Mooring Field Construction and Use
1) Lash barges laden with hazardous or toxic materials will not be moored at the mooring field.
2) The permittee must install and maintain, at his expense, any signl lights, markings or signals
prescribed by the U. S. Coast Guard, through regulations or otherwise, on the buoys and moored
barges. If not otherwise required by the U. S. Coast Guard, the buoys shall be lighted with a
slow flashing white light.

This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not
covered hereunder requires further Departmental approval.
All work must cease when the pemrit expires on
December 31,1999
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina
Coastal Management Program.

3) In order to preclude possible damage to area bridges and other facilities, the State Ports Authority
must obtain written approval from the U. S. Coast Guard that an acceptable heavy weather
protection and recovery plan has been developed for the fleeting area. Documentation of this
approval must be provided to the Division of Coastal Management prior to initiation of
construction of the mooring facilities. Any violation of or deviation from the plan approved by
the U. S. Coast Guard will be considered a violation of this CAMA permit.
General
4) No attempt will be made by the permittee to prevent the free and full use by the public of all
navigable waters at or adjacent to the authorized work.
5) It is possible that the authorized structure may be damaged by wavewash from passing vessels.
The issuance of this permit does not relieve the permittee from taking all proper steps to ensure
the integrity of the permitted structure and the safety of moored vessels. The permittee shall not
hold the United States liable for any such damage.
6) This permit does not authorize the interference with any existing or proposed Federal Project.
7) The Federal Government does not assume any liability for:
A. Damages to the permitted project or uses thereof as a result of other permitted or
unpermitted activities or natural causes.
B. Damages to the permitted project or uses thereof as a result of current or future Federal
activities initiated on the public's behalf.
C. Damages to other permitted or unpermitted activities or structures caused by the
authorized activity.
D. Design and construction deficiencies associated with the permitted work.
E. Damage claims associated with any future modification, suspension, or revocation of this
permit.
8) The permittee will maintain the authorized work in good condition and in conformance with the

Dear Mr. Parker:
On 9-4-96, the North Carolina State Ports Authority,
Morehead City Terminal Facility was issued Permit #112-96 for the
construction and use of a mooring field. The Permit's Additional
Condition 3) requires, prior to construction, written approval
from the U.S. Coast Guard accepting the NCSPA's inclusion of the
fleeting area in its Hurricane Response Plan.
Please find attached the U.S. Coast Guard's acceptance
letter regarding the Morehead City Terminal's Hurricane Response
Plan. Captain Rice's comments are presently being incorporated in
the Terminal's plan by Morehead City Terminal staff.

policies and.procedures you. -have outlined in the plan.
The following comments are recommended 'to be considered during. your
next revision. Additional general comments have been made on the draft
'•hurricane response plan, a copy of which is returned as enclosure (1).
i. Diagrams/chartlets`which depict the mooring arrangements of the
±Pjash barge,, both at they bargee. fleeting area and at identified
hurricane mooring, should be included.
2. Is Came:;: River Towing Company dedicated solely to the support of
'Lash baroes2 Pending potential non -availability, have alternate towing
:companies been ,identifi.ed? If so, what is their response time and time
irequirod to sacure the greatestnumber of barges to be at the facility

S z. Condition Three - CG requires specific information from
;vessels/'ba.rgc%s which intend on remaining in port, per page C-21-D-11 of
:Captain of the Port (COTP) Wilmington!s Hurricane Plan. This info
:should be included in your plan's Condition Three section. In
addition, COTP Wilmington should be apprised of the type and quantity
:of cargo on vessels/barges remaining in port.
4. Condition Two for Lash Barge Fleeting area - Include notifying
the COTP tor Item 5.
We hold a meeting of all.port users each spring prior to the beginning
!of hurri„cane season. The purpose of the meeting is to ensure the
currency of the COTP Wilmington plan. The closer agreement we have
:with oi:r plans, the better we can. all respond -t:o a hurricane.

Reference your application for a Department of the Army permit to place
a "LASH" barge mooring field covering approximately 5.4 acres of non -vegetated
shallow water in the Newport River,adjacent to Radio Island in the NC State
Ports complex in Morehead City, Carteret County, North Carolina.
Your proposal has been reviewed and found to be consistent with the
provisions and objectives of general permit No. 198000291. Therefore, you may
commence construction activity in strict accordance with applicable State
authorization and the enclosed plan. Failure to comply with the State
authorization or conditions of the general permit could result in civil and/or
administrative penalties.
If any change in your work is required because of unforeseen or altered
conditions or for any other reason, plans revised to show the change must be
sent promptly to this office and the North Carolina Division of Coastal
Management prior to performing any such change or alteration. Such action is
necessary as revised plans must be reviewed and the authorization modified.

The enclosed permit constitutes authorization under the Coastal Area Management Act, and where applicable,
the State Dredge and Fill Law, for you to proceed with your project proposal. The original (buff -colored form) is
retained by you and it must be available on site when the project is inspected for compliance. Please sign both the
original and the copy and return the copy to this office in the enclosed envelope. Signing the permit and proceeding
means you have waived your right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-121.1
or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of
Administrative Hearings, P.O. Drawer 11666, Raleigh, NC 27611, (919) 733-2698 within twenty (20) days of this
decision on your permit. You should also be aware that if another qualified party submits a valid objection to the
issuance of this permit within twenty (20) days, the matter must be resolved prior to work initiation. The Coastal
Resources Commission makes the final decision on any appeal.
The project plan is subject to those conditions appearing on.the permit form. Otherwise, all work must be
carried out in accordance with your application. Modifications, time extensions, and future maintenance require
additional approval. Please read your permit carefully prior to starting work and review all project plans, as approved.
If you are having the work done by a contractor, it would be to your benefit to be sure that he fully understands all
permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we request that
you complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise concerning
permit conditions, environmental safeguards, or problem areas, you may contact Department personnel at any time for
assistance. By working in accordance with the permit, you will be helping to protect our vitally important coastal
resources.

The North Carolina State Ports Authority is requesting an
amendment to CAMA Permit Number 112-96. The spirit of the second
NOTE on page one is understood, however the verbiage restricts
the Port's import\export flexibility.
On August 7, 1996, a meeting was held at the Morehead City,
Division of Coastal Management's field office. Mr. Pate, Mr.
Jones, and myself discussed this issue and the following amended
wording was acceptable to all. 'LASH barges laden with hazardous
or toxic materials will not be moored at the mooring field.•
The NCSPA is requesting the second NOTE on page one of
Permit Number 112-96 be amended to read as above. The NCSPA
appreciates the Division's assistance in this matter, and if any
