any parts of the structure and the adjacent property owners' riparian access corridors.
4) The riprap material shall be free from loose dirt or any pollutant. It shall be of a size sufficient to prevent°
its movement from the site by wave or current action.
5) The riprap material shall consist of clean rock or masonry materials such as but not limited to granite or
broken concrete.
6) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project
initiation.
7) This Minor Modification authorizes 2 additional formalized slips for a total slip count of 44 formalized
boat slips at the authorized marina facility.
8) This Minor Modification shall be attached to the original Permit No. 132-96, which was transferred to the
permittee on 10/6/15, and copies of both documents shall be readily available on site when Division
personnel inspect the project for compliance.
9) All conditions and stipulations of the active permit remain in force under this Minor Modification unless

Mr. David Edmonds, acting agent for AB Marina Group, LLC is requesting a minor modification to State
Permit # 132-96. State Permit # 132-96 was originally issued to Oak Winds Marina, c/o Charles Thacker on
September 19, 1996 for renovation of an existing commercial marina, with some highground excavation and
maintenance excavation of the existing boat basin. State Permit # 132-96 was amended on October 1, 1996 for the
relocation of the spoil material. A Letter of Refinement was issued on October 21, 1996 for riprap placement in lieu
of the authorized bulkhead. The permit was transferred to Marina Partnership, LLC and renewed for maintenance
excavation on November 1,1999. On November 22, 1999 State Permit #132-96 was transferred to Marina Partners,
LLC and renewed for a five-year maintenance period. State Permit # 132-96 was once again renewed for
maintenance excavation on May 20, 2005. The permit was then transferred on September 27, 2005 to Atlantic Blue
Properties, LLC and then again to Anchors Bend Yacht Club, Inc. on May 14, 2010.
The permit was transferred again to Foreverhome of Wilmington III, LLC on May 16, 2013 and then modified
on May 29, 2013 and again on November 15, 2013 for a new boat -ramp and reconfiguration of the existing 42-slip
marina, including the removal of the existing two (2) large roof -covered docking areas, associated floating and fixed
finger piers and pilings to continue to allow the existing facility to accommodate up to 42 vessels by reducing the total
square footage by 40% within the existing marina facility. State Permit # 132-96 was due to expire on December 31,
2013; however, was subject to extension by the Session Law 2009-406, and as amended by Session Law 2010-177,
the Permit Extension Act. State Permit # 132-96 was renewed on February 11, 2014 and recently transferred on
October 6, 2015 from Foreverhome of Wilmington III, LLC to AB Marina Group, LLC, which is due to expire on
December 31, 2018. To date, the work authorized under the last two modifications has not be initiated and the
existing structures remain (See Sheet 1 of 3 and Project Narrative).
Mr. Edmonds states that the new owners are requesting another modification to State Permit # 132-96 to
allow for the reconfiguration of the existing 42-slip marina, including the removal of the existing two (2) large roof -
covered docking areas, associated floating and fixed finger piers and associated mooring pilings to allow the existing
facility to accommodate from 42 vessels to 44 vessels total. Once these structures are removed, (14) fixed finger
piers, each measuring from approximately 35' in length by 4' in width and 40' in length by 5' in width would be
constructed from the existing main fixed access pier along the northern shoreline of the existing marina.

As proposed, (26) boat lifts, each measuring from approximately 13' in length by 13' in width and 16' in
length by 14' in width would be installed between each of the finger piers. The application states that slips #1 through
#11 would accommodate vessels up to 30' in length and slips #12 through #26 would accommodate vessels up to 25'
to 38' in length. Mr. Edmonds states the existing main floating dock along the shoreline and the existing floating
finger piers and associated be pilings along the eastern end of the existing marina would be removed. A new access
pier, measuring approximately 345' in length by 8' in width would be constructed along the shoreline, essentially in
the same footprint. Eight (8) fixed finger piers, each measuring approximately 40' in length by 4' in width would
extend from the main access pier toward the channel. As proposed, (17) boat lifts, each measuring from
approximately 13' in length by 13' in width would be installed between each of the finger piers. Mr. Edmonds states
the proposed reconfiguration would allow the community marina facility to accommodate up to 44-slips for the
Anchors Bend Subdivision. Mr. Edmonds also states that the existing 6' in width fixed access walkway along the
shoreline of the existing marina would be rebuilt within the existing footprint, and additional rip -rap along the shoreline
would be added as needed to maintain existing rip -rip shoreline (See Sheets 1 through 3 of 3 and Project
Narrative).
The agent has submitted a check (check No. 4021) in the amount of $100 for the modification request along
with the letters provided to the adjacent riparian property owners via certified mail. The proposed structures would not
encroach into the adjacent 15' Riparian Corridor Setback Area requirements. As proposed, this office has no
objection to the proposed project modification as long as there is no objections from other the agencies to this
proposal. It appears that the project would be located within the existing footprint of the existing marina facility and a
reduction of total square footage, and continues to be CONSISTENT with the use standards set forth in NCAC 07H
.0208(b).
By copy of this memo, DCM is requesting that the USACE and DWR provide any comment that your
agency may have on the proposed project to Heather Coats of DCM's Wilmington office within 14 days of
receipt of this memo.

Per our site visits, discussions and email exchanges this letter is to formally request the
modification to Permit # 132-96 for the project known as Anchors Bend Marina located at 2127
Clemmons Ways Wilmington, NC 28411. .
As required, we have provided detailed plans for the work to be completed for both the demo of the
existing structure(s) and the construction of the new fix dock, finger piers, walkways and power
lifts. These updated plans are attached as Exhibit A for your reference. Additionally, a full set of
construction drawings will be completed and submitted to the county for building permit, as
required by code.
Further details are attached as Exhibit B, providing you with a general summary of overview of the
work to be completed for this rehabilitation of the marina.
We have sent certified notification to adjacent landowners detailing the updated plan, those
certified mail receipts are attached as ExhibitC. We have arranged to meet with each respective
owner tomorrow to discuss these updates and get signoff.
As a reference to what is planned to be installed, we have attached the Electrical Plans as Exhibit D.
We are currently working with a local Electrical Engineer to have these plans certified and sealed.
As you know, we have been working on this for quite some time so we greatly appreciate your
continued attention to releasing the permits in order for us to begin work.

immediately assign an action identification number, acknowledge receipt thereof, and examine
the application to assure that it can be processed pursuant to this programmatic general permit.

'The applicant and the •NCDCM will be furnished written notification of the Corps'
determination. Notification to the applicant will include a brief description of the administrative
process.
b, For those proposals that may result in a discharge into waters of the United
States, including wetlands, the North Carolina Division of Water Quality (NCDWQ) and the
applicant will be informed regarding the applicant's need to obtain a Water Quality Certification
in accordance with section 401 of the Clean Water Act.
c. If, at any time, the Corps determines that a proposed activity is eligible for
authorization under another regional general permit (RGP) or a nationwide permit (NWP), this
procedure may be terminated and the activity authorized pursuant to the terms and conditions of
the appropriate RGP or NWP.
d. The permit review process conducted by the NCDCM is a public process
involving publication of public notices in local newspapers, public hearings, and various publio
appeal procedures. The Corps may issue a separate public notice for a specific proposal if it is
deemed necessary for compliance with appropriate laws, regulation -and guidance.
e. This general permit does not, in any way, alter established procedures or
responsibilities, as required by federal laws, memoranda of agreements (MOA's) or
administrative regulations, with respect to the Corps' coordination with appropriate review
agencies. The applicant will continue to have the opportunity to rebut any objections to a
proposal.
f. The Corps will provide copies of the application and plans, the NCDCM's Field
Investigation Report, and the state Bio-Report, to the U.S. Fish and Wildlife Service (USFWS},
the National Marine Fisheries Service (NMFS) the U.S. Environmental Protegtion Agency
(EPA), and -any other federal agency that the Corps determines to be a necessary review agency
(collectively, the "Federal Agencies"). Receipt of this material will initiate the Federal Agencies'
review, The Federal Agencies will be allowed sufficient time, normally thirty (30) days, to
provide the Corps with their comments and recommendations, including any proposed permit
special conditions and recommendations of denial. The Corps maygrant extensions •of time for
Federal Agency review if justified by unusual circumstances. If an extension isgranted that
would substantially delay an NCDCM decision, the application may be removed from this
general permit process.
. g. The Corps will receive and review all Federal Agency comments as well as any
applicant rebuttal. Pro#ided all Federal Agencies and the Corps are in agreement, the Corps will
prepare a coordinated federal position incorporating all Federal Agency connnents, including
proposed permit special conditions and any recommendations for denial. The Corps will -
typically furnish this coordinated federal position to the NCDCM within 45 days of its receipt of
the complete application, and copies of the Field Investigation Report and Bio-Report.
h. If the Corps does not concur with a Federal Agency's comments or
recommendations, the Corps will contact the Federal Agency and advise it of the Corps' position:

Attempts to resolve the issue may include initiating the referral procedures outlined by current
memoranda of agreement (MOA's) between the Department of the Army and the agency. No
coordinated federal position will be furnished to the NCDCM until and unless the Corps receives
written agreement from the Federal Agency that all issues have been resolved to the satisfaction
of that agency.
i. If any of the recommendations and/or conditions included in the coordinated
federal position are unacceptable to the NCDCM, the NCDCM will contact the Corps within ten
(10) days of receipt of the coordinated federal position and attempt to resolve the conflict. If
resolution of the conflict involves changes to the conditions or recommendations provided by the
Federal Agencies, the provisions of paragraphs g. and h. (above) will, apply. If the conflict ig
resolved to the satisfaction of the Corps and any affected Federal Agency, the NCDCM permit
will be issued and the authority of this general permit will apply.
j. If a Federal Agency conflict is not resolved within the time necessary for a
decision by the NCDCM, the NCDCM may proceed, independently, to conclude the state action
without inclusion of the federal position. In such case, the applicant and the NCDCM will be
notified immediately, in writing, that the state permit does not satisfy the federal permit
requirements.arid that the proposal in question may not proceed without federal authorization.
k. If the coordinated federal position is not in conflict with state agencies'
positions, law, regulation, or policy, and is acceptable to the NCDCM, a state permit will be
developed by the NCDCM fully incorporating the state and federal positions. The NCDCM will'
famish copies of the final permit to the applicant and the Corps. The NCD WQ will furnish a
copy of the Section 401 Water Quality Certification, if required, to the applicant and the Corps.
The Corps will not confirm the authorization of a proposed project under this General Permit.

o. This general permit will not be used to authorize an activity when the District
Engineer determines that the proposed activity would significantly affect the quality of the
human environment and therefore require preparation of an Environmental Impact Statement -
(EIS).
General Conditions
a. Except as authorized by this general permit or any USACE approved
modification to this general permit, no excavation, fill or mechanized land -clearing activities
shall take place, at anytime in the construction or maintenance of this project, within waters or
wetlands. This permit does not authorize temporary placement or double handling of excavated
or .fill material within waters or wetlands outside the permitted area. This prohibition applies to
all borrow and fill activities connected with this project.
b. Authorization under this general permit does not obviate the need to obtain
other federal, state, or local authorizations.
c. All work authorized. by this general permit must comply with the terms and
conditions of the applicable Clean Water Act Section 401. Water Quality Certification for this
general permit issued by the North Carolina Division of Water Quality.
d. The permittee shall employ all sedimentation and erosion control measures
necessary to prevent an increase in sedimentation or turbidity within waters and wetlands outside
the permit area. This shall include, but is not limited to, the immediate installation of silt fencing
or similar appropriate devices around all areas subject to soil disturbance or the movement of
earthen fill, and the immediate stabilization of all disturbed areas. Additionally, the project must
remain in full compliance. with 4 aspects of the Sedimentation Pollution Control Act of 1973
(North Carolina General Statutes Chapter 113A Article 4).
e. The activities authorized by this general permit must not interfere with the
public's right to free navigation on all navigable waters of the United States: No attempt will be
made by the permittee to prevent the frill and free use by the public of all navigable waters at or
adjacent to the authorized work for a reason other than safety.
f. • The permittee understands and agrees that, if future operations by the United
States require the removal, relocation, or other alteration, of the structure or work herein authorized,
or if, in the opinion of the Secretary of the Army or his authorized representative, said structure or
work shall cause unreasonable obstruction to the free navigation of the navigable waters, the
permittee will be required, upon due notice from the Corps of Engineers, to iemove, relocate, or
alter the structural work or obstructions caused thereby, without expense to the United States. No
claim shall be made against the United States on account of any such -removal or alteration.

g. The permittee, upon receipt of a notice of revocation of this permit or upon its
expiration before completion of the work will, without expense to the United States and in such
time and manner as the Secretary of the Arrny or his authorized representative may direct, restore
the affected water of the United States to its former conditions.
h. The permittee will allow the Wilmington District Engineer or his -
representative to inspect the authorized activity at any time deemed necessary to assure that the
activity is being performed or maintained in strict accordance with the Special and General
Conditions of this permit.
i. This general permit does not grant any property rights or exclusive privileges.
J. This permit does not authorize any injury to the property or rights of others.
k. This general permit does not authorize the interference with any existing or
proposed federal project.
1. In issuing this permit, the Federal Government does not assume any liability for
the following:
(1) Damages to the permitted project or uses thereof as a result of other
permitted or unpermitted activities or from natural causes.
(2) Damages to the permitted project or uses thereof as a result of current
or fixture activities undertaken by or on behalf of the United States in the public interest.
(3) Damages to persons, property, or to other permitted or unpermitted
activities or structures caused by the activity authorized by this permit.

(2). Historic, cultural or archeological sites listed in or eligible for
inclusion in the National Register of Historic Places as defined in the National Historic
Preservation Act of 1966 and its codified regulations, the National Historic Preservation
Amendment Acts of 1980 and 1992, the Abandoned Shipwreck Act of 1987 and the Native
American Graves Protection and Repatriation Act.
(3) Sites included in or determined eligible for listing in the National
Registry of Natural Landmarks.,
o. This general permit does not authorize any activity which will adversely affect
any threatened or endangered species or a species proposed for such designation, or their
designated critical habitat as identified under the Federal Endangered Species Act (16 U.S.C.
1531). Information on the location of threatened and endangered species and their critical habitat
can be obtained directly from the Corps field offices or at the following internet address:

be subject to the National Flood Insurance Program that prohibits any development, including
fill, within a floodway that results many increase in base flood elevations. This- general permit
does not authorize any activity prohibited by the National Flood Insurance Program.
q. The permittee must install and maintain, at his expense, any signal lights and
signals.prescn'bed by the U.S. Coast Guard, through regulations -or otherwise, on authorized
facilities. For further information, the permittee should contact the U.S. Coast Guard Marine

I have no issues with the proposed modification provided that the conditions of the original dredge
maintenance clause is active, to include the moratorium, turbidity curtain and dredge dimensions. The proposed
increase in slips are within an closed shellfishharvest area, so if the NC DMF Shellfish Sanitation Section determines that
the addition of these slips increases the shellfish closure, then I object to any number of slips that would result in the
additional closure of shellfish harvest grounds. Finally, the marina is in close proximity to other facilities, so the
proposed configuration should not inhibit the use of those adjacent facilities.

where applicable, the State Dredge and Fill Law, for you to proceed with your project proposal. The
original (buff -colored form) is retained by you and it must be available on site when the project is
inspected for compliance. Please sign both the original and the copy and return the copy to this office in
the enclosed envelope. Signing the permit and proceeding means you have waived your right of appeal
described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS
113A-121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter
150B with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714,
[phone] within twenty (20) days of this decision on your permit. You should also be aware that
another qualified party may submit an objection to the issuance of this permit within twenty (20) days.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work
must be carried out in accordance with your application. Modifications, time extensions, and future
maintenance requires additional approval. Please read your permit carefully prior to starting work and
review all project plans, as approved. If you are having the work done by a contractor, it would be to your
benefit to be sure that he fully understands all permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we
request that you complete and mail the enclosed Notice Card just prior to work initiation. However, if
questions arise concerning permit conditions, environmental safeguards, or problem areas, you may
contact Department personnel at any time for assistance. By working in accordance with the permit, you
will be helping to protect our vitally important coastal resources.

learned of your request to modify your permit issued October 14, 1996, authorizing the
renovation and expansion of an existing commercial marina, including maintenance dredging of
shallow water bottom for the construction and reconfiguration of bulkheads and piers, at 2127
Middle Sound Loop Road, off Middle Sound, in Ogden, New Hanover County, North Carolina.

Your proposal continues to be consistent with the provisions and objectives of general
permit No. 19800291 (copy enclosed). The permit is hereby modified. It is understood that all
other conditions of your permit remain applicable.
If any change in your work is required because of unforeseen or altered conditions or for
any other reason, plans revised to show the change must be sent promptly to this office and the
North Carolina Division of Coastal Management prior to performing any such change or

A general permit to do work in or affecting navigable waters of the United States and waters of
the United States, upon recommendation of the Chief of Engineers, pursuant to Section 10 of the
Rivers and Harbors Act of March 3,1899 (U.S.C. 403), and Section 404 of the Clean Water Act
(33 U.S.C. 1344), is hereby issued by authority of the Secretary of the Army by

TO AUTHORIZE THOSE CONSTRUCTION ACTIVITIES IN THE 20 COASTAL
COUNTIES: RECEIVING PRIOR APPROVAL FROM THE STAVE OF NORTH
CAROLINA IN THE FORM OF A, COASTAL AREA MANAGEMENT ACT (CAMA)
PERMIT, AND/OR A STATE DREDGE AND FILL PERMIT, AND IF REQUIRED, A
WATER QUALITY CERTIFICATION, THAT ARE OTHERWISE NOT ELIGIBLE
FOR FEDERAL AUTHORIZATION IN THE FORM OF A NATIONWIDE PERMIT OR
ANOTHER REGIONAL GENERAL PERMIT.
Operating Procedures
a. Applications for joint state and federal authorization under this programmatic•
general permit will be accepted through the North Carolina Division of Coastal Management
(NCDCM). Receipt of a complete application by the NCDCM will initiate the State's field
review that will include a site visit and preparation of a Field Investigation Report and a state
Bio-Report. The NCDCM will -forward a copy of the complete application, its Field
Investigation Report and its Bio-Report, to the appropriate Corps of Engineers field office,
thereby initiating federal review of the project. The Corps, upon receipt of an application, will
immediately assign an action identification number, acknowledge receipt thereof, and examine
the application to assure that it can be processed pursuant to this programmatic general permit.

'The applicant and the NCDCM will be famished written notification of the Corps'
determination. Notification to the applicant will include a brief description of the administrative
process.
b. For those proposals that may result in a discharge into waters of the United
States, including wetlands, the North Carolina Division of Water Quality (NCDWQ) and the
applicant will be informed regarding the applicant's need to obtain a Water Quality Certification
in accordance with section 401 of the Clean Water Act.
c. If, at anytime, time Corps determines that a proposed activity is eligible for
authorization under another regional general permit (RGP) or a nationwide permit (NWP), this
procedure may be terminated and the activity authorized pursuant to the terms and conditions of
the appropriate RGP or NWP.
d. The permit review process conducted by the NCDCM is a public process
involving publication of public notices in local newspapers, public hearings, and various public
appeal procedures. The Corps may issue a separate public notice for a specific proposal if it is
deemed necessary for compliance with appropriate laws, regulation•and guidance.
e. This general permit does not, in any way, alter established procedures or
responsibilities, as required by federal laws, memoranda of agreements (MOA's) or
administrative regulations, with respect to the Corps' coordination with appropriate review
agencies. The applicant will continue to have the opportunity to rebut any objections to a
proposal.
f. The Corps will provide copies of the application and plans, the NCDCM's Field
Investigation Report, and the state Bio-Report, to the U.S. Fish and Wildlife Service (USFWS);
the National Marine Fisheries Service (NMFS) the U.S. Environmental Protection Agency
(EPA), and -any other federal agency that the Corps determines to be a necessary review agency
(collectively, the "Federal Agencies"). Receipt of this material will initiate the Federal Agencies'
review. The Federal Agencies will be allowed sufficient time, normally thirty (30) days, to
provide the Corps with their comments and recommendations, including any proposed permit
special conditions and recommendations of denial. The Corps maygrant extensions 'of time for
Federal Agency review if justified by unusual circumstances. If an extension is. granted that
would substantially delay an NCDCM decision, the application may be removed from this
general permit process.
. g. The Corps will receive and review all Federal Agency comments as well as any
applicant rebuttal. Provided all Federal Agencies and the Corps are in agreement, the Corps will
prepare a coordinated federal position incorporating all Federal Agency comments, including
proposed permit special conditions and any recommendations for denial. The Corps will
typically furnish this coordinated federal position to the NCDCM within 45 days of its receipt of
the complete application, and copies of the Field Investigation Report and Bio-Report.
h. If the Corps does not concur with a Federal Agency's comments or
recommendations, the Corps will contact the Federal Agency and advise it of the Corps' position:

Attempts to resolve the issue may include initiating the referral procedures outlined by current
memoranda of agreement (MOA's) between the Department of the Army and the agency. No
coordinated federal position will be furnished to the NCDCM until and unless the Corps receives
written agreement from the Federal Agency that all issues have been resolved to the satisfaction
of that agency.
i. If any of the recommendations and/or conditions included in the coordinated
federal position are unacceptable to the NCDCM, the NCDCM will contact the Corps within ten
(10) days of receipt of the coordinated federal position and attempt to resolve the conflict. If
resolution of the conflict involves changes to the conditions or recommendations provided by the
Federal Agencies, the provisions of paragraphs g. and h. (above) will, apply. If the conflict is
resolved to the satisfaction of the Corps and any affected Federal Agency, the NCDCM permit
will be issued and the authority of this general permit will apply.
j. If a Federal Agency conflict is not resolved within the time necessary for a
decision by the NCDCM, the NCDCM may proceed, independently, to conclude the state action
without inclusion of the federal position. In such case, the applicant and the NCDCM will be
notified immediately, in writing, that the state permit does not satisfy the federal permit
requirements and that the proposal in question may not proceed without federal authorization.
k. If the coordinated federal position is not in conflict with state agencies'
positions, law, regulation, or policy, and is acceptable to the NCDCM, a state permit will be
developed by the NCDCM fully incorporating the state and federal positions. The NCDCM will'
furnish copies of the final permit to the applicant and the Corps. The NCDWQ will furnish a
copy of the Section 401 Water Quality Certification; if required, to the applicant and the Corps.
The Corps will not confirm the authorization of a proposed project under this General Permit
until the issuance of the NCDCM permit and, if required, the Section 401 Water Quality
Certification.
1. If the NCDCM permit or Section 401 Water Quality Certification is denied, the
applicant will be informed that federal authorization is denied without prejudice. '
in. No work may proceed under this general permit until the District Engineer or
his representative provides written verification that.the procedures and conditions of the general
permit have been satisfied.
n. The NCDCM and the Corps will monitor all permitted work and periodically
inspect projects for compliance with permit conditions and applicable state and federal
regulations. If any violation of the NCDCM permit is discovered which would also constitute a
violation of the federal position, both the NCDCM and the Corps, in accordance with their
respectivexegulations and policies, may take enforcement action.

o. This general permit will not be used to authorize an activity when the District
Engineer determines that the proposed activity would significantly affect the quality of the
human environment and therefore require preparation of an Environmental Impact Statement -
(EIS).
General Conditions
a. Except as authorized by this general permit or any USACE approved
modification to this general permit, no excavation, fill or mechanized land -clearing activities
shall take place, at any time in the construction or maintenance of this project; within waters or
wetlands. This permit does not authorize temporary placement or double handling of excavated
or fill material within waters or wetlands outside the permitted area. This prohibition applies to "
all borrow and fill activities connected with this project.
b. Authorization under this general permit does not obviate the need to obtain
other federal, state, or local authorizations.
c. All work -authorized. by this general permit must comply with the terms and
conditions of the applicable Clean Water Act Section 401. Water Quality Certification for this
general permit issued by the North Carolina Division of Water Quality.
d. The permittee shall employ all sedimentation and erosion control measures
necessary to prevent an increase in sedimentation or turbidity within waters and wetlands outside
the permit area. This shall include, but is not limited to, the immediate installation of silt fencing
or similar appropriate devices around all areas subject to soil disturbance or the movement of
earthen fill, and the immediate stabilization of all disturbed areas. Additionally, the project must
remain in full compliance _with all aspects of the Sedimentation Pollution Control Act of 1973
(North Carolina General Statutes Chapter 113A Article 4).
e. The activities authorized by this general permit must not interfere with the
public's right to free navigation on all navigable waters of the United States: No attempt will be
made by the permittee to prevent the full and free use by the public of all navigable waters at or,
adjacent to the authorized workfor a reason other than safety.
f. • The permittee understands and agrees that, if future operations by the United
States require the removal, relocation, or other alteration, of the structure or work herein authorized,
or if, in the opinion of the Secretary of the Army or his authorized representative, said structure or
work shall cause unreasonable obstruction to the free navigation of the navigable waters, the
permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate, or
alter the structural work or obstructions caused thereby, without expense to the United States. No
claim shall be made against the United States on account of any such.remove or alteration.

g. The permittee, upon receipt of a notice of revocation of this permit or upon its
expiration before completion of the work will, without expense to the United States and in such
time and manner as the Secretary of the Army or his authorized representative may direct, restore
the affected water of the United States to its former conditions.
h. The permittee will allow the Wilmington District Engineer or his
representative to inspect the authorized activity at any time deemed necessary to assure that the
activity is being performed or maintained in strict accordance with the Special and General
Conditions of this permit.
i. This general permit does not grant any property rights or exclusive privileges.
j. This permit does not authorize any injury to the property or rights of others.
k. This general permit does not authorize the interference with any existing or
proposed federal project.
1. In issuing this permit, the Federal Government does not assume any liability for
the following:
(1) Damages to the permitted project or uses thereof as a result of other
permitted or unpermitted activities or from natural causes.
(2) Damages to the permitted project or uses thereof as a result of current
or future activities undertaken by or on behalf of the United States in the public interest.
(3) Damages to persons, property, or to other permitted or unpermitted
activities or structures caused by the activity authorized by this permit.
(4) Design or construction deficiencies associated with the permitted work
(5) Damage claims associated with any fixture modification, suspension, or
revocation of this permit.
in. Authorization provided by this general permit may be modified, suspended or
revoked in whole or in part if the Wilmington District Engineer, acting for the Secretary of the
Army, determines that such action would be in the best public interest. The term of this general
permit shall be five (5) years unless subject to modification, suspension or revocation. Any
modification, suspension or revocation of this authorization will not be the basis for any claim
for damages against the United States Government,
n. This general permit does not authorize any activity which the District Engineer
determines, after any necessary investigations, would adversely affect:

(1) Rivers named in Section 3 of the Wild and Scenic Rivers Act (15

I have no issues with the proposed modification provided that the conditions of the original dredge
maintenance clause is active, to include the moratorium, turbidity curtain and dredge dimensions. The proposed
increase in slips are within an closed shellfish harvest area, so if the NC DMF Shellfish Sanitation Section determines that
the addition of these slips increases the shellfish closure, then I object to any number of slips that would result in the
additional closure of shellfish harvest grounds. Finally, the marina is in close proximity to other facilities, so the
proposed configuration should not inhibit the use of those adjacent facilities.

Per our site visits, discussions and email exchanges this letter is to formally request the an
additional modification to Permit # 132-96 for the project (mown as Anchors Bend Marina located
at 2127 Clemmons Ways Wilmington, NC 28411.
As discussed, the owners and their brokers have diligently marketed the sales of slips and have
come to the determination that the 40'+ boat slips are simply not the correct demand in the market.
Therefore after modifying the plans and digging into the construction documents, they have
reduced the overall number of 40'+ slips to only 2 slips and reduced the other slips down to 30'
slips to match those in Phase 1, Slips 1-11. With this reduction, there also has been additional room
for more slips to be installed within the footprint of the previously permitted marina adding a total
of 4 additional 30' boat slips.
As required, we have provided detailed plans for the work to be completed. These updated plans
are attached as Exhibit A for your reference.
Further details are attached as Exhibit B. providing you with a general summary of overview of the
work to be completed for this rehabilitation of the marina.
We have sent certified notification to adjacent landowners detailing the updated plan, those
certified mail receipts are attached as Exhibit C. Also, we have arranged to meet with each
respective owner to discuss these updates and get there signoff after answering any questions.
Lastly, with respect to the additional slips request, we have provided Ex. D a schematic showing the
originally modified plan as compared to this new plan requested as evidence of the overall footprint
from all aspects reducing —Pile Lengths, Depths, Above Water Coverage Square Footage, etc.

Permit No. 132-86. The DWR has determined that the expansion of the existing marina from 44 to 48
formalized boat slips would be INCONSISTENT with our current rules under: 15A NCAC 02B .0225
Outstanding Resource Waters (e) (7)(F) (attached), which states: (7) In the following designated
waterbodies, the only type of new or expanded marina that shall be allowed shall be those marinas located
in upland basin areas, or those with less than 10 slips, having no boats over 21 feet in length and no boats

(i) the total volume of treated wastewater for all upstream discharges combined shall not
exceed 50 percent of the total instream flow in the designated ORW under 7Q10
conditions, which are defined in Rule .0206(a)(1) of this Section;
(ii) a safety factor shall be applied to any chemical allocation such that the effluent
limitation for a specific chemical constituent shall be the more stringent of either the
limitation allocated under design conditions (pursuant to 15A NCAC 02B .0206) for the
normal standard at the point of discharge, or the limitation allocated under design
conditions for one-halfthe normal standard at the upstream border ofthe ORW segment;
(iii) a safety factor shall be applied to any discharge of complex wastewater (those containing
or potentially containing toxicants) to protect for chronic toxicity in the ORW segment
by setting the whole effluent toxicity limitation at the higher (more stringent) percentage
effluent determined under design conditions (pursuant to 15A NCAC 02B .0206) for
either the instream effluent concentration at the point of discharge or twice the effluent
concentration calculated as if the discharge were at the upstream border of the ORW
segment;
(C) New or expanded NPDES permitted wastewater discharges located upstream of the designated
ORW (for the North Fork New River ORW area; see Subparagraph (14) of this Paragraph) shall
comply with the following:
(i) Oxygen Consuming Wastes: Effluent limitations shall be as follows: BOD = 5 mg/l,
and NH3-N = 2 mg/I;
(ii) Total Suspended Solids: Discharges of total suspended solids (TSS) shall be limited to
effluent concentrations of 10 mg/I for trout waters and to 20 mg/1 for all other waters;
(iii) Emergency Requirements: Failsafe treatment designs shall be employed, including
stand-by power capability for entire treatment works, dual train design for all treatment
components, or equivalent Wlsafe treatment designs;
(iv) Nutrients: Where nutrient overenrichment is projected to be a concern, effluent
limitations shall be set for phosphorus or nitrogen, or both;
(5) Old Field Creek (New River Basin): the undesignated portion of Old Field Creek (from its source to Call
Creek) shall comply with Paragraph (c) of this Rule in order to protect the designated waters as per Rule
.0203 of this Section;
(6) In the following designated waterbodies, no additional restrictions shall be placed on new or expanded
marinas. The only new or expanded NPDES permitted discharges that shall be allowed shall be
non -domestic, non -process industrial discharges. The Alligator River Area (Pasquotank River Basin)
extending from the source of the Alligator River to the U.S. Highway 64 bridge including New Lake Fork,
North West Fork Alligator River, Juniper Creek, Southwest Fork Alligator River, Scouts Bay, Gum Neck
Creek, Georgia Bay, Winn Bay, Stumpy Creek Bay, Stumpy Creek, Swann Creek (Swann Creek Lake),
Whipping Creek (Whipping Creek Lake), Grapevine Bay, Rattlesnake Bay, The Straits, The Frying Pan,
Coopers Creek, Babbitt Bay, Goose Creek, Milltail Creek, Boat Bay, Sandy Ridge Gut (Sawyer Lake) and
Second Creek, but excluding the Intracoastal Waterway (Pungo River -Alligator River Canal) and all other
tributary streams and canals;
(7) In the following designated waterbodies, the only type of new or expanded marina that shall be allowed
shall be those marinas located in upland basin areas, or those with less than 10 slips, having no boats over
21 feet in length and no boats with heads. The only new or expanded NPDES permitted discharges that
shall be allowed shall be non -domestic, non -process industrial discharges:
(A) The Northeast Swanquarter Bay Area including all waters northeast of a line from a point at Lat.
35E 23N 51 O and Long. 76E 21N 020 thence southeast along the Swanquarter National Wildlife
Refuge hunting closure boundary (as defined by the 1935 Presidential Proclamation) to Drum
Point.
(B) The Neuse-Southeast Pamlico Sound Area (Southeast Pamlico Sound Section of the Southeast
Pamlico, Core and Back Sound Area); (Meuse River Basin) including all waters within an area
defined by a line extending from the southern shore of Ocracoke Inlet northwest to the
Tar -Pamlico River and Neuse River basin boundary, then southwest to Ship Point.
(C) The Core Sound Section of the Southeast Pamlico, Core and Back Sound Area (White Oak River
Basin), including all waters of Core Sound and its tributaries, but excluding Nelson Bay, Little

(D) The Western Bogue Sound Section of the Western Bogue Sound and Bear Island Area (White

mainland at SR 1117 to a line across Bogue Sound from the southwest side of Gales Creek to
Rock Point, including Taylor Bay and the Intracoastal Waterway.
(E) The Stump Sound Area (Cape Fear River Basin) including all waters of Stump Sound and
Alligator Bay from marker Number 17 to the western end of Permuda Island, but excluding
Rogers Bay, the Kings Creek Restricted Area and Mill Creek.
(F) The Topsail Sound and Middle Sound Area (Cape Fear River Basin) including all estuarine
waters from New Topsail Inlet to Mason Inlet, including the Intracoastal Waterway and Howe
Creek, but excluding Pages Creek and Futch Creek;
(8) In the following designated waterbodies, no new or expanded NPDES permitted discharges and only new
or expanded marinas with less than 10 slips, having no boats over 21 feet in length and no boats with heads
shall be allowed:
(A) The Swanquarter Bay and Juniper Bay Area (Tar -Pamlico River Basin) including all waters
within a line beginning at Juniper Bay Point and running south and then west below Great Island,
then northwest to Shell Point and including Shell Bay, Swanquarter and Juniper Bays and their
tributaries, but excluding all waters northeast of a line from a point at Lat. 35E 23N 510 and
Long. 76E 21N 020 thence southeast along the Swanquarter National Wildlife Refuge hunting
closure boundary (as defined by the 1935 Presidential Proclamation) to Drum Point and also
excluding the Blowout Canal, Hydeland Canal, Juniper Canal and Quarter Canal.
(B) The Back Sound Section of the Southeast Pamlico, Core and Back Sound Area (White Oak River
Basin) including that area of Back Sound extending from Core Sound west along Shackleford
Banks, then north to the western most point of Middle Marshes and along the northwest shore of
Middle Marshes (to include all of Middle Marshes), then west to Rush Point on Harker's Island,
and along the southern shore of Harker's Island back to Core Sound.
(C) The Bear Island Section of the Western Bogue Sound and Bear Island Area (White Oak River
Basin) including all waters within an area defined by a line from the western most point on Bear
Island to the northeast mouth of Goose Creek on the mainland, east to the southwest mouth of
Queen Creek, then south to green marker No. 49, then northeast to the northern most point on
Huggins Island, then southeast along the shoreline of Huggins Island to the southeastern most
point of Huggins Island, then south to the northeastern most point on Dudley Island, then
southwest along the shoreline of Dudley Island to the eastern tip of Bear Island.
(D) The Masonboro Sound Area (Cape Fear River Basin) including all waters between the Barrier
Islands and the mainland from Carolina Beach Inlet to Masonboro Inlet;
(9) Black and South Rivers ORW Area (Cape Fear River Basin) [Index Nos. 18-68-(0.5), 18-68-(3.5),
18-68-(11.5), I8-68-12-(0.5), 18-68-12-(11.5), and 18-68-21: the following management strategies, in
addition to the discharge requirements specified in Subparagraph (c)(l) of this Rule, shall be applied to
protect the designated ORW areas:
(A) Stornwater controls described in Subparagraph (c)(l) of this Rule shall apply to land within one
mile of and that drains to the designated ORW areas;
(B) New or expanded NPDES permitted wastewater discharges located one mile upstream of the
stream segments designated ORW (upstream on the designated mainstem and upstream into direct
tributaries to the designated mainstem) shall comply with the following discharge restrictions:
W Oxygen Consuming Wastes: Effluent limitations shall be as follows: BOD = 5 mg/I and

The modification of State Permit #132-96, as proposed, would not cause a closure of
open shellfishing waters. It is requested that the modified permit reference the workplan
drawings — "Exhibit A" (2), 2-3 of 3, date 02/04/16 — that were included in the supporting
documents for the modification request.
It should be noted that the Prohibited area buffer zone surrounding this marina basin is
currently adequate for up to 125 slips. This project, as proposed, will bring the total slip
count within the basin up to 125. If this modification request is approved, and if the slips
are constructed as proposed, then the future addition of any slips on any of the
properties within the basin will necessitate an expanded closure in the area.
