Commission ermcit X M ajor Development in an. of Environmental Concern pursuant toNCGS 113A-118 X Excavation and/or filling pursuant to NCGS 113-229 Issued to Jarrett Bay Boatworks Inc. 1290 Marshallberg Rd., Marshallberg, NC 28553 8-96 authorizing development in Carteret County at basin off of Core Creek/AIWW, on SR 1162 ,as requested in the permittee's application dated 3/31/98 including attached work plan drawings, 4 dated received 4/l/98 and 1 dated 3/31/98. This permit, issued on Azp — :;)--91 < , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to a fine, imprisonment or civil action; or may cause the permit to be null and void. Wash Down Basin 1) No solvents, detergents or other additives may be utilized in the wash down system. Any future plans to utilize such measures will require modification of this permit. NOTE: It is strongly recommended that he permittee exercise all available precautions in the day- to-day operation of the facility to prevent sand blasting residue or other facility waste from entering adjacent waters. Such discharge, either directly or indirectly, to adjacent waters could contravene State water quality standards, thereby violating State law. ee attached sheets for Additional This petmit_action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit expires on December 31,1999 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Permit #8-96 Page 2 of 3 ADDITIONAL CONDITIONS Additional Upland Development 2) No land disturbing activities may take place except for that which is necessary for the construction of the wash down basin and concrete basin apron. 3) No additional development of any portion of the entire tract is authorized except for that which is expressly detailed in the permit application. Any additional development proposal for any portion of the tract will require additional review under this permit. This requirement shall apply even if individual parcels are leased or sold. Stormwater Management 4) The Division of Water Quality approved this project under stormwater management rules of the Environmental Management Commission on 5/26/98 (Permit No. SW8 980409). Any violation of or deviation from the plan approved by the DWQ will be considered a violation of this CAMA permit General 5) No excavated or fill material may be placed at any time, even temporarily, in any open waters or vegetated wetlands. 6) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee will not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 7) No attempt will be made by the permittee to prevent the free and full use by the public of all navigable waters at or adjacent to the authorized work. Use of the permitted activity must not interfere with the public's right to free navigation on all navigable waters of the United States. 8) No portion of any new or refurbished structure may be located nearer than 80 feet from the near edge of the federally maintained Atlantic Intracoastal Waterway channel. 9) This major modification must be attached to the original of Permit No. 8-96, which was transferred into the name of the permittee on 4/17/98, and all documents must be readily available on site when a Division representative inspects the project for compliance. All conditions and stipulations of the original permit remain in force under this modification unless altered herein. Jarrett Bay Boatworks, Inc. Permit #8-96 Page 3 of 3 ADDITIONAL CONDITIONS NOTE: The North Carolina Division of Water Quality has assigned the proposed project DWQ Project No. 980307. NOTE: The permittee should provide any and all ground water monitoring data to the Division of Water Quality, Ground Water Section, 127 Cardinal Drive Extension, Wilmington, NC 28405-3845. NOTE: The U.S. Army Corps of Engineers has assigned the proposed project COE Action ID No. 199801224. NOTE: This permit does not eliminate the need to obtain any additional permits, approvals or authorizations that may be required.
