This permit, issued on .Tune 3.2002 is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Excavation
1) The area proposed to be excavated in the permittee's application is hereby reduced to an area 360' x 60'
which is depicted in the revised workplan drawing dated 3120/96.
2) Finished water depth in the basin will slope from —5' MLW at the north end to -6.5' at the AIWW
connection.
3) In order to protect juvenile shrimp and finfish populations, no excavation or filling will be permitted
between April 1 and September 30 of any year without the prior approval of the Division of Coastal
Management, in consultation with the Division of Marine Fisheries.
(See attached sheets for Additional, Conditions)
This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date. An appeal requires resolution prior to work initiation or
continuance as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2006
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
4) All excavated materials will be confined above mean high water and landward of regularly or irregularly
flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any
marsh or surrounding waters. An inspection of the spoil disposal area by a DCM representative is
required prior to the initiation of dredging.
5) The disposal area effluent will be contained by pipe, trough, or similar device to a point at or beyond the
mean low water level to prevent gully erosion and unnecessary siltation.
6) The ternunal end of the pipeline will be positioned at or greater than 50 feet'from any part of the dike
and a maximum distance from spillways to allow settlement of suspended sediments.
7) A water control structure will be installed at the intake end of the effluent pipe to assure compliance
with water quality standards.
8) The spoil area will be properly graded and provided a ground cover sufficient to restrain erosion within
30 working days of project completion.
9) The permitted activity will be conducted in such a manner as to prevent a significant increase in
turbidity outside of the area of construction or construction -related discharge. Increases such that the
turbidity, in the waterbody is 25 NTU's or less in all saltwater classes are not considered significant.
Maintenance Clause
10) The Division of Coastal Management shall be notified in writing at least two (2) weeks in advance of
any maintenance work authorized by this permit, and such notification shall include:
A. The number of the original permit.
B. A statement that no dimensional changes are proposed.
C. A copy of the original permit plans with cross -hatching indicating the area to be maintained, the
area to be used for spoil disposal, and the estimated amount of material to be removed. The
location, design and holding capacity of the spoil disposal site must be approved by a
representative of the Division prior to the initiation of any maintenance dredging activities.
D. The date of map revision and the permittee's signature shown anew on the original plan.
Marina Operation
11) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
manna facility. Any sewage discharge at the manna facility shall be considered a violation of this
permit for which the pemrittee is responsible. This prohibition shall be applied and enforced throughout
the entire existence of the permitted structure.

12) This permit authorizes only the docks, piers, and other structures and uses located in or over the water
that are expressly and specifically set forth in the permit application. No other structure, whether
floating or stationary, may become a permanent part of this marina facility without permit modification.
No non -water dependent uses of structures may be conducted on, in or over public trust waters without
permit modification.
13) The permittee will maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
14) The permittee must install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities.
15) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee will not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
16) The permittee's scheme of development, of which the authorized work is part, contemplates the
presence of structures and their attendant utilities on lands subject to an easement in favor of the United
States for the operation, maintenance, improvement, and enlargement of the Atlantic Intracoastal
Waterway (AIWW). Accordingly, the permittee will be required to remove such structures and
improvements at his own expense in the event that, in the judgment of the U.S. Army Corps of
Engineers acting on behalf of the United States, the lands are needed at any time for any purpose within
the scope of the easement. Permanent buildings will not be constructed within the easement.
Sedimentation and Erosion Control
NOTE: An Erosion and Sedimentation Control Plan will be required for this project. This plan must be
filed at least thirty (30) days prior to the beginning of any land disturbing activity. Submit this
plan to the Department of Environment and Natural Resources, Land Quality .Section, 127
Cardinal Drive Extension, Wilmington, NC 28405.

Through coordination with the North Carolina Division of Coastal Management, we have
learned of your request to renew and transfer Sandy Tyner's Department of the Army (DA)
permit issued on April 4, 1996, which authorized the excavation of an access channel, boat basin,
replacement of an existing pier and bulkhead, and construct new commercial piers on the
Atlantic Intracoastal Waterway, east of the N.C. Highway 133 Oak Island Bridge, Brunswick
County, North Carolina.
Your proposal continues to be consistent with the provisions and objectives of general
permit No. 198000291. The permit is hereby renewed and transferred. It is understood that all
other conditions of your permit remain applicable and that the expiration date is December 31,
2006.

The enclosed permit constitutes authorization under the Coastal Area Management Act, and where applicable, the
State Dredge and Fill Law, for you to proceed with your project proposal. The original (buff -colored form) is retained by you
and it must be available on site when the project is inspected for compliance. Please sign both the original and the copy and
return the copy to this office in the enclosed envelope. Signing the permit and proceeding means you have waived your right of
appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-121.1 or 113-
229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of Administrative
Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, (919) 733-2698 within twenty (20) days of this decision on
your permit. You should also be aware that if another qualified party submits a valid objection to the issuance of this permit
within twenty (20) days, the matter must be resolved prior to work initiation. The Coastal Resources Commission makes the
final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be carried out
in accordance with your application. Modifications, time extensions, and future maintenance require additional approval.
Please read your permit carefully prior to starting work and review all project plans, as approved. If you are having the work
done by a contractor, it would be to your benefit to be sure that he fully understands all permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we request that you
complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise concerning permit
conditions, environmental safeguards, or problem areas, you may contact Department personnel at any time for assistance. By
working in accordance with the permit, you will be helping to protect our vitally important coastal resources.

The Wilmington Office has received a request to renew and transfer Permit #40-96. A check for $200.00 has been
submitted with the request (copy attached). The last renewal was issued on 1/11/00 and expired on December 31,
2001. We received the initial renewal/transfer request on 12/27/01, but had to request additional information before
processing. To my knowledge no work was done under the last renewal.
The 1996 permit required that an easement from DOA State Property be received prior to construction. Do you have
a copy of that easement in your files?
The applicant is NOT requesting that the bulkhead/dock work be re -authorized. A portion of the bulkhead work
was completed and the dock work was completed. The docks and old bulkhead are in generally poor condition.
Attached are some digital photos made at the site.
I have talked with Fritz Rohde of the Division of Marine Fisheries about the dredging and they have no objection
to the renewal. The spoil disposal area will require work before it can be used. Division personnel will need to make
an inspection of the spoil disposal area prior to them commencing any dredging.
Please renew and transfer the permit with all conditions pertaining to the dredging and include the "maintenance
clause". Although the applicant is requesting a 5-year maintenance clause, I am hereby recommending 2
years or 3 years max. Also, please add a condition or note that the existing dockage must confirm to the approved
permit drawings.

Dear Janet,
The Sandy's Seafood tract has been sold to George E. Saunders. On his behalf, I am
requesting the transfer of Permit # 40-96 to his name. A copy of the deed is enclosed. Mr.
Saunders would also like to renew this permit with a five year maintenance clause added
for future maintenance of the originally permitted 360' x 60' dredging area only. No time
extension is requested for any structures. A permit fee check to NCDENR for $200 is
enclosed to cover both the permit transfer and the renewal.
According to Mr. Adger Wilson (Mr. Saunders' realtor), he had spoken with Bob Stroud
and received his guidance in securing the ability to maintain the dredging area. Please
contact me with any questions that you may have regarding this request. Thank you for

dredging only
Dear Janet,
The Sandy's Seafood tract has been sold to George E. Saunders. On his behalf, I am
requesting the transfer of Permit # 40-96 to his name. A copy of the deed is enclosed. Mr.
Saunders would also like to renew this permit with a five year maintenance clause added
for future maintenance of the originally permitted 360' x 60' dredging area only. No time
extension is requested for any structures. A permit fee check to NCDENR for $200 is
enclosed to cover both the permit transfer and the renewal.
According to Mr. Adger Wilson (Mr. Saunders' realtor), he had spoken with Bob Stroud
and received his guidance in securing the ability to maintain the dredging area. Please
contact me with any questions that you may have regarding this request. Thank you for
your assistance.

(excuse the pun). When we looked at the spoil disposal area it was
overgrown and did not look like it had been used in a few years. I'll let

To answer your question, we do not have a copy of the DOA State Property
Easement in our file, nor do we ever require that the permittee provide
on to us. The original permittee should have a copy in their possession,
or you can contact Wanda King at State Property, (919) 733-4346, for a
copy.
I have a question for you. You said that to your knowledge no work was
done under the last renewal period. Did the permittee, or Mr. Sanders
provide any information that work was done during that period. I need
to know for sure whether any work was done, because if no work was done,
then I will have to deny this request, and Mr. Sanders will need to
apply for a new permit. I would prefer that the permittee provide us
with some type of evidence, either something in writing that details the
work done or photographs of the work done.
