1) Unless specifically altered herein, this minor modification authorizes the reconfiguration of the marina
facility including the additional floating docks and finger piers, all as expressly and specifically set forth
in the attached workplan drawing. No other additional structures, whether floating or stationary, or any
additional boat slips, shall become a permanent part of this marina facility without permit modification.
No non -water dependent uses of structures shall be conducted on, in or over public trust waters without
permit modification.

This permit action may be appealed by the permiffee or
other qualified persons within twenty (20) days of the issuing
date. An appeal requires resolution prior to work initiation or
continuance as the case may be.
This permit shall be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work shall cease when the permit expires on
December 31, 2013
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina Coastal

2) This minor modification does not authorize any additional boat slips.
3) This minor modification shall be attached to the original Permit No. 132-96, which was issued on 9/19/96
as well as all subsequent modifications, refinements and renewals, and copies of all documents shall be
readily available on site when Division personnel inspect the project for compliance.
4) All conditions and stipulations of the active permit remain in force under this minor modification unless
specifically altered herein.

I am writing you in order to request a Minor Modification to NCDENR Major Permit #132-96 in
association with proposed renovations to the Anchors Bend Marina located near Middle Sound
in New Hanover County. Proposed modifications to the existing facility include removal of two
large covered docking areas and associated finger piers, pilings, walkways, etc. The existing
docking configuration will be replaced with an updated floating walkway and fingers as shown
in the proposed project layout. The renovations seek to improve the existing unsafe facility
conditions, reduce impacts on the public trust, and improve facility aesthetics by mimicking
adjacent marina features. The proposed renovations does not seek to expand the facility and
maintains the existing slip count at 42.
Project specifics include the replacement of a 315' floating dock shown in red within the project
drawing (Phase 1). The existing floater is in need of structural repair due to the effects of
impinging wave energy associated with boat traffic within the nearby Atlantic Intracoastal
Waterway (AIW W). No dimensional changes are proposed for this portion of the renovation and
the floating structure will simply be replaced with a new updated structure.
Phase 2 of the proposed work will include removal of the aforementioned covered docking
structures depicted within the project drawings. The covered areas are comprised of concrete
and wood pilings approximately 30-40' in height with a dilapidated galvanized steel roof. The
structures are in poor condition and may pose a threat to public safety especially during or
following a storm event. We propose to remove the structure rather than renovate in order to
reduce shading and replicate the aesthetics of the surrounding marinas. Removal of the covered
docking areas will also include complete removal of the existing finger piers and walkways
within the area. Most of these structures (piers, pilings, etc.) are also in disrepair and pose
potential threats to public safety. The proposed floating dock, shown in green within the project
drawings, seeks to replace the existing docking facility with a modern floating walkway and
floating fingers. Calculations show that the proposed floating dock will decrease the area of
shaded bottom by approximately 40% while improving facility safety and aesthetics.

Mr. Adam C. Knierim, President of Maritech, LLC and acting agent for Foreverhome of Wilmington III, LLC, is
requesting a minor modification to State Permit # 132-96. State Permit # 132-96 was originally issued to Oak Winds
Marina, c/o Charles Thacker on September 19, 1996 for renovation of an existing commercial marina, with some
highground excavation and maintenance excavation of the existing boat basin. State Permit # 132-96 was amended on
October 1, 1996 for the relocation of spoil material. A Letter of Refinement was issued on October 21, 1996 for riprap
placement in lieu of the authorized bulkhead. The permit was transferred to Marina Partnership, LLC and renewed for
maintenance excavation on November 1, 1999. On November 22, 1999 State Permit #132-96 was transferred to Marina
Partners, LLC and renewed for a five-year maintenance period. State Permit #132-96 was once again renewed for
maintenance excavation on May 20, 2005. The permit was then transferred on September 27, 2005 to Atlantic Blue
Properties, LLC and then again to Anchors Bend Yacht Club, Inc. on May 14, 2010. The agent recently requested transfer
of State Permit # 132-96 to Foreverhome of Wilmington III, LLC, which is anticipated to be issued this week per the
Morehead City Office. State Permit #132-96 was due was due to expire on December 31, 2012; however, was subject to
extension by the Session Law 2009406, and as amended by Session Law 2010-177, the Permit Extension Act.
Mr. Knierim is requesting modification to State Permit #132-96, pending that the permit has been transferred to
Foreverhome of Wilmington III, LLC. Mr. Knierim states that the applicant proposes to reconfigure the existing 42-slip
marina. Phase I of the reconfiguration process would include the removal of the existing two (2) large roof -covered
docking areas, associated floating and fixed finger piers and pilings. Once complete, a new floating dock, measuring
approximately 315' in length by 8' in width would replace the existing floating dock located at the most eastern end of the
marina facility. This floating dock would continue to run parallel to the shoreline and would include 9- 16' in length by 4'
finger piers to continue to accommodate 16-40' slips. Another floating dock, measuring approximately 510' in length by
8' in width would be constructed within the central and most western end of the existing facility, which would run parallel
to the shoreline. This floating dock would also include 10 finger piers, measuring approximately 16' in length by 4' to
continue to accommodate 12-25' slips and 8-40' slips.

Extending off this floating dock would also be one (1) finger pier, measuring approximately 38' in length by 4'
and width and two (2) 65' in length by 4' in width, which would accommodate vessels ranging from 45' to 65' in length.
The application states that the proposed reconfiguration would continue to allow the existing facility to accommodate up
to 42 vessels and would reduce the total square footing by 40% within the existing marina facility. The agent has
included check (ck no. 1443) in the total amount of $100.00 for the processing the modification request. The agent has
also requested if the permit modification could be expedited to allow for the work to be completed for the
upcoming season.
This office has no objections to the modification of State Permit #132-96.

The enclosed permit constitutes authorization under the Coastal Area Management Act, and where applicable, the
State Dredge and Fill Law, for you to proceed with your project proposal. The original (buff -colored form) is retained by
you and it must be available on site when the project is inspected for compliance. Please sign both the original and the
copy and return the copy to this office in the enclosed envelope. Signing the permit and proceeding means you have
waived your right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-121.1 or
113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of
Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, (919) 733-2698 within twenty (20) days
of this decision on your permit. You should also be aware that if another qualified party submits a valid objection to the
issuance of this permit within twenty (20) days, the matter must be resolved prior to work initiation. The Coastal
Resources Commission makes the final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be carried
out in accordance with your application. Modifications, time extensions, and future maintenance requires additional
approval. Please read your permit carefully prior to starting work and review all project plans, as approved. If you are
having the work done by a contractor, it would be to your benefit to be sure that he fully understands all permit
requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we request that you
complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise concerning permit
conditions, environmental safeguards, or problem areas, you may contact Department personnel at any time for assistance.
By working in accordance with the permit, you will be helping to protect our vitally important coastal resources.

Dear Mr. Knierim:
Please reference your request to modify the permit for Foreverhome of Wilmington III, LLC
issued on October 14, 1996, which authorized the renovation and expansion of an existing
commercial marina, including maintenance dredging of shallow water bottom for the
construction and reconfiguration of bulkheads and piers, Oak Winds Marina, off of Middle
Sound, at 2127 Middle Sound Loop Road, in Ogden, New Hanover County, North Carolina. The
requested modification authorizes the reconfiguration of the marina facility including the
additional floating docks and finger piers.
The proposal continues to be consistent with the provisions and objectives of general permit
No. 198000291 (enclosed). The permit is hereby modified. It is understood that all other
conditions of your permit remain applicable and the permit will expire on December 31, 2013.
