Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null ana vota. 1) Unless specifically altered herein, this minor modification authorizes the installation of three "no wake zone" buoys, as expressly and specifically set forth in the attached permit application and workplan drawing. Any additional development activities shall require additional approval from the Division. 2) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 3) This minor modification shall be attached to the original permit No. 11-14, which was issued on 1/27/14, and copies of both documents shall be readily available on site when Division personnel inspect the project for compliance. This permit action may be appealed by the petinittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2017 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. State Permit No. 11- 14 is due to expire on December 31, 2017. The permittee is requesting authorization to place three (3) "no wake zone" buoys within Bald Head Creek and has attached House Bill 774, which was issued on July 28, 1987 establishing a "no wake zone" throughout the creek. According to the applicant, the buoys would all be located in the designated locations depicted in the proposal drawing, dated received on August 10, 2015. The applicant states that all buoy locations are outside of the creek channel. The permittee has submitted a check (#58242) in the amount of $100.00 for the modification. This office has no objection to the modification request, provided all other local, State and federal regulations are adhered to. By copy of this memo, DCM is requesting that the USACE, WRC, DWR and DCM/Fisheries Resource Specialist, provide any comment that your agency may have on the proposed project to Heather Coats of RCM's Wilmington Regional Office office within 14 days of receipt of this memo. The Village request this under a Minor Modification to its existing CAMA Major Permit#11-14 which authorized the dredging of Lighthouse Creek in 2014. For your review and consideration, I have attached a copy of House Bill 774, issued on July 28, 1987, that establishes a "no wake zone" throughout the creek. Furthermore, I have attached a site plan dated 21 JUL 2015 showing the proposed locations of the three buoys labeled A , B & C showing the GPS coordinates, distances from the entrance to BH Creek, depths at normal low tide that were taken on July 10th, approximate distance of proposed buoy location from edge of marsh, and a design of the buoys to be installed, all of which to be located outside the creek channel. A check included in the amount of $100.00 which covers the application fee for the permit modification is also included. The General Assembly of North Carolina enacts: Section 1. No person shall operate any motorboat or vessel at greater than no -wake speed upon any of the waters within the community of Sunset Harbor and the Village of Bald Head Island, provided that the restricted areas are marked in accordance with the Uniform Waterway Marking System by the community or its designee. Sec. 2. "No -wake speed" is idle speed or a slow speed creating no appreciable wake. Sec. 2.1. Any person who violates this act shall be guilty of a misdemeanor and on conviction thereof shall be subject to a fine not to exceed two hundred and fifty dollars ($250.00). Sec. 3. This law shall be enforced by officers of the Wildlife Resources Commission, and by the Brunswick County Sheriff. Sec. 4. This act shall become effective August 1, 1987. In the General Assembly read three times and ratified this the 28th day of July, 1987.
