1) This minor modification authorizes the installation of 6 dolphin clusters on 20 ft. centers extending
southwest from the corner of the existing basin to protect larger vessels from the presence of
submerged rocks. The dolphin clusters shall be installed in accordance with the attached workplan
drawing dated received 12/10/99.
2) In accordance with commitments made by the permittee, the authorized dolphin clusters will not be
used for the mooring of vessels.
3) This minor modification must be attached to the original of Permit No. 8-96, which was transferred
into the name of the permittee on 4/17/98, and the major modification issued on 6/2/98 as well as all
subsequent modifications, refinements and renewals, and all documents must be readily available on
site when a Division representative inspects the project for compliance. All conditions and
stipulations of the active permit remain in force under this modification unless altered herein.
This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date. An appeal requires resolution prior to work initiation or
continuance as the case may be.
This permit must be accessible on -site to Department

Attached is a request from Jarrett Bay Boatworks to modify their permit which
authorized the construction of a docking facility and basin expansion for launching and
maintenance of vessels. The permittee now wishes to add 6 dolphin clusters on 20'
centers extending southwest from the comer of the basin to protect larger vessels from
the presence of submerged rocks. He states that these dolphins would not be used for
mooring.
Unfortunately, this request has been in this office for over two months. And
although Tere Barrett requested that it be handled by a Letter of Refinement, you and I
discussed the need for a minor modification. Therefore, the processing fee has been
deposited and a copy of the $50.00 check is attached for your files. Ms. Barrett and I
both agree that the project as proposed is consistent with the pertinent rules and have no
objections to the issuance of a modified permit with the same conditions as originally
permitted and/or modified as long as the work is constructed in accordance with the

Please find enclosed a request from Mason Cox, acting on behalf of Jarrett Bay
Boatworks, to modify this permit by way of refinement. The original permit
authorized a docking facility north of the basin, and an expansion of the basin for
vessel launching and maintenance. The applicant is having difficulty preventing
vessels from running into the pre-existing rock placed for shoreline stabilization.
The currents in Core Creek are strong, and prevent ease and safety of navigating
into the basin. Mr. Cox is proposing to place 6 cluster dolphins extending
southward from the mouth of the basin, for vessels to lay alongside as they are
attempting to enter the basin. He has stated that these are not to be used for
mooring, and in fact, they are not positioned such that they can be utilized for
mooring. The dolphins are proposed for 20' apart, extending 100' from the dogleg
in the bulkhead, for a total distance of 50' into Core Creek.
Everything else about the project remains as authorized originally or modified. I
recommend the request be authorized under a Letter of Refinement, to include all
original conditions.

Based on the disclosure requirements of CAMA Permit No. 8-96, I have submitted two maps to your
1. Lot No. 11 subdivision, into Lot I lA and I1B, with no improvements (simple subdivision for the
purpose of sale pending on Lot I IA to Gregory Poole Power Systems)
2. Lot No. 7 subdivision, into ten (10) smaller parcels, with the proposed improvements of an 800' road
extension off of Sensation Weigh (South) into the parcel. The proposed subdivision will also extend
municipal water and sewer service.
Please call me with any questions or concerns, and I am more than willing to supply any supporting
documents that your might request.
I would also like to formally request to refine CAMA permit No. 8-96 to include 6 clusters of pilings
(dolphins) on 20' centers extending southwest from the southwest comer of our Basin. The purpose of these
pilings is to protect large vessels (>100') from the presence of submerged rocks in this area. We have already
experienced an unfortunate encounter with these rocks, and this hazard continues to present itself to larger
vessels. These pilings will not facilitate a "slip" for a vessel of any length, and will only be utilized as a safety

Through coordination with the North Carolina Division of Coastal Management, we have
learned of your request for renewal and modification of your permit to install six dolphin clusters.
The Department of the Army (DA) permit issued on July 1, 1998, authorized excavation of
material for maintenance of a barge basin in Core Creek, on the Intracoastal Waterway north of
Beaufort, Carteret County, North Carolina.
Your proposal continues to be consistent with the provisions and objectives of general
permit No. 198000291. The permit is hereby modified to include the proposed work. It is
understood that all other conditions of your permit remain applicable and that the expiration date
is December 31, 2001 for new work and December 31, 2004 for maintenance.
Please be advised that the following are conditions of this DA permit:
1. The permittee understands and agrees that, if future operations by the United States
require the removal, relocation, or other alteration, of the structure or work herein authorized, or
if, in the opinion of the Secretary of the Army or his authorized representative, said structure or
work shall cause unreasonable obstruction to the free navigation of the navigable waters, the
permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate, or
alter the structural work or obstructions caused thereby, without expense to the United States.
No claim shall be made against the United States on account of any such removal, relocation, or
alteration. The permittee shall notify NOAA/NATIONAL OCEAN SERVICE, Chief Source
Data Unit, Attention: Sharon Tear N CS261, 1315 E West HWY RM 7316, Silver Spring, MD
20910-3282 at least two weeks prior to beginning work and upon completion of work.
2. The applicant will comply with the attached US Coast Guard regulations.

COAST GUARD REGULATIONS APPLICABLE TO DREDGE OPERATIONS
Below is a list of regulations which are applicable to dredge operations in the COTP Wilmington
zone. This list is not all inclusive. We encourage dredge companies to schedule a meeting with
members of the USCG staff, in order to be provided amplifying information or answers to any
questions that may exist. We also strongly encourage all Uninspected Towing Vessels (UTV)
associated with each dredging operation to participate in the USCG's UTV Voluntary
Commercial Dockside Examination program. Please contact LT Dave Brown of the USCG staff

The enclosed permit constitutes authorization under the Coastal Area Management Act, and where
applicable, the State Dredge and Fill Law, for you to proceed with your project proposal. The original
(buff -colored form) is retained by you and it must be available on site when the project is inspected for
compliance. Please sign both the original and the copy and return the copy to this office in the enclosed
envelope. Signing the permit and proceeding means you have waived your right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS
113A-121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B
with the Office of Administrative Hearings, P.O. Drawer 11666, Raleigh, NC 27611, (919) 733-2698
within twenty (20) days of this decision on your permit. You should also be aware that if another qualified
party submits a valid objection to the issuance of this permit within twenty (20) days, the matter must be
resolved prior to work initiation. The Coastal Resources Commission makes the final decision on any
appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work
must be carried out in accordance with your application. Modifications, time extensions, and future
maintenance require additional approval. Please read your permit carefully prior to starting work and
review all project plans, as approved. If you are having the work done by a contractor, it would be to your
benefit to be sure that he fully understands all permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we
request that you complete and mail the enclosed Notice Card just prior to work initiation. However, if
questions arise concerning permit conditions, environmental safeguards, or problem areas, you may contact
Department personnel at any time for assistance. By working in accordance with the permit, you will be
helping to protect our vitally important coastal resources.

RE: Cama Major Permit #8-96
Dear Tere,
Jarrett Bay Boatworks, Inc., was issued a State permit #8-96 on 04/17/98. This
permit allows for the maintenance dredging of the existing basin. We intend on
contracting the maintenance dredging of the existing basin to its original depth. No
dimensional changes are proposed. We estimate that approximately 5,000 cu. ft. of
materials will be removed by hydraulic dredge during the period of 01 April 2003.This
letter serves as a final notice that Jarrett Bay Boatworks, Inc., will exercise State permit
#8-96 within one month (dependent on contractors).
