Dear Sir:
Through coordination with the North Carolina Division of Coastal
Management, we have learned of your request for transfer and renewal of State
Permit No. 132-96. The Department of the Army permit issued on October 14,
1996 to Oaks Winds Marina and transferred to Marina Partners, LLC authorized
renovation and expansion of an existing commercial marina, involving
maintenance dredging of approximately 137,000 square feet and filling of
1,127 square feet of shallow water bottom for the construction and
reconfiguration of bulkheads and piers, off of Middle Sound, at 2127 Middle
Sound Loop Road, in Ogden, New Hanover County, North Carolina.
This proposal continues to be consistent with the provisions and
objectives of general permit No. 198000291. The permit is hereby renewed and
transferred to Marina Partners, LLC. It is understood that all other
conditions of your permit remain applicable and that the expiration date is
December 31, 2004.
Please be advised that the following is an additional condition of this
permit:
"The permittee shall comply with the attached list of United States
Coast Guard regulations."

Through coordination with the North Carolina Division of Coastal

permit to Marina Partnership, LLC, renewal of the permit, and authorization to
perform maintenance work. The Department of the Army permit issued to Mr.
Charles Thacker of Oak Winds Marina on October 14, 1996 authorized renovation
and expansion of an existing commercial marina, including maintenance dredging
of shallow water bottom for the construction and reconfiguration of bulkheads

Gentlemen:
Through coordination with the North Carolina Division of Coastal
Management (NCDCM), we have learned of the modification of your State permit
that authorizes you to renovate and expand a commercial marina, including
maintenance dredging and the reconfiguration and construction of bulkheads, on
Middle Sound, near Ogden, New Hanover County, North Carolina. This
modification provides for your use of excavated material retention areas, Site
A on Greenview Drive and Site B on Middle sound Loop Road.
Your use of either retention area, as indicated in the State's letter to
you of December 12, 1996, is consistent with the provisions and objectives of
general permit No. CESAW-0080-N-000-0291. Therefore, you may continue your
work in strict accordance with your modified State authorization. Failure to
comply with the State authorization or conditions of the general permit could
result in civil and/or administrative penalties.
If there is a need to further extend the duration of this Federal
authorization, or if any change in your work is required because of unforeseen
or altered conditions or for any other reason, a written request for renewal
of authorization or plans revised to show any change must be sent promptly to
this office and the North Carolina Division of Coastal Management before
continuing work or doing any change or alteration. Such action is necessary
as specific renewal of authorization must be obtained or revised plans must be
reviewed and the authorization modified. A request for extension of
authorization must be received no later that thirty (30) days before
expiration of the permit.
