Bayside Dr., near Chocowinity off State Rd. 1182 , as requested in the permittee's application dated 5/14/14 mm-1 and w-21 and 4/29/14 (MP-4), including the attached workplan drawings (12),9 dated 4/27/14, 1 dated 3/31/14, 1 dated 5/14/14, and 1 dated 5/12/14. This permit, issued on July 28, 2014 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Dockine Facility 1) Unless specifically altered herein, this permit authorizes the additional boathouse with associated catwalk and additional personal water craft lifts, as :well as the associated uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, may become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures may be conducted on, in or over public trust waters without permit modification. *." RECE ED (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2017 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. RM Permittee Edwin Causey Permit 9 66-14 Page 2 of 3 Y` F ADDITIONAL CONDITIONS 2) ouse shall not be completely enclosed or have side coverage more than one half the height of the side, from the roof waterward. 3) The authorized boathouse shall be single story, and shall not be designed to allow for second story use. 4) The authorized structure shall not extend more than '/4 of the width of the waterbody, as measured from the waterward edge of the bulkhead on both sides of the water body immediately in front of the project site. 5) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 6) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 7) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 8) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 9) This permit authorizes a maximum of six formalized boat slips at the authorized facility. Boat Ramp 10) Unless specifically altered herein, this permit authorizes the construction of the new boat ramp as indicated on the attached workplan drawings. 11) The boat ramp shall either be poured at an upland location and pushed into place once hardened, or poured entirely within a watertight containment structure. Live concrete shall not be allowed to contact waters of the State or waters that will enter waters of the State. Shoreline Stabilization 12) The authorized replacement bulkhead shall adhere to the alignment depicted on the attached workplan drawings. 13) The alignment of the permitted bulkhead shall be staked by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of any construction. 14) The bulkhead shall be structurallytight so as to prevent seepage of backfill materials through the structure. Edwin Causey Permit # 66-14 Page 3 of 3 ADDITIONAL CONDITIONS 15) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal sheet piles or other suitable materials approved by department personnel. 16) All backfill material shall be clean and free of any pollutants except in trace quantities. Sedimentation and Erosion Control 17) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 18) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, etc.). At a minimum, a silt fence shall be properly installed immediately landward of the bulkhead cap immediately following completion of backfilling activities. General 19) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. 20) The permittee and/or his contractor shall meet with a representative of the Division prior to project initiation in order to discuss the conditions set forth in this permit. 21) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required, including any Stormwater Permit needed from the Division of Energy, Mineral, and Land Resources, Land Quality Section. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 946-6481 prior to the commencement of any such activity for this determination. The permittee is further advised that many development or land disturbing activities are not allowed within the Environmental Management Commission's Tar Pamlico River Buffer. Contact a representative of the Division of Water Resources at (252) 946-6481 for more information concerning allowable uses within the Tar Pamlico Buffer. Skvada, III Secretary The project site is located off SR 1182 at 57 West Bayside Drive in the Bayside Shores Subdivision on Chocownity Bay near the Town of Chocowinity in Beaufort County, North Carolina. The Bayside Shores Subdivision is an existing development with lots situated with the Pamlico River and/or Chocowinity Bay on one side and a man-made canal system located on the other. The lot is approximately 0.51 acres (22,386 ft) in size and has 98 linear feet of shoreline on Chocowinity Bay and 76 linear feet on a man-made canal. Man-made features on the lot include a single- family residence, impervious driveway, bulkhead on both the Bay and canal shore and an 85' long pier with 16' by 18' platform with two 4 piling wet slips in the Bay. The only man-made feature on the canal side is a bulkhead. The lot is approximately 3.0' in elevation above the normal water level. The water depth in the man-made canal ranges from -3.5' adjacent to the bulkhead to -4.5' in the center of the canal. The canal measures approximately 117' in width. The lot is mostly vegetated with lawn grasses and ornamental shrubs. Both the downstream and upstream properties are developed with single family dwellings. Both adjacent properties are bulkhead on the canal side and Bay side. The downstream property does have a boathouse located in the man-made canal. Both the downstream and upstream properties have a pier in Chocowinity Bay. Chocowinity Bay is classified as SB NSW by the Environmental Management Commission at the project site. The Wildlife Resource Commission classifies Chocowinity Bay as inland fishing waters. Project description The applicant proposes to construct a boathouse in the canal in the shape of an' L". The short dimension of the L will be 14' by 14' with two - 3' by 8' catwalks located under the roof to accommodate two personal water craft while the longer dimension of the L-shaped boathouse will be 12' by 24'. The boathouse roof will cover approximately 484 ft2 as measured from the dripline. A 6' wide by 24' long pier is also proposed to bisect the boathouse. Additionally, a 3' by 24' catwalk is proposed alongside the upstream side of the proposed boathouse. The applicant proposes to replace the bulkhead along both the Canal and Bay shoreline. The replacement bulkhead in the canal will be placed 1' waterward of the existing bulkhead. The replacement bulkhead along the Bay shoreline will be 1.7' waterward of the existing bulkhead. . A 14' by 20' boatramp is proposed in the canal on the upstream side of the property. Two uncovered PWC lifts are also proposed on the existing pier located in Chocowinity Bay. Anticipated impacts The project will result in localized turbidity as a result of the installation of the boathouse pilings and bulkhead installation. The proposed boathouse and catwalk will result in the shading of 556 ftz of canal bottom. The construction of the boathouse is of similar design as existing boathouses in the man-made canal system and will not cause interruption of existing navigation. The total number of slips for this property will be six. Approximately 272 fto of Public Trust Area will be filled in conjunction with the bulkhead replacement. Causey for the construction of a 484 ft2 boathouse in a man-made with 2 boatlifts to accommodate a boat and 2 personal watercraft (PWC), bulkhead replacement, boat ramp, and installation of 2 PWC lifts on an existing pier located off SR 1182 at 57 West Bayside Drive in the Bayside Shores Subdivision on the Pamlico River near the Town of Chocowinity in Beaufort County, North Carolina Staff has reviewed the proposed project with regard to rules found in Subchapter 7H concerning development in a Public Trust Area. It is staffs recommendation that the proposed project appears consistent with 15A NCAC 07H .0208 as described below. This office feels the development is consistent with 15A NCAC 07H .0208(b)(6)(B) which states in part that "The total square footage of shaded impact for docks and mooring facilities (excluding the pier) allowed shall be 8 square feet per linear foot of shoreline with a maximum of 2,000 square feet." The applicant has 76 linear feet of shoreline on the canal which provides a maximum shaded impact of 608 W. The applicant is proposing 556 ft2 of shaded impact The applicant states that the large boathouse (>400 ft2) is needed to accommodate a boat as well as 2 PWCs. The construction of the boathouse is of similar design in the man- made canal system and will not cause mtemiption of existing navigation. Additionally, this office feels the development is consistent with 15A NCAC 07H .0208(b)(6)(Gxiii) which states in part "Pier and docking facility length shall be limited by not extending more than one-fourth the width of a natural water body, or humanmade canal or basin". While the bulkhead replacement will encroach into the canal F the boathouse encroachment into the canal is 24'. The total length of the structure with bulkhead replacement will be 25'. Although the plat indicates a canal width of 110' to 114' the on -site field visit indicated a width of 117' as measured from the bulkhead to the face of Coastal Wetlands on the opposite side of the canal. We are planning on replacing the rotten wood bulkheads with new vinyl seawalls. Also, we are planning on installing a boat ramp on the left side of the property. (Canal side) This project is located on Edwin Causey's property. The walkway will be around the new boatlift will be installed by using a hydraulic excavator. Walkway will be 3ft wide by 24ft long around the east side. There are two walkways around the jet -ski lift, 3ft wide by Sft long. We are planning on having an entrance walkway of 6ft wide by 27ft long. The total square footage of the boathouse is approximately totaling 600 square foot. The pilings for the boat house will be pile driven into the ground by a hydraulic excavator. The pilings will be no higher than twelve feet above normal tide. The boat lift will have top over it. It is now called a boat house. This is for boat house overhang. The total boathouse dimensions will be 20' wide by 30' long. The boat house roof will be no greater than a five/twelve pitch. The roof height may not be any higher than 5' above the boat lift. The boathouse will be on the canal side extending out a total amount of thirty feet from shore. The boat house will need to be larger than the 400 sq ft to keep both the jet skis and boat from the weather. The homeowner would like to install a boat ramp, canal side, on the left side of his property. Bulkheads will be replaced with vinyl seawall on canal and river side. Skvarla, III Secretary The project site is located off SR 1182 at 57 West Bayside Drive in the Bayside Shores Subdivision on Chocowinity Bay near the Town of Chocowinity in Beaufort County, North Carolina. The Bayside Shores Subdivision is an existing development with lots situated with the Pamlico River and/or Chocowinity Bay on one side and a man-made canal system located on the other. The lot is approximately 0.51 acres (22,386 ftz) in size and has 98 linear feet of shoreline on Chocowinity Bay and 76 linear feet on a man-made canal. Man-made features on the lot include a single- family residence, impervious driveway, bulkhead on both the Bay and canal shore and an 85' long pier with 16' by 18' platform with two 4 piling wet slips in the Bay. The only man-made feature on the canal side is a bulkhead. The lot is approximately 3.0' in elevation above the normal water level. The water depth in the man-made canal ranges from -3.5' adjacent to the bulkhead to 4.5' in the center of the canal. The canal measures approximately 117' in width. The lot is mostly vegetated with lawn grasses and ornamental shrubs. Both the downstream and upstream properties are developed with single family dwellings. Both adjacent properties are bulkhead on the canal side and Bay side. The downstream property does have a boathouse located in the man-made canal. Both the downstream and upstream properties have a pier in Chocowinity Bay. Chocowinity Bay is classified as SB NSW by the Environmental Management Commission at the project site. The Wildlife Resource Commission classifies Chocowinity Bay as inland fishing waters. Project description The applicant proposes to construct a boathouse in the canal in the shape of an 'U'. The short dimension of the L will be 14' by 14' with two - 3' by 8' catwalks located under the roof to accommodate two personal water craft while the longer dimension of the L shaped boathouse will be 12' by 24'. The boathouse roof will cover approximately 484 ftz as measured from the dripline. A 6' wide by 24' long pier is also proposed to bisect the boathouse. Additionally, a 3' by 24' catwalk is proposed alongside the upstream side of the proposed boathouse. The applicant proposes to replace the bulkhead along both the Canal and Bay shoreline. The replacement bulkhead in the canal will be placed 1' waterward of the existing bulkhead. The replacement bulkhead along the Bay shoreline will be 1.7' waterward of the existing bulkhead. A 14' by 20' boatramp is proposed in the canal on the upstream side of the property. Two uncovered PWC lifts are also proposed on the existing pier located in Chocowinity Bay. Anticipated impacts The project will result in localized turbidity as a result of the installation of the boathouse pilings and bulkhead installation. The proposed boathouse and catwalk will result in the shading of 556 ft2 of canal bottom. The construction of the boathouse is of similar design as existing boathouses in the man-made canal system and will not cause interruption of existing navigation. This office feels the development is consistent with 15A NCAC 07H .0208(b)(6)(B) which states in part that "The total square footage of shaded impact for docks and mooring facilities (excluding the pier) allowed shall be 8 square feet per linear foot of shoreline with a maximum of 2,000 square feet." The applicant has 76 linear feet of shoreline on the canal which provides a maximum shaded impact of 608 ftz. The applicant is proposing 556 ftz of shaded impact. The applicant states that the large boathouse (>400 ftz) is needed to accommodate a boat as well as 2 PWCs. The construction of the boathouse is of similar design in the man- made canal system and will not cause interruption of existing navigation. Additionally, this office feels the development is consistent with 15A NCAC 07H .0208(b)(6)(G)(iii) which states in part "Pier and docking facility length shall be limited by not extending more than one-fourth the width of a natural water body, or humantrade canal or basin". While the bulkhead replacement will encroach into the canal F the boathouse encroachment into the canal is 241. The total length of the structure with bulkhead replacement will be 25'. Although the plat indicates a canal width of 110' to 114' the on -site field visit indicated a width of 117' as measured from the bulkhead to the face of Coastal Wetlands on the opposite side of the canal. We are planning on replacing the rotten wood bulkheads with new vinyl seawalls. Also, we are planning on installing a boat ramp on the left side of the property. (Canal side) This project is located on Edwin Causey's property. The walkway will be around the new boatlift will be installed by using a hydraulic excavator. Walkway will be aft wide by 24ft long around the east side. There are two walkways around the jet -ski lift, 3ft wide by 811 long. We are planning on having an entrance walkway of 6ft wide by 27ft long. The total square footage of the boathouse is approximately totaling 600 square foot. The pilings for the boat house will be pile driven into the ground by a hydraulic excavator. The pilings will be no higher than twelve feet above normal tide. The boat lift will have top over it. It is now called a boat house. This is for boat house overhang. The total boathouse dimensions will be 20' wide by 30' long. The boat house roof will be no greater than a five/twelve pitch. The roof height may not be any higher than 5' above the boat lift.
