be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
1) ' Unless specifically altered herein, this minor modification authorizes the boatramp and relocation of
the previously authorized floating dock, all as expressly and specifically set forth in the attached
workplan drawings.
` 2) The authorized boat ramp shall either be poured at an upland location and pushed into place once
hardened, or poured entirely within a watertight containment structure. Live concrete shall not be
allowed to contact waters of the State or waters that will enter waters of the State.
(See Attached Sheet for Additional Conditions)
This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date: An appeal requires resolution prior to work initiation or
continuance as the case may be.
This permit shall be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
'hereunder requires further Division approval.
All work shall cease when the permit expires on
- December 31, 2013
In issuing this permit, the State of North Carolina agrees

Management Program.

Mr. Adam C. Knierim, President of Maritech, LLC and acting agent for Foreverhome of Wilmington III,
LLC, is requesting a minor modification to State Permit # 132-96. State Permit # 132-96 was originally issued
to Oak Winds Marina, c/o Charles Thacker on September 19, 1996 for renovation of an existing commercial
marina, with some highground excavation and maintenance excavation of the existing boat basin. State
Permit # 132-96 was amended on October 1, 1996 for the relocation of the spoil material. A Letter of
Refinement was issued on October 21, 1996 for riprap placement in lieu of the authorized bulkhead. The
permit was transferred to Marina Partnership, LLC and renewed for maintenance excavation on November 1,
1999. On November 22, 1999 State Permit #132-96 was transferred to Marina Partners, LLC and renewed for
a five-year maintenance period. State Permit # 132-96 was once again renewed for maintenance excavation
on May 20, 2005. The permit was then transferred on September 27, 2005 to Atlantic Blue Properties, LLC
and then again to Anchors Bend Yacht Club, Inc. on May 14, 2010.
The permit was transferred again to Foreverhome of Wilmington III, LLC on May 16, 2013 and then
modified on May 29, 2013 for reconfiguration of the existing 42-slip marina, including the removal of the
existing two (2) large roof -covered docking areas, associated floating and fixed finger piers and pilings to
continue to allow the existing facility to accommodate up to 42 vessels by reducing the total square footage by
40% within the existing marina facility. State Permit # 132-96 is due to expire on December 31, 2013; however,
was subject to extension by the Session Law 2009-406, and as amended by Session Law 2010-177, the
Permit Extension Act.
Mr. Knierim is requesting another modification to State Permit # 132-96 to allow for the construction of
a new boat -ramp, measuring approximately 98' in length by 20' in width, of which approximately 35' would be
located below the normal high water (NHW) boundary. The new boat -ramp would be located adjacent to the
existing loading and unloading area of the parking lot of the existing marina and within the footprint of the
existing large roof -covered docking areas between slips 21 and 22.

The authorized floating dock which was to be located in the area of the proposed new boat -ramp would
be relocated on the eastern side of the new ramp, measuring now approximately 40' in length by 4' in width.
The authorized floating dock, also measuring approximately 40' in length by 4' in width located between slips
20 and 21 would remain. These two (2) docks would accommodate only temporary tie-up vessels associated
with the new boat -ramp; further, the authorized floating docks and associated tie pilings for slips 14 through 19
would be slightly shifted towards the west to allow for the construction of the new boat -ramp. The proposed
boat -ramp and slight reconfiguration would continue to allow the community marina facility to accommodate up
to 42-slips for the Anchors Bend Subdivision (See sheets 1 through 3 of 3 and Project Narrative).
The agent has included check (ck no. 1798) in the total amount of $100.00 for the processing the
modification request.
This office has no objections to the modification of State Permit # 132-96.

I am writing you in order to request a Minor Modification to NCDENR Major Permit #132-96 in
association with ongoing renovations to the Anchors Bend Marina located near Middle Sound in
New Hanover County. Specifically, we are requesting the addition of a boat ramp to the existing
facility as recently authorized under a Minor Modification issued on May 29, 2013 to Permit
#132-96. I am including a brief description of the earlier authorized minor modification request
in order to provide supplemental information on the project as a whole.
Facility modifications authorized in May included the removal of two large covered docking
areas and associated finger piers, pilings, walkways, etc. Followed by the replacement of the
existing docking configuration with an updated floating walkway and fingers as shown in the
proposed project layout (Sheet 2 of 3). The authorized renovations sought to improve the
existing unsafe facility conditions, reduce impacts on the public trust, and improve facility
aesthetics by mimicking adjacent marina features. The authorized renovations did not seek to
expand the facility and maintains the existing slip count at 42.
Under the present modification request, we propose to install a small boat ramp in order to
provide direct access to the marina. The proposed location of the ramp is designated within the
attached project layout and is in the area of the eastern covering in the vicinity of Slip 22 (Sheet
1 of 3). Ramp specifications are 100' x 20' and consist of a typical poured reinforced concrete
slab. Impacts on the adjacent floating docks authorized under the previous modification are
minimal. Specifically, the floating fingers extending waterward from the main floating walkway
were reconfigured so that Slips 14-22 are slightly narrower than previously proposed. For
comparison, I am including an additional drawing showing the authorized dock layout versus the
proposed layout with the addition of the boat ramp (Sheet 3 of 3). Please keep in mind that Slips
23-42 remain unchanged and the facility's total slip count remains the same at 42.

waived your right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-121.1 or
113-229, Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of
Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, (919) 733-2698 within twenty (20) days
of this decision on your permit. You should also be aware that if another qualified party submits a valid objection to the
issuance of this permit within twenty (20) days, the matter must be resolved prior to work initiation. The Coastal
Resources Commission makes the final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be carried
out in accordance with your application. Modifications, time extensions, and future maintenance requires additional
approval. Please read your permit carefully prior to starting work and review all project plans, as approved. If you are
having the work done by a contractor, it would be to your benefit to be sure that he fully understands all permit
requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we request that you
complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise concerning permit
conditions, environmental safeguards, or problem areas, you may contact Department personnel at any time for assistance.
