HomeMy WebLinkAbout8-96 Minor Mod 2006 Jarrett Bay Group LLCPermit Class MODIFICATION/NIINOR STATE OF NORTH CAROLINA Department of Environment and Natural Resources and Coastal Resources Commission C-ri"t for X Major Development in an Area of Environmental Concern pursuant to NCGS 113A-118 Excavation and/or filling pursuant to NCGS 113-229 Permit Number 8-96 Issued to Jarrett Bay Group LLC 530 Sensation Weigh, Beaufort, NC 28516 Authorizing development in Carteret County at adi. to AIWW, Core Creek, off SR 1242, Beaufort as requested in the permittee's letter dated 9/14/06, including the attached workplan drawing (1) dated 9/20/06 This permit, issued on XXX 2006 is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Dolphin Clusters 1) Unless specifically altered herein, this minor modification authorizes only the two dolphin clusters to be located in the areas depicted on the attached workplan drawing dated 9/20/06. No other structure, whether floating or stationary, shall become a permanent part of this facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over public trust waters without permit modification. 2) At no time shall any vessel be moored at the authorized dolphin clusters. The mooring of vessels at the authorized dolphin clusters may be considered a violation of this permit. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit shall be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work shall cease when the permit expires on December 31, 2009 Signed by the authority of the Secretary of DENR and the Chairman of the Coastal Resources Commission. Char es S. Signature of Permittee Jarrett Bay Group, LLC ADDITIONAL CONDITIONS General Permit #8-96 Page 2 of 2 3) This minor modification shall be attached to the original of Permit No. 8-96, which was issued on 1/17/96, and transferred to the permittee on 4/17/03, and copies of all documents, including all subsequent renewals, modifications, or letters of refinement, shall be readily available on site when Division personnel inspect the project for compliance. 4) All conditions and stipulations of the active permit remain in force under this minor modification, unless specifically altered herein. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 808-2808 prior to the commencement of any such activity for this determination. As you may be aware Session Law 2009-406, entitled "An Act to Extend Certain Government Approvals Affecting the Development of Real Property Within the State", was enacted by the General Assembly and signed into law by Governor Perdue on August 5, 2009, and amended by Session Law 2010-177 on August 2, 2010. The purpose of this Act was to prevent of the abandonment of approved projects and activities due to the unfavorable economic conditions by adding additional time to certain permits. Therefore, in accordance with this Act, you are hereby informed that the current expiration date for Permit No. 8-96 is now officially extended until December 31, 2013. You should attach this letter to the original of Permit No. 8-96, as well as all subsequent modifications, renewals and refinements and copies of all documents shall be readily available on site when a Division representative monitors the project for compliance. You are also advised that this action does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required.
