1) This minor modification authorizes the following activities, subject to the conditions listed herein;
A) Construction of a bulkhead around the perimeter of the boat basin.
B) Construction of a bulkhead on each side of the existing entrance canal.
C) Construction of two t150' wooden groins into Albemarle Sound.
Shoreline Stabilization
2) Within the existing basin, the bulkhead will not extend waterward more than 2 feet from the normal
water level at any point along its alignment at the time of construction.
(See attached sheet for Additional Conditions)
This pemuCaction may be appealed by the permittee or
other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not
covered hereunder requires further Departmental approval.
All work must cease when the permit expires on
December 31.1999
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina
Coastal Management Program.

Wooden Groins
9) To ensure adequate flushing of the basin and entrance canal, the height of the proposed groins
shall not exceed six inches above the normal water level.
10) The alignment of the two groins must be approved on site by a representative of the Division of
Coastal Management prior to the start of construction.

11) This minor modification must be attached to the original of Permit No. 38-96, which was issued
on 3/15/96, and both documents must be readily available on site when a Division representative
inspects the project for compliance. All conditions and stipulations of the original permit remain
in force unless altered herein.

The enclosed permit constitutes authorization under the Coastal Area Management Act, and where applicable,
the State Dredge and Fill Law, for you to proceed with your project proposal. The original (buff -colored form) is
retained by you and it must be available on site when the project is inspected for compliance. Please sign both the
original and the copy and return the copy to this office in the enclosed envelope. Signing the permit and proceeding
means you have waived your right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-121.1
or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of
Administrative Hearings, P.O. Drawer 11666, Raleigh, NC 27611, (919) 733-2698 within twenty (20) days of this
decision on your permit. You should also be aware that if another qualified party submits a valid objection to the
issuance of this permit within twenty (20) days, the matter must be resolved prior to work initiation. The Coastal
Resources Commission makes the final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be
carried out in accordance with your application. Modifications, time extensions, and future maintenance require
additional approval. Please read your permit carefully prior to starting work and review all project plans, as approved.
If you are having the work done by a contractor, it would be to your benefit to be sure that he fully understands all
permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we request that
you complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise concerning
permit conditions, environmental safeguards, or problem areas, you may contact Department personnel at any time for
assistance. By working in accordance with the permit, you will be helping to protect our vitally important coastal
resources.

Mr. Warren Woodard has requested a modification to CAMA Permit No. 38-96. The
permit was originally issued for the excavation of a basin in the high ground, maintenance
excavation of an existing canal, excavation of an access channel in Albemarle Sound, docks, and
a boat ramp. The project site is off SR 1219 (Dewey's Pier Road) near Columbia in Tyrrell
County. I have provided Deborah Sawyer (DWQ), Sara Winslow (DMF), Chad Thomas (WRC),
and Raleigh Bland (COE) a copy of the proposed changes and have attached their comments.
Raleigh Bland did not respond in writing but in our 11 July 1997 telephone conversation, he stated
that the COE, NMFS, and USFW did not object to the proposed changes. The $50 check to cover
the cost of the permit modification has been deposited into the Department account.
Mr. Woodard is requesting CAMA Permit No. 38-96 be modified to include the following
changes (see attached plats dated 4 June 1997):
Construct a bulkhead around the perimeter of the new basin.
2. Construct a bulkhead on each side of the existing canal.
3. Construct wooden groins ± 150' out into Albemarle Sound to the edge of
a natural slough on each side of the new access channel.
I recommend a minor modification of Permit No.38-96 to authorize the changes outlined
above and suggest the following conditions be added to the existing permit;
The bulkhead will not extend waterward more than 2 feet from the normal
water level at any point along its alignment at the time of construction.
2. The bulkhead must be constructed prior to any backfilling activities.
3. The bulkhead must be structurally tight so as to prevent seepage of backfill
materials through the structure.

4. The fill material will be clean and free of any pollutants except in trace
quantities. Metal products, organic materials, or unsightly debris will not
be used.
5. The bulkhead which is constructed adjacent the wooded wetland areas will
be limited to 6 inches above the wetland substrate. The backfdl in this area
will be limited to that needed to fill in the space between the new bulkhead
and the existing wetland and will approximate the existing elevation.
6. The height of the groins shall not exceed 1 foot above the normal water
level.

The above subject modification request has been reviewed by this office. The original permit
included a canal and boat basin with a total length of approximately 350 feet. The modification
request is to construct wooden groins 150 feet out into the Albemarle Sound which will extend
the length of the groin/canal/basin to approximately 500 feet. It is the opinion of this office that a
flushing model should be performed to evaluate the potential for adequate flushing of the basin to
determine if the dissolved oxygen water quality standard will be contravened.

The N.C. Division of Marine Fisheries approves of the proposed bulkheading of the basin
and the canal. This agency submits the following comments relative to the two f 150 feet
wooden groins. The proposed height of the groins or size of the material to be used is not
included in the applicants request. The Division recommends, if 6 inch boards are utilized in the
construction of the groins, one board be left out every 8 or 10 feet. This will provide adequate
water exchange and allow fish and invertebrate passage to occur.

SUBJECT: Modification request for CAMA Permit No. 38-96 issued to Warren Woodard,
Albemarle Sound, Tyrrell County.
Although we would prefer the use of rock rip -rap wherever practical, we will not object:to
bulkhead construction around the perimeter of the man-made basin. However, bulkhead
construction and back -fill in the canal will result in the destruction of wetlands. Erosion in this
area is min and shoreline hardening is unnecessary: If shoreline hardening devices are
permitted in this area, they should be constructed at the wetland/upland interface to minimise
wetland destruction.
The shoreline adjacent to the excavated basin is comprised of wooded wetlands; annual
erosion on -site is negligible. Jetty construction may result in environmentally damaging. sediment
deposition and erosion in the project area and should not be permitted..

Please reference your June 24, 1997, request for comments concerning the proposed modification
of Action ID. No. 199601104 submitted by Mr. Warren Woodard for the construction of a bulkhead
around the perimeter of his existing boat basin and canal. In addition, two 150-foot-long wooden
groins are proposed parallel to the access channel in Albemarle Sound. The purpose of this work is
to stabilize the shoreline and reduce the shoaling in the access channel.
In our opinion, the proposed work should have a minimal impact on National Marine Fisheries
Service trust resources. Therefore, we have no objection to federal authorization of the modified
project plans.

This letter of refinement is in reference to your 18 March 1997 correspondence addressing minor
changes in CAMA Major Permit No. 38-96. CAMA Major Permit No. 38-96 was issued to you for the
construction of a boat basin with boat ramp and docks, maintenance of an existing canal and dredging a new
entrance channel in Albemarle Sound onsite your property off SR 1219 near Columbia in Tyrrell County,
North Carolina. Your request to modify the aforementioned permit to allow the following items listed below
and depicted on your revised plats dated 18 March 1997 is hereby authorized.
1. Modify the permitted side to docking (for 25 to 30 vessels) to 13 - ±3' by ±25'
finger piers with 3 mooring pilings between each for a total member of 26 slips.
2. Extend the permitted boat ramp landward by 25'.
3. Construct a bulkhead ±2' below the normal water level at the fuel dock for a linear
distance of ±140.
All previous permit conditions including the 31 December 1999 expiration date still apply and remain
unchanged. Your modified plats dated 18 March 1997 will become a part of your permit and construction
should be accomplished accordingly.

Dear Sir:
I am writing to you concerning my Permit Number 3896; to ask for
a variation in the configurations of the boat docks. I would like
to increase the size of the boat ramp to 50' X 15", and also add
another walkway on the south side. I would like to build a solid
dock on the north side loading and unloading boats and fueling
boats. This dock would be 4' wide with bulkhead underneath and a silt
fence attached to the timbers that are being used as bulkhead material.
Attached to this letter; you will find plans for the changes I am
proposing. Thanks for any consideration you can give me.

with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to a fine, imprisonment or civil action; or may cause the permit to be null and void.
1) This minor modification authorizes the following activities, subject to the conditions listed herein;
A) Construction of a bulkhead around the perimeter of the boat basin.
B) Construction of a bulkhead on each side of the existing entrance canal.
C) Construction of two f150' wooden groins into Albemarle Sound.
Shoreline Stabilization
2) Within the existing basin, the bulkhead will not extend waterward more than 2 feet from the normal
water level at any point along its alignment at the time of construction.
(See attached sheet for Additional Conditions)
This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not
covered hereunder requires further Departmental approval.
All work must cease when the permit expires on
December 31.1999
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina
Coastal Management Program.
Signed by the authority of the Secretary of DEHNR and the
Chairman of the Coastal Resources Commission.

3) The height of the proposed bulkhead along either side of the entrance canal shall not exceed six
inches above the adjacent wetland substrate. The back fill material in this area shall be limited to
that necessary to fill the space between the new bulkhead and the existing wetland, and the elevation
of the back fill material shall not exceed that of the adjacent wetland substrate.
4) The bulkhead must be constructed prior to any backfilling activities.
5) The bulkhead must be structurally tight so as to prevent seepage of backfill materials through the
structure.
6) The bulkhead must be solid and constructed of treated wood, concrete slabs, metal sheet piles or
other suitable materials approved by department personnel. No excavation is permitted except
for that which may be required for the construction of the bulkhead wall, riprap, deadmen cables,
etc.
7) The back fill material will be clean and free of any pollutants except in trace quantities.
8) All back fill material will be obtained from a highground source and confined behind the
permitted bulkhead.
Wooden Groins
9) To ensure adequate flushing of the basin and entrance canal, the height of the proposed groins
shall not exceed six inches above the normal water level.
10) The alignment of the two groins must be approved on site by a representative of the Division of
Coastal Management prior to the start of construction.
General

on 3/15/96, and both documents must be readily available on site when a Division representative
inspects the project for compliance. All conditions and stipulations of the original permit remain
in force unless altered herein.

This letter is in reference to your 31 March 1998 request to modify your

CAMA Major permit No. 38-96. The permit was originally issued for the construction

of a boat basin with boat ramp and docks, maintenance of an existing canal and
dredging a new entrance channel in Albemarle Sound onsite your property off SR 1219
near Columbia. You have requested to undertake maintenance excavation at the mouth
of the manmade canal using mats on the wetland section and trucking the material to
the high ground portion of your property. CAMA Major permit No. 38-96 was issued
in part to allow maintenance of the manmade canal to finished project depth of -6 feet
below the normal water level. As long as you comply with the conditions on your
existing permit you are already authorized to undertake the proposed work.
All conditions of your CAMA Major permit No. 38-96 remain unchanged and
in force including the 31 December 1999 expiration date. I appreciate your willingness
