The original (buff - colored form) is retained by you and it must be available on site when the project is inspected for compliance. Please sign both the original and the copy and return the copy to this office in the enclosed envelope. Signing the permit and proceeding means you have waived your right of appeal described below. If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A- 121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of Administrative Hearings, P.O. Drawer 11666, Raleigh, NC 27611, (919) 733-2698 within twenty (20) days of this decision on your permit. You should also be aware that if another qualified party submits a valid objection to the issuance of this permit within twenty (20) days, the matter must be resolved prior to work initiation. The Coastal Resources Commission makes the final decision on any appeal. The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be carried out in accordance with your application. Modifications, time extensions, and future maintenance require additional approval. If you are having the work done by a contractor, it would be to your benefit to be sure that he fully understands all permit requirements. The property has historically been used in the manufacture and shipment of steel and concrete products by the various owners and tenants but is not in use at the present time. The site is secured by fences and is posted so persons wishing to visit the site should contact Mr. F.X. Lavalle, Project Manager, with Eastern Environmental at telephone //919-637- 7884 to gain access to the project site. Several buildings and associated parking areas are located on the property which have been used in the manufacture and shipment of product from the facility. The remainder of the property consists of woodlands and wetlands. In 1971, General Steel, received Dredge and Fill Permit #414 which authorized the excavation of a barge slip into the property. The barge slip measures approximately 400' long x 80' wide and was excavated to a depth of -12' mean low water (MLW) deep. The basin has been maintained several times over the years by the various owners with the most recent work being authorized by CAMA Permit 210-85 issued to Morehead City Precast Company. The banks of the slip have been stabilized on the north side by concrete riprap and along the head of the basin and on the south side by vertical sheet pile material. Waters at the project site have been classified as SA by the Division of Environmental Management and are open to the harvesting of shellfish. The barge slip has shoaled in to an average depth of between -4' to - 8' deep at MLW and the new owner wishes to maintenance excavate the slip to its original permitted depth of -12' at MLW. The excavation is proposed to be accomplished by hydraulic dredge with the primarily sand and silt material being pumped to an existing dike disposal area which is immediately adjacent to the basin. 10. ANTICIPATED IMPACTS: The project as proposed will result in the maintenance excavation of approx. 32,000 ft.2 of boat basin bottom with. approx. 4,500 yds.' of sandy/silt material being removed. The excavation is proposed to be accomplished by the use of a hydraulic dredge with the spoils being pumped to an existing dike disposal area immediately adjacent to the basin. The effluent discharge pipe would be placed near the head of the basin and filter fabric or silt screen would be used at the mouth of the basin to help reduce the amount of turbidity associated with the dredging operation. The spoil disposal area has a capacity in excess of 14,000 yds.' No other land disturbing activities are planned at the site at the present time except that the spoil dikes may have to be reinforced or strengthen by use of a bulldozer or other piece of equipment. This would not increase the overall dimension of the dike since all work would occur inside the existing dikes. This terminal opens onto the AIWW near SR 1162, see Figure 2, and is used in the barge transport of concrete products manufactured at the AWH facility. Terminal was built in 1965 and last dredged in 1985 (Permit 210-85). The captioned COE Action ID number was assigned pursuant to our previous application that employed obsolete forms. Application documents included are: - Form DCM-MP-1, Application - Form DCM-MP-2, Excavation and Fill - $250 check to NC DEHNR for processing fee - Figure 1, Project Location Map - Figure 2, Site Map - Figure 3, Dredging Plat & Section A - Figure 4, Sounding Plat & Section B - Figure 5, Riparian Ownership Plat - copy of riparian owner notification & return receipt - 1974 Deed of Conveyance for property including barge basin (AWH is wholly owned by Hopeman Brothers Inc) AWH proposes to restore the barge basin to its original depth (-7 feet sloping to -12 feet MLW) by removing 4500 cubic yards of accumulated sediment (mud/silt/sand). Hydraulic dredging will be employed and the sediment slurry will be pumped into an existing diked spoils area that has 14,200 cubic yards capacity, see Figures 2, 3 & 4. The terminal end of the dredge pipeline will be set 50 feet inside the containment dike to preclude dike erosion and to allow adequate settlement of suspended solids. After settling, dredged water will be returned to the barge basin by overflow into the 24" riser pipe shown standing at +6' MLW on Section A of Figure 3. Actually the riser pipe height will be continuously adjusted (with short lengths of pipe) to maintain a level so as to skim only settled top water for return to the barge basin. October 16, 1995, AWH redredge application, Page 2 COE letter dated April 4, 1995 requests information regarding: (a) possible alternatives to proposed work; plans to (b) minimize adverse impacts and (c) mitigate unavoidable loss of water or wetlands. The hydraulic dredging procedure outlined above will serve to (b) minimize any adverse impacts. There will be no water loss (c) and wetlands are not involved. Concerning possible alternatives (a), an important attribute of the AWH facility is the barge basin that for 30 years has been used for most efficient transport of products manufactured at the site, e.g. steel tanks, ocean ship deckhouses, reinforced and prestressed concrete components for roadways and bridges. Because of its proximal location on the AIWW, the AWH site is an ideal place to manufacture concrete structural elements for the new US Highway 17 bridge that will span the Neuse River between New Bern and Bridgeton. It is to service this new construction that a dredging permit is sought. The upland alternative to barging is truck transport that: 1) is far more expensive and 2) exposes the public to obvious environmental safety hazards. The dredging operation as herein proposed will have no wetlands impact and to be least damaging to waters of the Atlantic Intracoastal Waterway.
