1) This renewal shall be attached to the original Permit No. 8-96, which was transferred to the permittee on 4/ 17/98,
as well as all subsequent modifications, refinements and renewals, and copies of all documents shall be readily
available on site when Division personnel inspect the project for compliance. RECEIVED

3) The Division of Coastal Management shall be notified in writing at least two (2) weeks in advance of any
maintenance work authorized by this permit and that notification include:
A. The number of the original permit
B. A statement that no dimensional changes are proposed
C. A copy of the original permit plan(s) with cross -hatching indicating the area to be maintained and the
area to be used for dredge spoil, and the estimated amount of material to be removed.
D. The date of plan revision and the permittee's signature shown anew on the original plan
This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2018

Please find correspondence enclosed dated December 3, 2014 from Mr. Tate Lawrence, Vice President of
Operations, requesting a permit renewal. State Permit #8-96 was issued for the excavation and construction of a
haul out basin within Corer Creek, near Beaufort in Carteret County. The permit expired on December 31,
2013.
The request is to renew this permit. This permit authorizes the maintenance excavation of the haul out basin
within Core Creek. The boat yard has been performing on -going maintenance excavation semi-annually and is
requesting an extension to the permit in order to continue to maintain the permitted water depths.
It is suggested that this request be processed in accordance with 15A NCAC 07J .0404(b) which states:
"Renewals for maintenance and repairs ofpreviously approved projects may be granted for periods not to
exceed 10 years." The Morehead City District Staff recommends granting the request contingent upon the
dredge and fill conditions pursuant to 15A NCAC 07J .0407(d). A check in the amount of $100 (#62585) has
been received in order to process the request.

As per our phone conversation today, we are writing this letter as a follow up to the letter dated January
13, 2012 from Mr. Jeff Fulcher (former Jarrett Bay Yard Manager) to request a five year extension on our
maintenance dredging permit (Permit # 8-96). Our intentions are to perform maintenance dredging this
Spring on our two haul out slips, 50/75 ton and 200 ton. This dredging is required so that we may
accommodate our customers with deeper draft vessels due to the buildup of silt over time.

The enclosed permit constitutes authorization under the Coastal Area Management Act, and where
applicable, the State Dredge and Fill Law, for you to proceed with your project proposal. The original (buff -
colored form) is retained by you and it must be available on site when the project is inspected for
compliance. Please sign both the original and the copy and return the copy to this office in the enclosed
envelope. Signing the permit and proceeding means you have waived your right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS
113A-121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B
with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, (919) 733-
2698 within twenty (20) days of this decision on your permit. You should also be aware that another
qualified party may submit an objection to the issuance of this permit within twenty (20) days.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work
must be carried out in accordance with your application. Modifications, time extensions, and future
maintenance requires additional approval. Please read your permit carefully prior to starting work and review
all project plans, as approved. If you are having the work done by a contractor, it would be to your benefit to
be sure that he fully understands all permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we
request that you complete and mail the enclosed Notice Card just prior to work initiation. However, if
questions arise concerning permit conditions, environmental safeguards, or problem areas, you may contact
Department personnel at any time for assistance. By working in accordance with the permit, you will be
helping to protect our vitally important coastal resources.

I am writing this letter to inform you of our need to perform
interim maintenance dredging under permit number 8-96, Core
Creek/AIWW basin off of SR 1162. We typically perform a
complete hydraulic dredging of the entire basin; however,
economical considerations preclude us from doing this until the
spring of 2013.
We would like to remove approximately 3' of muck/mud/silt
from our two haul out slips only this year. Our plan submitted for
your consideration and approval would be to utilize Trader
Construction of New Bern, N.C. to remove the spoils via a long
arm excavator and place said spoil into dump trucks and placement
of spoils into our existing containment area. We would have to
open the wall of the containment area to allow the dumping by
truck of the spoil being removed from the haul out slips.
The 200 ton slip is approximately 100' long by 30' wide
requiring removal of approximately 333 cubic yards of material.
The 50/75 ton slip is approximately 55'long by 19'wide requiring
removal of approximately 116.11 cubic yards of material.
We are currently experiencing difficulty in scheduling and hauling
of deeper draft vessels at low to mid tide levels due to the build up
of silt in the basins over the past several years. This
difficulty has limited our haul out operations and has created an
undue hardship to us and our customers.
I also believe that the current permit extension is at or near
the 5 year renewal period that we last received so I would like to
request a renewal at this time.
Please let me know if there are any questions or concerns. I
am available to meet with you on site to review our request. I
would like to perform this dredging within the next 4-6 weeks if
not sooner.
