This permit, issued on September 212014 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. 1) In accordance with the permittee's email dated 9/7/17, the original proposal to fill non -coastal wetlands is hereby removed from this project. Any reference to the wetland fill in the attached application is hereby null and void. Observation Pier 2) Unless specifically altered herein, this permit authorizes the construction of the observation pier located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this reconfigured docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over public trust waters without permit modification. 3) No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. The permittee is not relieved of this requirement if he abandons the pe tttivity without having it transferred to a third party. 5) ThR e t does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 6) The permttee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 7) This permit does not authorize any formalized boat slips. General 8) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 9) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. 10) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 11) The permittee and/or his contractor shall meet with a representative of the Division prior to project initiation in order to discuss the conditions set forth in this permit. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 264-3901 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal water level. NOTE: The U.S. Army Corps of Engineers authorized the proposed project under COE Action Id. No. SAW-2201401381. Project Narrative for Partial Fill of Wetlands on 123 Otter Way, Hertford, NC, Lot #48 I seek permission to fill half of the wetlands on my property. I believe this is the best way to both respect the environment and secure more usable land. The wetlands leading into the water will be unaffected; thus providing a natural filter and other wetlands benefits. The half extending further onto my property and leading to my proposed pier I would like to fill. When I was sold the property I was assured that it was all solid land. Although you are not responsible for what has been told me, I do believe that this compromise of letting half remain as is, particularly as that half is the most important half to retain the benefits of the wetlands, and filling the other half, which doesn't even look like wetlands most of the year, is an appropriate plan of action. Actually, the entire wetlands on my property is of negligible consequence, given its size and location. Please let me know if you have any further questions or if I can be of service in any way. Sharon Burtner Field Investigation Report Page 2 Project Setting The subject property is located at 123 Otter Way, Rivers Edge,Subdi vision (a small waterfront residential community), adjacent to the Little River, in New Hope Township, Perquimans County, North Carolina. The lot is 53,530 square feet upon which the owner has constructed a single family residence with associated infrastructure approximately 175' landward of normal water level. Located to the north of the applicant's property is the Little River, to the east and west are undeveloped residential lots, and to the south is a private residential street (Otter Way). On March 22, 2012, General Permit #58757A was issued to the applicant to placed riprap along 153' of shoreline for erosion control. The alignmentties into riprap on the adjacent property to the west and into a bulkhead on the east side of the property. Vegetation of the property is predominantly domestic grasses with the exception of an area of delineated non -coastal wetlands located adjacent to the Little River. in the northwest corner of the applicant's property. Vegetation in this area includes, but is not limited to, broad-leaved cattail (Typha latifolia), narrow -leaved cattail (Typha angustifolia), crimson eyed rose mallow (Hibiscus palustris), wax myrtle (Myrica cerifera), poison ivy (Toxicodendron radicans), pennywort (Hydrocotyle umbellate), smart weed (Polygonum ssp.), spike rush (Eleochads tuberculosa), prickley sow thistle (Sonchus asper), and catbrier (Smilax bona-nox). The average elevation of the applicant's property is 3' above normal water level, general flat and located within the AE Special Flood Hazard Area. There are no unusual geologic formations on the property, and no identified archeological or historical sites on or near the property. (H) Piers or docking facilities longer than 400 feet shall be permitted only if the proposed length gives access to deeper water at a rate of at least 1 foot each 100 foot increment of length longer than 400 feet, or, if the additional length is necessary to span some obstruction to navigation. (1) Piers and docking facilities shall not interfere with the access to any riparian property and shall have a minimum setback of 15 feet between any part of the pier or docking facility and the adjacent property owner's areas of riparian access. (J) Applicants for authorization to construct a pier or docking facility shall provide notice of the permit application to the owner of any part of a shellfish franchise or lease over which the proposed dock or pier would extend. PROJECT SUMMARY: The applicant proposes to fill 2,000sf of non -coastal wetlands in order to obtain direct access to a proposed 6' x 32' pier with a 12' x 16' platform in the Little River. Project will also include a 6' x 10' access walkway to the pier and an additional 2,178sf of grading adjacent to the wetland fill area. Sharon Burtner Field Investigation Report Page 2 Project Setting The subject property is located at 123 Otter Way, Rivers Edge Subdivision (a small waterfront residential community), adjacent to the Little River, in New Hope Township, Perquimans County, North Carolina. The lot is 53,530 square feet upon which the owner has constructed a single family residence with associated infrastructure approximately 175' landward of normal water level. Located to the north of the applicant's property is the Little River, to the east and west are undeveloped residential lots, and to the south is a private residential street (Otter Way). On March 22, 2012, General Permit#58757A was issued to the applicant to placed riprap along 153' of shoreline for erosion control. The alignment ties into riprap on the adjacent property to the west and into a bulkhead on the east side of the property. Vegetation of the property is predominantly domestic grasses with the exception of an area of delineated non -coastal wetlands located adjacent to the Little River in the northwest corner of the applicant's property. Vegetation in this area includes, but is not limited to, broad-leaved cattail (Typha latifolia), narrow -leaved cattail (Typha angustifolia), crimson eyed rose mallow (Hibiscus palustris), wax myrtle (Myrica cerifera), poison ivy (Toxicodendron radicans), pennywort (Hydrocotyle umbellate), smart weed (Polygonum ssp.), spike rush (Eleocharis tuberculosa), prickley sow thistle (Sonchus asper), and catbrier (Smilax bona-nox). The average elevation of the applicant's property is 3' above normal water level, general flat and located within the AE Special Flood Hazard Area. There are no unusual geologic formations on the property, and no identified archeological or historical sites on or near the property. Development Proposal The applicant proposes to construct a 6' x 32' pier with a 12' x 16' platform in the Little River that will be accessed by a 6' wide walkway approximately 10' in length that will cross the existing riprap alignment. The pier, as proposed, will be located in the center of the lot and will have a small area of non -coastal wetlands between the dwelling and the pier. The applicant proposes to fill 2,OOOsf of noncoastal wetlands to provide a straight access from the dwelling to the proposed pier. An additional 2,178sf of high ground will we fill in conjunction with the wetland fill activity if approved. Submitted by: Lynn W. Mathis Date: July 14, 2014 Project Narrative for Partial Fill of Wetlands on 123 Otter Way, Hertford, NC, Lot #48 I seek permission to fill half of the wetlands on my property. I believe this is the best way to both respect the environment and secure more usable land. The wetlands leading into the water will be unaffected; thus providing a natural filter and other wetlands benefits. The half extending further onto my property and leading to my proposed pier I would like to fill. When I was sold the property I was assured that it was all solid land. Although you are not responsible for what has been told me, I do believe that this compromise of letting half remain as is, particularly as that half is the most important half to retain the benefits of the wetlands, and filling the other half, which doesn't even look like wetlands most of the year, is an appropriate plan of action. Actually, the entire wetlands on my property is of negligible consequence, given its size and location. Please let me know if you have any further questions or if I can be of service in any way. Overview: The subject property consists of a 1.23 acre lot with 153 linear feet of shoreline along the Little River. The lot is elevated approximately 3 feet above Normal Water Level (NWL). Vegetation on the site consists of domestic grasses, with an area of non -coastal wetlands along the shoreline at the northwest comer of the lot. The property is within the AE Floodzone. A single-family residence and associated infrastructure are located on the lot. Riprap is located along the length of the shoreline as permitted under General Permit #58757A issued in March 2012. The riprap ties into riprap on the adjacent property to the west and bulkhead on the adjacent property to the east. Installation of a 6 foot wide by 10 foot long walkway connecting to a 6 foot wide by 32 foot long pier with a 12 foot by 16 foot terminus platform is proposed. The walkway/pier will be located in the center of the lot, with the walkway extending from high ground over the riprap. The waters of the Little River are classified SC in this area and are closed to shellfish harvesting. A review of Submerged Aquatic Vegetation (SAV) was not provided. Sharon Burtner Field Investigation Report Page 2 Project Setting The subject property is located at 123 Otter Way, Rivers Edge Subdivision (a small waterfront residential community), adjacent to the Little River, in New Hope Township, Perquimans County, North Carolina. The lot is 53,530 square feet upon which the owner has constructed a single family residence with associated infrastructure approximately 175' landward of normal water level. Located to the north of the applicant's property is the Little River, to the east and west are undeveloped residential lots, and to the south is a private residential street (Otter Way). On March 22, 2012, General Permit#58757A was issued to the applicant to placed riprap along 153' of shoreline for erosion control. The alignment ties into riprap on the adjacent property to the west and into a bulkhead on the east side of the property. Vegetation of the property is predominantly domestic grasses with the exception of an area of delineated non -coastal wetlands located adjacent to the Little River in the northwest corner of the applicant's property. Vegetation in this area includes, but is not limited to, broad-leaved cattail (Typha latifolia), narrow -leaved cattail (Typha angustifolia), crimson eyed rose mallow (Hibiscus palustris), wax myrtle (Myrica cerifera), poison ivy (Toxicodendron radicans), pennywort (Hydrocotyle umbellate), smart weed (Polygonum ssp.), spike rush (Eleocharis tuberculosa), prickley sow thistle (Sonchus asper), and catbrier (Smilax bona-nox). The average elevation of the applicant's property is 3' above normal water level, general flat and located within the AE Special Flood Hazard.Area.
