Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Docking Facility 1) Unless specifically altered herein, this permit authorizes only the addition of four floating platforms to the existing dock and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over public trust waters without permit modification. 2) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work.: � APR 11 2014 (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 4) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee will not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 5) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 6) This permit authorizes a maximum of three formalized boat slips. General 7) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. 8) No Coastal Wetlands or open water areas shall be excavated or filled, even temporarily. 9) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 10) The permittee and/or his contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittce's property may require a modification of this permit. Contact a representative of the Division at (252) 808-2808 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: The U.S. Army Corps of Engineers authorized the proposed project under General Permit No. SAW- 1996-03692. Wastewater treatment facilities are provided by the Town of Beaufort at a facility which has the capacity to treat and discharge 1.5 million gallons into Taylors Creek o. Describe existing drinking water supply source. Drinking water is provided by the Town of Beaufort through the Castle Hayne Aquifer p. Describe existing storm water management or treatment systems. The Town of Beufort has an existing stormwater system that is supported by numerous ditches, culverts and drop inlets which the Town activity maintains. 5. Activities and Impacts a. The Town of Beaufort is partnering with the National Park Service to provide ADA accessible passenger ferry service to Cape Lookout National Seashore in a more efficient and safe manor. This will be a year round operation run by the Park Service and their ferry concessionaire providing a public benefit which is difficult to measure. The dockage will also be used as transient as vessels will not be peranently moored at this facility. c. Describe the proposed construction methodology, types of construction equipment to be used during construction, the number of each type of equipment and where lt is to be stored. The proposed two floating docks are to be pre -manufactured and should not take long to install. There will be a few steel piles for each dock section which will be installed by a marine contractor with a barge and some heavy equipment. d. List all development activities you propose. The Town of Beaufort proposes to add two floating docks to the existing fixed dock at Grayden Paul Park. One of the proposed docks would be on the east side with dimensions of 12' X 48'. The dock on the west side is proposed to be 12' X 60'. The floating docks are to be premanufactured by a marine dock manufacturing company in two sections and fastened together. A "Major CAMA Permit" is required due to the installation of two floating docks with gangways from the Beaufort waterfront via Grayden Paul Park. These new docks are vital to accomplish the Parks Service's mission to make the national parks accessible to all citizens in a safe and functional environment of embarkation/debarkation thus enhancing the public benefit. This location is within close proximity to the Park Service's office which will share space with Beaufort's Town Hall, located across Front Street in the former Post Office. We believe that the environmental impact of this project will be minor as supported by a "Finding of No Significant Impact" (FONZI) report that was conducted by the Park Service when selecting this location for passenger ferry service. A copy of this report can be supplied if needed. Also, due to the materials for the floating docks and gangways being pre -manufactured thus there should be limited impact. Some negligible impact could happen through the installation of eight (8) steel pilings to be installed by an experienced marine contractor but it is not anticipated. This project is designed to not add any additional stormwater impact to Taylors Creek. The Park Service will also be responsible for the concessionaire operating the ferry service insuring that they provide an environmentally safe operation. Careful consideration has been given to protect the environment while providing safe and functional ferry operations to the National Seashore. (Again as referenced in the FONZI document). The project is projected to take only a few days to implement since the majority of the work will be completed waterside of Grayden Paul Park instead of landside. Item 6 — A Project Narrative a. RECEIVED FJAN 17 2014 DCM•MHDCIry DOCK IMPROVEMENT RECOMMENDATIONS The existing dock at Grayden Paul Park consists of a fixed wood dock and timber piles.The dock is approximately 10' wide by 90' long with a 4' x 15' finger dock at the end on the east side. There is approximately 8.5' of water at the end of the dock at mean low water. An existing dock plan and profile are depicted in on the following page. The dock was recently renovated with a new deck and the addition of new wood piles for additional structural support. Currently, its primary use is for swimming, fishing, and casual waterfront observation. During the programming workshop, three concept alternatives were considered for renovating the existing dock at Grayden Paul Park for ferry operations. Subsequent discussions related to the alternatives focused on minimizing impacts to the site and minimizing new construction/renovation of the existing fixed dock The alternatives that were considered and discussed are summarized briefly below and graphically represented in the Appendix. ALTERNATIVE 1 This alternative considered a new floating dock on the east side of the fixed dock with a gangway and a new gangway landing attached to the fixed dock Some wood railings would also be added for safety of ferry passengers traversing to/from the ferries. Electric and power would be added to the dock. Ferry vessels would moor on the new floating dock, along the west side of the fixed dock and also at the end of the fixed dock if additional mooring space is needed. ALTERNATIVE 2 This alternative is similar to Alternative I except that the new floating dock is placed on the _ west side of the fixed dock with 2 to 3 mooring slips located on the east side of the dock This arrangement provides more linear feet of floating dock on which to moor ferry vessels.The end of the fixed dock can also be utilized for mooring. ALTERNATIVE 3 This alternative places the new floating dock at the end of the fixed dock with a gangway positioned along the west side of the fixed dock and a new fixed gangway landing constructed adjacent to the dock Operationally, this arrangement does not work well due to the gangway being alongside the fixed dock and taking up dock footage that could be used for directly mooring vessels. Also, there could potentially be an encroachment into the navigation channel with the new floating dock and mooringimaneuvering ferry vessels. Each dock would likely be manufactured in two sections and securely fastened together. The floating dock sections would likely be moored with two steel piles for each dock section. Two aluminum gangways are proposed, each with a dimension of 5' x 35'.The gangways would be secured to the existing bulkhead and extend perpendicular to the bulkhead to the floating docks. At the bulkhead end of the gangways, the gangways would be equipped with a security chain and sign indicating when the ferry is not in operation and that the floating docks are closed to the public. Railings along the entire perimeter of the fixed dock are suggested in order to provide a safe use of the dock by the public and also to separate the public use of the existing fixed dock from the ferry operations on the new floating docks.This arrangement also provides additional queuing area on the fixed dock for ferry passengers waiting to board the ferry. With the railings in place, the fixed dock could remain open to the public for fishing and as a scenic overlook of the water. Two power pedestals are proposed to be installed on each side of the existing fused dock to service the ferry vessel fleet. (see photo) • If mooring larger vessels at the end of the fixed dock are desired, then additional piles may be necessary for fendering and mooring of the vessels. At this time, it would appear that mooring larger vessels at the end would not be necessary because there is sufficient space along the floating docks and also slips available nearby at the BB&T dodo orTown docks. • In general, the water depths appear adequate for the floating docks and the ferry vessel operations. However, a hydrographic survey is recommended to confirm the water depth and whether it is sufficient for the proposed docks and ferry vessel. Some minor dredging along both sides of the fixed dock may be required. • Due to the close proximity to the Town Dock and availability of additional slips, overnight mooring could be arranged at the Town docks or the BB&T dock if needed. Narrative Description: The Town of Beaufort Town Dock project is located at 718 Front Street in the Town of Beaufort, Carteret County. The site is found by turning right off of Cedar Street (Hwy 70 East) onto Pollock Street. Follow this road to the last stop sign along Front Street and look directly ahead. It is located within the Beaufort Historic District and Beaufort's urban waterfront area. The property is 4866.08 square feet (.112 acres) in its entirety, 9.5' above NHW, has a total length of 66' along the NHW contour and is located along the North Side of Front Street. The upland vegetation mainly consists of lawn grasses, cedars, oaks, shrubs and is bordered by a 5' x 30'fringe of coastal wetlands along the western side of the existing bulkhead. The coastal wetlands adjacent to the property mainly consist of salt marsh cordgrass S artina alterniflora). The waters of Taylors Creek have an approximate -3' lunar tidal amplitude. The project site is designated as an "Urban Waterfront". The Division of Water Quality classifies this area as SC Waters. Taylors Creek is not designated as a Primary Nursery Area and is closed to the taking of shellfish. The Town of Beaufort's Land Use Plan classifies this area as Commercial with Conservation within the AECs and is within the Beaufort Historic District. The Town of Beaufort has designated this area as an "Urban Waterfront" as well. There are no shellfish resources in the area. Per the USACOE Google Earth file, the Federal Channel Setback within this area of Taylors Creek is 15'. A portion of the existing fixed pier (approximately 25') encroaches over the channel setback, however, no work is proposed on this portion of the existing dock. During a pre - application meeting that was conducted prior to an official submittal, DCM advised the applicant that placement of the floating docks would be encroaching within the USACOE channel setback. The water depths within this project location were determined to range from - 7'nlw to-10'nlw with a connecting water depth of-10' plus nlw. The bottom substrate is silty sand with shell. Taylors Creek is approximately 706' wide at this location. 10) Proposed Development: The applicant wishes to add four new floating docks and three permanent wet slips (no formalized slips currently) along the existing fixed pier, in order to maintain compliance with a Memorandum of Agreement with the National Park Service that would provide ADA compliant passenger ferry service to Cape Lookout. The existing pier is 10' x 90' and intersects a fixed 4' x 15' L-head platform. There is an existing 8' x 15' floating platform located on the west side of the existing pier that would be removed. The proposed platforms would be used to safely assist in the loading and unloading of passengers. The proposed floating platforms along the eastern side of the pier would be 12'x 24' and 12' x 30'. They would be held in place by four steel pilings and would be accessed by a 5' x 35' gangway adjacent to the east side of the existing pier access. This area would be designated as slip #1 and would allow for the docking of a 13' x 35' forty-eight passenger ferry. The final two floating platforms would be located on the western side of the pier and landward of the existing fixed L-head platform and held into place by four steel pilings. The dimensions for these platforms would both be 12' x 30' and would be accessed by a 5' x 35' gangway. The gangway would be located on the western side of the pier access. The proposed platforms would be located a distance of 25' from the western riparian corridor and 15' from the eastern riparian corridor. The two most waterward platforms (starting approximately 36' from the bulkhead or nhw/mhw) would encroach over the USACOE channel setback approximately 25', however would be landward of the existing fixed L-head platform. This would increase the slip count to a total of three permanent slips located within this area. The typical boat using this docking facility would be 27'- 35' passenger ferries. The docking facility would prohibit overboard discharge with no overnight or live aboard dockage. 11. Anticipated Impacts: The proposed platform additions would shade and incorporate 1,368 ft2 of shallow bottom and add three permanent wet slips (no formalized slips currently). The existing water depths (7' to 10' nlw) are sufficient for this use and would not require dredging at this time. The setting of pilings has the potential to cause a temporary increase in turbidity during construction activities. There should be no hindrance to navigation due to the proposed floating platforms and slips are located landward of the existing fixed 1-head platform located at the end of the existing pier. The Town's grant herein is more specifically described as the non -revocable right for the Seashore and Concessioner to use and occupy the following areas and structures within the Town Facilities (hereinafter "Permitted Use Facilities") for engaging in the Permitted Use: (i) Exclusive use and occupancy of approximately 800 square feet of space within the Town Hall for, among other things, Seashore orientation, visitor education, and Concession Operation ticket sales; and (ii) Exclusive use of three (3) boat slips at the Grayden Paul Park dock on Taylor's Creek sufficient to accommodate the mooring and refueling of the vessels required or authorized in the Concession Contract for use in the Concession Operation; and (iii) Exclusive, use of 85 parking spaces within 1500 feet the Town Hall for Concession Operation passengers and Concessioner staff. (iv) The non-exclusive use of the common areas and restroom facilities within the Town Hall, and at or upon the dock and boat slips described in subparagraph (ii) at Grayden Paul Park for use in connection with the Concession Operation. 3. In addition to the non -revocable right of use and occupancy granted herein, the Town agrees to carry out the commitments it made to the Seashore in the "Cape Lookout National Seashore Town of Beaufort Departure Site Response" dated January 6, 2011, a copy of which is attached hereto and incorporated herein as if set forth verbatim in this Agreement. 4. , NPS shall cause the Concessioner to conduct the Concession Operation in such a way that the Permitted Use Facilities shall remain in the same or similar condition as they were on the effective date of this Agreement, reasonable wear and tear excepted. The Town shall pay the costs of utilities incurred for use of the Permitte(P9kyMIMes in furtherance of the Permitted Use, to include but not be limited to electricity, water, sewer, and such other utilities to enable such Permitted Use of the premises by the Seashore and the Concessioner. 6. No ad valorem, property or other use or occupancy taxes will be assessed by the Town to the Seashore, NPS, or the Concessioner during the term of this Agreement. NPS and/or the Concessioner shall be responsible for the installation and maintenance costs for any telephone, computer or other communication services or devices utilized by NPS or the Concessioner in furtherance of the Permitted Use at or within the Permitted Use Facilities. 8. NPS and the Seashore are self -insured and are not required to obtain liability insurance for the activities associated with the Permitted Use. NPS and the Seashore's liability is and shall be limited to any claims allowed by the Federal Tort Claims Act, 28 U.S.C. §§2671-2676. 9. The Town acknowledges that the NPS expects to enter into a 10-year Concession Contract with a Concessioner to assist in or implement some of the activities associated with the Permitted Use, most notably the Concession Operation. As required in the Concession Contract, the Concessioner will procure and continuously maintain insurance policies of the types and in the minimum amounts detailed in the Concession Contract during its 10-year term and any subsequent renewal periods. 10. The Town shall maintain a general property insurance policy during the term of this Agreement with sufficient coverage to enable repair or replacement of the Permitted Use Facilities. In this regard, the Town represents that said insurance policy shall cover the Permitted Use Facilities against damage caused by natural disaster, vandalism, fire and other casualties. 11. NPS shall cause its Concessioner to indemnify, save, hold harmless and defend the Town, its respective boards, officers, employees, representatives and agents against any claim, action, loss, damage, injury, liability, cost and expense of whatsoever kind or nature (including but not by way of limitation, attorneys' fees and court costs) arising out of injury to persons or damage to property caused by Concessioner's acts or omissions arising out of or incidental to the Permitted Use. This indemnification provision is separate and apart from, and in no way limited by, any insurance policy or coverage provided by Concessioner pursuant to the Concession Contract. 12. The initial term of this Agreement shall be for a period of ten (10) years from the effective date of the Concession Contract, which is expected to be January 1, 2014. In any event, the initial term of this Agreement shall commence not later than the effective date of the Concession Contract. The non -revocable right to use and occupy the Permitted Use Facilities granted in this Agreement shall be in effect continuously and without interruption for the initial ten (10) year term and any renewal term thereafter. 13. The Town acknowledges that the intent of this Agreement is to provide for the use of the Permitted Use Facilities, in part, by a Concessioner who shall be authorized to conduct the Concession Operation for a period of ten (10) years under the Concession Contract. The non -revocable right to use and occupy the Permitted Use. Facilities as set forth in this Agreement is a necessary and essential element in support of the Concessioner successfully performing the Concession Contract and of the parties thereto avoiding a breach of contract. Accordingly, the Town specifically agrees that this Agreement may be terminated only upon the express written consent of the NPS with reasonable advance notice to the Town, and that the Town shall not have the unilateral right to terminate this Agreement, or any of its rights or obligations hereunder, except and unless the NPS consents to such termination. 14. This Agreement shall not be assigned. In the event of an assignment, this Agreement shall automatically terminate and be of no further force and effect. Notwithstanding the foregoing, it is understood and agreed that nothing precludes NPS from contracting with others to conduct the Concession Operation, or to operate, manage, assist in, or implement the duties and responsibilities associated with the Permitted Use. 15. Pursuant to 31 U.S.C. § 1341, nothing herein contained shall be construed as binding the Seashore or NPS to expend in any one fiscal year any sum in excess of, or in advance of, appropriations made by Congress for the purpose of this Agreement for that fiscal year, or to involve the Seashore or NPS in any contract or other obligation for the expenditure of money in excess of such appropriations. 16. This Agreement is the sole and exclusive agreement between the Town and the Seashore, and this Agreement supersedes and replaces any prior agreements previously entered into by and between the Seashore and any of the Town's predecessors in interest relating to the Permitted Use Facilities, if any. No consideration, except as is expressly contained in this Agreement, shall be due, payable or owing from either party to the other. 17. This Agreement shall be duly filed. and recorded in the public records of Carteret County, North Carolina. 18. Narrative Description: The Town of Beaufort Town Dock project is located at 718 Front Street in the Town of Beaufort, Carteret County. The site is found by turning right off of Cedar Street (Hwy 70 East) onto Pollock Street. Follow this road to the last stop sign along Front Street and look directly ahead. It is located within the Beaufort Historic District and Beaufort's urban waterfront area. The property is 4866.08 square feet (.112 acres) in its entirety, 9.5' above NHW, has a total length of 66' along the NHW contour and is located along the North Side of Front Street. The upland vegetation mainly consists of lawn grasses, cedars, oaks, shrubs and is bordered by a 5' x 30'fringe of coastal wetlands along the western side of the existing bulkhead. The coastal wetlands adjacent to the property mainly consist of salt marsh cordgrass S artina alterniflora). The waters of Taylors Creek have an approximate -3' lunar tidal amplitude. The project site is designated as an "Urban Waterfront". The Division.of Water Quality classifies this area as SC Waters. Taylors Creek is not designated as a Primary Nursery Area and is closed to the taking of shellfish. The Town of Beaufort's Land Use Plan classifies this area as Commercial with Conservation within the AECs and is within the Beaufort Historic District. The Town of Beaufort has designated this area as an "Urban Waterfront" as well. There are no shellfish resources in the area. Per the USACOE Google Earth file, the Federal Channel Setback within this area of Taylors Creek is 15'. A portion of the existing fixed pier (approximately 25') encroaches over the channel setback, however, no work is proposed on this portion of the existing dock. During a pre - application meeting that was conducted prior to an official submittal, DCM advised the applicant that placement of the floating docks would be encroaching within the USACOE channel setback. The water depths within this project location were determined to range from - 7'nlw to-10'nlw with a connecting water depth of -10' plus nlw. The bottom substrate is silty sand with shell. Taylors Creek is approximately 706' wide at this location. 10) Proposed Development: The applicant wishes to add four new floating docks and three permanent wet slips (no formalized slips currently) along the existing fixed pier, in order to maintain compliance with a Memorandum of Agreement with the National Park Service that would provide ADA compliant passenger ferry service to Cape Lookout. The existing pier is 10' x 90' and intersects a fixed 4' x 15' L-head platform. There is an existing 8' x 15' floating platform located on the west side of the existing pier that would be removed. The proposed platforms would be used to safely assist in the loading and unloading of passengers. The pr9posed,floating platforms along the eastern side of the pier would be 12'x 24' and 12' x 30'. They would be held in place by four steel pilings and would be accessed by a 5' x 35' gangway adjacent to the east side of the existing pier access. This area would be designated as slip #1 and would allow for the docking of a 13' x 35' forty-eight passenger ferry. The final two floating platforms would be located on the western side of the pier and landward of the existing fixed L-head platform and held into place by four steel pilings. The dimensions for these platforms would both be 12' x 30' and would be accessed by a 5' x 35' gangway. The gangway would be located on the western side of the pier access. The Field Investigation Report: Town of Beaufort Town Docks Page 3 of 3 area would be designated as slips two and three and would allow the dockage of two smaller (8' x27') eighteen passenger ferries. The proposed platforms would be located a distance of 25' from the western riparian corridor and 15' from the eastern riparian corridor. The two most waterward platforms (starting approximately 36' from the bulkhead or nhw/mhw) would encroach over the USACOE channel setback approximately 25', however would be landward of the existing fixed L-head platform. This would increase the slip count to a total of three permanent slips located within this area. The typical boat using s oc g acility would be 27'- 35' passenger ferries. The docking facility would prohibit overboard discharge with no overnight or live aboard dockage. 11. Anticipated Impacts: The proposed platform additions would shade and incorporate 1,368 ft2 of shallow bottom and add three permanent wet slips (no formalized slips currently). The existing water depths (7' to 10' nlw) are sufficient for this use and would not require dredging at this time. The setting of pilings has the potential to cause a temporary increase in turbidity during construction activities. There should be no hindrance to navigation due to the proposed floating platforms and slips are located landward of the existing fixed 1-head platform located at the end of the existing pier. There is approximately 8.5' of water at the end of the dock at mean low water. An existing dock plan and profile are depicted in on the following page.The dock was recently renovated with a new deck and the addition of new wood piles for additional structural support. Currently, its primary use is for swimming fishing, and casual waterfront observation. During the programming workshop, three concept alternatives were considered for renovating the existing dock at Grayden Paul Park for ferry operations. Subsequent discussions related to the alternatives focused on minimizing impacts to the site and minimizing new constmction/renovation of the existing foxed dock.The alternatives that were considered and discussed are summarized briefly below and graphically represented in the Appendix. ALTERNATIVE I This alternative considered a new floating dock on the east side of the fixed dock with a gangway and a new gangway landing attached to the fixed dock Some wood railings would also be added for safety of ferry passengers traversing to/from the ferries. Electric and power would be added to the dock. Ferry vessels would moor on the new floating dock, along the west side of the fixed dock, and also at the end of the fixed dock if additional mooring space is needed. ALTERNATIVE 2 This alternative is similar to Alternative I except that the new floating dock is placed on the west side of the fixed dock with 2 to 3 mooring slips located on the east side of the dock This arrangement provides more linear feet of floating dock on which to moor ferry vessels.The end of the fixed dock can also be utilized for mooring ALTERNATIVE 3 This alternative places the new floating dock at the end of the fixed dock with a gangway positioned along the west side of the fixed dock and a new fixed gangway landing constructed adjacent to the dock Operationally, this arrangement does not work well due to the gangway being alongside the fixed dock and taking up dock footage that *Could be used for directly mooring vessels. Also, there could potentially be an encroachment into the navigation channel with the new floating dock and mooring/maneuvering ferry vessels. A "Major CAMA Permit" is required due to the installation of two floating docks with gangways from the Beaufort waterfront via Grayden Paul Park. These new docks are vital to accomplish the Parks Service's mission to make the national parks accessible to all citizens in a safe and functional environment of embarkation/debarkation thus enhancing the public benefit. This location is within close proximity,to the Park Service's office which will share space with Beaufort's Town Hall, located across Front Street in the former Post Office. We believe thatlthe environmental impact of this project will be minor as supported by a "Finding of No Significant Impact" (FONZI) report that was conducted by the Park Service when selecting this location for passenger ferry service. A copy of this report can be supplied if needed. Also, due to the materials for the floating docks and gangways being pre -manufactured thus there should be limited impact. Some negligible impact could happen through the installation of eight (8) steel pilings to be installed by an experienced marine contractor but it is not anticipated. This project is designed to not add any additional stomiwater impact to Taylors Creek. The Paik Service will also be responsible for the concessionaire operating the ferry service insuring that they provide an environmentally safe operation. Careful consideration has been given to protect the environment while providing safe and functional ferry operations to the National Seashore. (Again as referenced in the FONZI document). The project is projected to take only a few days to implement since the majority of the work will be completed waterside of Grayden Paul Park instead of landside. Item 6 — A Project Narrative GAWANAY EXAMPI FS TYPCAL POWER PEDESTAL several dock manufacturing -companies. Each dock would likely be manufactured in two sections and securely fastened togethdr.The floating dock sections would likely be moored with two steel piles for each dock section. Two aluminum gangways are proposed, each with a dimension of 5' x 35'.The gangways would be secured to the existing bulkhead and extend perpendicular to the bulkhead to the floating docks. At the bulkhead end of the gangways, the gangways would be equipped with a security chain and sign indicating when the ferry is not in operation and that the floating docks are closed to the public. Railings along the entire perimeter of the fixed dock are suggested in order to provide a safe use of the dock by the public and also to separate the public use of the existing fixed dock from the ferry operations on the new floating docks.This arrangement also provides additional queuing area on the fixed dock for ferry passengers waiting to board the ferry. With the railings in place, the fixed dock could remain open to the public for fishing and as a scenic overlook of the water. However, a hydrographic survey is recommended to confirm the water depth and whether rt is sufficient for the proposed docks and ferry vessel. Some minor dredging along both sides of the fixed dock may be required. • Due to the close proximity to the Town Dock and availability of additional slips, overnight mooring could be arranged at the Town docks or the BB&T dock if needed. The project is located within the Urban Waterfront Area as well as the Town of Beaufort Historic District. Field Investigation Report: Town of Beaufort (Town Docks) Page 2 of 3 9. Narrative Description: The Town of Beaufort Town Dock project is located at 718 Front Street in the Town of Beaufort, Carteret County. The site is found by turning right off of Cedar Street (Hwy 70 East) onto Pollock Street. Follow this road to the last stop sign along Front Street and look directly ahead. It is located within the Beaufort Historic District and Beaufort's urban waterfront area. The property is 4866.08 square feet (.112 acres) in its entirety, 9.5' above NHW, has a total length of 66' along the NHW contour and is located along the North Side of Front Street. The upland vegetation mainly consists of lawn grasses, cedars, oaks, shrubs and is bordered by a 5' x 30'fringe of coastal wetlands along the western side of the existing bulkhead. The coastal wetlands adjacent to the property mainly consist of salt marsh cordgrass (,Sartina alterniflora). The waters of Taylors Creek have an approximate -3' lunar tidal amplitude. The project site is designated as an "Urban Waterfront". The Division of Water Quality classifies this area as SC Waters. Taylors Creek is not designated as a Primary Nursery Area and is closed to the taking of shellfish. The Town of Beaufort's Land Use Plan classifies this area as Commercial with Conservation within the AECs and is within the Beaufort Historic District. The Town of Beaufort has designated this area as an "Urban Waterfront" as well. There are no shellfish resources in the area. Per the USACOE Google Earth file, the Federal Channel Setback within this area of Taylors Creek is 15'. A portion of the existing fixed pier (approximately 25') encroaches over the channel setback, however, no work is proposed on this portion of the existing dock. During a pre - application meeting that was conducted prior to an official submittal, DCM advised the applicant that placement of the floating docks would be encroaching within the USACOE channel setback. The water depths within this project location were determined to range from - 7'nlw to-10'nlw with a connecting water depth of -10' plus nlw. The bottom substrate is silty sand with shell. Taylors Creek is approximately 706' wide at this location. 10) Proposed Development: The applicant wishes to add four new floating docks and three permanent wet slips (no formalized slips currently) along the existing fixed pier, in order to maintain compliance with a Memorandum of Agreement with the National Park Service that would provide ADA'compliahpassenger ferry service to Cape Lookout. The existing pier is 10' x 90' and intersects a filed 4' x 15' L-head platform. There is an existing 8' x 15' floating platform located on the west side of the existing pier that would be removed. The proposed platforms would be used to safely assist in the loading and unloading of passengers. The proposed -floating platforms along the eastern side of the pier would be 12'x 24' and 12' x 30'. They would be held in place by four steel pilings and would be accessed by a 5' x 35' gangway adjacent to the east side of the existing pier access. This area would be designated as slip #1 and would allow for the docking of a 13' x 35' forty-eight passenger ferry. The final two floating platforms would be located on the western side of the pier and landward of the existing fixed L-head platform and held into place by four steel pilings. The dimensions for these platforms would both be 12' x 30' and would be accessed by a 5' x 35' gangway. The gangway would be located on the western side of the pier access. The Field Investigation Report: Town of Beaufort Town Docks Page 3 of 3 area would be designated as slips two and three and would allow the dockage of two smaller (8' x27') eighteen passenger ferries. The proposed platforms would be located a distance of 25' from the western riparian corridor and 15' from the eastern riparian corridor. The two most waterward platforms (starting approximately 36' from the bulkhead or nhw/mhw) would encroach over the USACOE channel setback approximately 25', however would be landward of the existing fixed L-head platform. This would increase the slip count to a total of three permanent slips located within this area. The typical boat using this docking facility would be 27'- 35' passenger ferries. The docking facility would prohibit overboard discharge with no overnight or live aboard dockage. 11. Anticipated Impacts: The proposed platform additions would shade and incorporate 1,368 ft2 of shallow bottom and add three permanent wet slips (no formalized slips currently). The existing water depths (7' to 10' nlw) are sufficient for this use and would not require dredging at this time. The setting of pilings has the potential to cause a temporary increase in turbidity during construction activities. There should be no hindrance to navigation due to the proposed floating platforms and slips are located landward of the existing fixed 1-head platform located at the end of the existing pier. A "Major CAMA Permit" is required due to the installation of two floating docks with gangways from the Beaufort waterfront via Grayden Paul Park. These new docks are vital to accomplish the Parks Service's mission to make the national parks accessible to all citizens in a safe and functional environment of embarkation/debarkation thus enhancing the public benefit. This location is within close proximity to the Park Service's office which will share space with Beaufort's Town Hall, located across Front Street in the former Post Office. We believe that the environmental impact of this project will be minor as supported by a "Finding of No Significant Impact" (FONZI) report that was conducted by the Park Service when selecting this location for passenger ferry service. A copy of this report can be supplied if needed. Also, due to the materials for the floating docks and gangways being pre -manufactured thus there should be limited impact. Some negligible impact could happen through the installation of eight (8) steel pilings to be installed by an experienced marine contractor but it is not anticipated. This project is designed to not add any additional stormwater impact to Taylors Creek. The Park Service will also be responsible for the.concessionaire operating the ferry service insuring that they Provide an environmentally safe operation. Careful consideration has been given to protect the environment while providing safe and functional ferry operations to the National Seashore. (Again as referenced in the FONZI document). The project is projected to take only a few days to implement since the majority of the work will be completed waterside of Grayden Paul Park instead of landside. Item 6 —A Project Narrative RECEIVED JAN 17 2014 Dc-TY1-gacffY DOCK 1MPROVEA/MN I The existing dock at Grayden Paul Park consists of a fixed wood dock and timber piles.The dock is approximately 10' wide by 90' long with a 4' x 15' finger dock at the end on the east side. There is approximately 8.5' of water at the end of the dock at mean low water. An existing dock plan and profile are depicted in on the following page. The dock was recently renovated with a new deck and the addition of new wood piles for additional structural support. Currently, lts primary use is for swimming, fishing, and casual waterfront observation. During the programming workshop, three concept alternatives were considered for renovating the existing dock at Grayden Paul Park for ferry operations. Subsequent discussions related to the alternatives focused on minimizing impacts to the site and minimizing new construction/renovation of the existing fixed clock. -The alternatives that were considered and discussed are summarized briefly below and graphically represented in the Appendix. ALTERNATIVE 1 This alternative considered a new floating dock on the east side of the fixed dock with a gangway and a new gangway landing attached to the fixed dock Some wood railings would also be added for safety of ferry passengers traversing to/from the ferries. Electric and power would be added to the dock Ferry vessels would moor on the new floating dock, along the west side of the fixed dock and also at the end of the fixed dock if additional mooring space is needed. ALTERNATIVE 2 This alternative is similar to Alternative I except that the new floating dock is placed on the west side of the fixed dock with 2 to 3 mooring slips located on the east side of the dock This arrangement provides more linear feet of floating dock on which to moor ferry vessels.The end of the fixed dock can also be utilized for mooring. ALTERNATIVE 3 This alternative places the new floating dock at the end of the fixed dock with a gangway positioned along the west side of the fixed dock and a new fixed gangway landing constructed adjacent to the dock Operationally, this arrangement does not work well due to the gangway being alongside the fixed dock and taking up dock footage that'could be used for directly mooring vessels. Also, there could potentially be an encroachment into the navigation channel with the new floating dock and mooring/maneuvering ferry vessels. Each dock would likely be manufactured in two sections and securely fastened togethdr.The floating dock sections would likely be moored with two steel piles for each dock section. Two aluminum gangways are proposed, each with a dimension of S' x 35'.The gangways would be secured to the existing bulkhead and extend perpendicular to the bulkhead to the floating docks. At the bulkhead end of the gangways, the gangways would be equipped with a security chain and sign indicating when the ferry is not in operation and that the floating docks are closed to the public. Railings along the entire perimeter of the fixed dock are suggested in order to provide a safe use of the dock by the public and also to separate the public use of the existing fixed dock from the ferry operations on the new floating docks.This arrangement also provides additional queuing area on the fixed dock for ferry passengers waking to board the ferry. With the railings in place, the fixed dock could remain open to the public for fishing and as a scenic overlook of the water. Two power pedestals are proposed to be installed on each side of the existing fixed dock to service the ferry vessel fleet. (see photo) • If mooring larger vessels at the end of the fixed dock are desired, then additional piles may be necessary for Tendering and mooring of the vessels. At this time, it would appear that mooring larger vessels at the end would not be necessary because there is sufficient space along the floating docks and also slips available nearby at the BUT dock orTown docks. • In general, the water depths appear adequate for the floating docks and the ferry vessel operations. However, a hydrographic survey is recommended to confirm the water depth and whether it is sufficient for the proposed docks and ferry vessel. Some minor dredging along both sides of the fixed dock may be required. • Due to the close proximity to the Town Dock and availability of additional slips, overnight mooring could be arranged at the Town docks or the BB&T dock if needed. JA N 17 2014 This USE AND OCCUPANCY AGREEMENT ("Agreement") is made by e& en the TOWN of BEAUFORT, a North Carolina municipal corporation ("Town") and Cape Lookout National Seashore (Seashore), a unit of the National Park Service ("NPS"), for the purposes set forth herein. RECITALS WHEREAS, the Town owns certain real estate located in Carteret County, North Carolina, known as the Town Hall, located at 701 Front Street, Beaufort, North Carolina ("Town Hall") and Grayden Paul Park, which has access to Taylor's Creek and is located directly across Front Street from the Town Hall. Collectively, the Town Hall and Grayden Paul Park are referred to herein as the "Town Facilities;" and WHEREAS, the Seashore intends to offer its visitors the opportunity to enjoy the unique natural and cultural resources situated on Shackelford and Core Banks via passenger ferry transportation service from a launch point in Beaufort, North Carolina; and WHEREAS, this passenger ferry service will be provided by the Seashore through NPS concession contract CC-CALO001-14 ("Concession Contract") between the National Park Service ("NPS") and a Concessioner pursuant to Public Law 105-391, a copy of which shall be attached hereto and incorporated herein as if set forth verbatim in this Agreement. Cam' NOW, THEREFORE, in exchange for the benefits to the Town as a result of the Seashore providing the Concession Operation and conducting visitor outreach activities in the Town of Beaufort, the parties agree to the following terms and conditions. TERMS AND CONDITIONS 1. The Town hereby grants to the Seashore the non -revocable right to use and occupy certain areas and structures within the Town Facilities for the purpose of enabling and facilitating the Concession Operation, visitor outreach activities, and for such other purposes described herein (collectively hereinafter the "Permitted Use"). 2. The Town's grant herein is more specifically described as the non -revocable right for the Seashore and Concessioner to use and occupy the following areas and structures within the Town Facilities (hereinafter "Permitted Use Facilities") for engaging in the Permitted Use: (i) Exclusive use and occupancy of approximately 800 square feet of space within the Town Hall for, among other things, Seashore orientation, visitor education, and Concession Operation ticket sales; and (ii) Exclusive use of three (3) boat slips at the Grayden Paul Park dock on Taylor's Creek sufficient to accommodate the mooring and refueling of the vessels required or authorized in the Concession Contract for use in the Concession Operation; and (iii) Exclusive use of 85 parking spaces within 1500 feet the Town Hall for Concession Operation passengers and Concessioner staff. (iv) The non-exclusive use of the common areas and restroom facilities within the Town Hall, and at or upon the dock and boat slips described in subparagraph (ii) at Grayden Paul Park for use in connection with the Concession Operation. 3. In addition to the non -revocable right of use and occupancy granted herein, the Town agrees to carry out the commitments it made to the Seashore in the "Cape Lookout National Seashore Town of Beaufort Departure Site Response" dated January 6, 2011, a copy of which is attached hereto and incorporated herein as if set forth verbatim in this Agreement. 4. NPS shall cause the Concessioner to conduct the Concession Operation in such a way that the Permitted Use Facilities shall remain in the same or similar condition as they were on the effective date of this Agreement, reasonable wear and tear excepted. The Town shall pay the costs of utilities incurred for use of the Pennitte(PPVTNT files in furtherance of the Permitted Use, to include but not be limited to electricity, water, sewer, and such other utilities to enable such Permitted Use of the premises by the Seashore and the Concessioner. 6. No ad valorem, property or other use or occupancy taxes will be assessed by the Town to the Seashore, NPS, or the Concessioner during the term of this Agreement. NPS and/or the Concessioner shall be responsible for the installation and maintenance costs for any telephone, computer or other communication services or devices utilized by NPS or the Concessioner in furtherance of the Permitted Use at or within the Permitted Use Facilities. 8. NPS and the Seashore are self -insured and are not required to obtain liability insurance for the activities associated with the Permitted Use. NPS and the Seashore's liability is and shall be limited to any claims allowed by the Federal Tort Claims Act, 28 U.S.C. §§2671-2676. 9. The Town acknowledges that the NPS expects to enter into a 10-year Concession Contract with a Concessioner to assist in or implement some of the activities associated with the Permitted Use, most notably the Concession Operation. As required in the Concession Contract, the Concessioner will procure and continuously maintain insurance policies of the types and in the minimum amounts detailed in the Concession Contract during its 10-year term and any subsequent renewal periods. 10. The Town shall maintain a general property insurance policy during the term of this Agreement with sufficient coverage to enable repair or replacement of the Permitted Use Facilities. In this regard, the Town represents that said insurance policy shall cover the Permitted Use Facilities against damage caused by natural disaster, vandalism, fire and other casualties. 11. NPS shall cause its Concessioner to indemnify, save, hold harmless and defend the Town, its respective boards, officers, employees, representatives and agents against any claim, action, loss, damage, injury, liability, cost and expense of whatsoever kind or nature (including but not by way of limitation, attorneys' fees and court costs) arising out of injury to persons or damage to property caused by Concessioner's acts or omissions arising out of or incidental to the Permitted Use. This indemnification provision is separate and apart from, and in no way limited by, any insurance policy or coverage provided by Concessioner pursuant to the Concession Contract. 12. The initial term of this Agreement shall be for a period of ten (10) years from the effective date of the Concession Contract, which is expected to be January 1, 2014. In any event, the initial term of this Agreement shall commence not later than the effective date of the Concession Contract. This Agreement may be extended for an additional Page 3 of 6 rJA RECMM I N 17 2014 period up to three (3) years beyond the initial term, and such renew%sha Mtomatic unless NPS gives the Town notice of its intent not to renew within a reasonable time before expiration of the initial term. Any renewal beyond the initial term shall be executed by written instrument signed by authorized representatives of the parties. The non -revocable right to use and occupy the Permitted Use Facilities granted in this Agreement shall be in effect continuously and without interruption for the initial ten (10) year term and any renewal term thereafter. 13. The Town acknowledges that the intent of this Agreement is to provide for the use of the Permitted Use Facilities, in part, by a Concessioner who shall be authorized to conduct the Concession Operation for a period of ten (10) years under the Concession Contract. The non -revocable right to use and occupy the Permitted Use. Facilities as set forth in this Agreement is a necessary and essential element in support of the Concessioner successfully performing the Concession Contract and of the parties thereto avoiding a breach of contract. Accordingly, the Town specifically agrees that this Agreement may be terminated only upon the express written consent of the NPS with reasonable advance notice to the Town, and that the Town shall not have the unilateral right to terminate this Agreement, or any of its rights or obligations hereunder, except and unless the NPS consents to such termination. 14. This Agreement shall not be assigned. In the event of an assignment, this Agreement shall automatically terminate and be of no further force and effect. Notwithstanding the foregoing, it is understood and agreed that nothing precludes NPS from contracting with others to conduct the Concession Operation, or to operate, manage, assist in, or implement the duties and responsibilities associated with the Permitted Use. 15. Pursuant to 31 U.S.C. § 1341, nothing herein contained shall be construed as binding the Seashore or NPS to expend in any one fiscal year any sum in excess of, or in advance of, appropriations made by Congress for the purpose of this Agreement for that fiscal year, or to involve the Seashore or NPS in any contract or other obligation for the expenditure of money in excess of such appropriations. 16. This Agreement is the sole and exclusive agreement between the Town and the Seashore, and this Agreement supersedes and replaces any prior agreements previously entered into by and between the Seashore and any of the Town's predecessors in interest relating to the Permitted Use Facilities, if any. No consideration, except as is expressly contained in this Agreement, shall be due, payable or owing from either party to the other. 17. This Agreement shall be duly filed and recorded in the public records of Carteret County, North Carolina. 18.
