Any violation of these terms may be subject to a fine, imprisonment or civil action; or may cause the permit to be null and void. Bulkhead Construction 1) The proposed bulkhead shall not exceed an average of two (2) feet waterward of the normal water level contour at any point along its alignment at the time of construction. In no case shall the bulkhead be positioned greater than five (5) feet waterward of the normal water level contour at the time of construction. This condition shall not apply to the proposed filling of the 60' x 67' area at the upper end of the existing basin located east of the high ground peninsula. 2) The alignment of the proposed bulkhead must be staked by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of construction. Failure to initiate construction within 30 days, or erosion of the shoreline by adverse weather conditions, will require the alignment to be restaked by DCM within a maximum of 30 days prior to the new expected start of construction. (See attached sheet for Additional This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit expires on December 31,1999 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Permit#130-96 Page 2 of 2 4) The bulkhead must be structurally tight so as to prevent seepage of backfill materials through the structure. 5) The fill material will be clean and free of any pollutants except in trace quantities. Metal products, organic materials, or unsightly debris will not be used. 6) All fill material to be placed below normal water level will be confined behind the permitted bulkhead. Excavation and Spoil Disposal 7) Excavation will not exceed 7 feet below the normal water level. 8) All excavated materials will be confined above mean high water and landward of regularly or irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surrounding waters. General 9) The temporary placement or double handling of excavated or fill material within waters or vegetated wetlands is not authorized. 10) The authorized structure and associated activity shall not cause an unacceptable interference with navigation. 11) The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction -related discharge. Increases such that the turbidity is NTU's or less in all saltwater classes are not considered significant. NOTE: The N.C. Division of Water Quality has authorized the proposed project under General Water Quality Certification No. 3025 (DWQ Project No. 960660), which was issued on 8/8/96. (Refer to Coastal Resources Commission Rule 7J.0203 for a detailed description.) Please note that original drawings are preferred and only high quality copies will be accepted. Blue -line prints or other larger plats are acceptable only if an adequate number of quality copies are provided by applicant. (Contact the U.S. Army Corps of Engineers regarding that agency's use of larger drawings.) The site is located on the Trent River between the Ramada Inn and the Railroad Trestle, near the City of New Bern in Craven County. With this application, the applicant is proposing to construct a bulkhead, to fill in a portion of an existing basin, to excavate a barge basin and construct a load -out bridge. Areas of Environmental Concern (AECs) impacted by this proposal include Estuarine Waters, Public Trust Areas and the Estuarine Shoreline. A fringe of 1404' wetlands is also located on the property. Waters at the site are classified as SE and are closed to the harvesting of shellfish. The area is not a Primary Nursery Area. I have reviewed this proposal for the consistency with the recently certified 1996 Craven County Land Use Plan (LUP) Update and offer the following comments. The general area of the project is classified as Developed, while the ABCs impacted by the proposal are classified as Conservation. Throughout the LUP, Craven County states support for state and federal permitting requirements for development in AECs and '404' wetlands. Specific applicable policies include Resource Production and Management Policies for Marine Resource Areas (Page IV-S). These policies state Craven County's support for the 7H Use Standards for estuarine and public trust areas. Resource Protection Policies regarding Soils (Pages IV-2 and IV-3) support the U.S. Army Corps of Engineers in the regulation and enforcement of the '404, wetlands permitting process. Craven County will co-operate but does not support or impose any additional local wetlands regulations. Bulkhead Policies are found on Page IV-6 of the LUP and state the County's support for bulkheads which satisfy the 7H Use Standards. Economic and Community Development Polices for Transportation state the County's support for the Neuse River Bridge replacement project. Elsewhere in the Plan, the discussion of public facilities development needs and land use issues notes that transportation improvements, such as the Neuse River Bridge replacement are essential to Craven County's continued growth and economic development. The policy section of the LUP also states support for state and federal programs which provide improvements to the County, including the North Carolina Department of Transportation road and bridge improvement programs. The applicant, Shipyard Properties, proposes to excavate and fill open water habitat and wetlands of the Neuse River, Craven County, North Carolina, to facilitate construction of a barge dock. The proposed project consists of the construction of 800 feet of shoreline bulkhead aligned up to 12 feet waterward of the existing upland. The bulkhead construction will isolate a6SO-foot-long by 67-foot-wide portion of an existing boat basin. This area will be filled from an upland source. Also proposed is the construction of a pile supported barge loading facility. In order to provide sufficient water depth in the barge slip, the applicant proposes to dredge a 60-foot-wide by 160-foot-long area to a depth of 8 feet normal water level. All dredged material would be deposited on adjacent high ground. Based on our knowledge of the project area, which included a previous on -site inspection and the historical use of the site as a shipyard, we do not object to most of the proposed work. However, we are concerned that the proposed bulkhead alignment does not minimize open water habitat losses. The project area is a part of the Neuse River estuarine system which provides habitat for a variety of commercially, recreationally, and ecologically important fishery resources including spot (Leiostomus xanthurus), flounders (Paralichthvs spp.), Atlantic menhaden (Brevoortia tvrannus), striped mullet (Mugil ceohalus), blueback herring (Alosa aestivalis), and blue crab (Callinectes sapidus). These fishery resources utilize the shallow waters along the project's shoreline as forage habitat. The proposed bulkhead alignment will result in the conversion of 0.24 acre of this habitat to high ground. Although the loss of habitat associated with this work is small, the cumulative loss of shallow water areas from many bulkhead construction projects is not in the best interest of fishery resources. Accordingly, we believe that the bulkhead should be realigned to minimize fishery habitat loss. In view of the above, we recommend that federal authorization of this project not be granted unless the following condition is incorporated into the project plans: "The bulkhead shall be realigned so that it extends no further than two feet waterward of the existing shoreline." The applicant (Shipyard Properties in association with Traylor Brothers, Incorporated) proposes to rehabilitate a bulkhead around a peninsula (historical fastland created by filling shallows where the Trent and Neuse Rivers join), and to construct a load -out bridge. The applicant proposes to place the rehabilitated bulkhead in a location which is an average of twelve feet waterward of the Normal Water Level (NWL) around the area called "the peninsula of highground,'t and, an average of two feet waterward of the NWL (defined by an existing bulkhead) in an area along the Trent River. Some dredging would also be required to facilitate barge access to the rehabilitated bulkheads. The site is currently being used as a staging area for the Neuse River Bridge Project. This is the report of the Service submitted pursuant to, and in accordance with, provisions of the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.) and the Endangered Species Act of 1973 (87 Stat. 884, as amended; 16 U.S.C. 1531 et seq.). The Service recommends the District Engineer seek modification of this permit application such that all proposed activities occur landward of the NWL. It is our opinion that the proposed activities would impose avoidable adverse impacts on fish and wildlife resources and are inconsistent with Federal policy (i.e., the proposed activities represent a net loss of aquatic hnEVENT and the activities are only a small subset of historical, cand future impacts on the nearshore environment). E1vED ASTAi996co The shoreline was historically altered to provide the artificial upland attributes which the applicant seeks to restore. The filling activities which created the subject peninsula eliminated aquatic habitat from the adjacent rivers. In addition to the peninsula, historic activities have resulted in the alteration of significant wetland acreage in the immediate vicinity. These anthropogenic alterations of estuarine, riverine, wetland, and riparian habitats require maintenance on a continuous basis, and extensive rehabilitation such as the proposed activities on occasion. Therefore, the subject proposal is an integral component of spatially and temporally continuous (i.e., cumulative) adverse impacts to fish and wildlife resources in the Trent/Neuse River ecosystem. The Service believes that areas where the artificial shoreline has retreated landward are, in effect, reclaimed aquatic habitat. For the purposes of assessing potential impacts of the proposed activities on fish and wildlife resources, the current shoreline (or alternately, the shoreline boundaries prior to the original alterations) should be considered the baseline condition. To minimize adverse impacts, the proposed rehabilitated bulkhead should be constructed landward of the NWL. We believe this modification will protect fish and wildlife resources and allow the applicant to use the existing fastland for the purposes outlined in the application.
