BARRETT 'O" COASTALMWGEMENT �-�.- SUBJECT: MINOR MODIFICATION REQUEST - CAMA MAJOR PERMIT -fl; JARRETT BAY BOATWORKS, CARTERET COUNTY DATE: October 8, 1998 Please find enclosed a request from Mason Cox representing Jarrett Bay Boatworks, to modify State Permit #8-96. This modification is necessitated by condition #3 on the permit which states that "no additional development of any portion of the entire tract is authorized except for that which is expressly detailed in the permit application. Any additional development proposal for any portion of the tract will require additional review under this permit. This requirement shall apply even if individual parcels are leased or sold." The anticipated subdivision and re -zoning of the tract has occurred, and ownership transfers are in progress. Mr. Cox is submitting the proposal for the relocation and reconstruction of the entrance road into the tract, Sensation Weigh. The new road will allow for access to the newly subdivided lots without imposing on the portion of the property maintained by the original purchaser, Jarrett Bay. This roadway will require three (3) wetland crossings, totaling approximately .15 acres. The project has received approval through a Nationwide 14 authorization and a General 401 Water Quality Certification. The project does not lie within a CAMA AEC. This portion of the project has also been submitted to the Division of Water Quality for stormwater review and certification. The tract is to be developed under the low density option, and therefore, the applicant has allocated a certain impervious footprint for each tract to be sold. Restrictive covenants will be recorded with each deed to limit the purchaser to their allocation of impervious area. Included with this memo is a copy of the proposed roadway and subdivided tracts, and a table of the impervious allocations. Jarrett Bay is currently involved in obtaining a Major Modification to this permit to allow for the expansion of the high ground basin, docking facilities, ship store, and parking. The applicant anticipates receiving a re -development exemption from the stormwater requirements for this work. The Major Modification specifically address work to be accomplished on the site retained by Jarrett Bay, while the proposed roadway will provide access to the other tracts. A total of 137.5 AC of the original parcel has been sold to the White Water Development Group, LLC. The intended land use is to develop the 137.5 AC tract into a Marine Industrial Park. Therefore, a 2,900 linear foot roadway extension (Sensation Weigh) is proposed to extend into the parcel in order to service 16 lots. All of the property has been rezoned for industrial/wholesale and the proper 404 & 401 certifications are in place for the roadway construction. The road will serve an industrial subdivision that includes sixteen lots on 137.5 acres. Total area of impervious areas in this road project is 1.62 acres. Site Description The site is located at South of Steel Tank Road (S.R. 1642) West of the intersection of Steel Tank Road and N.C. Highway 101 North of Beaufort in Carteret County. Site is predominantly low coastal pine forest and wetlands. Elevations range from sea level to approximately elevation 9.0 NGVD. The site drains to the South to the Newport River through extensive 404 wetlands areas and coastal marsh at the margin.of he River. Waters of the Newport River at the site. . are classified SA by the Division of Water Quality. The Atlantic Intracoastal Waterway, Adams Creek Canal borders the site on the West.. Adjacent Land Uses The site is surrounded on the West and South by the Newport River and the associated coastal and 404 wetland areas. Adjacent properties are industrial boatbuilding and rural residential. Soils Soils on the site are for the most part dredge spoils from the excavation of the Adams Creek Canal of the AIWW. The site is flat except for spoil piles that were deposited on the site in the distant past and have taken on a natural forested character. The dredge spoil material is underlain by stiff clays characteristic of the natural soils in the area. Groundwater is typically `1.5 to 2 feet below the surface due to perching on the underlying clay layers. Stormwater Management Plan Sensation Weigh Stormwater Management Plan Page 1 The project will be developed under the Low Density Criteria of the Division of Water Quality. Ditches are to be constructed in fill areas of the road. Because the site is flat, the ditches are intermittent. Generally runoff will flow onto flat grass areas on the site. Two culverts are included in the road project to provide conveyance for runoff to flow south and east from the site towards the extensive wetlands areas and eventually to the Newport River. Flow Spreaders: Large rip -rap aprons are called for at the outfall of the culverts to functions as energy dissipaters and as flow spreader. Details of the outlet protection and spreaders are on the plans. Restrictive Covenants: An following table is provided which allocates impervious surface.areas to each of the development sites. Restrictive covenants will be included and recorded with each conveyance of property making the limitations on impervious surfaces. Copies of the restrictive covenants for each property will be provided to the Division of Water Quality. BARRETT rp SUBJECT: COMMENTS & RECOMMENDATIONS - CAMA MAJOR PERMIT - JARREfT BAY BOATWORKS, LLC, CARTERET COUNTY DATE: April 2, 1998 The following are my comments and recommendations for the above mentioned proposal: Because we can expect there to be high intensity use of this tract outside of the current proposal, and given that the property must have a CAMA Permit prior to its initial use, I feel we can justify and should require modifications to the issued permit for any future use of the tract, without regard to the AEC. The tract as a whole is to be reviewed if there is to be any activity in the AEC, and I would argue, that regardless of future divisions and ownership of the tract , this will still be applicable because of the initial development within the AEC. I feel the scrutiny is necessary due to the open status of the shellfish waters, the documentation of a shellfish resource, and the extensive amount of wetlands present on the remainder of the property. The current permit, #8-96, is set to expire on 12/31/99. This permit allows for maintenance excavation of the basin. I would recommend that with this modification to the permit, we issue a 10 year maintenance clause for the authorized excavation, to include current conditions. I recommend the project be authorized as proposed contingent upon the following conditions: 1) No other development can take place on this tract, regardless of change of ownership, without agency review and modifications to this permit. 2) Should the applicant desire to utilize solvents, detergents, or other additives in the wash down system, the current system must undergo additional scrutiny by the DWO prior to the implementation of the change. NOTE: It is strongly recommended that the permittee exercise all available precautions in the day-to-day operation of the facility to prevent sand blasting residue and/or other facility waste from entering the adjacent waters. Such discharge, either directly or indirectly, to adjacent waters could contravene State water quality standards, thereby violating State law. The applicant proposes to renovate the old concrete manufacturing and shipping plant for use as a boat manufacturing facility. Proposed work includes the construction of highground travelways, travel IA and washdown basin. In addition, the project includes extension of municipal sewer lines from the Town of Beaufort, as well as the extension of water lines from the County's North River System. (The infrastructure improvements were the subject of a consistency opinion done in March for the County's request for Community Development Block Grant Funds. A copy of that consistency opinion is attached.) Areas of Environmental Concern (AECs) impacted by the proposal include Estuarine Waters and the Estuarine Shoreline. Waters at the project site are classified as SA and are closed to the harvesting of shellfish. The area is not a Primary Nursery Area. Areas of ' 404' wetlands are also located on the site, although they appear to be located outside of the area proposed for development. I have reviewed this proposal for consistency with the 1991 Carteret County Land Use Plan (LUP) Update, as amended September 24, 1993, and offer the following comments. The general area of the project is classified as Limited Transition, while the AECs impacted by the Proposed work are classified as Conservation. In general, Carteret County allows development in Estuarine Waters which is consistent with the State's minimum use standards. A few exceptions are noted in the Marine Resource Areas policies in the Land Use Plan, but .none of these more restrictive local policies appears to be applicable to this project. Policies regarding Residential, Commercial, and Industrial Development Impacts on Resources restrict commercial and industrial uses in the Estuarine Shoreline to those that are water dependent and which cannot function elsewhere. Boat repair and construction facilities are specifically listed in these policies as being acceptable uses. The plan also states that all uses must be consistent with established zoning, where applicable. Resource Protection and Economic and Community Development policies speak to the County's support for central sewer services in several classifications, including Limited Transition.
