Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Docking Facility 1) Unless specifically altered herein, this permit authorizes the docks, piers, platforms and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over public trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2017 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. CONDITIONS 3) No portion of the permitted structure shall be located within 80 feet of the near bottom edge of the federally maintained AIWW channel. ' 4) An as -built survey shall be conducted which shall include the permitted structure and the exact coordinate location of the waterward end of the structure. The survey shall be provided to the Division of Coastal Management and the US Army Corps of Engineers immediately following construction of the docking facility. 5) The construction and/or operation of the authorized facilities shall not directly result in any closure of any waters that are open to the taking of shellfish. Any such closure directly attributable to the docking facility shall require that the permittee undertake remedial actions to remedy the situation. Such actions may include, but are not limited to, a removal of any unauthorized slips or mitigative measures to reduce or eliminate the cause(s) of the closure. fi) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 7) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 8) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 9) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 10) This permit authorizes a total of (5) formalized boat slips in association with this docking facility. General 11) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. '12) No vegetated wetlands or open water areas shall be excavated or filled, even temporarily, without permit modification. Clyd6 Dinkins Permit #107-14 Page 3 of 3 ADDITIONAL. CONDITIONS 13) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 14) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: The N.C. Division of Water Resources has authorized the proposed project under DWR Project No. 14-1054. NOTE: The U.S. Army Corps of Engineers authorized the proposed project under COE Action Id. PROJECT DESCRIPTION: The project site is located at the end of Seabreeze Road within the Seabreeze waterfront community, adjacent to the AIWW/Myrtle Grove Sound, in New Hanover County. To locate the project site from the Wilmington Regional Office (WiRO), travel from Wilmington towards Carolina Beach south on College Road (NC Hwy 421) for approximately 12 miles until you reach the stop light just north of the Snow's Cut Bridge. Turn left onto Seabreeze Road and travel east approximately 0.2 miles until the road bends towards the north. The project site is located at the bend of the road on the right hand side. The project site consists of two (2) lots, which are along the waterfront totaling approximately 0.55 acres of land with elevations averaging approximately 7'above normal high water (NHW). There is approximately 100' of shoreline along the project area adjacent to the AIWW/Myrtle Grove Sound, which is stabilized by a timber bulkhead. The applicant currently maintains an elevated residential building apparently utilized as a bed and breakfast business. Existing high ground vegetation on this tract consists of grasses and hardwoods including Oak. Waterward of the timber bulkhead towards Myrtle Grove Sound is an area of coastal wetlands approximately 20' consisting primarily of Smooth Cordgrass (Spartina altemiflora). The applicant maintains an existing access pier, which measures approximately 155' in length by 6' in width, which terminates into a fixed uncovered platform, measuring approximately 20' in length by 15' in width. There are four (4) fender pilings along the southern side of the existing platform. The existing facility was authorized under State Permit No. 3-04 issued on January 5, 2004. Water depths at the end of the existing structure are approximately -2' @ normal low water (NLW). State Permit No. 3-04 authorized two (2) finger piers and two (2) boatlifts on each side of the landward side of the existing platform, which authorized a total of four (4) formalized slips at this location; however, the construction of these structures were not completed. State Permit No. 3-04 was modified on November 5, 2004, which authorized the exiting residential building, aforementioned. State Permit No. 3-04 expired on December 31, 2007 (See Sheet 3 of 3 and Project Narrative). The Wilmington -New Hanover County 2006 Land Use Plan Update classifies adjacent waters as Conservation, and the adjacent high ground portion of the project area as Resource Protection. The waters of the AIWW/Myrtle Grove Sound are classified SA by the Division of Water Quality. They ARE designated as a Primary Nursery Area by the N.C. Division of Marine Fisheries and they are OPEN to the harvest of shellfish. PROPOSED PROJECT: The applicant requests authorization to expand an existing docking facility within Myrtle Grove Sound. The application states that a new fixed pier would extend from the existing platform a distance of approximately 80' in length by 6' in width. The application also requests to construct the previously authorized finger piers and boatlifts within the originally authorized location. The finger piers would measure approximately 10' in width by 5' in width and the boatlifts would measure approximately 12' in length by 13' in width each. The application states that the proposed docking facility would accommodate up to six (6) vessels at this location in water ranging from approximately -2' to 4 @ NLW (See Sheets 1 through 3 of 3 and Project Narrative). Clyde and Barbara Dinkins c/o Jimmy North Page 2 3 PROJECT DESCRIPTION: The project site is located at the end of Seabreeze Road within the Seabreeze waterfront community, adjacent to the AIWW/Myrtle Grove Sound, in New Hanover County. To locate the project site from the Wilmington Regional Office (WiRO), travel from Wilmington towards Carolina Beach south on College Road (NC Hwy 421) for approximately 12 miles until you reach the stop light just north of the Snow's Cut Bridge. Turn left onto Seabreeze Road and travel east approximately 0.2 miles until the road bends towards the north. The project site is located at the bend of the road on the right hand side. The project site consists of two (2) lots, which are along the waterfront totaling approximately 0.55 acres of land with elevations averaging approximately Tabove normal high water (NHW). There is approximately 100' of shoreline along the project area adjacent to the AIWW/Myrtle Grove Sound, which is stabilized by a timb ently maintains an elevated residential building apparently utilized as bed and breakfast business. Existing high ground vegetation on this tract consists of grasses and hardwoods including Oak. Waterward of the timber bulkhead towards Myrtle Grove Sound is an area of coastal wetlands approximately 20' consisting primarily of Smooth Cordgrass (Spartina altemiflora). The applicant maintains an existing access pier, which measures approximately 155' in length by 6' in width, which terminates into a fixed uncovered platform, measuring approximately 20' in length by 15' in width. There are four (4) fender pilings along the southern side of the existing platform. The existing facility was authorized under State Permit No. 3-04 issued on January 5, 2004. Water depths at the end of the existing structure are approximately -2' @ normal low water (NLW). State Permit No. 3-04 authorized two (2) finger piers and two (2) boatlifts on each side of the landward side of the existing platform, which authorized a total of four (4) formalized slips at this location; however, the construction of these structures were not completed. State Permit No. 3-04 was modified on November 5, 2004, which authorized the exiting residential building, aforementioned. State Permit No. 3-04 expired on December 31, 2007 (See Sheet 3 of 3 and Project Narrative). The Wilmington -New Hanover County 2006 Land Use Plan Update classifies adjacent waters as Conservation, and the adjacent high ground portion of the project area as Resource Protection. The waters of the AIWW/Myrtle Grove Sound are classified SA by the Division of Water Quality. They ARE designated as a Primary Nursery Area by the N.C. PROJECT DESCRIPTION: The project site is located at the end of Seabreeze Road within the Seabreeze waterfront community, adjacent to the AIWW/Myrtle Grove Sound, in New Hanover County. To locate the project site from the Wilmington Regional Office (WiRO), travel from Wilmington towards Carolina Beach south on College Road (NC Hwy 421) for approximately 12 miles until you reach the stop light just north of the Snow's Cut Bridge. Turn left onto Seabreeze Road and travel east approximately 0.2 miles until the road bends towards the north. The project site is located at the bend of the road on the right hand side. The project site consists of two (2) lots, which are along the waterfront totaling approximately 0.55 acres of land with elevations averaging approximately 7'above normal high water (NHW). There is approximately 100' of shoreline along the project area adjacent to the AIWW/Myrtle Grove Sound, which is stabilized by a timber bulkhead. The applicant currently maintains an elevated residential building apparently utilized as a bed and breakfast business. Existing high ground vegetation on this tract consists of grasses and hardwoods including Oak. Waterward of the timber bulkhead towards Myrtle Grove Sound is an area of coastal wetlands, approximately 20' consisting primarily of Smooth Cordgrass (Spartina alterniflora). The applicant maintains an existing access pier, which measures approximately 155' in length by 6' in width, which terminates into a fixed uncovered platform, measuring approximately 20' in length by 15' in width. There are four (4) fender pilings along the southern side of the existing platform. The existing facility was authorized under State Permit No. 3-04 issued on January 5, 2004. Water depths at the end of the existing structure are approximately -2' @ normal low water (NLW). State Permit No. 3-04 authorized two (2) finger piers and two (2) boatlifts on each side of the landward side of the existing platform, which authorized a total of four (4) formalized slips at this location; however, the construction of these structures were not completed. State Permit No. 3-04 was modified on November 5, 2004, which authorized the exiting residential building, aforementioned. State Permit No. 3-04 expired on December 31, 2007 (See Sheet 3 of 3 and Project Narrative). The Wilmington -New Hanover County 2006 Land Use Plan Update classifies adjacent waters as Conservation, and the adjacent high ground portion of the project area as Resource Protection. The waters of the AIWW/Myrtle Grove Sound are classified SA by the Division of Water Quality. They ARE designated as a Primary Nursery Area by the N.C. Division of Marine Fisheries and they are OPEN to the harvest of shellfish. PROPOSED PROJECT: The applicant requests. authorization to expand an existing docking facility within Myrtle Grove Sound. The application states that a new fixed pier would extend from the existing platform a distance of approximately 80' in length by 6' in width. The application also requests to construct the previously authorized finger piers and boatlifts within the originally authorized location. The finger piers would measure approximately 10' in width by 5' in width and the boatlifts would measure approximately 12' in length by. 13' in width each. The application states that the proposed docking facility would accommodate up to six (6) vessels at this location in water ranging from approximately -2' to 4 @ NLW (See Sheets 1 through 3 of 3 and Project Narrative). 10. ANTICIPATED IMPACTS: The proposed structures would incorporate an additional approximately 1,204 sq. ft. of Public Trust Area and Estuarine Waters. The structures would not encroach into the 15' riparian corridor setback requirement of the adjacent riparian properties. Based on the provided drawings, the proposed structures would not encroach into the 80''setback from the AIWW federal channel. Existing Fixed platform = 20' x 15' = 300 sq. ft. Fixed finger piers= 5' x 10'x 2 = 100 sq. ft. Total = 400 sq. ft. It is the staffs recommendation that the proposed docking facility appears to be consistent with the use standards set forth in NCAC 07H .0208(b)(6), including the eight square foot rule and the pier width rule. The proposed pier, finger piers and boatlifts would be located entirely over open water; however the extension appears to be inconsistent with NCAC 07H .0208(b)(6)(G)(iii) (the '% width rule) by approximately 12.5'. If the permit is conditioned that the proposed development would not exceed the '% width rule and determined to be consistent with NCAC 07H .0208(b)(6), this office has no objection to the proposed work, provided it is consistent with all other state and federal permitting requirements. Any permit issued should include the following conditions: This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structures, whether floating or stationary, may become a permanent part of the structure without permit modification. No non -water dependent uses of structures may be conducted on, in, or over public trust waters without permit modification. 2. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 3. The authorized structure and associated activity must not cause an unacceptable interference with navigation and shall not exceed the % width distance rule and the authorized structure and associated activity must not cause an unacceptable interference with navigation and shall not exceed the established pierhead line. 4. The permittee must install and maintain, at his expense, any signal lights and signals prescribed by the U.S. Coast Guard, through regulations or otherwise, on authorized facilities. 5. In order to protect water quality, runoff from the construction must not visibly increase the amount of suspended sediments in adjacent waters. 6. The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the project without having the permit transferred to a third -party. This permit authorizes a maximum of six (6) boat slips. At no time shall more than six (6) vessels be moored or docked at the facility. The restriction of the number of vessels shall apply to all marine vessel types, including but not limited to motorboats, sailing vessels and personal watercraft. 8. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 9. The authorized project is located within a primary nursery area (PNA). Therefore, in accordance with 07H.0208 of the Rules of the Coastal Resources Commission, no new dredging or excavation within the PNA shall be permitted. Dredging in any manner, including "kicking" with boat propellers, is not authorized. NOTE: The permittee is cautioned that this permit does not authorize the placement of tie piles in association with the docking facility. Furthermore, due to the proximity of the AIWW, boats utilizing the docking facility will be subject to frequent wave wash from passing vessels. The issuance of this permit does not relieve the permittee from taking all proper steps to ensure the integrity of the structure and the safety of moored boats. NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed development. You should post this notice at a conspicuous point along your property where it can be observed from a public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-way fronting your property; or at a point along the road right-of-way where a private road would lead one into your property. Failure to post this notice could result in an incomplete application. A field report has been prepared and is in the process of being circulated to the various state and federal review agencies for their comments.
