This permit, issued on February 6.2014 is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Docking Facility
1) Unless specifically altered herein, this permit authorizes only the additional boathouse, finger piers,
boatlslip, single -pile mooring, additional pilings for the stabilization of the existing pier, and other
structures and uses located in or over the water that are expressly and specifically set forth in the
permit application. No other structure, whether floating or stationary, shall become a permanent part
of this docking facility without permit modification. No non -water dependent uses of structures shall
be conducted on, in or over public trust waters without permit modification. .

. ADDPI'IONAL CONDITIONS

t 2) The boathouse shall not be completely enclosed or have side coverage more than one half the height of
the side, from the roof waterward.
3) The authorized boathouse shall be single story, and shall not be designed to allow for second story use.
No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
The single -pile mooring shall be marked or colored in compliance with all appropriate U.S. Coast Guard
and/or N.C. Wildlife Resources Commission requirements. The required markings shall be maintained
for the life of the mooring.
5) The single -pile mooring shall bear the owner's name, state vessel registration and/or US Customs
Documentation numbers. Required identification shall be legible for the life of the mooring.
The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee will not be entitled to compensation for damage to the authorized structure or work, or injury
". which may be caused from existing or future operations undertaken by the United States in the public
interest.
3) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
This permit authorizes two additional boat slips for a maximum of three formalized boat slips.
General
1'll) The permittee understands and agrees that, if future operations by the United States requires the
removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause
unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required,
upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or
obstructions caused thereby, without expense to the United States or the state of North Carolina. No
{- claim shall be made against the United States or the state of North Carolina on account of any such
, removal or alteration.
No Coastal Wetlands or open water areas shall be excavated or filled, even temporarily.

written approval of the Division of Coastal Management.

initiation.
fE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
1TE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 946-6481 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal water level.
1TE: The U.S. Army Corps of Engineers authorized the proposed project under General Permit No.

The project site is located off SR 1346 at 136 Stell Road adjacent Bath Creek near the Town
of Bath in Beaufort County, North Carolina. The lot is approximately 11.04 acres (480,902 ft2) in
size and has approximately 897 linear feet of shoreline. Man-made features on the lot include a
single-family residence, 105 linear feet of bulkhead, a 82' long pier with a ±20' by ±14' L-head
platform and t 13' by f 13' uncovered boatlift. Currently the applicant has one fixed boat slip. The
existing total shaded impact is approximately 772 ft2. Water depths at the terminal end of the
existing pier structure range from -4.5 to - 5.0' below Normal Water Level (NWL). Landward of the
existing bulkhead the elevation gradually slopes upward to an approximate elevation of f4' above
the NWL. The lot is mostly vegetated with pines, mixed hardwoods, lawn grasses and ornamental
shrubs. The upland portion of the site is bordered on both sides by Typha spp., Carex spp., Spartina
cynosuroides and Juncus roemerianus.
Both adjacent properties on the upstream (north) side and downstream (south) side are
undeveloped lots. Coastal Wetlands dominate the upstream lot while the downstream lot is wooded
wetland vegetation adjacent to Bath Creek which transitions to uplands vegetated with pines and
mixed hardwoods.
Bath Creek is classified as SB NSW by the Environmental Management Commission at the
project site. Bath Creek is an Inland Waters Primary Nursery Area and is not open to shell fishing.
No SAVs were observed during the on -site field visit. State Historic site No. Bf 84 is located near
the project site.
Proiect description
The applicant proposes to construct a 20' by 30' roof (dripline) over the existing boatlift.
Additionally, the applicant proposes to construct a 6' by 19' and 6' by 13' catwalk around the
boatlift. A 4 - piling 14' by 14' wet slip is proposed on the upstream side of the existing L-Head
platform. A single -pile mooring pole with a 40' swing diameter is proposed upstream of the existing
pier. The addition of the wet slip and single mooring piling will bring the total number of slips to
three. The applicant is also proposing to install pilings every 14' along the perimeter of the pier and
platform to stabilize the existing structure which was permitted via CAMA General Permit 17159-B
issued on 1 I March 1997.
Anticipated impacts
The project will result in localized turbidity as a result of the installation of the pilings. The
expansion of the existing docking facility will result in an additional 662 ft2 of shaded impact with a
total Creek bottom shaded impact of 1,429ft2.

LUP Consistency Determination: The proposal is Consistent With & Not in Conflict with the
1997 Beaufort County Land Use Plan certified by the CRC on January 13, 2010.
Overview:
The Area of Environmental Concern (AEC) impacted by the proposal is Public Trust Area. The
waters are classified as SB NSW, are closed to the harvesting of shellfish, and are classified as inland
waters primary nursery area.
Development within the designated AECs is limited by CAMA regulations and development
guidelines. Applicable or related policy includes the following:
"Local governments in the planning area consider boating access to be an important
component of the economy and water access system. However, they recognize the need
for land use and development guidelines to prevent negative impacts on the area's
natural resources and land areas. Marinas and other docking facilities are allowed,
provided guidelines contained in 2.0 Policies on Development and Use of Natural
Resources are met. " (Policies for Public Access, P. 1.6, pg. III-9)

John Johnston & Son, LLC has submitted a CAMA Major Permit application on behalf of Wild
Goose Farms, LLC located off SR 1346 at 136 Stell Road adjacent Bath Creek near the Town of Bath in Beaufort
County, North Carolina. The applicant proposes to construct a 20' by 30' roof (dripline) over the existing boatlift.
Additionally, the applicant proposes to construct a 6' by 19' and 6' by 13' catwalk around the boatlift. A 4 — piling
14' by 14' wet slip is proposed on the upstream side of the existing L-Head platform. A single -pile mooring pole is
proposed upstream of the existing pier. The addition of the wet slip and single mooring piling will bring the total
number of slips to three.
I have reviewed the proposed project with regard to rules found in Subchapter 7H concerning development in
a Public Trust Area. It is staff s recommendation that the proposed project appears consistent with 15A NCAC 07H
.0208 as described below.
This office feels the development is consistent with 15A NCAC 07H .0208(b)(6)(B) which states in part that
"The total square footage of shaded impact for docks and mooring facilities (excluding the pier) allowed shall be 8
square feet per linear foot of shoreline with a maximum of 2,000 square feet." The applicant has 897 linear feet of
shoreline which provides a maximum shaded impact of 2,000 ft2. The applicant is proposing a total 937 ft' of
shaded impact, excluding the existing pier.
This office also feels the construction of the boathouse is consistent with 15A NCAC .0208(b)(6)(D) which
states in part "A boathouse shall not exceed 400 square feet except to accommodate a documented need for a larger
boathouse". The applicant has stated that the additional boathouse overhang is to provide adequate coverage to
prevent algae growth on the finger piers in an effort to assist entry and exit from boat by a handicapped family
member who walks with the assistance of crutches.
The applicant is also proposing to install pilings every 14' along the perimeter of the pier and
platform to stabilize the existing structure which was permitted via CAMA General Permit 17159-B issued on 11
March 1997. This has been included on the Major Permit application but it should be noted that this activity alone
would be exempt from requiring a CAMA permit.
Staff recommend the following conditions be included if the project is permitted.
No attempt will be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
2. This permit authorizes only the structures and uses located in or over the water that are expressly and
specifically set forth in the permit application. No other structure, whether floating or stationary, may
become a permanent part of this docking facility without permit modification. No non -water dependent uses
of structures may be conducted on, in or over public trust waters without permit modification.
3. The boathouse shall not be completely enclosed or have side coverage more than one half the height of the
side, from the roof waterward.
4. The authorized boathouse shall be single story, and shall not be designed to allow for second story use.
5. This permit authorizes a maximum of three boat slips.

The NC Division of Coastal Management hereby acknowledges receipt of your
application for State approval for development of your property located off SR 1346 at 136 Stell
Road near the town of Bath on Bath Creek in Beaufort County, North Carolina It was received
on 11 December 2013, and appears to be adequate for processing at this time. The projected
deadline for making a decision is 25 February 2014. An additional 75-day review period is
provided by law when such time is necessary to complete the review. If you have not been
notified of a final action by the initial deadline stated above, you should consider the review
period extended. Under those circumstances, this letter will serve as your notice of an extended
review. However, an additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from the 11 December
2013, you may request a meeting with the Director of the Division of Coastal Management and
permit staff to discuss the status of your project. Such a meeting will be held within five
working days from the receipt of your written request and shall include the property owner,
developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which must
be posted at the property of your proposed development. You should post this notice at a
conspicuous point along your property where it can be observed from a public road. Some
examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-
way fronting your property, or at a point along the road right-of-way where a private road would
lead one into your property. Failure to post this notice could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be
contacted by the appropriate State or Federal agency. Please contact me if you have any

We propose to construct a boathouse over an existing boatlift. This WOPWITY
located on Mr. Rusty Duke's property. The walkway around the existing boatlift will be
installed by using a hydraulic excavator. Walkways will be 6ft wide by 19ft long around
the west and south sides. The excess boathouse overhand is to prevent the accumulation
of water and algae growth on the finger piers. This overhang will assist the handicapped
family member who walks with the assistance of crutches.
The pilings for the boat house will be pile driven into the ground by a hydraulic
excavator. The pilings will be no higher than twelve feet above normal tide. The boat lift
will have top over it. It is now called a boat house. This is for boat house overhang. The
total boathouse dimensions will be 20' wide by 30' long. The boat house roof will be no
greater than a five/twelve pitch. The roof height may not be any higher than 5' above the
boat lift. All construction will be using modern materials.
We will also be planning on driving bumper piles on the pier, Tee end at the
comers and in the middle. We would like to drive 2 mooring piles on the North side of
the tee about 12 ft from the pier and approximately 75ft from the shore.

The modification of the existing boatlift is to better protect the boat from the elements. The projected boat
width is 8ft wide by 26ft long. The 400 sq ft boathouse will not be enough to fully cover the boat. We want to fully
cover the boat and to cover shade from the sun and elements. The main reason for the oversized boathouse is that
the owner's son is handicap. He wants to be able to get around on the walkways without the possibility of falling
down. The boathouse is used for private/family use only. The homeowner will be using on the occasional use and
more when family and friends are down.
