This permit, issued on December 31.2014 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
De subject to rmes, imprisonment or civil action; or may cause the permit to be null and void.
1) Unless specifically altered herein, this minor modification authorizes the placement of sandbags at 2382,
2386, 2390 and 2392 New River Inlet Road, all expressly and specifically set forth in the attached
permit drawing and project narrative.
2) This minor modification shall be attached to the original of Permit No. 92-14, which was issued on
10/24/14, as well as all subsequent amendments, and copies of all documents shall be readily available
on site when Division personnel inspect the project for compliance.
3) All conditions and stipulations of the active permit remain in force under this minor modification unless
specifically altered herein.
(See attached sheet for Additional Conditions)
This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2017
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina Coastal
Management Program.
Signed by the authority of the Secretary of DENR and the
Chairman of the Coastal Resources Commission.

4) In keeping with 15A NCAC 07H.0308(a)(2)(K) of the rules of the Coastal Resources Commission,
the base width of the authorized temporary erosion control structure shall not exceed 20 feet, and the
height shall not exceed six feet.
NOTE: The configuration of the individual sandbags may vary from that shown on the attached
workplan drawings, so long as the dimensions, alignment, and size requirements of
Condition No. 4 of this permit are not exceeded.
5). This permit does not authorize an extension of the geotube permitted by CRC Variance dated
November 26, 2014.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.

The Town of North Topsail Beach has submitted a request to modify CAMA Major Permit No. 92-14. CAMA Major
Permit No. 92-14 was originally issued on October 24, 2014, and later amended by the Coastal Resources Commission on
November 26, 2014. The permit authorized the installation of a 12' (H) x 45' (W) x 1,500' (L) temporary erosion control
structure that extends from Topsail Reef north to 2382 New River Inlet Road. The permit is scheduled to expire on
December 31, 2017.
The Town's proposal includes installing a 6' (H) x 20' (W) x 275' (L) sandbag revetment, beginning at the northern
terminus of the existing revetment (located at 2382 New River Inlet Road). The proposed temporary erosion control
structure would span north and encompass the wet sand beach from 2382 New River Inlet Road to 2392 New River Inlet
Road (roughly 275 linear feet). As proposed, the sand bag revetment would be placed seaward of the foundation pilings of
the threatened structures, and extend toward the ocean a distance of 20 feet. A 6'(H) x 20'(W) x 50'(L) return would be
installed north of 2392 New River Inlet Road, than would run perpendicular to the shoreline to help stabilize the erosion
escarpment that is affecting this property. The applicant has provided easement agreements from each of the affected
property owners, allowing construction of the proposed structure(s).
Currently, there is accelerated erosion in the subject area and the Town is attempting to mitigate the accelerated erosion
by erecting the temporary erosion control structure, in conjunction with the recently permitted sand bag revetment.
Check # 39043 in the amount of $100.00 has been submitted to cover the request.

Dear Mr. Dail,
This letter is a follow up to our a -mail exchange dated December 4, 2014 regarding the additional placement of sand
bags along 4 properties north of the North Topsail Beach North End Sand Bag Revetment Project permitted under
CAMA Permit 92-14. The Town of North Topsail Beach is seeking a minor permit modification to the above
referenced permit to allow for the construction of a 6' high and 20' wide sand bag revetment north of the project
(Figure 1). The extended revetment would be constructed from the return wall at the north end of the project
currently permitted under CAMA Permit 92-14 and would extend across the seaward edge of the properties at 2382,
2386, 2390, and 2392 New River Inlet Road (Figure 2). A 50' return wall would be constructed perpendicular to the
shoreline along the northwest edge of the residential structure at 2392 New River Inlet Road (Figure 2). The property
at 2382 New River Inlet Road is owned by the Town of North Topsail Beach and includes no residential structures.
The other three properties are privately owned and have residential structures constructed on them.

Town project north of the Topsail Reefs condominiums. Sand bags will be three (3) to five (5) feet wide and seven to
15 feet long when measured flat. Sand will be backfilled behind the structure to stabilize the back side of the
revetment. Sand used for the project (both for filling the bags and backfilling) will be of the same general
characteristics as the sand in the area in which the material is to be placed. No temporary containment tubes are
proposed for use to construct this project.

As previously discussed, since there are no residential structures located on the property at 2382 New River Inlet
Road, the Director would have to grant permission to extrapolate the alignment across this undeveloped lot. In your
e-mail dated December 4, 2014 you confirmed that you had discussed this matter with the Director, and he seemed to
be agreeable to granting such permission. Finally, since the Town has existing easements for the properties at 2386,
2390, and 2392 New River Inlet Road, you indicated a request for a modification to the existing Town permit (92-14)
would be considered by the Division as opposed to requiring 4 separate permit applications for the proposed project.
Please accept this letter as the Town's request for modification of LAMA Permit 92-14. It is my understanding that
along with this requested permit modification, which includes the proposed site plan and cross section, the Town of
North Topsail Beach will provide you with the following.

The attached easement should have been attached to the first e-mail I sent on Tuesday. Not sure what happened. We
talked things over with the Town this morning and they have asked us to adjust the design so that there are no bags
placed on the property at 2389 and that the extension terminate on the property at 2392 NRIR. Does this make sense?

Thanks. Again, please note that I do not have a copy of the easement for 2392 NRIR (Graziosi). The information I
gathered for this determination was provided by Onslow Co. GIS. If I am missing something here, please let me know.
Otherwise, I will need easements or some other type of legally binding agreement between the Town and these
property owners.
BTW, I will be out of the office next week so if things do not come together before noon on Friday, I suggest you keep
going through Debra Wilson.

Attached is a revised figure 2 (Plan View) showing the plan view with property boundaries superimposed. As you can
see, the current design does in fact cut onto the property at 2389 New River Inlet Road. We will discuss with the Town
whether they wish to revise the design or seek an easement from the property owner at 2389 New River Inlet Road. I'll
get back to you later today.

Ken, to follow up on my previous email, I do not see anywhere in the attachment an easement for 2389 New River Inlet
Road (Gene Falco) nor 2392 New River Inlet Road (Gene Graziosi). The northern return on the proposed revetment
appears to cut back between the two properties and without a consent agreement from the homeowners, the temp.
erosion control structure will need to terminate along the northern side of 2390 New River Inlet Road. Please advise, or
get me this information as soon as possible.

applicable, the State Dredge and Fill Law, for you to proceed with your project proposal. The original (buff -
colored form) is retained by you and it must be available on site when the project is inspected for
compliance. Please sign both the original and the copy and return the copy to this office in the enclosed
envelope. Signing the permit and proceeding means you have waived your right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS
113A-121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B
with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, (919) 733-
2698 within twenty (20) days of this decision on your permit. You should also be aware that another
qualified party may submit an objection to the issuance of this permit within twenty (20) days.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work
must be carried out in accordance with your application. Modifications, time extensions, and future
maintenance requires additional approval. Please read your permit carefully prior to starting work and review
all project plans, as approved. If you are having the work done by a contractor, it would be to your benefit to
be sure that he fully understands all permit requirements.

The Town of North Topsail Beach is currently installing a sand bag revetment along approximately 1,450
feet of shoreline north of the Topsail Reef Condominiums. Given continued erosion north of the project
area, the Town is applying for permits to extend a sand bag revetment across the Town owned property
located at 2382 New River Inlet Road as well as along the seaward edge of the residential structures
located at 2386, 2390, and 2392 New River Inlet Road. The proposed revetment would be 6' high and
20' wide. The extended revetment would be constructed from the return wall at the north end of the
project currently permitted under CAMA Permit 92-14 and would extend across the seaward edge of the
properties at 2382, 2386, 2390, and 2392 New River Inlet Road. A 50' return wall would be constructed
perpendicular to the shoreline along the northwest edge of the residential structure at 2392 New River
Inlet Road.
Sand bags used to construct the revetment will be made of the same material currently being used to
construct the Town project north of the Topsail Reefs condominiums. Sand bags will be three (3) to five
(5) feet wide and seven to 15 feet long when measured flat. Sand will be backfilled behind the structure
to stabilize the back side of the revetment. Sand used for the project (both for filling the bags and
backfilling) will be of the same general characteristics as the sand in the area in which the material is to
be placed. No temporary containment tubes are proposed for use to construct this project.
This letter is in response to CAMA permit application requirements to notify adjacent property owners of
the intended action. Adjacent property owners have the right to protest the application.
