This permit, issued on November 24. 2014 is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
oe suoject to Tines, imprisonment or civu action; or may cause me permit to oe nuu anu vuiu.
Shoreline Stabilization
1) The authorized bulkhead shall adhere to the alignment depicted on the attached workplan drawings
and shall not extend waterward an average of more than 3 feet from the normal water level at any
point along its alignment at the time of construction.
2) In order to protect anadromous fish, no in -water work shall be permitted between February 15 and
September 30 of any year without the prior approval of the Division of Coastal Management.
3) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the
structure.
(See attached sheet for Additional Conditions)
[. This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2017
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIIONS
4) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal sheet piles or other
suitable materials approved by department personnel. No excavation landward of the authorized
alignment is permitted except for that which may be required for the construction of the bulkhead wall
and deadmen cables, etc.
5) The bulkhead shall be constructed prior to any backfilling activities.
6) All backfill material shall be clean and free of any pollutants except in trace quantities.
7) All backfill material shall be obtained from a high ground source and confined behind the permitted
bulkhead.
Sedimentation and Erosion Control
8) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
9) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence,
diversion swales or berms, etc.). At a minimum, a silt fence shall be properly installed immediately
landward of the bulkhead cap immediately following completion of backfrlling activities.
9 10) All disturbed areas shall be properly graded and provided a ground cover sufficient to restrain erosion
within thirty days of project completion.
General
11) The pennittee and/or his contractor shall meet with a representative of the Division prior to project
initiation in order to discuss the conditions set forth in this permit.
-12) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
_ 'NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 946-6481 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal water level.
The U.S. Army Corps of Engineers has assigned the proposed project COE Action Id. No SAW-
2014.02154.

Narrative for Domtar's Riverfront Bulkhead Replacment
on the Roanoke River in Martin County
Domtar Paper Company LLC proposes to construct a new steel sheet pile bulkhead on the Roanoke
River to replace an existing corroded bulkhead on their property located off US Highway 64 west
of Plymouth in Martin County. Recent inspection of Domtar's 3580 feet of riverfrom bulkhead
identified 1434 feet of sheet piling exhibiting deterioration to a level that Domtar believes requires
replacement. Thus, Domtar is programming to install new sheet piling for the segments totaling
1434 feet.
Due to some irregular alignment of the existing sheeting, required sheeting section size for
deepwater (water depth varies with maximum depth of 18 feet NWL) and proximity to existing
buildings, an offset of feet is necessary for installation in lieu ofthe typical offset oft feet allowed
for residential bulkheads. Replacement of the total 1434 feet will be programmed over multiple
fiscal years.
Construction ofthe replacement bulkhead will involve driving the sheet piles followed by placement
of fill material between existing and new bulkhead. Permanent or temporary closure sheets at ends
ofthe fill segment will be installed confine the fill material between the sheet piles. Fill material will
be provided from an approved, permitted site.

applicable, the State Dredge and Fill Law, for you to proceed with your project proposal, The original (buff -colored
form) is retained by you and it must be available on site when the project is inspected for compliance. Please sign
both the original and the copy and return the copy to this office in the enclosed envelope. Signing the permit and
proceeding means you have waived your right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-
121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office
of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, (919) 733-2698 within twenty
(20) days of this decision on your permit. You should also be aware that another qualified party may submit an
objection to the issuance of this permit within twenty (20) days.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be
carried out in accordance with your application. Modifications, time extensions, and future maintenance requires
additional approval. Please read your permit carefully prior to starting work and review all project plans, as
approved. If you are having the work done by a contractor, it would be to your benefit to be sure that he fully
understands all permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we request that
you complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise

existing failing bulkhead on the Roanoke River.

PROJECT SETTING
Domtar Paper Company LLC has submitted a Major CAMA permit request for development on their
property on the Roanoke River off of SR 1565 upstream of the Town of Plymouth. The land portion
of this project is in Martin County, while waterward of the normal water level (NWL) is in Bertie
County. The site is currently developed as an industrial paper mill site. The site currently has 3,580ft
of metal sheet pile bulkhead, of which 1,434ft is failing. Water depths at the project site range from -
8 to -18ft below NWL. The property upstream of the project site is wooded wetlands and Welchs
Creek is downstream.
The Roanoke River is classified as C SW by the Environmental Management Commission at the
project site. The project site is located in joint waters and is designated as Anadromous Fish
Spawning Area by the North Carolina Wildlife Resource Commission and the North Carolina
Marine Fisheries Commission.
PROJECT DESCRIPTION
Domtar Paper LLC proposes to replace 1,434ft of steel sheetpile bulkhead 3ft waterward of the
existing bulkhead in the same alignment. The existing shoreline in the location of the bulkhead to be
replaced is impervious surface (concrete). The fill between the two bulkheads will grade back from
the shoreline to direct surface water from the Roanoke River. There will be no disturbance to the
existing high ground due to the installation techniques for the bulkhead. The bulkhead will be
constructed without tie backs using cantilevered sheets.
There is an existing permitted cooling water discharge that is flush with the bulkhead. This discharge
will be extended 3ft to remain flush to the proposed bulkhead. There is a 25ft by 35ft existing
boathouse that may have to be removed for the installation of the bulkhead. This boathouse will be
reconstructed in the same footprint not extending further into the Roanoke River. Due to the water
depths and presence of industrial infrastructure over hanging the water the bulkhead will be 3'
waterward of the existing structure. This 3' is needed to avoid damage to these structures during
construction.
ANTICIPATED IMPACTS
The project will result in localized turbidity due to the installation of bulkhead. Approximately
4,032ft2 of river bottom will be filled associated with the installation of the bulkhead.

Pat Wemple has submitted a Major CAMA application for Domtar Paper Company LLC to replace
1,432 feet of failing metal sheet pile bulkhead.
Staff has reviewed the proposed project with regard to rules found in Subchapter 7H concerning
development in Coastal Shorelines. It is staffs recommendation that the proposed project appears consistent
with 15A NCAC 07H .0208 as described below.
Staff has reviewed the project, and the applicant has documented the need to construct the bulkhead
waterward of the NWL.
The applicants have properly notified the riparian neighbors to the project via certified mail. You will
be sent a copy of the signed and dated green cards as proof of receipt by the adjacent Properties once the
applicants have provided them to staff. If the permit is issued, staff would suggest the following conditions:

1. The bulkhead shall not extend waterward an average of more than 3 feet from the normal
high/normal water level at any point along its alignment at the time of construction.

2. The alignment of the authorized bulkhead/riprap shall be staked by a representative of the
Division of Coastal Management within a maximum of 30 days prior to the start of construction.
Failure to initiate construction within 30 days, or erosion of the shoreline by adverse weather
conditions, shall require the alignment to be restaked by DCM within a maximum of 30 days
prior to the new expected start of construction.
3. The bulkhead shall be constructed prior to any backfilling activities.
4. The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the
structure.
5. The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal sheet piles or
other suitable materials approved by Division of Coastal Management personnel. No excavation
is permitted except for that which may be required for the construction of the bulkhead wall,
riprap, deadmen cables, etc. This permit does not authorize any excavation waterward of the
approved alignment.
6. The fill material shall be clean and free of any pollutants except in trace quantities.
7. All fill material to be placed below normal water level shall be confined behind the permitted
bulkhead.
General
1. The permittee understands and agrees that, if future operations by the United States requires the
removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall
cause unreasonable obstruction to free navigation of the navigable waters, the permittee will be
required, upon due notice from the Corps of Engineers, to remove relocate or alter the structural
work or obstructions caused thereby, without expense to the United States or the state of North
Carolina. No claim shall be made against the United States or the state of North Carolina on
account of any such removal or alteration.
2. The permittee and/or his or her contractor shall contact a representative of the Division at (252)-
946-6481 prior to project initiation to set up a pre -construction meeting
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local
permits, approvals or authorizations that may be required, including any local approvals.
NOTE: Future development of the pernuttee's property may require a modification of this

Biologists with the North Carolina Wildlife Resources Commission (NCWRC) reviewed the
permit application with regard to impacts on fish and wildlife resources. The project site is located at the
end of SR 1565 off of US Hwy 64 in Plymouth, NC adjacent the Roanoke River. Our comments are
provided in accordance with provisions of the Coastal Area Management Act (G.S. 113A-100 through
113A-128), as amended, Sections 401 and 404 of the Clean Water Act, as amended, and the Fish and
Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.).
The applicant proposes to construct 1,434' of bulkhead with an alignment being waterward an
existing failed bulkhead structure. The average distance waterward the existing structure is 3'. An existing
cooling water discharge will be extended 3' waterward as well to be flush with the new bulkhead The
Roanoke River at this location is classified C Sw by the Environmental Management Commission and is
designated an anadromous fish spawning area by the NC Wildlife Resources Commission.
The NCWRC has reviewed the permit application and does not object to permit issuance. To
minimize impacts to important aquatic resources, a February 15 — September 30 in -water moratorium
should be included as a permit condition as it has been for previously permitted projects for the applicant.

PROJECT SETTING
Domtaz Paper Company LLC has submitted a Major CAMA pemvt request for development on their
property on the Roanoke River off of SR 1565 upstream of the Town of Plymouth. The land portion
of this project is in Martin County, while waterward of the normal water level (NWL) is in Berde
County. The site is currently developed as an industrial paper mill site. The site currently has 3,580ft
of metal sheet pile bulkhead, of which 1,434ft is failing. Water depths at the project site range from -
8 to -18ft below NWL. The property upstream of the project site is wooded wetlands and Welchs
Creek is downstream.
The Roanoke River is classified as C SW by the Environmental Management Commission at the
project site. The project site is located in joint waters and is designated as Anadromous Fish
Spawning Area by the North Carolina Wildlife Resource Commission and the North Carolina
Marine Fisheries Commission.
PROJECT DESCRIPTION
Domtaz Parer LLC—proposes to r ace 1 434ft f khead aft waterwazd of the
existing bulkhead in the same alignment. The existing shoreline in the location of the bulkhe o e
r e is impervious surface (concrete). The fill between the two bulkheads will grade back from
the shoreline to direct surface water from the Roanoke River. There will be no disturbance to the
existing high ground due to the installation techniques for the bulkhead. The bulkhead will be
constructed without tie backs using cantilevered sheets.

The project will result in localized turbidity due to the installation of bulkhead. Approximately
4,032ft2 of river bottom will be filled associated with the installation of the bulkhead.

Narrative for Domtar's Riverfront Bulkhead Replacment
on the Roanoke River in Martin County
Domtar Paper Company LLC proposes to construct a new steel sheet pile bulkhead on the Roanoke
River to replace an existing corroded bulkhead on their property located off US Highway 64 west
of Plymouth in Martin County. Recent inspection of Domtar's 3580 feet of riverfront bulkhead
identified 1434 feet of sheet piling exhibiting deterioration to a level that Domtar believes requires
replacement. Thus, Domtar is programming to install new sheet piling for the segments totaling
1434 feet.
Due to some irregular alignment of the existing sheeting, required sheeting section size for
deepwater (water depth varies with maximum depth of 18 feet NWL) and proximity to existing
buildings, an offset of 3 feet is necessary for installation in lieu of the typical offset of feet allowed
for residential bulkheads. Replacement of the total 1434 feet will be programmed over multiple
fiscal years.
Construction ofthe replacement bulkhead will involve driving the sheet piles followed by placement
of fill material between existing and new bulkhead. Permanent or temporary closure sheets at ends
ofthe fill segment will be installed confine the fill material between the sheet piles. Fill material will
be provided from an approved, permitted site.

SUBJECT: Major Permit Request by Domtar Paper Company, LLC to replace 1,434 linear
feet of steel sheet pile bulkhead 3 feet waterward of the existing bulkhead
alignment on the Roanoke River in Bertie County; to be accessed from the
property located at the terminus of SR 1565 off of US 64, in Martin County.
Date: September 30, 2014
Consistency Determination: The request is consistent with/not in conflict with the Bertie
County 1998 Land Use Plan certified by the CRC on
September 8, 1999.
Overview: The 1,181 acre subject property consists of approximately 1.9 miles of shoreline
along the Roanoke River and approximately 2.8 miles of shoreline along Welch Creek. An
industrial paper mill is located on the property. The Roanoke River shoreline is the dividing
line between Martin County and Bertie County, which means the river is in Bertie County and
the upland area is in Martin County. The project area consists of 1,434 feet of Roanoke River
shoreline along a failing bulkhead. Upland improvements at the location include a cooling
water discharge that is flush with the bulkhead and a 25 foot by 35 foot boathouse that
extends over the river. Additional industrial infrastructure also hangs over the water. The
river is approximately 485 feet wide in this location. Water depths at the project site range
from 8 to 18 feet below Normal Water Level (NWL).
Replacement of 1,434 linear feet of steel sheet pile bulkhead 3 feet waterward of the existing
bulkhead alignment is proposed. The bulkhead will be constructed without tiebacks with the
use of cantilevered sheets. Backfill will be graded from the shoreline to direct surface water
away from the river. The cooling water discharge will be extended 3 feet to remain flush with
the bulkhead. The boathouse may have to be reconstructed, but will not extend further into
the river. Extending the bulkhead 3 feet waterward will avoid damage to overhanging
industrial structures during construction.
The waters of the Roanoke River are classified as C Sw in this area and are closed to
shellfishing. The waters are designated as a joint Anadromous Fish Spawning Area (AFSA).
A review of archaeological resources was not provided.

Anticipated impacts: resulting from this project are expected to include: the filling of 4,302 sq.
ft. of Public Trust Area/Estuarine Waters Area of Environmental Concern (AEC).
Basis for Determination:
The Bertie County Future Land Use Map identifies the Roanoke River as "Conservation", per
narrative on Page 94 that includes Public Trust Waters and Estuarine Waters in the
classification. The following LUP policies may be applicable to this request:
A. RESOURCE PROTECTION
2. Areas of Environmental Concern,
a. Estuarine Waters and Estuarine Shorelines:

"...In order to promote the quality of estuarine waters, Bertie County officials will
consider land use controls which protect the values of the estuarine system.
Residential, recreational, and commercial uses would also be controlled within
the estuarine shoreline provided that:
• A significant change of pollution occurring from the development does not
exist.
• Development does not have a significant adverse impact on estuarine
resources.
• Development does not significantly interfere with existing public rights or
access to, or use of, navigable waters or public resources."
b. Public Trust Areas:
Pages 61 and 62.
"... Bertie County will continue to promote reasonable conservation management
practices of Public Trust Waters. Appropriate uses include those which protect
public rights for navigation and recreation. Projects which would directly block or
impair existing navigation channels, increase shoreline erosion, deposit spoils
below mean high tide, cause adverse water circulation patterns, violate water
quality standards, or cause degradation of shellfish waters shall be discouraged.
Encouraged uses shall be those which do not cause unreasonable detriment to
the physical or biological functions of Public Trust Waters. Such uses as
navigational channels, drainage ditches, bulkheads to prevent erosion, piers,
docks, marinas, and bridges will be encouraged."

Dear Mr. Huggett:
Reference the application of Domtar Paper Company, c/o Wynne Shaw, to construct a
1,434 linear foot bulkhead approximately 3 feet waterward of existing failing bulkhead, at
Domtar Paper Company, adjacent to Roanoke River, Bertie County, North Carolina.
The Federal agencies have completed review of the proposal as presented by the
application and your field investigation report.
We recommend that the following conditions be included in the State authorization:
1. All work authorized by this permit must be performed in strict compliance with the
attached plans, which are a part of this permit. Any modification to these plans must be approved
by the US Army Corps of Engineers (USACE) prior to implementation.
2. The permittee understands and agrees that, if future operations by the United States
require the removal, relocation, or other alteration, of the structure or work herein authorized, or
if, in the opinion of the Secretary of the Army or his authorized representative, said structure or
work shall cause unreasonable obstruction to the free navigation of the navigable waters, the
permittee will be required, upon due notice from the U.S. Army Corps of Engineers, to remove,
relocate, or alter the structural work or obstructions caused thereby, without expense to the
United States. No claim shall be made against the United States on account of any such removal,
relocation, or alteration. The permittee shall notify NOAA/NATIONAL OCEAN SERVICE
Chief Source Data Unit N CS261, 1315 E West HWY- RM 7316, Silver Spring, MD 20910-
3282 at least two weeks prior to beginning work and upon completion of work.
3. Except as specified in the plans attached to this permit, no excavation, fill or mechanized
land -clearing activities shall take place at any time in the construction or maintenance of this
project, in such a manner as to impair normal flows and circulation patterns within waters or
wetlands or to reduce the reach of waters or wetlands.
4. Except as authorized by this permit or any USACE approved modification to this
permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in
the construction or maintenance of this project, within waters or wetlands. This permit does not
authorize temporary placement or double handling of excavated or fill material within waters or
wetlands outside the permitted area. This prohibition applies to all borrow and fill activities
connected with this project.
5. Unless otherwise authorized by this permit, all fill material placed in waters or wetlands
shall be generated from an upland source and will be clean and free of any pollutants except in
trace quantities. Metal products, organic materials (including debris from land clearing
activities), or unsightly debris will not be used.
6. The authorized structure and associated activity must not interfere with the public's right
to free navigation on all navigable waters of the United States. No attempt will be made by the
permittee to prevent the full and free use by the public of all navigable waters at or adjacent to
the authorized work for reason other than safety.
7. The permittee shall advise the Corps in writing at least two weeks prior to beginning the
work authorized by this permit and again upon completion of the work authorized by this permit.
8. The permittee shall require its contractors and/or agents to comply with the terms and
conditions of this permit in the construction and maintenance of this project, and shall provide
each of its contractors and/or agents associated with the construction or maintenance of this
project with a copy of this permit. A copy of this permit, including all conditions, shall be
available at the project site during construction and maintenance of this project.
9. The permittee shall employ all sedimentation and erosion control measures necessary to
prevent an increase in sedimentation or turbidity within waters and wetlands outside the permit
area. This shall include, but is not limited to, the immediate installation of silt fencing or similar
appropriate devices around all areas subject to soil disturbance or the movement of earthen fill,
and the immediate stabilization of all disturbed areas. Additionally, the project must remain in
full compliance with all aspects of the Sedimentation Pollution Control Act of 1973 (North
Carolina General Statutes Chapter 113A Article 4).
10. The activity will be conducted in such a manner as to prevent a significant increase in
turbidity outside the area of construction or construction -related discharge. Increases such that
the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by
the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all
saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not
considered significant.
11. Violations of these conditions or violations of Section 404 of the Clean Water Act or
Section 10 of the Rivers and Harbors Act must be reported in writing to the Wilmington District
U.S. Army Corps of Engineers within 24 hours of the permittee's discovery of the violation.

conspicuous point along your property where it can be observed from a public road. Some
examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-
way fronting your property, or at a point along the road right-of-way where a private road would

The Department of Environment and Natural Resources hereby gives public notice as
required by N.C.G.S. 113A-119(b) that an application for a development permit in an Area of
Environmental Concern as designated under the Coastal Area Management Act (CAMA) was

Domtar Paper Company LLC is applying for a CAMA Major permit to construct a new steel sheet pile bulkhead
on the Roanoke River to replace an existing corroded bulkhead on their property located off US Highway 64 west of
Plymouth in Martin County. The specifics of the proposed work are in the application forms and drawings included
in this correspondence.
As the adjacent riparian property owner to the aforementioned project, I am required to notify you of the
development in order to give you the opportunity to comment on the project. Please review the attached permit
application and drawings.
