PROJECT DESCRIPTION The project site (property) is located at 32 Pelican Drive (off NC Hwy 74), adjacent to Banks Channel, in Wrightsville Beach, New Hanover County., To locate the property travel east on Eastwood Road from Military Cut-off Road, approximately 1 mile toward Wrightsville Beach. Cross the drawbridge, continue traveling North on W. Salisbury St. for approx. 0.5 mile to Pelican Drive. Pelican Drive parallels Salisbury Street and is adjacent to Banks Channel and Lee's Cut. The project site is located on the left side of the road. Existing structures on the project site include a single family residence and private docking facility. The project site is approximately 0.20 acres and is vegetated primarily with domestic grasses and ornamental landscaping. The project site has approximately 62 feet of shoreline frontage along Lee's Cut that has been stabilized by a concrete bulkhead. No wetland vegetation is present water ward of the existing bulkhead and the high water meets the bulkhead. CAMA General Permit #20441 D was issued to Brad Fields on April 6, 1999, and authorized the installation of a 12 feet wide by 12 feet long boatlift. This general permit drawing references an "existing pier, T-head, and floats". These structures appear to be consistent with the existing facility. The Wrightsville Beach Land Use Plan classifies the adjacent waters as Conservation and the adjacent high ground portion as Developed. The waters of Banks Channel and Lee's Cut are classified as SB, by the NC Division of Water Quality. These waters are not designated as PNA by the NC Division of Marine Fisheries and are closed to the harvest of shellfish. 10. PROPOSED., PROJECT The applicant proposes to excavate a boat basin and construct a private seven (7) slip docking facility. The applicant is proposing to remove the existing docking facility and reconstruct a new docking facility. As proposed, an access pier would originate near the center of the lot at the bulkhead and extend water ward. The proposed access pier would measure approximately 6 feet in width by 12 feet in length and would terminate at an "L"-head platform measuring approximately 10 feet in width and 12 feet in length. The applicant is proposing to cover this platform and a portion of the access- pier. As proposed, the roof dimensions would measure approximately 16 feet in width by 12 feet in length. The access pier would connect via an access ramp, measuring approximately 4 feet in width by 16 feet in length. The ramp would connect to a proposed floating access pier measuring approximately 44.5 feet in length by 6 feet in width. The floating access pier would terminate at a "T"-head floating dock that, as proposed, would measure approximately 6 feet in width by 34 feet in length. The applicant is also proposing two (2) finger piers on either side of the access pier. The proposed finger pier on the east side of the floating access pier would be located approximately 35 feet from the existing bulkhead. As proposed the finger pier on the east side of the floating access pier which would measure approximately 6 feet in width by 12 feet in length. A finger pier is also proposed on the west side of the fixed access pier which would be located approximately 5 feet water ward of the existing bulkhead. As proposed, the finger pier would measure approximately 6 feet in width by 16 feet in length. The applicant is also proposing two (2) boatlifts on either side of the floating access pier and both would measure approximately 13 feet in width by 13 feet in length. The applicant is also proposing to excavate a boat basin in the location of the docking facility. The proposed boat basin would measure approximately 40 feet in width and approximately 40 feet in length on the north side and approximately 50 feet in length on the south side. Existing water depths range from +2 feet at MLW (adjacent to the bulkhead) to -6 feet at Mean Low Water on the water ward side of the proposed 7-head" floating dock. The applicant is proposing to excavate the basin to a final project depth of -4 feet at Mean Low Water. As proposed, the boat basin would be excavated to meet the existing natural -4 foot contour. The spoil disposal area is ACOE DA # 248 and is owned by Agnes Beans. A letter of authorization to deposit spoil material at this location has been included as part of this application packet. The applicant states an area measuring approximately 300 feet in length by 200 feet in width. The applicant has stated that the material would be kept on site by silt fence or a diked berm. 11. ANTICIPATED IMPACTS Based on the submitted drawings, the proposed dredging would result in the removal of approximately 185 cubic yards of spoil material in the disturbance of approximately 60,000 sq. ft. of high ground. The proposed spoil disposal area would be located a minimum of 30 feet landward of the MHW boundary and would not impact any wetlands. The construction of the proposed docking facility would result in the incorporation of approximately 1,307 square feet of Estuarine Waters AEC. The proposed boat basin excavation would result in the disturbance of approximately 2,000 square feet of shallow bottom habitat. As proposed the docking facility would provide slips for seven (7) vessels. The proposed docking facility would adhere to the established pier head line and would be setback a minimum of 15 feet from both of the adjacent riparian property owners. The dredging activity and docking facility construction would result in a temporary increase in turbidity; however, no long term impacts are anticipated. PROJECT DESCRIPTION The project site (property) is located at 32 Pelican Drive (off NC Hwy 74), adjacent to Banks Channel, in Wrightsville Beach, New Hanover County. To locate the property travel east on Eastwood Road from Military Cut-off Road, approximately 1 mile toward Wrightsville Beach. Cross the drawbridge, continue traveling North on W. Salisbury St. for approx. 0.5 mile to Pelican Drive. Pelican Drive parallels Salisbury Street and is adjacent to Banks Channel and Lee's Cut. The project site is located on the left side of the road. Existing structures on the project site include a single family residence and private docking facility. The project site is approximately 0.20 acres and is vegetated primarily with domestic grasses and ornamental landscaping. The project site has approximately 62 feet of shoreline frontage along Lee's Cut that has been stabilized by a concrete bulkhead. No wetland vegetation is present water ward of the existing bulkhead and the high water meets the bulkhead. CAMA General Permit #20441 D was issued to Brad Fields on April 6, 1999, and authorized the installation of a 12 feet wide by 12 feet long boatlift. This general permit drawing references an "existing pier, T-head, and floats". These structures appear to be consistent with the existing facility. The Wrightsville Beach Land Use Plan classifies the adjacent waters as Conservation and the adjacent high ground portion as Developed. The waters of Banks Channel and Lee's Cut are classified as SB, by the NC Division of Water Quality. These waters are not designated as PNA by the NC Division of Marine Fisheries and are closed to the harvest of shellfish. 10. PROPOSED PROJECT The applicant proposes to excavate a boat basin and construct a private seven (7) slip docking facility. The applicant is proposing to remove the existing docking facility and reconstruct a new docking facility. As proposed, an access pier would originate near the center of the lot at the bulkhead and extend water ward. The proposed access pier would measure approximately 6 feet in width by 12 feet in length and would terminate at an "L"-head platform measuring approximately 10 feet in width and 12 feet in length. The applicant is proposing to cover this platform and a portion of the access pier. As proposed, the roof dimensions would measure approximately 16 feet in width by 12 feet in length. The access pier would connect via an access ramp, measuring approximately 4 feet in width by 16 feet in length. The ramp would connect to a proposed floating access pier measuring approximately 44.5 feet in length by 6 feet in width. The floating access pier would terminate at a "T"-head floating dock that, as proposed, would measure approximately 6 feet in width by 34 feet in length. The applicant is also proposing two (2) finger piers on either side of the access pier. The proposed finger pier on the east side of the floating access pier would be located approximately 35 feet from the existing bulkhead. As proposed the finger pier on the east side of the floating access pier which would measure approximately 6 feet in width by 12 feet in length. A finger pier is also proposed on the west side of the fixed access pier which would be located approximately 5 feet water ward of the existing bulkhead. As proposed, the finger pier would measure approximately 6 feet in width by 16 feet in length. The applicant is also proposing two (2) boatlifts on either side of the floating access pier and both would measure approximately 13 feet in width by 13 feet in length. The applicant is also proposing to excavate a boat basin in the location of the docking facility. The proposed boat basin would measure approximately 40 feet in width and approximately 40 feet in length on the north side and approximately 50 feet in length on the south side. Existing water depths range from +2 feet at MLW (adjacent to the bulkhead) to -6 feet at Mean Low Water on the water ward side of the proposed "T-head" floating dock. The applicant is proposing to excavate the basin to a final project depth of -4 feet at Mean Low Water. As proposed, the boat basin would be excavated to meet the existing natural -4 foot contour. &L. The spoil disposal area is ACOE DA # 248 and is owned by Agnes Beans. A letter of authorization to deposit spoil material at this location has been included as part of this application packet. The applicant states an area measuring approximately 300 feet in length by 200 feet in width. The applicant has stated that the material would be kept on site by silt fence or a diked berm. 11. ANTICIPATED IMPACTS Based on the submitted drawings, the proposed dredging would result in the removal of approximately 185 cubic yards of spoil material in the disturbance of approximately 60,000 sq. ft. of high ground. The proposed spoil disposal area would be located a minimum of 30 feet landward of the MHW boundary and would not impact any wetlands. The construction of the proposed docking facility would result in the incorporation of approximately 1,307 square feet of Estuarine Waters AEC. The proposed boat basin excavation would result in the disturbance of approximately 2,000 square feet of shallow bottom habitat. As proposed the docking facility would provide slips for seven (7) vessels. The proposed docking facility would adhere to the established pier head line and would be setback a minimum of 15 feet from both of the adjacent riparian property owners. The dredging activity and docking facility construction would result in a temporary increase in turbidity; however, no long term impacts are anticipated. Total = 492 sq. ft It is the staff's recommendation that the proposed docking facility and boat basin are CONSISTENT with the Rules of 15 NCAC 7H.0206 (d) Use Standards for Estuarine Waters, and Rules of 15 NCAC 7H.0207 (d) Use Standards for Public Trust Areas. It is staff's recommendation that the proposed docking facility is CONSISTENT with the Rules in 15 NCAC 7H.0208 (b) (6) Use Standards for Docks and Piers. It is staff's recommendation that the proposed boat basin is CONSISTENT with the Rules in 15 NCAC 7H.0208 (b) (1) Use Standards for Navigation channels, canals, and boat basins. The construction would provide docking space for the total up to seven (7) vessels. It is recommended that any permit issued should include the following conditions: 1. This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structures, whether floating or stationary, may become a permanent part of the structure without permit modification. No non -water dependent uses of structures may be conducted on, in, or over public trust waters without permit modification. 2. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 3. The authorized structure and associated activity must not cause an unacceptable interference with navigation and shall not exceed the established pier line and 1/4 width of the waterbody. 4. The permittee must install and maintain, at his expense, any signal lights and signals prescribed by the U.S. Coast Guard, through regulations or otherwise, on authorized facilities. 5. In order to protect water quality, runoff from the construction must not visibly increase the amount of suspended sediments in adjacent waters. 6. This permit does not authorize the interference with any existing or proposed Federal project, and, the permittee will not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 7. The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the project without having the permit transferred to a third -party. At no time shall more than seven vessels be moored or docked at the facility, with exception of the temporary tie-up docks adjacent to the boat ramp. The restriction of the number of vessels shall apply to all marine vessel types, including but not limited to motorboats, sailing vessels and personal watercraft. No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 10. No vegetated coastal wetlands/marsh grass will be excavated or filled 11. The permitted activity will be conducted in such a manner as to prevent a significant increase in turbidity outside of the area of construction or construction -related discharge. Increases such that the turbidity in the waterbody is 25 NTU's or less in all saltwater classes are not considered significant. 12. Appropriate sedimentation and erosion control devices, measures or structures must be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, sand fence, etc.). 13. Any development or land disturbing activity that is considered non -water dependent is not authorized within 30 feet of the normal high water level unless specifically exempted by Coastal Resource Commission (CRC) regulations in place at the time of such development. NOTE: It is strongly recommended that the permittee exercise all available precautions in the day-to-day operation of the facility to prevent facility waste from entering the adjacent waters. Such discharge, either directly or indirectly, to adjacent waters could contravene state water quality standards, thereby violating state law. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. Except as specified in the plans attached to this permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in the construction or maintenance of this project, in such a manner as to impair normal flows and circulation patterns within waters or wetlands or to reduce the reach of waters or wetlands. 8. Except as authorized by this permit or any USACE approved modification to this permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in the construction or maintenance of this project, within waters or wetlands. This permit does not authorize temporary placement or double handling of excavated or fill material within waters or wetlands outside the permitted area. This prohibition applies to all borrow and fill activities connected with this project. -3- 9. All mechanized equipment will be regularly inspected and maintained to prevent contamination of waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic materials. In the event of a spill of petroleum products or any other hazardous waste, the permittee shall immediately report it to the N.C. The authorized structure and associated activity must not interfere with the public's right to free navigation on all navigable waters of the United States. The permittee shall employ all sedimentation and erosion control measures necessary to prevent an increase in sedimentation or turbidity within waters and wetlands outside the permit area. All excavated materials will be confined landward of the mean high water level elevation contour and any vegetated wetlands. 13.
