameter if round, or 8
inches to a side if square; and the first floor level of the sills and joists must meet the 100-year flood level
elevation.
6. All pilings shall have a tip penetration greater than eight feet below the lowest ground elevation under the
structure.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals
or authorizations that may be required.
NOTE: Future development of the permittee's property may require a modification of this permit. Contact a
representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this
determination.

9. PROJECT DESCRIPTION:
John L. Pierce and Associates, P.A., on behalf of Craig Edwards, has requested that the attached application be
processed under the Express Review Permitting Program.
The applicant's project is located at 1311 North New River Drive, adjacent to Stump Sound, in Surf City, Pender
County. To find the property, take Highway 17 North from Wilmington and travel approximately 20 miles to NC 210.
Turn right onto NC 210 and travel approximately 2.8 miles to the intersection of NC 50 & NC 210. Turn right onto NC
50 / NC 210 and travel approximately 1.9 miles to North New River Drive. Turn left onto North New River Drive and
travel approximately 1.5 miles to the project site which will be located on the left at 1311 North New River Drive.
The properly consists of a single lot with a total area of approximately 10,000 sq. ft. ofwhich only approximately 1,983
sq. ft. is uplands. The remainder of the lot (approximately 8,017 sq. ft.) is predominately jurisdictional §404 wetlands,
but contains several species of coastal wetlands along the lower elevations. The vegetation has been mowed on the front
portion of the lot were the proposed dwelling is to be located. Located just waterward of the proposed building footprint
are Southern Wax Myrtles (Merica cerifera) and Scrub Oaks and the vegetation then transitions to Coastal Wetlands
which consists primarily of Black Needle Rush (Juncus roemarianus).The applicant received a Notification of
Jurisdictional Determination (SAW-2001-00236) from the U.S. Army Corps of Engineers on January 15, 2014.The lot
has an average elevation of approximately 1.0' above Normal High Water (NHW) and does not have any water frontage
along Stump Sound. The first line of stable natural vegetation is located approximately 550 feet oceanward of the
southeast property line. There are no man-made structures currently on the property.
The long term erosion rate for this portion of Surf City is 2 feet per year. The 100-year storm recession line for this area
is 135 feet, creating a total Ocean Erodible Area (OEA) AEC of 255 feet. Although the applicants' property is located
outside the OEA, it is located within the High Hazard Flood AEC as indicated by zone VE (elevation 11) on the Flood
Insurance Rate Maps. With a 2 feet per year erosion rate, structures with a total floor area less than 5,000 square feet
must be set back a distance of 60 feet landward from the first line. The 60 foot setback is located approximately 490
feet oceanward of the southeast property line.
The waters of Stump Sound, adjacent to the project site, are classified as SA by the North Carolina Division of
Water Quality and are designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries.
According to maps provided by the Department of Environmental Health, Shellfish Sanitation Section, the waters
in this area are OPEN to the harvesting of shellfish. The waters of the Atlantic Ocean in the vicinity of the project
area are classified SB by the North Carolina Division of Water Quality. The subject property is located within the
High Hazard Flood Area, as indicated by Zone VE (elevation 11) on the Flood Insurance Rate Map. The High
Hazard Flood Area (VE Zone) associated with the subject property is contiguous to the Atlantic Ocean.
PROPOSED PROJECT:
The applicant proposes to construct a single-family residence with associated §404 type wetland fill. As proposed,
approximately 1,680 sq. ft. of §404 wetlands would be filled on the front portion of the lot within the proposed building
envelope. As proposed, there will be no encroachment into the coastal wetlands. A silt fence would be placed at the
limits of disturbance to contain the fill material. The area of the proposed fill has an elevation approximately 2 foot
lower than the adjacent high ground (uplands) of the lot. The applicant is proposing to either relocate an existing
structure which is currently resting on blocks on the lot located to the west of the property or construct a new home
within the same dimensions. The proposed dwelling will have a maximum footprint of approximately 35' in width by
50' in length which includes an open uncovered deck measuring approximately 8' wide across the rear of the house. As
proposed, the dwelling would be elevated on pilings with a concrete slab under the home. The applicant is proposing to
construct a pervious concrete driveway which would extend from the edge of the pavement to the concrete slab under

10. ANTICIPATED IMPACTS:
As proposed, the project would result in the filling of approximately 1,680 sq. ft. of §404 wetlands and 615 sq. ft.
of high ground. There would also be approximately 99 sq. ft. of §404 wetlands which would be shaded by the
elevated deck on the rear of the dwelling. The proposed development would be located within the High Hazard
Flood AEC, landward of the applicable development setbacks.

The purpose of this CAMA application is construct or move an existing home to site and to be
used for residential purposes. The physical address of the property is 1311 North New River

This notice is intended to make you, the applicant, aware of the
special risks and conditions associated with development in this
area, which is subject to natural hazards such as storms, erosion
and currents. The rules of the Coastal Resources Commission
require that you receive an AEC Hazard Notice and
acknowledge that notice in writing before a permit for
development can be issued.
The Commission's rules on building standards, oceanfront
setbacks and dune alterations are designed to minimize, but not
eliminate, property loss from hazards. By granting permits, the
Coastal Resources Commission does not guarantee the safety of
the development and assumes no liability for future damage to
the development. Permits issued in the Ocean Hazard Area of
Environmental Concern include the condition that structures be
relocated or dismantled if they become imminently threatened
by changes in shoreline configuration. The structure(s) must be
relocated or dismantled within two (2) years of becoming
imminently threatened, and in any case upon its collapse or
subsidence.
The best available information, as accepted by the Coastal
Resources Commission, indicates that the annual long-term
average ocean erosion rate for the area where your property is
located is _ 2 feet per year.
The rate was established by careful analysis of aerial
photographs of the coastline taken over the past 50 years.
Studies also indicate that the shoreline could move as much as
270 feet landward in a major stone.
The flood waters in a major storm are predicted to be about
11-12 feet deep in this area.
Preferred oceanfront protection measures are beach nourishment
and relocation of threatened structures. Hard erosion control
structures such as bulkheads, seawalls, revetments, groins, jetties
and breakwaters are prohibited. Temporary sand bags may be
authorized under certain conditions.
The applicant must acknowledge this information and
requirements by signing this notice in the space below. Without
the proper signature, the application will not be complete.

SPECIAL NOTE: This hazard notice is required for
development in areas subject to sudden and massive storms and
erosion. Permits issued for development in this area expire on
December 31 of the third year following the year in which the
permit was issued. Shortly before work begins on the project
site, the Local Permit Officer must be contacted to determine the
vegetation line and setback distance at your site. If the property
has seen little change since the time of permit issuance, and the
proposed development can still meet the setback requirement,
the LPO will inform you that you may begin work. Substantial
progress on the project must be made within 60 days of this
setback determination, or the setback must be re -measured. Also,
the occurrence of a major shoreline change as the result of a
storm within the 60-day period will necessitate re -measurement
of the setback. It is important that you check with the LPO
before the permit expires for official approval to continue the
work after the permit has expired. Generally, if foundation
pilings have been placed and substantial progress is continuing,
permit renewal can be authorized. It is unlawful to continue
work after permit expiration.

CAMA Maior Development Permit Application Checklist
This checklist is provided solely as an informational resource to assists in the preparation of
the permit application. Although this checklist is not required to be filled out as part of the
permitting process, nor is it required that this checklist be provided to the Division of
Coastal Management (DCM), the items included within the checklist are required to
complete the permit application.
During the pre -application or application submittal meeting, a DCM representative will sit
down with you and review the application package for completeness. The Division
representative will refer to this checklist to determine whether or not an application is
deemed to be complete or to be insufficient. If an application package is deemed incomplete,
the specific deficiencies will be noted on the application checklist. A copy of the checklist will

A North Carolina Division of Coastal Management (DCM) Fisheries Resource Specialist has reviewed the
subject CAMA Major Permit Application for proposed actions that impact fish and fish habitats. The purpose
of the project is to fill wetlands to allow construction of a single family dwelling on Topsail Island. The
adjacent waters are designated Primary Nursery Area (PNA).
Primary Nursery Areas are essential for post -larval and juvenile species of finfish, crabs and shrimp because
they afford food and protection during a vulnerable period of their life cycle. Wetlands are important fish
habitats that provide the additional function of filtering water runoff. The footprint of the dwelling should be

CONSISTENCY DETERMINATION:
This project is consistent with the 2005 Surf City Land Use Plan Update.
The applicant proposes to construct a single-family residence with associated 404 type
wetland fill. The project is located at 1311 North New River Drive, adjacent to Stump
Sound in Surf City.
Areas of Environmental Concern (AEC's) impacted by the proposal are OH, HH. Waters
at the project site are classified as SA; HQW and are open to the harvest of shellfish. The
area is a Primary Nursery Area.
I have reviewed this proposal for consistency with the 2005 Surf City Land Use Plan
Update and offer the following comments.
The general area of the project is classified as Conservation/Resource Protection.
In general, Surf City allows development in Conservation/Resource Protection classified
areas and AECs, which is consistent with the State's minimum use standards. The Surf
City Land Use Plan contains some policies and discussion, which exceed the State's
minimum use standards. However, none of these policies are applicable to this project.
This project appears to be consistent with the 2005 Surf City Land Use Plan Update.

2. This approval is for the purpose and design described in your application. The plans and
specifications for this project are incorporated by reference as part of the Certification. If you
change your project, you must notify the Division and you may be required to submit a new
application package with the appropriate fee. If the property is sold, the new owner must be
given a copy of this approval letter and General Certification(s)/Permit/Authorization and is
responsible for complying with all conditions.
3. This General Certification shall expire on the same day as the expiration date of the
corresponding General Permit. The conditions in effect on the date of issuance of the
Certification for a specific project shall remain in effect for the life of the project, regardless of
the expiration of this Certification.
4. The applicant/permitee and their authorized agents shall conduct all activities in a manner
consistent with State water quality standards (including any requirements resulting from
compliance with 303(d) of the Clean Water Act), and any other appropriate requirements of
State and Federal law. If the Division determines that such standards or laws are not being
met, including failure to sustain a designated or achieved use, or that State or Federal law is
being violated, or that further conditions are necessary to assure compliance, than the Division
may reevaluate and modify this General Water Resources Certification.
5. No Sediment & Erosion Control Measures within Wetlands or Waters
Sediment and erosion control measures shall not be placed in wetlands or waters to the
maximum extent practicable. If placement of sediment and erosion control devices in
wetlands and waters is unavoidable, they shall be removed and the natural grade restored
within six months of the date that the Division of Energy, Mining and Land Resources (DEMLR)
has released the project.
6. Sediment and Erosion Control Measures
Sediment and erosion control measures shall be in place prior to ANY land disturbing activities
commencing. The silt fences shall be installed in accordance to plan and the side cast from the
trenching shall be placed on the impacted side of the fence and NOT the side of the wetland
that is to be left undisturbed.
7. Wetland Boundary Identification
The wetland boundary must be clearly identified within 50 feet of the project corridor as

8. All mechanized equipment operated near surface waters or wetlands will be regularly
inspected and maintained to prevent contamination of waters and wetlands from fuels,
lubricants, hydraulic fluids or other potential toxic chemicals. In the event of a hydrocarbon
or chemical spill, the permitee/contractor shall immediately contact the Division of Water
Resources, between the hours of 8 am to 5 pm at the Wilmington Regional Office at
910.796.7215 and after hours and on weekends call (800) 858-0368. Management of such
spills shall comply with provisions of the North Carolina Oil Pollution and Hazardous
Substances Control Act.
9. Certificate of Completion
Upon completion of all work approved within the 401 Water Quality Certification or
applicable Buffer Rules, and any subsequent modifications, the applicant is required to return
the attached certificate of completion to the 401/Wetlands Unit, North Carolina Division of
Water Resources, 1650 Mail Service Center, Raleigh, NC, 27699-1650.
Violations of any condition herein set forth may result in revocation of this Certification and may
result in criminal and/or civil penalties. The authorization to proceed with your proposed impacts
or to conduct impacts to waters as depicted in your application and as authorized by this
Certification shall expire upon expiration of the 404 or CAMA Permit.
This approval and its conditions are final and binding unless contested.
This Certification can be contested as provided in Articles 3 and 4 of General Statute 150B by filing
a written petition for an administrative hearing to the Office of Administrative Hearings (hereby
known as OAH). A petition form may be obtained from the OAH at http://www.ncoah.com/ or by
calling the OAH Clerk's Office at (919) 431-3000 for information.
Within sixty (60) calendar days of receipt of this notice, a petition must be filed with the OAH. A
petition is considered filed when the original and one (1) copy along with any applicable OAH filing
fee is received in the OAH during normal office hours (Monday through Friday between 8:00am
and 5:00pm, excluding official state holidays).
The petition may be faxed to the OAH at (919) 431-3100, provided the original and one copy of the
petition along with any applicable OAH filing fee is received by the OAH within five (5) business
days following the faxed transmission.
