This permit, issued on November 24. 2014 is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Shoreline Stabilization 1) The authorized bulkhead shall adhere to the alignment depicted on the attached workplan drawings and shall not extend waterward an average of more than 3 feet from the normal water level at any point along its alignment at the time of construction. 2) In order to protect anadromous fish, no in -water work shall be permitted between February 15 and September 30 of any year without the prior approval of the Division of Coastal Management. 3) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. (See attached sheet for Additional Conditions) [. This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2017 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Domtar Paper Company LLC c Permit # 102-14, Page 2 of 2 ADDITIONAL CONDITIIONS 4) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal sheet piles or other suitable materials approved by department personnel. No excavation landward of the authorized alignment is permitted except for that which may be required for the construction of the bulkhead wall and deadmen cables, etc. 5) The bulkhead shall be constructed prior to any backfilling activities. 6) All backfill material shall be clean and free of any pollutants except in trace quantities. 7) All backfill material shall be obtained from a high ground source and confined behind the permitted bulkhead. Sedimentation and Erosion Control 8) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 9) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, etc.). At a minimum, a silt fence shall be properly installed immediately landward of the bulkhead cap immediately following completion of backfrlling activities. 9 10) All disturbed areas shall be properly graded and provided a ground cover sufficient to restrain erosion within thirty days of project completion. General 11) The pennittee and/or his contractor shall meet with a representative of the Division prior to project initiation in order to discuss the conditions set forth in this permit. -12) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. _ 'NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 946-6481 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal water level. Recent inspection of Domtar's 3580 feet of riverfrom bulkhead identified 1434 feet of sheet piling exhibiting deterioration to a level that Domtar believes requires replacement. Thus, Domtar is programming to install new sheet piling for the segments totaling 1434 feet. Due to some irregular alignment of the existing sheeting, required sheeting section size for deepwater (water depth varies with maximum depth of 18 feet NWL) and proximity to existing buildings, an offset of feet is necessary for installation in lieu ofthe typical offset oft feet allowed for residential bulkheads. Replacement of the total 1434 feet will be programmed over multiple fiscal years. Construction ofthe replacement bulkhead will involve driving the sheet piles followed by placement of fill material between existing and new bulkhead. Permanent or temporary closure sheets at ends ofthe fill segment will be installed confine the fill material between the sheet piles. Fill material will be provided from an approved, permitted site. Domtar Paper Company LLC Martin/Berde Counties PROJECT SETTING Domtar Paper Company LLC has submitted a Major CAMA permit request for development on their property on the Roanoke River off of SR 1565 upstream of the Town of Plymouth. The land portion of this project is in Martin County, while waterward of the normal water level (NWL) is in Bertie County. The site is currently developed as an industrial paper mill site. The site currently has 3,580ft of metal sheet pile bulkhead, of which 1,434ft is failing. Water depths at the project site range from - 8 to -18ft below NWL. The property upstream of the project site is wooded wetlands and Welchs Creek is downstream. The Roanoke River is classified as C SW by the Environmental Management Commission at the project site. The project site is located in joint waters and is designated as Anadromous Fish Spawning Area by the North Carolina Wildlife Resource Commission and the North Carolina Marine Fisheries Commission. PROJECT DESCRIPTION Domtar Paper LLC proposes to replace 1,434ft of steel sheetpile bulkhead 3ft waterward of the existing bulkhead in the same alignment. The existing shoreline in the location of the bulkhead to be replaced is impervious surface (concrete). The fill between the two bulkheads will grade back from the shoreline to direct surface water from the Roanoke River. There will be no disturbance to the existing high ground due to the installation techniques for the bulkhead. The bulkhead will be constructed without tie backs using cantilevered sheets. There is an existing permitted cooling water discharge that is flush with the bulkhead. This discharge will be extended 3ft to remain flush to the proposed bulkhead. There is a 25ft by 35ft existing boathouse that may have to be removed for the installation of the bulkhead. This boathouse will be reconstructed in the same footprint not extending further into the Roanoke River. Due to the water depths and presence of industrial infrastructure over hanging the water the bulkhead will be 3' waterward of the existing structure. This 3' is needed to avoid damage to these structures during construction. ANTICIPATED IMPACTS The project will result in localized turbidity due to the installation of bulkhead. Approximately 4,032ft2 of river bottom will be filled associated with the installation of the bulkhead. PROJECT SUMMARY: The applicant proposes to construct 1,434ft of bulkhead in -front of an existing failing bulkhead on the Roanoke River. Domtaz Paper Company LLC Martin/Bertie Counties PROJECT SETTING Domtaz Paper Company LLC has submitted a Major CAMA pemvt request for development on their property on the Roanoke River off of SR 1565 upstream of the Town of Plymouth. The land portion of this project is in Martin County, while waterward of the normal water level (NWL) is in Berde County. The site is currently developed as an industrial paper mill site. The site currently has 3,580ft of metal sheet pile bulkhead, of which 1,434ft is failing. Water depths at the project site range from - 8 to -18ft below NWL. The property upstream of the project site is wooded wetlands and Welchs Creek is downstream. The Roanoke River is classified as C SW by the Environmental Management Commission at the project site. The project site is located in joint waters and is designated as Anadromous Fish Spawning Area by the North Carolina Wildlife Resource Commission and the North Carolina Marine Fisheries Commission. Recent inspection of Domtar's 3580 feet of riverfront bulkhead identified 1434 feet of sheet piling exhibiting deterioration to a level that Domtar believes requires replacement. Thus, Domtar is programming to install new sheet piling for the segments totaling 1434 feet. Due to some irregular alignment of the existing sheeting, required sheeting section size for deepwater (water depth varies with maximum depth of 18 feet NWL) and proximity to existing buildings, an offset of 3 feet is necessary for installation in lieu of the typical offset of feet allowed for residential bulkheads. Replacement of the total 1434 feet will be programmed over multiple fiscal years. Construction ofthe replacement bulkhead will involve driving the sheet piles followed by placement of fill material between existing and new bulkhead. Permanent or temporary closure sheets at ends ofthe fill segment will be installed confine the fill material between the sheet piles. Fill material will be provided from an approved, permitted site. Date: September 30, 2014 Consistency Determination: The request is consistent with/not in conflict with the Bertie County 1998 Land Use Plan certified by the CRC on September 8, 1999. Overview: The 1,181 acre subject property consists of approximately 1.9 miles of shoreline along the Roanoke River and approximately 2.8 miles of shoreline along Welch Creek. An industrial paper mill is located on the property. The Roanoke River shoreline is the dividing line between Martin County and Bertie County, which means the river is in Bertie County and the upland area is in Martin County. The project area consists of 1,434 feet of Roanoke River shoreline along a failing bulkhead. Upland improvements at the location include a cooling water discharge that is flush with the bulkhead and a 25 foot by 35 foot boathouse that extends over the river. Additional industrial infrastructure also hangs over the water. The river is approximately 485 feet wide in this location. Water depths at the project site range from 8 to 18 feet below Normal Water Level (NWL). Replacement of 1,434 linear feet of steel sheet pile bulkhead 3 feet waterward of the existing bulkhead alignment is proposed. The bulkhead will be constructed without tiebacks with the use of cantilevered sheets. Backfill will be graded from the shoreline to direct surface water away from the river. The cooling water discharge will be extended 3 feet to remain flush with the bulkhead. The boathouse may have to be reconstructed, but will not extend further into the river. Extending the bulkhead 3 feet waterward will avoid damage to overhanging industrial structures during construction. The waters of the Roanoke River are classified as C Sw in this area and are closed to shellfishing. The waters are designated as a joint Anadromous Fish Spawning Area (AFSA). A review of archaeological resources was not provided. The permittee shall employ all sedimentation and erosion control measures necessary to prevent an increase in sedimentation or turbidity within waters and wetlands outside the permit area. This shall include, but is not limited to, the immediate installation of silt fencing or similar appropriate devices around all areas subject to soil disturbance or the movement of earthen fill, and the immediate stabilization of all disturbed areas. Additionally, the project must remain in full compliance with all aspects of the Sedimentation Pollution Control Act of 1973 (North Carolina General Statutes Chapter 113A Article 4). 10. The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction -related discharge. Increases such that the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not considered significant. 11.
