Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. 1) This Minor Modification authorizes 1) the addition of two side -by -side wave runner floating platforms and 2) the construction of a 92' by 8' riprap shoreline stabilization structure located landward of the normal high water line and all wetlands, all as depicted on the attached workplan drawings. 2) This Minor Modification does not authorize any new excavation or filling of any vegetated wetlands or open water areas. 3) This Minor Modification shall be attached to the original of Permit No. 100-14, which was issued on 11/13/14, and copies of both documents shall be readily available on site when Division personnel inspect the project for compliance. 4) All conditions and stipulation -on unless specifically altered herein. This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval, All work must cease when the permit expires on December 31, 2017 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Aqua Vista Farms LLC was originally issued State Permit No. 100-14 on November 13, 2014 for the replacement and expansion of an existing docking facility to accommodate nine boat slips. This project is currently under construction. State Permit No. 100-14 is due to expire on December 31, 2017. The construction of the basin and access channel was originally authorized under State Permit No. 24-81, and was recently transferred (and modified) to SEL Property Investors, LLC for the new Helms Port Subdivision and community marina. Construction of the marina portion of the modification has been completed. Mr. Morrison requests a modification to State Permit No. 100-14 to allow for the addition of two side -by -side wave runner floating platforms within the authorized boat basin, with an overall dimension of approximately 16' in length by 10' in width. Also proposed is a 92' in length by 8' in width area of riprap shoreline stabilization landward of the existing coastal wetlands and the existing breakwater. Mr. Morrison has submitted a check (check No. 45566) in the amount of $100 for the modification request. This office has no objections to the proposed modification. By copy of this memo, DCM is requesting that the USACE and DWR provide any comments their agency may have on the proposed project to Doug Huggett, NCDENR-DCM, 400 Commerce Ave., Morehead City, NC 28557 within 10 days of receipt of this memo.
