with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may

Docking Facility
1) Unless specifically altered herein, this permit authorizes the docks, piers and other structures and
uses that are expressly and specifically set forth in the attached permit application and workplan
drawings. No other structure, whether floating or stationary, shall become a permanent part of this
docking facility without permit modification. No non -water dependent uses of structures shall be
conducted on, in or over public trust waters without permit modification.
2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
docking facility. Any sewage discharge at the docking facility shall be considered a violation of this
permit for which the permittee is responsible. This prohibition shall be applied and enforced
throughout the entire existence of the permitted structure.

ADDITIONAL CONDITIONS
No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to -the structure in order to make it more visible during hours of darkness or
inclement weather.
This permit authorizes (1) one boatslip in association with this docking facility.
Excavation
No excavation shall take place outside the area indicated on the attached workplan drawings.
Excavation shall not exceed -2.8 feet below the normal low, water level. In no case shall the depth of
excavation exceed the depth of the connecting waters. .
The temporary placement of double handling of excavated materials within waters or vegetated wetlands
is not authorized.
No excavation shall take place within 10' of any Coastal Wetlands.
Spoil Disposal
All excavated materials shall be confined above normal high water level and landward of regularly or
irregularly flooded wetlands behind adequate dikes or other retaining structures to prevent spillover of
solids into any wetlands or surrounding waters.
The spoil area shall be inspected and approved by the Division of Coastal Management prior to the
initiation of any dredge activities.

ADDITIONAL CONDITIONS
Sedimentation and Erosion Control
Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence,
diversion swales or berms, etc.).
In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.

Maintenance Clause
The Division of Coastal Management will be notified in writing at least two (2) weeks in advance of any
maintenance excavation work authorized by this permit and that notification include:
a. The number of the original permit
b. A statement that no dimensional changes are proposed
c: A copy of the original permit plan(s) with cross -hatching indicating the area to be maintained
and the area to be used for dredge spoil, and the estimated amount of material to be removed.
d. The date of plan revision and the permittee's signature shown anew on the original plan
General
The permittee understands and agrees that, if future operations by the United States requires the
removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause
unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon
due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions
caused thereby, without expense to the United States or the state of North Carolina. No claim shall be
made against the United States or the state of North Carolina on account of any such removal or
alteration.
No vegetated wetlands shall be excavated or filled, even temporarily, without permit modification.

`20) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.

such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high water level.

The dilapidated dock, which existed prior to May 1982, was removed for maintenance, however
too much was removed and the new dock must now conform to the current rules. The proposal meets
the criteria found within the letter provided by Ted Tyndall of the NC Division of Coastal Management,
dated May 3, 2013. The dock and boat lift proposed are to serve the same or similar purpose as the
original dock.
The original irregular dock had approximately 266sf of decking over water and encroached the
northern 15' setback by 3.5'. The proposal for the rebuild consists of two platforms with an
interconnecting dock. The irregular platforms are #1-10'x7'x12'x8.46' and #2 5.2'x5.6'x10'x10.4'. The
proposed dock measures 5.2'x15' and boat lift is 12'x13'. The location of the dock is proposed mostly
over high ground with only 85 square feet of decking over water. There is also a 1x stringer proposed
from the southern portion of the dock to the corner of the boat lift to lay a 1x12" board during times of
maintenance to the lift.
The owner is also proposing to dredge the canal around his proposed dock and boat lift. The
dredging depth is proposed at -2.8' NHW which is consistent with connecting water depths. The
excavation is approximately 36 cubic yards and is proposed as being disposed of by the dredging
contractor.

The existing dilapidated dock was removed for maintenance, however too much was removed and must now conform
to the current rules. The original irregular dock had approximately 266sf of decking over water and encroached
the northern 15' setback by 3.5'. The proposal for the rebuild consists of two platforms with an interconnecting dock.
The irregular platforms are #1-10'x7'x12'x8.46' and #2-5.2'x5.6'x10'x10.4'. The dock measures at 5.2'x15'. The location
of the dock is proposed mostly over high ground with only 85sf of decking over water, There is also a 1x stringer
proposed from the southern portion of the dock to the corner of the boat lift to lay a 1x12" board during times of
maintenance to the lift

issuance of this permit within twenty (20) days, the matter must be resolved prior to work initiation. The Coastal
Resources Commission makes the final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be carried
out in accordance with your application. Modifications, time extensions, and future maintenance requires additional
approval. Please read your permit carefully prior to starting work and review all project plans, as approved. If you are
having the work done by a contractor, it would be to your benefit to be sure that he fully understands all permit
requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we request that you

Atlantic Beach, Carteret County
The following is my assessment and consequent recommendations of the above referenced
proposal:
There are currently remnants of a non conforming I -slip docking facility along the shoreline of the
manmade canal along this property. The docking facility was built prior to May 1982 before the
effective date of 15A NCAC 07H.1205 (effective March, 1 1984) of the rule(s) in which it is
inconsistent. The proposal meets 15 A NCAC 0710211 (1-4) as it currently is proposed. Due to a
miscommunication and error on the dock removal, the applicant is proposing the current proposal
per the May 3, 2013 letter written by the Division of Coastal Managements former Assistant
Director Mr. Ted Tyndall. The applicant is proposing the reconfiguration of the old dock (reducing
the dimensions), the placement of a boatlift within the riparian area and maintenance excavation.
There would be one slip along this parcel. The side -too pier (including platforms) and finger pier
(stringer) would extend a maximum of 6' to 12', depending on location, waterward of the existing
bulkhead with the outer portion of the boatlift a maximum of 17'. The development conforms to
the guidelines set forth under 15A NCAC 07H .0208 and 15 A NCAC 0710211 (1-4). Assuming
that state and federal agencies concur with the proposal, the District recommends the project be
authorized as proposed, contingent upon the following conditions:
• The total number of slips shall not exceed a maximum of 1.
• All parts of the docking facility shall remain within the footprint which existed and was described
per the letter by the former Assistant Director Mr. Ted Tyndall dated May 3, 2013.
• The placement of the docking facility shall remain completely within the riparian area as shown
on plats dated received February 20, 2014 and March 6, 2014.
• Recommend an "As- Built" survey as a condition once the docking facility is complete.

PROJECT SUMMARY:
The project proposed is for the reconfiguration of the existing one -slip dock, the addition
of a boatlift and maintenance excavation.
9. Narrative Description
The John Cannon project is located on the west side of the terminus of an existing
manmade canal that is continuous to Bogue Sound at 102 Bayview Blvd. in Atlantic
Beach. The project area is found by turning off of Highway 70 East in Morehead City
(Arendell Street) onto the on -ramp for Atlantic Beach. Follow the Atlantic Beach
Causeway to the four-way stop light intersection then turn left onto East Fort Macon Road
and left onto Bayview Blvd. The site is the first house on the right (approximately 50 from
the beginning of the road).
The property is .12 acres (5123.73 sf) in its entirety and is 2' above NHW/MHW. The
shoreline length for this property is 50'. The site currently has an existing single family
residence, driveway, bulkhead and a permanent one -slip dock. The high ground portion of
the tract is covered with typical yard grasses and landscape shrubbery. The proposed
development is a private project and currently has one existing slip. The docking facility
has been in place since before 1982 according to the 8/7/95 survey by Donald C.
Clemments Jr. More than 50% of the dock was removed inadvertently by a marine
contractor as observed by DCM staff on 5/1/13 however since the dock existed prior to
May of 1982, The Division of Coastal Management determined it would meet the
nonconforming requirements of 15A NCAC 07J.0211 and therefore may be replaced as
long as they followed the following guidelines;
A non -conforming structure is any structure within an AEC other than Ocean Hazard and
Inlet Hazard AECs that is inconsistent with current CRC rules, and, was built prior to the
effective date(s) of the rule(s) with which it is.inconsistent.
Replacement of such structures shall be allowed when all of the following criteria are met:
(1) the structure will not be enlarged beyond its original dimensions;
(2) the structure will serve the same or similar use;
(3) there are no practical alternatives for replacing the structure to provide the same or
similar benefits in compliance with current rules; and
(4) the structure will be rebuilt so as to comply with current rules to the maximum extent
possible.
There are developed residential properties to the north and a commercial property to the
south of the site. The Town of Atlantic Beach's Land Use Plan classifies this property as

Single Family Residential with all parts of the AEC classified Conservation. The manmade
canal connecting to Bogue Sound, which is coastal waters, is not designated as Primary
Nursery Area and is closed to the taking of shellfish. The canal within this area carries a
water classification of SA/HQW and has an average width of 73.5' within the project area.
The water depths within the project area range from -.9'to -2.2' nlw/mlw and have been
field verified. The tidal amplitude within this area is approximately 2.5'. The lines of
division of the areas for riparian access are wedged or pie -shaped, because of the location
of the properties in the terminus of the canal. There were no shellfish beds or SAV
observed within the project area. The substrate in the project area is mostly mud (silt).
There are coastal wetlands to the south of the project area but would not be impacted by
the proposal.
10. Project Description:
The previously existing development is private and with has one existing docking space
and is located at the southern terminus of a manmade canal. The existing dock has been in
place since before May of 1982 according to the 8/7/95 Clemments survey. The applicant
previously hired a contractor for the repair of the existing dock; however, on 5/1/13 DCM
staff observed more than 50% of the structural framing members were removed. DCM was
concluded a general permit could not be issued at that time due to the fact the proposal
would encroach into the adjacent riparian access areas which is inconsistent with 15A
NCAC 07H.1205 (effective Marchl, 1984). The Division of Coastal Management
determined the proposal would meet the requirements for non -conforming development
(15A NCAC 07J.0211). A May 3, 2013 letter from DCM was sent to the applicants
explaining the criteria to replace the structure. The current proposal would meet 15A
NCAC 0710211 (1-5). The proposal would not be enlarged beyond the original
dimensions of the structure as described in the 8/7/1995 survey by Donald C. Clemments
Jr.; the proposal would serve the same or similar use for the facility; there are no practical
alternatives for replacing the structure to provide the same or similar benefits in
compliance with the current rules; and the proposed structure would be re -built to comply
with the current rules to the maximum extent possible as depicted in the work plan
submitted to the Division for a permit determination. No additional slips would be added
to the one -slip docking facility.
The applicant is proposing to construct the dock and platforms partially over high ground
and partially over open water in order to accommodate a 20'-25' open runabout type boat.
They are also proposing a 12' x 13' boatlift and maintenance excavation. All portions of
the docking facility would remain within the Cannon riparian area, Due to the non-
conforming designation; a riparian access line waiver would not be required. The water
depth within the proposed boatlift area is an average of -1.3' nlw/mlw. While the 8/7/95
survey depicts an "existing boatlift", there was not a boat lift or apparent support piles in

place at the time of DCM staff visit 5/1/13.
The proposed southern platform (#2 on drawings) would start approximately 3' from the
southern property corner and would be located partially over high ground and partially
over open water. The platform is irregularly shaped and would be a width of 5.6'-10.4' and
a length of 7'-8.46' depending on location. The widest portion of platform #2 would not
exceed a distance of 6' beyond the existing vinyl bulkhead (nhw). The southern platform
would connect to a side -to dock that would also be located 4' over high ground and 1.2'
over open water. The dock would be 5.2' x 15' and would not exceed a distance of 1.2'
beyond the bulkhead (nhw). It would connect to the final irregular shaped platform (#1) to
the north. This platform would be a width of 5.2'-10' and a length of 10'-12' depending on
location. It would not extend more than 7', at its widest point, beyond the existing
bulkhead and would be 15' from the northern riparian access line.
The applicant is also proposing a 12' x 13' boatlift and a 12" x 12.2' "catwalk" (stringer).
The catwalk would extend from the southern platform (#2) and follow along the riparian
access line for 12' were it would intersect the most eastern boatlift piling. The farthest
point for the catwalk would not exceed a distance of 12' from the bulkhead and would stay
within the Cannon riparian access area. The boatlift would be located along the northern
platform (#1) and would be angled in order to stay within the riparian area. The southeast
boatlift piling would not exceed a distance of 12' beyond the bulkhead with the northeast
piling a maximum distance of 17' from the bulkhead into a 73.5' wide canal. The
maximum'/4 distance allowed within this area of the existing canal is 18.4'. All portions of
the dock and boatlift would be a distance of 15' from the northern riparian access line. The
proposal would not be enlarged beyond its original dimensions and would not increase the
number of existing docking spaces.
The applicant is proposing maintenance excavation of the canal along his property. The
existing water depths within this area of the canal are an average of -1.8' nlw. The
connecting water depths are-2.8'nlw.
A total of 36 cubic yards of material would be removed from this portion of the canal with
an excavation area of 25' x 38'. The final depth for the all the excavation areas would be —
2.8' feet below NHW. The excavation would be done by bucket to barge and taken offsite
to a pre -approved spoil location.
Anticipated Impacts:
The proposed excavation would increase turbidity temporarily and cause 950 square feet

of disturbance to shallow bottom habitat. The proposed boatlift, catwalk, dock and
platforms would shade 315 ft2 and incorporate 561 ft2 of open water. The increase in
suspended sediment and turbidity levels from the pier placement would be temporary, and
occur while the dock is constructed. All work proposed would be a maximum of 17' water
ward of the bulkhead in a water body with a width of 73.5'. The maximum'/4 distance
allowed within this area of the existing canal is 18.4'. There would be no increase in the
number of slips or docking spaces. Due to the non -conforming status of the docking
facility, a waiver for the encroachment of the 15' riparian access line would not be
required. The coastal wetlands to the south of the project area would not be impacted. The
proposal would be within its original dimensions, or less than, as depicted in the 8/7/98
Clemments survey.

The dilapidated dock, which existed prior to May 1982, was removed for maintenance, however
too much was removed and the new dock must now conform to the current rules. The proposal meets
the criteria found within the letter provided by Ted Tyndall of the NC Division of Coastal Management,
dated May 3, 2013. The dock and boat lift proposed are to serve the same or similar purpose as the
original dock.
The original irregular dock had approximately 266sf of decking over water and encroached the
northern 15' setback by 3.5'. The proposal for the rebuild consists of two platforms with an
interconnecting dock. The irregular platforms are #1-10'x7'x12'x8.46' and #2 5.2'x5.6'x10'x10W. The
proposed dock measures 5.2'x15' and boat lift is 12'x13'. The location of the dock is proposed mostly,
over high ground with only 85 square feet of decking over water. There is also a 1x stringer proposed
from the southern portion of the dock to the corner of the boat lift to lay a 1x12" board during times of
maintenance to the lift.
The owner is also proposing to dredge the canal around his proposed dock and boat lift.
dredging depth is proposed at -2.8' NHW which is consistent with connecting water depths. The
excavation is approximately 36 cubic yards and is proposed as being disposed of by the dredging
contractor.

The existing dilapidated dock was removed for maintenance, however too much was removed and must now conform
to the current rules. The original irregular dock had approximately 266sf of decking over water and encroached
the northern 15' setback by 3 5'. The proposal for the rebuild consists of two platforms with an interconnecting dock.
The irregular platforms are #1-10'x7'x12'x8 46' and #2-5 2'x5 6'x10'x10 4' The dock measures at 5.2'x15'. The location
of the dock is proposed mostly over high ground with only 85sf of decking over water. There is also a 1 x stringer
proposed from the southern portion of the dock to the corner of the boat lift to lay a 1x12" board during times of
maintenance to the lift.

Subject: Major Permit Application, requested by John Cannon, to reconfigure an existing one slip
dock, add a boatlift, and perform maintenance excavation on property located at 102
Bayview Blvd„ adjacent to a manmade canal connecting to Bogue Sound, Atlantic
Beach, Carteret County, North Carolina.
LUP Consistency Determination: The proposal is Consistent With & Not in Conflict with the
2008 Atlantic Beach Land Use Plan certified by the CRC on July 24, 2008.
Overview:
Areas of Environmental Concern (AEC's) impacted by the proposal include Public Trust Area,
Estuarine Shoreline, and Estuarine Water. The waters at the project site are classified as SA; HQW
and are closed to the harvesting of shellfish. The area is not a Primary Nursery Area.
The Atlantic Beach Future Land Use Map designates the subject property as Residential.
Development within the designated AECs is limited by CAMA regulations and development
guidelines. Applicable or related policy includes the following:
"The Town of Atlantic Beach supports 15.4 NCAC 711for the protection of all AECs. "
(Conservation Policy, P.22, pg. 175)
"The Town of Atlantic Beach supports the construction of all marinas, docks, and piers
which minimize or eliminate adverse effects on coastal wetlands and subaquatic
vegetation and comply with I5A NCAC 7H minimum use standards. Marina development

PROJECT SUMMARY:
The project proposed is for the reconfiguration of the existing one -slip dock, the addition
of a boatlift and maintenance excavation.
9. Narrative Description
The John Cannon project is located on the west side of the terminus of an existing
manmade canal that is continuous to Bogue Sound at 102 Bayview Blvd. in Atlantic
Beach. The project area is found by turning off of Highway 70 East in Morehead City
(Arendell Street) onto the on -ramp for Atlantic Beach. Follow the Atlantic Beach
Causeway to the four-way stop light intersection then turn left onto East Fort Macon Road
and left onto Bayview Blvd. The site is the first house on the right (approximately 50 from
the beginning of the road).
The property is .12 acres (5123.73 sf) in its entirety and is 2' above NHW/MHW. The
shoreline length for this property is 50'. The site currently has an existing single family
residence, driveway, bulkhead and a permanent one -slip dock. The high ground portion of
the tract is covered with typical yard grasses and landscape shrubbery. The proposed
development is a private project and currently has one existing slip. The docking facility
has been in place since before 1982 according to the 8/7/95 survey by Donald C.
Clemments Jr. More than 50% of the dock was removed inadvertently by a marine
contractor as observed by DCM staff on 5/1/13 however since the dock existed prior to
May of 1982, The Division of Coastal Management determined it would meet the
nonconforming requirements of 15A NCAC 07J.0211 and therefore may be replaced as
long as they followed the following guidelines;
A non -conforming structure is any structure within an AEC other than Ocean Hazard and
Inlet Hazard AECs that is inconsistent with current CRC rules, and, was built prior to the
effective date(s) of the rule(s) with which it is.inconsistent.
Replacement of such structures shall be allowed when all of the following criteria are met:
(1) the structure will not be enlarged beyond its original dimensions;
(2) the structure will serve the same or similar use;
(3) there are no practical alternatives for replacing the structure to provide the same or
similar benefits in compliance with current rules; and
(4) the structure will be rebuilt so as to comply with current rules to the maximum extent
possible.
Thereare developed residential properties to the north and a commercial property to the
south. of_the site. The Town of Atlantic Beach's Land Use Plan classifies this property as

Single Family Residential with all parts of the AEC classified Conservation. The manmade
canal connecting to Bogue Sound, which is coastal waters, is not designated as Primary
Nursery Area and is closed to the taking of shellfish. The canal within this area carries a
water classification of SA/HQW and has an average width of 73.5' within the project area.
The water depths within the project area range from -.9'to -2.2' nlw/mlw and have been
field verified. The tidal amplitude within this area is approximately 2.5'. The lines of
division of the areas for riparian access are wedged or pie -shaped, because of the location
of the properties in the terminus of the canal. There were no shellfish beds or SAV
observed within the project area. The substrate in the project area is mostly mud (silt).
There are coastal wetlands to the south of the project area but would not be impacted by
the proposal.
10. Pro!ect Description:
The previously existing development is private and with has one existing docking space
and is located at the southern terminus of a.manmade canal. The existing dock has been in
place since before May of 1982 according to the 8/7/95 Clemments survey. The applicant
previously hired a contractor for the repair of the existing dock; however, on 5/1/13 DCM
staff observed more than 50% of the structural framing members were removed. DCM was
concluded a general permit could not be issued at that time due to the fact the proposal
would encroach into the adjacent riparian access areas which is inconsistent with 15A
NCAC 0711.1205 (effective Marchl, 1984). The Division of Coastal Management
determined the proposal would meet the requirements for non -conforming development
(15A NCAC 07J.0211). A May 3, 2013 letter from DCM was sent to the applicants
explaining the criteria to replace the structure. The current proposal would meet 15A
NCAC 07J.0211 (1-5). The proposal would not be enlarged beyond the original
dimensions of the structure as described in the 8/7/1995 survey by Donald C. Clemments
Jr.; the proposal would serve the same or similar use for the facility; there are no practical
alternatives for replacing the structure to provide the same or similar benefits in
compliance with the current rules; and the proposed structure would be re -built to comply
with the current rules to the maximum extent possible as depicted in the work plan
submitted to the Division for a permit determination. No additional slips would be added
to the one -slip docking facility.
The applicant is proposing to construct the dock and platforms partially over high ground
and partially over open water in order to accommodate a 20'-25' open runabout type boat.
They are also proposing a 12' x 13' boatlift and maintenance excavation. All portions of
the docking facility would remain within the Cannon riparian area, Due to the non-
conforming designation; a riparian access line waiver would not be required. The water
depth within the proposed boatlift area is an average of -1.3' nlw/mlw. While the 8/7/95
survey depicts an "existing boatlift", there was not a boat lift or apparent support piles in

place at the time of DCM staff visit 5/1/13.
The proposed southern platform (#2 on drawings) would start approximately 3' from the
southern property corner and would be located partially over high ground and partially
over open water. The platform is irregularly shaped and would be a width of 5.6'-10.4' and
a length of 7'-8.46' depending on location. The widest portion of platform #2 would not
exceed a distance of 6' beyond the existing vinyl bulkhead (nhw). The southern platform
would connect to aside -to dock that would also be located 4' over high ground and 1.2'
over open water. The dock would be 5.2' x 15' and would not exceed a distance of 1.2'
beyond the bulkhead (nhw). It would connect to the final irregular shaped platform (#1) to
the north. This platform would be a width of 5.2'-10' and a length of 10'-12' depending on
location. It would not extend more than 7', at its widest point, beyond the existing
bulkhead and would be 15' from the northern riparian access line.
The applicant is also proposing a 12' x 13' boatlift and a 12" x 12.2' "catwalk" (stringer).
The catwalk would extend from the southern platform (#2) and follow along the riparian
access line for 12' were it would intersect the most eastern boatlift piling. The farthest
point for the catwalk would not exceed a distance of 12' from the bulkhead and would stay
within the Cannon riparian access area. The boatlift would be located along the northern
platform (#1) and would be angled in order to stay within the riparian area. The southeast
boatlift piling would not exceed a distance of 12' beyond the bulkhead with the northeast
piling a maximum distance of 17' from the bulkhead into a 73.5' wide canal. The
maximum '''A distance allowed within this area of the existing canal is 18.4'. All portions of
the dock and boatlift would be a distance of 15' from the northern riparian access line. The
proposal would not be enlarged beyond its original dimensions and would not increase the
number of existing docking spaces.
The applicant is proposing maintenance excavation of the canal along his property. The
existing water depths within this area of the canal are an average of -1.8' nlw. The
connecting water depths are-2.8'nlw.
A total of 36 cubic yards of material would be removed from this portion of the canal with
an excavation area of 25' x 38'. The final depth for the all the excavation areas would be —
2.8' feet below NHW. The excavation would be done bybucket to barge and taken offsite
to a pre -approved spoil location.
Anticipated Impacts:
The proposed excavation would increase turbidity temporarily and cause 950 square feet

of disturbance to shallow bottom habitat. The proposed boatlift, catwalk, dock and
platforms would shade 315 Wand incorporate 561 ftz of open water. The increase in
suspended sediment and turbidity levels from the pier placement would be temporary, and
occur while the dock is constructed. All work proposed would be a maximum of 17' water
ward of the bulkhead in a water body with a width of 73.5'. The maximum 'Adistance
allowed within this area of the existing canal is 18.4'. There would be no increase in the
number of slips or docking spaces. Due to the non -conforming status of the docking
facility, a waiver for the encroachment of the 15' riparian access line would not be
required. The coastal wetlands to the south of the project area would not be impacted. The
proposal would be within its original dimensions, or less than, as depicted in the 8M98
Clemments survey.

The dilapidated dock, which existed prior to May 1982, was removed for maintenance, however
too much was removed and the new dock must now conform to the current rules. The proposal meets
the criteria found within the letter provided by Ted Tyndall of the NC Division of Coastal Management,
dated May 3, 2013. The dock and boat lift proposed are to serve the same or similar purpose as the
original dock.
The original irregular dock had approximately 266sf of decking over water and encroached the
northern 15' setback by 3.5'. The proposal for the rebuild consists of two platforms with an
interconnecting dock. The irregular platforms are #1-10'x7'x12'x8.46' and #2 5.2'x5.6'x10'x10.4'. The
proposed dock measures 5.2'x15' and boat lift is 12'x13'. The location of the dock is proposed mostly
over high ground with only 85 square feet of decking over water. There is also a 1x stringer proposed
from the southern portion of the dock to the corner of the boat lift to lay a 1x12" board during times of
maintenance to the lift.
The owner is also proposing to dredge the canal around his proposed dock and boat lift. The
dredging depth is proposed at -2.8' NHW which is consistent with connecting water depths. The
excavation is approximately 36 cubic yards and is proposed as being disposed of by the dredging
contractor.

The existing dilapidated dock was removed for maintenance, however too much was removed and must now conform
to the current rules The original irregular dock had approximately 266sf of decking over water and encroached
the northern 15' setback by 3.5'. The proposal for the rebuild consists of two platforms with an interconnecting dock.
The irregular platforms are #1 -10'x7'xl 2'x8.46' and #25 2'x5 6'x10'x10 4' The dock measures at 5.2'x15'. The location
of the dock is proposed mostly over high around with only 85sf of decking over water. There is also a 1 x stringer
proposed from the southern portion of the dock to the corner of the boat lift to lay a 1x12" board during times of
maintenance to the lift

Approval of 401 Water Quality Certification with Additional Conditions
You have our approval, in accordance with the attached conditions and those listed below to construct a
dock, boatlift and platform and to conduct maintenance excavation of the canal adjacent to your property,
as described in your CAMA application dated March 19, 2014 and received by the Division of Water
Resources (DWR) in the Wilmington Regional Office (WiRO) on March 21, 2013. After reviewing your
application, we have decided that the impacts are covered by General Water Quality Certification Numbers
3883 (GC 3883) and 3894 (GC 3894). These Certifications allow you to use the General Permits 198700056
and 198200277 when issued by the US Army Corps of Engineers and the CAMA Major Permit when issued
by the Division of Coastal Management. In addition, you should obtain or otherwise comply with any other
required federal, state or local permits before you go ahead with your project including (but not limited to)
Erosion and Sediment Control, Non -discharge, and stormwater regulations. Also, this approval to proceed
with your proposed impacts or to conduct impacts to waters as depicted in your application shall expire
upon expiration of the General Permits or LAMA Permit.
This approval is for the purpose and design that you described in your application. If you change your
project, you must notify us and you may be required to send us a new application. If the property is sold,
the new owner must be given a copy of this General Certification and approval letter and is thereby
responsible for complying with all conditions. If total fills for this project (now or in the future) exceed one
acre of wetland or 150 linear feet of stream, compensatory mitigation may be required as described in 15A
NCAC 2H .0506 (h). This approval requires you to follow the conditions listed in the attached certification
and any additional conditions listed on the following pages.

2. No Waste, Spoil, Solids, or Fill of Any Kind
No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond the
footprint of the impacts depicted in the application. All construction activities, including the design,
installation, operation, and maintenance of sediment and erosion control Best Management Practices,
shall be performed so that no violations of state water quality standards, statutes, or rules occur.
3. This approval is for the purpose and design described in your application. The plans and specifications for this
project are incorporated by reference as part of the Certification. If you change your project, you must notify
the Division and you may be required to submit a new application package with the appropriate fee, if the
property is sold, the new owner must be given a copy of this approval letter and General Certification and is
responsible for complying with all conditions
4. Turbidity Standard
The turbidity standard of 25 NTUs (Nephelometric Turbidity Units) shall not be exceeded as described
in 15 A NCAC 2B..0221. Appropriate sediment and erosion control practices must be used to meet this
standard. Turbidity curtains s hall be used as appropriate. Please notify this Office if any turbidity
Issues arise at 910.796.7215
5. Any final construction plans for this project must include or reference the application and plans
approved by the DWR under the authorization letters and certifications.
6. All mechanized equipment will be regularly inspected and maintained to prevent contamination of
waters and wetlands from hydrocarbons or other potential toxic chemicals. In the event of a
hydrocarbon or chemical spill, the permitee/contractor shall immediately contact the Division of Water
Quality, between the hours of 8 am to 5 pm at the Wilmington regional office at 910.796.7215 or Steve
Lewis at 919.807.6308 and after hours and on weekends call the USCG National Response center at
1.800.424.8802.
7. Fueling, lubrication and general equipment maintenance should not take place within 50 feet of a
waterbody or wetlands to prevent contamination by fuel and oils.

Continuing Compliance:
8. The applicant/permitee and their authorized agents shall conduct all activities in a manner
consistent with State water quality standards (including any requirements resulting from
compliance with 303(d) of the Clean Water Act), and any other appropriate requirements of
State and Federal law. If the Division determines that such standards or laws are not being
met, including failure to sustain a designated or achieved use, or that State or Federal law is
being violated, or that further conditions are necessary to assure compliance, than the Division
may reevaluate and modify this General Water Quality Certification.
9. Certificate of Completion
Upon completion of all work approved within the 401 Water Quality Certification or applicable Buffer
Rules, and any subsequent modifications, the applicant is required to return the attached certificate of
completion to the 401/Wetlands Unit, North Carolina Division of Water Quality, 1650 Mail Service
Center, Raleigh, NC, 27699-1650.
Violations of any condition herein set forth may result in revocation of this Certification and may result in
criminal and/or civil penalties. The authorization to proceed with your proposed impacts or to conduct
impacts to waters as depicted in your application and as authorized by this Certification shall expire upon
expiration of the 404 or CAMA Permit.
If you wish to contest any conditions in the enclosed certification (associated with the approved wetland or
waters impacts) you must file a petition for an administrative hearing. You may obtain the petition form
from the office of Administrative hearings. You must file the petition with the office of Administrative
Hearings within thirty (30) days of receipt of this notice. A petition is considered filed when it is received in
the office of Administrative Hearings during normal office hours. The Office of Administrative Hearings
accepts filings
Monday through Friday between the hours of 8:00 am and 5:00 pm, except for official state holidays. The
original and one (1) copy of the petition must be filed with the Office of Administrative Hearings.
The petition may be faxed -provided the original and one copy of the document is received by the Office of

Dear Mrs. Styron,
The purpose of this letter is to comment on the proposed dock and boatlift to be constructed at 102
Bayview Boulevard, Atlantic Beach, NC.
It is my understanding that Mr. Cannon has been granted permission to construct a new dock and
boadift as long as the new structure is built within the dimensions of the old dock and the structure
does not encroach riparian lines regardless of any setbacks. The old dock extended approximately 1.5'
into the north 15' setback as evidenced by the survey dated 6-25-99 by Stroud Engineering. The current
proposal shows the new dock located directly on the riparian line common to mine and Mr. Cannon's
property. If the dock location was shifted north approximately 1.5', this would allow better access to
my property. I do not believe that this would impact Mr. Cannons use of his dock in any way yet
would allow approximately 1' additional width for access to my property. This minor change may also
be beneficial to Mr. Lawrence. Additionally, I want to be sure that the 2x plank atop the proposed
stringer is to be set flush with the framing and hopefully located approximately 1' away from the
riparian line achievable by shifting the dock approximately 1.5' northward. Please see the 1999 survey
and my drawing showing Mr. Cannons old dock overlaid onto the newly proposed dock plans. In
regards to the boat lift Ginger Turner of Stroud Engineering told me that the lines on her design
represent the outside of the structure including pilings.
I have exchanged emails and personally spoken to Mr. Cannon regarding my plans to apply for a
permit to build a small dock and minor amount of dredging that would not interfere with the use of his
proposed dock. He says that he would not be opposed to this however he is concerned about waiving
his 15' setback because he would have no control over what future owners may do within the setback.
He would be more comfortable waiving his rights in a manner that is project specific. I do not know
how all of this works but would agree to this. I mention this to make the point that if Mr. Cannon is
permitted to build his new dock within my property setback I feel it would only be fair that I am able
to build a small dock within his 15' setback as long as it meets CAMA regulations and does not impact
the use of his dock. I realize that this would require Mr. Lawrence s approval as well. I have spoken to
him and he is willing to work with me as I am willing to work with him in the future.

This letter concerns the filing of an application for a major development permit under the Coastal Area
Management Act for the replacement of an existing water dependent structure at 102 Bayview Blvd, Atlantic
Beach, in Carteret County. After making a site inspection on May 2, 2013, the Division has determined that
the activity you propose is allowable since the work meets the conditions for replacement of a non -conforming
structure specified by the rule cited below. This activity will require obtaining the necessary CAMA
development permit before commencing construction. If your plans should change and your project will no
longer meet these conditions, please contact the Division before proceeding.
NON -CONFORMING DEVELOPMENT:15A NCAC 07J.0211 A non -conforming structure is any structure
within an AEC other than Ocean Hazard and Inlet Hazard AECs that is inconsistent with current CRC rules,
and, was built prior to the effective date(s) of the rule(s) with which it is inconsistent.
Replacement of such structures shall be allowed when all of the following criteria are met:
(1) the structure will not be enlarged beyond its original dimensions;
(2) the structure will serve the same or similar use;
(3) there are no practical alternatives for replacing the structure to provide the same or similar benefits in
compliance with current rules; and
(4) the structure will be rebuilt so as to comply with current rules to the maximum extent possible.
In this case:
1. The proposed work consists of the replacement of an existing fixed dock platform in the terminus
end of a man-made canal system contiguous with Bogue Sound which said structure was built prior
to May 1982 before the effective date of 15A NCAC 07H .1205 (Eff. March 1,1984) of the rule(s) in
which it is Inconsistent;
2. The proposed work does not enlarge the structure beyond its original dimensions as described in
08/0711995 survey by Donald C. Clemments, Jr.;
3. The proposed platform would serve the same or similar use for a residential facility;
4. There are no practical alternatives for replacing the structure to the provide the same or similar
benefits in compliance with the current rules as compliance with current rules would render the dock
platform area in size that it could not reasonably function as intended; and
5. The proposed structure would be rebuilt to comply with the current rules to the maximum extent
possible as depicted In the workplan for the proposed replacement of the dock platform submitted to
the Division for a permit determination.

PROJECT SUMMARY:
The project proposed is for the reconfiguration of the existing one -slip dock, the addition
of a boatlift and maintenance excavation.
9. Narrative Description
The John Cannon project is located on the west side of the terminus of an existing
manmade canal that is continuous to Bogue Sound at 102 Bayview Blvd. in Atlantic
Beach. The project area is found by turning off of Highway 70 East in Morehead City
(Arendell Street) onto the on -ramp for Atlantic Beach. Follow the Atlantic Beach
Causeway to the four-way stop light intersection then turn left onto East Fort Macon Road
and left onto Bayview Blvd. The site is the first house on the right (approximately 50 from
the beginning of the road).
The property is .12 acres (5123.73 sf) in its entirety and is 2' above NHW/MHW. The
shoreline length for this property is 50'. The site currently has an existing single family
residence, driveway, bulkhead and a permanent one -slip dock. The high ground portion of
the tract is covered with typical yard grasses and landscape shrubbery. The proposed
development is a private project and currently has one existing slip. The docking facility
has been in place since before 1982 according to the 8/7/95 survey by Donald C.
Clemments Jr. More than 50% of the dock was removed inadvertently by a marine
contractor as observed by DCM staff on 5/1/13 however since the dock existed prior to
May of 1982, The Division of Coastal Management determined it would meet the
nonconforming requirements of 15A NCAC 07J.0211 and therefore may be replaced as
long as they followed the following guidelines;
A non -conforming structure is any structure within an AEC other than Ocean Hazard and
Inlet Hazard AECs that is inconsistent with current CRC rules, and, was built prior to the
effective date(s) of the rule(s) with which it is.inconsistent.
Replacement of such structures shall be allowed when all of the following criteria are met:
(1) the structure will not be enlarged beyond its original dimensions;
(2) the structure will serve the same or similar use;
(3) there are no practical alternatives for replacing the structure to provide the same or
similar benefits in compliance with current rules; and
(4) the structure will be rebuilt so as to comply with current rules to the maximum extent
possible.
There are developed residential properties to the north and a commercial property to the
south of the site. The Town of Atlantic Beach's Land Use Plan classifies this property as

Single Family Residential with all parts of the AEC classified Conservation. The manmade
canal connecting to Bogue Sound, which is coastal waters, is not designated as Primary
Nursery Area and is closed to the taking of shellfish. The canal within this area carries a
water classification of SA/HQW and has an average width of 73.5' within the project area.
The water depths within the project area range from -.9'to -2.2' nlw/mlw and have been
field verified. The tidal amplitude within this area is approximately 2.5'. The lines of
division of the areas for riparian access are wedged or pie -shaped, because of the location
of the properties in the terminus of the canal. There were no shellfish beds or SAV
observed within the project area. The substrate in the project area is mostly mud (silt).
There are coastal wetlands to the south of the project area but would not be impacted by
the proposal.
10. Protect Description:
The previously existing development is private and with has one existing docking space
and is located at the southern terminus of a manmade canal. The existing dock has been in
place since before May of 1982 according to the 8/7/95 Clemments survey. The applicant
previously hired a contractor for the repair of the existing dock; however, on 5/1/13 DCM
staff observed more than 50% of the structural framing members were removed. DCM was
concluded a general permit could not be issued at that time due to the fact the proposal
would encroach into the adjacent riparian access areas which is inconsistent with 15A
NCAC 07H.1205 (effective Marchl, 1984). The Division of Coastal Management
determined the proposal would meet the requirements for non -conforming development
(15A NCAC 07J.0211). A May 3, 2013 letter from DCM was sent to the applicants
explaining the criteria to replace the structure. The current proposal would meet 15A
NCAC 07J.0211 (1-5). The proposal would not be enlarged beyond the original
dimensions of the structure as described in the 8/7/1995 survey by Donald C. Clemments
Jr.; the proposal would serve the same or similar use for the facility; there are no practical
alternatives for replacing the structure to provide the same or similar benefits in
compliance with the current rules; and the proposed structure would be re -built to comply
with the current rules to the maximum extent possible as depicted in the work plan
submitted to the Division for a permit determination. No additional slips would be added
to the one -slip docking facility.
The applicant is proposing to construct the dock and platforms partially over high ground
and partially over open water in order to accommodate a 20'-25' open runabout type boat.
They are also proposing a 12' x 13' boatlift and maintenance excavation. All portions of
the docking facility would remain within the Cannon riparian area, Due to the non-
conforming designation; a riparian access line waiver would not be required. The water
depth within the proposed boatlift area is an average of -1.3' nlw/mlw. While the 8/7/95
survey depicts an "existing boatlift", there was not a boat lift or apparent support piles in

place at the time of DCM staff visit 5/1/13.
The proposed southern platform (#2 on drawings) would start approximately 3' from the
southern property corner and would be located partially over high ground and partially
over open water. The platform is irregularly shaped and would be a width of 5.6'-10.4' and
a length of 7'-8.46' depending on location. The widest portion of platform #2 would not
exceed a distance of 6' beyond the existing vinyl bulkhead (nhw). The southern platform
would connect to a side -to dock that would also be located 4' over high ground and 1.2'
over open water. The dock would be 5.2' x 15' and would not exceed a distance of 1.2'
beyond the bulkhead (nhw). It would connect to the final irregular shaped platform (#1) to
the north. This platform would be a width of 5.2'-10' and a length of 10'-12' depending on
location. It would not extend more than 7', at its widest point, beyond the existing
bulkhead and would be 15' from the northern riparian access line.
The applicant is also proposing a 12' x 13' boatlift and a 12" x 12.2' "catwalk" (stringer).
The catwalk would extend from the southern platform (#2) and follow along the riparian
access line for 12' were it would intersect the most eastern boatlift piling. The farthest
point for the catwalk would not exceed a distance of 12' from the bulkhead and would stay
within the Cannon riparian access area. The boatlift would be located along the northern
platform (#1) and would be angled in order to stay within the riparian area. The southeast
boatlift piling would not exceed a distance of 12' beyond the bulkhead with the northeast
piling a maximum distance of 17' from the bulkhead into a 73.5' wide canal. The
maximum''/4 distance allowed within this area of the existing canal is 18.4'. All portions of
the dock and boatlift would be a distance of 15' from the northern riparian access line. The
proposal would not be enlarged beyond its original dimensions and would not increase the
number of existing docking spaces.
The applicant is proposing maintenance excavation of the canal along his property. The
existing water depths within this area of the canal are an average of -1.8' nlw. The
connecting water depths are-2.8'nlw.
A total of 36 cubic yards of material would be removed from this portion of the canal with
an excavation area of 25' x 38'. The final depth for the all the excavation areas would be —
2.8' feet below NHW. The excavation would be done by bucket to barge and taken offsite
to a pre -approved spoil location.
Anticipated Impacts:
The proposed excavation would increase turbidity temporarily and cause 950 square feet

of disturbance to shallow bottom habitat. The proposed boatlift, catwalk, dock and
platforms would shade 315 ftz and incorporate 561 ftz of open water. The increase in
suspended sediment and turbidity levels from the pier placement would be temporary, and
occur while the dock is constructed. All work proposed would be a maximum of 17' water
ward of the bulkhead in a water body with a width of 73.5'. The maximum 1/4 distance
allowed within this area of the existing canal is 18.4'. There would be no increase in the
number of slips or docking spaces. Due to the non -conforming status of the docking
facility, a waiver for the encroachment of the 15' riparian access line would not be
required. The coastal wetlands to the south of the project area would not be impacted. The
proposal would be within its original dimensions, or less than, as depicted in the 8/7/98
Clemments survey.

development. You should post this notice at a conspicuous point along your property where it can be observed from a
public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-way
fronting your property, or at a point along the road right-of-way where a private road would lead one into your property.
Failure to post this notice could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted by the appropriate State
or Federal agency. Please contact me if you have any questions and notify me in writing if you wish to "receive a copy of
my field report and/or comments from reviewing agencies.

the northern 15' setback by 3.5'. The proposal for the rebuild consists of two platforms with an interconnecting dock.
The irregular platforms are #1-10'x7'x12'x8.46' and #2-5.2'x5.6'x10'x10.4'. The dock measures at 5.2'x15'. The location
of the dock is proposed mostly over high ground with only 85sf of decking over water. There is also a 1x stringer
