Any violation of these terms may be subject to a fine, imprisonment or civil action; or may cause the permit to be null and void. 1) The Division has determined that the proposal to construct a riprap groin in lieu of the previously authorized wooden structure would lead to an excessive amount of bottom disturbance (over 6,000 square feet assuming a structure height of 7 feet and a lrh:l slope) in a area determined by the NC Division of Marine Fisheries to be a functional primary nursery area. Therefore, the request to utilize riprap in place of a wooden structure for the groin is not authorized. 2) Within the existing canal, riprap may be used in lieu of wood for the purposed of shoreline stabilization on the east side of the canal. 3) The riprap on the east side of the entrance canal shall not extend waterward more than three (3) feet from the normal water line at any point along its alignment at the time of construction. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit expires on December 31,1999 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. It must be of a size sufficient to prevent its movement from the site by wave or current action. 6) The riprap material must consist of clean rock or masonry materials such as but not limited to granite or broken concrete. 7) This minor modification must be attached to the original of Permit No. 38-96, which was issued on 3/15/96, the minor modification of 9/10/97 and the letter of refinement of 4/27/98, and both documents must be readily available on site when a Division representative inspects the project for compliance. All conditions and stipulations of the active permit remain in force unless altered herein. If you are having the work done by a contractor, it would be to your benefit to be sure that he fully understands all permit requirements. From time to time, Department personnel will visit the project site. To facilitate this review, we request that you complete and mail the enclosed Notice Card just prior to work initiation. The permit was originally issued for the excavation of a basin in the high ground, maintenance excavation of an existing canal, excavation of an access channel in Albemarle Sound, docks, and a boat ramp. The project site is off SR 1219 (Dewey's Pier Road) near Columbia in Tyrrell County. The permit was modified on 10 September 1997 to include the following: 1. Construct a bulkhead around the perimeter of the new basin. 2. Construct a bulkhead on each side of the existing canal. 3. Construct wooden groins t 150' out into Albemarle Sound to the edge of a natural slough on each side of the new access channel. Mr. Woodard is requesting to change the two groins as well as the canal bulkhead from wood to riprap (see attached plat dated 25 June 1998). The base width of the groins is proposed at 16' and will project 3' above the NWL. The existing water depth at the end of the proposed groins is -6' so with a 2:1 slope and a F exposure above the NWL, the base width of the riprap groin should be 14'. The riprap on the east side of the entrance canal as proposed will follow the existing shoreline contour. The $50 check to cover the cost of the permit modification has been deposited into the Department account. If a minor modification of Permit No.38-96 is authorize to include the changes outlined above I suggest the following conditions be added to the existing permit; 1. The riprap on the east side of the entrance canal will not extend waterward more than 3 feet from the normal water level at any point along its alignment at the time of construction. The permit was originally issued for the construction of a boat basin with boat ramp and docks, maintenance of an existing canal and dredging a new entrance channel in Albemarle Sound onsite your property off SR 1219 near Columbia. The permit also included fuel tanks and a marina store. You have requested the addition of a 30' wide by 60' long crab buying station adjacent the existing basin and a 15' wide dock extending 6' out into the basin. The proposed structure will be located at the southeast corner of the basin. Your request is hereby authorized. All conditions of your CAMA Major permit No. 38-96 remain unchanged and in force including the 31 December 1999 expiration date.
