The Department of the Army permit issued on February 22, 1996 authorized excavation of approximately 32,000 square feet of material from non -vegetated shallow bottom waters for the maintenance of a barge basin to minus 12 feet deep in Core Creek, on the Atlantic Intracoastal Waterway, on SR 1242, approximately 5 miles north of Beaufort, in Carteret County, North Carolina. Your proposal continues to be consistent with the provisions and objectives of general permit No. 198000291. The permit is hereby modified to include the requested work. It is understood that all other conditions of your permit remain applicable and that the expiration date is December 31, 1999. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B withthe Office of Administrative Hearings, P.O. Drawer 11666, Raleigh, NC 27611, (919) 733-2698 within twenty (20) days ofthis decision on your permit. You should also be aware that if another qualified party submits a valid objection to the issuance of this permit within twenty (20) days, the matter must be resolved priorto work initiation. Otherwise, all work must be carried out in accordance with your application. Modifications, time extensions, and future maintenance require additional approval. The anticipated subdivision and re -zoning of the tract has occurred, and ownership transfers are in progress. Mr. Cox is submitting two modifications to the site outside of the AEC. The first is for the development of Lot 13 into a commercial, marine related business. The current proposal for this 1.38 acre site includes the filling of approx..15 acre of Section 404 Wetlands, with a finished impervious coverage of .74 acres. The total allowed on this lot in order to comply with the overall stormwater plan is .8 acres. The second item deals with Lot 17, also outside of the AEC. This lot has been purchased by Marine Industrial Partners, and they have already graded a 28,000 square foot area of high ground. No other work is expected for this lot at this time. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3103. This Certification allows you to use Nationwide Permi[ Number 14 when the Corps of Engineers issues it. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non -Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wedand fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in ISA NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act.
