This permit, issued on February 27, 2015 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terns may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Groins/Channel Stabilization
1) The authorized groins/channel stabilization shall adhere to the alignment depicted on the attached
workplan drawing.
2) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the
U.S. Coast Guard, through regulation or otherwise, on the authorized groins/channel stabilization. At
a minimum, permanent reflectors shall be attached to the structure in order to make it more visible
during hours of darkness or inclement weather.

This permit action may be appealed by the permittee or Signed by the authority of the Secretary of D:

Shoreline Stabilization
3) Unless specifically altered herein, this permit authorizes only the construction of the riprap and bulkhead
that are expressly and specifically set forth in the permit application and workplan drawing.
4) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the
structure.
5) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal sheet piles or other
suitable materials approved by department personnel. No excavation landward of the authorized
alignment is permitted except for that which may be required for the construction of the bulkhead wall,
riprap, deadmen cables, etc.
6) The riprap material shall be free from loose dirt or any pollutant. It shall be of a size sufficient to
prevent its movement from the approved alignment by wave or current action.
7) The riprap material shall consist of clean rock or masonry materials such as but not limited to granite,
marl, or broken concrete.
8) All backfill material shall be clean and free of any pollutants except in trace quantities.
9) All backfill material shall be obtained from a high ground source and confined behind the permitted
bulkhead.
Channel Excavation
10) Unless specifically altered herein, the dimensions of the area to be excavated shall not exceed the area
that is expressly and specifically set forth in the attached permit application and workplan drawings.
Any proposal to change the area to be excavated shall require permit modification.
11) Excavation shall not exceed —6.5 feet below the normal water level. In no case shall the depth of
excavation exceed the depth of connecting waters.
12) In order to protect anadromous fish spawning, no excavation shall be permitted between February 15
and September 30 of any year without the prior approval of the Division of Coastal Management.
13) The temporary placement or double handling of excavated.materials within waters or vegetated wetlands
is not authorized.
Spoil Disposal
14) All excavated materials shall be confined above normal high water and landward of regularly or
irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of
solids into any marsh or surrounding waters.

approvals or authorizations that may be required.
NOTE: Future development of the permittee's property may require a modification of this permit.

such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal water level.

The enclosed permit constitutes authorization under the Coastal Area Management Act, and where
applicable, the State Dredge and Fill Law, for you to proceed with your project proposal. The original (buff -
colored form) is retained by you and it must be available on site when the project is inspected for
compliance. Please sign both the original and the copy and return the copy to this office in the enclosed
envelope. Signing the permit and proceeding means you have waived your right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS
113A-121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B
with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, (919) 733-
2698 within twenty (20) days of this decision on your permit. You should also be aware that another
qualified party may submit an objection to the issuance of this permit within twenty (20) days.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work
must be carried out in accordance with your application. Modifications, time extensions, and future
maintenance requires additional approval. Please read your permit carefully prior to starting work and review
all project plans, as approved. If you are having the work done by a contractor, it would be to your benefit to
be sure that he fully understands all permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we
request that you complete and mail the enclosed Notice Card just prior to work initiation. However, if
questions arise concerning permit conditions, environmental safeguards, or problem areas, you may contact
Department personnel at any time for assistance. By working in accordance with the permit, you will be
helping to protect our vitally important coastal resources.

This email is in correspondence requesting authorization to undertake maintenance excavation under CAMA
Major Permit No. 38-96 issued to Phillip and Melony Carawan onsite their property at Woodard's Marina
located off SR 1219 on a manmade basin and canal adjacent the Albemarle Sound in Tyrrell County. I have
reviewed your submitted request and it appears to be in compliance with the requested information required by
the maintenance clause in your permit.
All conditions of your permit including subsequent modifications remain in force and should be adhered to. In
particular;
1. Excavation shall not exceed -6 feet below the elevation of Normal Water Level.
2. No excavated material will be placed at any time in any vegetated wetlands or surrounding waters.
3. All excavated materials shall be confined to high ground.
4. Excavation shall not take place between February 15 and September 30 without prior approval of the Division of
Coastal Management, in consultation with the Fishery Resource Specialist.

The reason for this letter is to sufficiently address the "Maintenance Clause" requirements for the above
referenced permit. The reason for the planned dredging is to maintain the prior permitting water
depths connected with an existing man-made boat basin and channel connected to the Albemarle
Sound so that there is reliable and safe ingress and egress of boats. Every year there is a buildup of
sediment in the basin but mainly in the canal leading from the Albemarle Sound to the basin. This is an
acknowledged problem by prior property owners as well as fisherman who attempt to use the basin for
boat dock during the commercial fishing season.
On January 21, 2017 Phillip Carawan collected the water depths in the basin as well as in the canal
leading from the Albemarle Sound into the basin based on NWL conditions. There is a considerable
amount of wind tide, with maximum low tides being around 2 ft lower than normal. The areas that
need to be dredged have been identified and it has been estimated that 3334 cu yards of material is to
be removed. The maintenance excavation work will be performed by the use of a land based excavator
using a clamshell bucket or a barge type mounted excavator with a clamshell bucket. The barge
_mounted excavator has sides on the back of the barge where the dig material will be placed until put on
spill area adjacent to basin on the North Eastside of the basin. If the excavation is from land the full
buckets will be loaded on a dump truck where it will be hauled to higher land on the property. If needed
timber mats may be used to reach the outer maintenance excavation area in shallow water areas. There
are no dimensional changes associated with this maintenance excavation.

Ok just got thru talking with Jonathan. Back in June 9 2015(acceptance date) Mr. Carawan submitted a major
modification to permit no. 38-96. Jonathan said they knew it was gonna be denined so they pulled it. They got Mr.
Carawan to change it and this is what this new one is. So there was no fee cause he paid it back in June of last year.

PROJECT SETTING
Quible and Associates, P.C. has submitted a CAMA Major request for Phillip Carawan
to modify an existing commercial fishing manmade basin (formerly Woodards Marina) on the
Albemarle Sound. The 356 acre project site is located at the end of Woodard Road off of Deweys
Pier Road (SR 1218) in the Town of Columbia, Tyrrell County. There is an existing active Major
CAMA permit (38-96) that permitted a 25ft wide by 225ft long by -6ft below Normal Water Level
(NWL) access channel into a 23ft wide by 150ft long by -6ft below NWL canal. This permit was
modified in 1997 for two 150ft wooden groins (with a height not to exceed 6inches above NWL) to
stabilize and protect the access channel. These groins have not been constructed at this time. These
groins were permitted as a compromise between the former owner of the property and the resource
agencies after longer rip rap groins had been proposed. Currently the site includes 27 boat slips, a
fish house, gravel parking and driveways, and a boat ramp. Fishermen store their crab pots and other
commercial fishing gear onsite. The site is surrounded by agriculture to the south and forested
wetlands and agriculture to the west and east. Due to regular shoaling there has been routine
maintenance excavation at the mouth of the channel in 3 of the last 5 years (2014, 2013, and 2010).
These requests have been made to perform excavation during the Anadromous Fish Spawning Area
moratorium to allow safer navigation during the crab fishing season.
The Albemarle Sound at the project site is classified as SB by the Environmental
Commission. The Albemarle Sound is approximately 7.5 miles wide at this location.
PROJECT DESCRIPTION
The applicant proposes to construct two 250ft by 20ft (average base width) riprap groins
into the Albemarle Sound. The top of the groins will be 3ft above Normal Water Level (NWL) with
a 2:1 slope. There will be a plateau at or near NWL to allow future maintenance work to be
performed from the groin. There will be riprap on top of the plateau that will be removed to perform
future maintenance work and then replaced once the work has been completed. The applicant has left
a 1 Oft buffer from the edge of the channel and the toe of the groin to *minimize the base width of the
groins. Between the groins the applicant is requesting to expand the current 25ft by 225ft by -6ft
below NWL channel to 60ft by 250ft by -6.5ft below NWL. To reach these dimensions the applicant
will remove 1,667 cubic yards of the sound bottom. The applicant also requests to the expand the
23ft wide by 300ft long by -6ft below NWL canal to 60ft by 300ft by -6.5ft below NWL. In order to
expand the canal the applicant will remove 3,041 sq ft of wooded wetlands and 414sq ft of upland.
The applicant is proposing to bulkhead 300ft along the canal. In the location of the wetlands the
bulkhead will be cantilevered (without tie backs and backfill). The applicant proposes to use 628ft of
riprap along the Albemarle Sound shoreline to protect the shoreline. The riprap will have a base
width of a max of 1 Oft not to exceed 2ft above NWL adjacent to the wetlands and not to exceed 3ft
above NWL adjacent to the uplands. There is no fill proposed landward of the shoreline stabilization.

Economic Benefits and Need for Improvements
Tyrrell County, along with other northeastern North Carolina counties, is considered a Tier 1
(distressed) County by NC Department of Commerce. In recent times, both agriculture and
manufacturing have declined sharply, and traditional manufacturing is virtually non-existent.
Tyrrell County is currently the least populated county the state and has suffered from a
population decrease of approximately 7% since 2010. Philip Carawan, owner of Captain Neill's
Seafood, one of the largest employers in the County, is involved in the seafood industry,
including processing, sales and commercial fishing. The Albemarle Region of eastern NC has
historically been recognized as a top seafood producer. With many coastal fish houses and
marinas in coastal NC having been shut down, in large part from change of use of the coastal
waterfront, it is important to identify and preserve key existing facilities. Mr. Carawan purchased
the subject property in 2013 for its' existing boat basin and commercial fishing port capabilities.
The nearest Albemarle Sound commercial fishing ports are Alligator River Marina (-15 miles
from Carawan's Marina) and Mackey's Marina (-24 miles from Carawan's Marina).
Captain Neill's Seafood is an extremely important part of the local economy which currently
employs approximately 150 people in the seafood processing operation and is directly
associated with approximately 45 fishing boats (private operations with 2 people per boat). In
addition to the approximately 240 person direct salary positive impacts associated with the
operation, there are extensive secondary positive impacts to the economy. The operation
affects nearly every business in Tyrell County, including utility companies, grocery stores, fuel
stations, etc. Most of this cannot be accurately quantified, but as an example, the monthly
water bill for the company is commonly over $10,000.
Background
The subject property is an approximately 356 acre tract of land in Tyrrell County, on the
Albemarle Sound, to the north of the Town of Columbia. The property is accessible from
Deweys Pier Road which leads to Woodard Road.
The property contains a man-made basin boat basin that is connected to The Albemarle Sound.
CAMA Major Permit 38-96 was originally issued in 1996 for the excavation of an upland basin in
high ground, maintenance excavation of an access channel in the Sound (to -6 ft NWL),
dockage structures and a boat ramp. The permit was modified in 1997 to include construction
of a bulkhead around the perimeter of the boat basin, construction of a bulkhead in each side of
the entrance canals and construction of (2) 150 ft wooden groins into the Albemarle Sound.
This work is permitted, but not yet built at this time.
In 2011, a wetland delineation was performed and confirmed by USACE on the northern
(waterward) 120 acres of the subject tract. The upland areas of the property consist of
agricultural fields and some wooded uplands. The wetland areas are primarily woi oodped.

Existing Environmental Conditions
The shallow water sound bottom consists of loose sand overlying clay beds in some areas. A
water depth survey and SAV analysis was performed in summer 2014 adjacent to the property
and also in the existing basin. No rooted SAV was observed in this area during this early June
survey. Based on conversations with representatives of NCDENFI, this southern shore of the
Albemarle has not been known this to be an SAV area, likely from the high wave energy,
especially from NE wind events.
Shoaling has been a constant problem for maintaining an operable marina is this location.
Since original permit issuance, the marina can only operate by maintenance dredging every
year. And, the existence of the dredging moratorium in this area (beginning February 15°i of
each year) is problematic for marina operation due to the rapid shoaling that occurs after
February 15`" and before the start of crabbing season. In fact, in many years', the entrance to
the basin shoals in almost immediately after an expensive dredge operation. Sand movement
occurs in this area from the shoreline to water depths exceeding 8 ft or more. This is evident
from aerial photograph inspection where bars and shoal formation and migration can be
followed.
Proposed Work
1. Channel Widening: The purpose of the proposed dredging is to maintain adequate water
depths along the entrance to and within the existing man-made canal/basin and channel
connected to The Albemarle Sound so that there is safe ingress and egress for large scale
commercial fishing boast that draw 4.5 feet of water. The existing channel is permitted at 25
ft wide and -6 ft deep. This permit request is to widen the channel to 60 ft at -6.5 ft deep
(relative to NWL). In order for this commercial marina to be successful, it is extremely
important to maintain a safe navigable channel of at least -6.5 ft relative to normal water
level (NWL), since many boats that will draw at least 4.5 ft of water. Based on frequent low
wind tide events and/or rough seas that affect wave trough effective depths by 2 ft on
regular occasion, a baseline of -6.5 in the channel is absolutely necessary since these
fishermen need to work every day.
The excavation work will be performed with the use of a barge mounted and/or land based
Qetty based) long reach excavator using a clamshell bucket. The excavator will dig material
from the channel area onto a material (hopper) barge with sides. Use of a clamshell bucket
minimizes the amount of bottom disturbance, and when the bucket is fully loaded, the
amount of water transferred to the barge is minimal. The barge, when loaded, will be moved
inside the basin and the material will be transferred to soil stockpile areas in the adjacent
agriculture fields on the subject property. if excavation is from land (jetty and/or beach) and
mats instead of barge, the full bucket of material will be directly transferred to a dump truck
and then it will be transferred to the same stockpile/disposal areas.

2. Channel Protection Jetties: Permitting of rock and concrete channel protection jetties was
the main topic of a July 9, 2014 interagency scoping meeting. The jetties proposed would
be on either side of the 60 ft wide channel and would extend 250 ft and 257 ft respectively in
to the sound, following the same angle as the existing permitted channel. These jetties
would be approximately 100 ft longer than the permitted (but not built) wooden groins (they
are permitted to 150 ft).
Constant shoaling and longshore sand movement is the primary need for these jetties.
While the fastest sand movement is in shallow water, sand movement clearly does occur out
to the naturally occurring project depth (-6.5 ft) and greater. Without channel protection
jetties, the channel quickly shoals in and requires maintenance dredging.
Rock and concrete is a much more permanent solution to the channel protection problem
than vertical sheet pining groins or jetties. This is an extremely high energy shoreline that
can quickly destroy sheetpile structures, both from wave energy and also from the battering
effect of trees, pilings and other items that ram into and tear out structures. This is a
commercial facility and needs to be armored as such. Mr. Carawan's idea is to adequately
armor this facility the first time. This will allow the livelihood of Captain Neill's Seafood and
and fishermen to proceed uninterruptedly. As we all have seen, North Carolina's
commercial fishing industry is fragile due to fishery conditions and imposed regulations to
help manage the system. What we need to ensure for the commercial fishermen is a way to
be able to work while following the protocol.
During the scoping meeting, the jetty footprint discussed was up to 36 ft wide. We have
since been able to reduce the proposed jetty footprint to an average width of 20 ft. This was
done as an attempt to avoid and minimize the bottom footprint of the rock structure.
Included on the CAMA Major Plan is a cross-section of the channel with jetties. Initially
(going in to the scoping meeting), the jetty would have been built at a 2:1 slope adjacent to
the edge of the channel. We have now separated the edge of the jetty from the channel
edge by at least 10 ft, allowing a reduction in the width. The width has been further reduced
by building the structures at a 2:1 slope from the substrate up to NWL. Instead of continuing
to build the wall up another 3 ft with a plateau on the top (for machine access down the
structure), the actual future work plateau will be at or near NWL. There will be a pile of rip -
rap on top of the plateau (up to 3 ft above NWL), but, this material will be removed for
machine access when maintenance to the jetty of channel is needed. When the
maintenance work is complete, the material will be put back in place.
For local comparison purposes, the jetty system at the Alligator River Marina appears to
extend about 300 ft into the river and is reportedly much wider than what we are proposing
herein.
3. Basin Entrance Widening: In order to widen the entrance to the boat basin to allow safe
ingress/egress and to promote better flushing, excavation of 3,041 sq.ft. of Section 404

wetlands and 1,443 sq.ft of uplands is proposed. The total volume of material to be
excavated in this area is 1,134 cu yds. The material will be dug from a land based
excavator, starting at the shoreline area closest to the Albemarle Sound and will work back
from there. When necessary, timber mats will be used in 404 areas to support the
excavator. Excavated material will be spread on upland agricultural areas, similarly to the
channel material.
Adjacent to wetlands, 300 lin.ft. of cantilevered bulkhead is proposed so that there would be
no bulkhead backfill in this area.
4. Shoreline Stabilization Rip -Rap: 628 of shoreline stabilization rip -rap (1Oft wide x 3 ft high)
is proposed to protect the natural shoreline from ongoing erosion at or near the existing
normal water line.

ANTICIPATED IMPACTS
The project will result in localized turbidity due the installation of the bulkhead, riprap
shoreline stabilization, and riprap groins. The groins and riprap will convert 10,000sq ft and 6,170sq
ft respectively of sound bottom to riprap. The bulkhead will replace 300sq ft of the canal bottom.
The project will excavate 3,041sq ft of wetlands, 414sq ft of uplands, and 15,000sq ft of sound
bottom (1,667 cubic yards).

Staff has reviewed the project, and the applicant has documented the need to construct the bulkhead
waterward of the NWL.
The applicants have properly notified the riparian neighbors to the project via sign off statements. If the
permit is issued, staff would suggest the following conditions:
DREDGE & FILL - EXCAVATION
In order to protect juvenile shrimp/fmfish/shrimp and finfish populations, no excavation
or filling shall be permitted between February 15 and October 31 of any year without the
prior approval of the Division of Coastal Management, in consultation with the Division
of Marine Fisheries.
Excavation shall not exceed 6.5 feet below the mean low/normal water level. In no case
shall the depth of excavation exceed the depth of connecting waters.
An earthen plug/silt screen shall be left between the area to be excavated and the existing
canal/river/creek/sound and a 24 hour period after completion of excavation will elapse
prior to plug removal to prevent unnecessary siltation into the adjacent water body.
4 No vegetated wetlands/marsh grass shall be excavated or filled.
The temporary placement or double handling of excavated or fill materials within waters
or vegetated wetlands is not authorized.
6 No excavated or fill material shall be placed at any time in any vegetated wetlands/marsh
or surrounding waters outside of the alignment of the fill area indicated on the workplan
drawing(s).
7 If the crossing of wetlands with mechanized construction equipment is necessary,
temporary construction mats shall be utilized for the areas to be crossed. The temporary
mats shall be removed immediately upon completion of construction.
Bulkhead and Rip Rap Shoreline Stabilization
8 The bulkhead alignment shall approximate the normal high/normal water level at the time
of construction.

The bulkhead/riprap shoreline stabilization shall not extend waterward more than 2 feet
from the normal water level at any point along its alignment at the time of construction.
10 The alignment of the authorized bulkhead/riprap shall be staked by a representative of the
Division of Coastal Management within a maximum of 30 days prior to the start of
construction. Failure to initiate construction within 30 days, or erosion of the shoreline
by adverse weather conditions, shall require the alignment to be restaked by DCM within
a maximum of 30 days prior to the new expected start of construction.
11 The riprap material shall be free from loose dirt or any pollutant. It shall be of a size
sufficient to prevent its movement from the site by wave or current action.
12 The riprap material shall consist of clean rock or masonry materials such as but not
limited to granite, marl, or broken concrete.
13 The bulkhead shall be constructed prior to any backfilling activities.
14 The bulkhead shall be structurally tight so as to prevent seepage of backfill materials
through the structure.
15 The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal sheet
piles or other suitable materials approved by Division of Coastal Management personnel.
No excavation is permitted except for that which may be required for the construction of
the bulkhead wall, riprap, deadmen cables, etc. This permit does not authorize any
excavation waterward of the approved alignment.
WATER QUALITY & STORMWATER
16 In order to protect water quality, runoff from the construction shall not visibly increase
the amount of suspended sediments in adjacent waters.
17 The Division of Water Quality is currently reviewing the permit application to determine
if the project is in compliance with North Carolina's Water Quality Certification
program. The permittee must receive a Water Quality Certification from DWQ prior to
the initiation of any construction activities.
With the exception of grass swales and the outlet conveyance, no portion of the proposed
stormwater system shall be located within the 30 foot Coastal Shoreline buffer. If this
condition results in a modification of the Stormwater Management Permit referenced in
Condition No. 3 above, the permittee shall provide a copy of the modified Stormwater

location of the wetlands the bulkhead will be cantilevered (without tie backs and backfill). The applicant
proposes to use 628ft of riprap along the Albemarle Sound shoreline to protect the shoreline. The riprap will
have a base width of a max of 1 Oft not to exceed 2ft above NWL adjacent to the wetlands and not to exceed 3ft
above NWL adjacent to the uplands. There is no fill proposed landward of the shoreline stabilization.
Staff has reviewed the proposed project with regard to rules found in Subchapter 7H concerning
development in Coastal Shorelines. It is staffs recommendation that the proposed project appears consistent
with 15A NCAC 07H .0208 as described below.

Staff has reviewed the project, and the applicant has documented the need to construct the bulkhead
waterward of the NWL.
The applicants have properly notified the riparian neighbors to the project via sign off statements. If the
permit is issued, staff would suggest the following conditions:
DREDGE & FILL - EXCAVATION
In order to protect juvenile shrimp/finfish/shrimp and finfish populations, no excavation
or filling shall be permitted between February 15 and October 31 of any year without the
prior approval of the Division of Coastal Management, in consultation with the Division
of Marine Fisheries.
Excavation shall not exceed 6.5 feet below the mean low/normal water level. In no case
shall the depth of excavation exceed the depth of connecting waters.
An earthen plug/silt screen shall be left between the area to be excavated and the existing
canal/river/creek/sound and a 24 hour period after completion of excavation will elapse
prior to plug removal to prevent unnecessary siltation into the adjacent water body.
No vegetated wetlands/marsh grass shall be excavated or filled.
The temporary placement or double handling of excavated or fill materials within waters
or vegetated wetlands is not authorized.
No excavated or fill material shall be placed at any time in any vegetated wetlands/marsh
or surrounding waters outside of the alignment of the fill area indicated on the workplan
drawing(s).
If the crossing of wetlands with mechanized construction equipment is necessary,
temporary construction mats shall be utilized for the areas to be crossed. The temporary
mats shall be removed immediately upon completion of construction.

9 The bulkhead/riprap shoreline stabilization shall not extend waterward more than 2 feet
from the normal water level at any point along its alignment at the time of construction.
10 The alignment of the authorized bulkhead/riprap shall be staked by a representative of the
Division of Coastal Management within a maximum of 30 days prior to the start of
construction. Failure to initiate construction within 30 days, or erosion of the shoreline
by adverse weather conditions, shall require the alignment to be restaked by DCM within
a maximum of 30 days prior to the new expected start of construction.
11 The riprap material shall be free from loose dirt or any pollutant. It shall be of a size
sufficient to prevent its movement from the site by wave or current action.
12 The riprap material shall consist of clean rock or masonry materials such as but not
limited to granite, marl, or broken concrete.
13 The bulkhead shall be constructed prior to any backfilling activities.
14 The bulkhead shall be structurally tight so as to prevent seepage of backfill materials
through the structure.
15 The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal sheet
piles or other suitable materials approved by Division of Coastal Management personnel.
No excavation is permitted except for that which may be required for the construction of
the bulkhead wall, riprap, deadmen cables, etc. This permit does not authorize any
excavation waterward of the approved alignment.
WATER QUALITY & STORMWATER
16 In order to protect water quality, runoff from the construction shall not visibly increase
the amount of suspended sediments in adjacent waters.
17 The Division of Water Quality is currently reviewing the permit application to determine
if the project is in compliance with North Carolina's Water Quality Certification
program. The permittee must receive a Water Quality Certification from DWQ prior to
the initiation of any construction activities.
With the exception of grass swales and the outlet conveyance, no portion of the proposed
stormwater system shall be located within the 30 foot Coastal Shoreline buffer. If this
condition results in a modification of the Stormwater Management Permit referenced in
Condition No. 3 above, the permittee shall provide a copy of the modified Stormwater

Consistency Determination: The request is consistent with/not in conflict with the Tyrrell
County/Town of Columbia Land Use Plan certified by the CRC
on March 25, 2010.
Overview: The 356 acre subject property has over 6,000 linear feet of combined shoreline
along the Albemarle Sound, a manmade canal, and a manmade boat basin with canal. The
property includes over 120 acres of wooded wetlands near the shoreline, wooded uplands,
and agricultural land. The project area encompasses the boat basin with canal and
connecting channel into the Albemarle Sound. It is within a ".2 percent annual chance" flood
zone.
Existing site improvements at the project area consist of a fish house and gravel parking and
driveways. The site is used as a base for commercial fishermen, with crab pots and other
commercial fishing gear being stored on -site. Existing shoreline improvements at the project
area consist of a boat basin with twenty-seven (27) boat slips, a loading dock extending from
the basin to the fish house, a boat ramp, and a 23 foot wide by 300 foot long canal at a depth
of -6 feet below Normal Water Level (NWL) connecting to a 25 foot wide by 225 foot long
channel at a depth of -6 feet below NWL extending into the Albemarle Sound. Improvements
for the boat basin with boat ramp and docks, canal, and connecting channel were initially
approved under CAMA Major Permit 38-96 in 1996. The permit was modified in 1997 to allow
bulkhead around the basin and wooden groins on either side of the access channel. To date,
the bulkhead and wooden groins have not been installed.

Installation of two (2) 20 foot wide by 250 foot long riprap groins into the Albemarle Sound,
expansion of the canal to measure 60 feet wide by 300 feet long by -6.5 feet below NWL and
the channel to measure 60 feet wide by 250 feet long by -6.5 feet below NWL, and installation
of 300 linear feet of bulkhead and 628 linear feet of riprap are proposed. The groins will be
installed on either side of the access channel. The top of the groins will be 3 feet above NWL.
The groins will be installed at a 2:1 slope. Bulkhead will be installed along the canal. In
wetland locations, the bulkhead will be cantilevered without tie backs and backfill. The riprap
will be installed along the shoreline of the Albemarle Sound. It will have a maximum base
width of 10 feet and will extend no more than 2 feet above NWL adjacent to wetlands and no
more than 3 feet above NWL adjacent to uplands. As indicated in the applicant's narrative,
excavation spoil will be transferred to soil stockpile areas in agricultural fields on the subject
property.
The waters of the Albemarle Sound in this area are classified as SB and are closed to
shellfish taking. The sound is approximately 7.5 miles wide at this location. A review of
Submerged Aquatic Vegetation (SAV) was not provided. A review of historic and
archaeological sites was not provided.
Anticipated impacts resulting from this project are expected to include: the dredging of .34
acre of Public Trust Area/Estuarine Waters Areas of Environmental Concern (AECs), 3,041
sq. ft. of Section 404 Wetlands within the Estuarine Shoreline AEC, and 1,443 sq. ft. of
Uplands within the Estuarine Shoreline AEC, and; the filling of .65 acre of Public Trust
Area/Estuarine Waters AEC.
Basis for Determination:
The Tyrrell County/Town of Columbia Land Future Land Use Plan Map identifies the site area
as "Rural". The "Conservation' designation also applies, since it includes land and water
areas which are environmentally sensitive, including areas of environmental concern, as
indicated on Page 133.

2nd Request for Additional Information Response
Roberto,
The purpose of this letter is to provide additional information as requested in your 12/15/2014
letter. It was indicated in the letter that two of the three responses to the 11/18/2014 letter (151
Request for Additional Information) were answered unsatisfactorily and the responses below are
intended to supply the additional information required. Since the last written correspondence,
we have verbally discussed these topics, and additionally, I have been in discussions with Kevin
Hart of DCM and Shane Staples of DCM/Fisheries. Along with the below responses and
discussion associated with the 12/15/2014 letter, I have also attached a copy of my last
response (1214/2014) as well as a revised CAMA plan and associated application with
shortened jetties as referenced below.
The DWR Comments are as follows:
Item 1. It is necessary to provide dropdowns or breaks within the groin to provide aquatic life
passage. Plans supplied to this Office show no such accommodations for aquatic life passage.
Item 2. It is necessary to demonstrate avoidance and minimization of impact of impacts for the
length of this project.
Qulble Response: I currently have authorization from Mr. Carawan to propose a reduction in
the jetty width from a maximum 257 ft to a maximum of 183It long. Please see attached plan
that reflects the adjusted proposed jetty lengths. The proposed jetties as shown on the attached
revised plan (dated 12/29/2014) are 175 It and 183 ft respectively. For the water depth
fluctuation reasons, high wave energy, shifting shoals and bars, and other reasons (discussed
in items 2 and 3 from my December 4, 2014 letter), it has taken some time on our end to justify
any shortening of the jetties. Based on agency recommendations, aerial photo review, collected
data and anecdotal information gathered by fishermen, we believe that the currently proposed
lengths are the minimum that will be required to maintain an adequate channel.
The revised plan does not indicate drop downs as we have discussed and I have recently
discussed with DCM. We strongly believe that the shortening of the jetties mitigates the need
for drop downs and we are familiar with many other recreational jetty systems that do not have
drop downs (for jetties much longer than what is currently proposed). There are some
examples listed in our 12/4/2014 letter and we can provide more if needed. While we do feel
that the need for the full 250 and 257 ft long jetties may be warranted, the owner is willing to
minimize lengths as shown on this accompanying plan. In relation to constructing drop down
and overlapping jetty sections to reduce wave impacts to the channel, it is our position that this
would actually cause additional impacts to large woody debris (LWD) outside the existing jetty
and channel footprint.
Additionally, please understand that this is an important commercial marina and the channel
must be maintained as such. This marina has become critical to this Tier 3 County and is a
critical lifeline to this area. As we mentioned in the project narrative, there are extensive primary
and secondary economic implications to this area that has nearly no other significant private
industry. Primary economic impacts with this marina include a documented 2.4 million dollars of.
direct business out of this marina over that last year, with an anticipated 5 million dollars in
business after completion of a stable and reliable port over the next year and a longer term
projection of 7-8 million dollars in years to follow. This does not include any of the off -site
indirect benefits to northeastern North Carolina.
After jetty construction, if there is documentation and justification to propose a modification to
increase jetty lengths from those currently proposed, we will inform all agencies involved in the
permitting process and we will request a meeting to discuss. Please understand that this is a
very expensive project (material and labor) and Mr. Carawan does not want to build the jetties
any further than needed to safely and consistently support this fishing hub that is intended to
support many vessels, including new 38-40 ft long inboard powered crab boats.

Roberto,
The purpose of this correspondence is to provide additional information as requested and to
respond to your November 18, 2014 letter. The following are the three items referenced in the
letter and our response to each item.
Project description lists two (20 250 foot long riprap groins. Plan sheet shows one groin
located north of the subject channel 250 feet in length and a second groin to the south
257 feet in length. Both project plans and project description should be consistent.
Quible Response: I have updated the MP-2 form (top table on sheet 1) to indicate (1)
rock groin @ 250 ft and (1) rock groin at 257 ft. I checked the plan and project narrative
and I believe this figure is now consistent everywhere. The reason for slightly different
lengths is the angled shoreline and the plan is to end the jetties the same distance out
into the sound.
2. During a scoping meeting held in this office on July 9, 2014, for the subject project, it
was discussed placement of dropdowns or breaks within the groin with overlaps to
provide aquatic life passage. Plans supplied to this office show no such
accommodations for aquatic life passage.
Quible Response: During the scoping meeting the question was asked whether we were
planning on including dropdowns and overlaps and the answer was that this was not
proposed. Below are a few points that should help to explain why we are not proposing
dropdowns:
NMFS has been consulted and they have determined that this location is not an
Essential Fish Habitat.
•
Drop downs allow sediment to enter channels which would require more frequent
dredging.
m This is an extremely rough body of water and this is a commercial marina where
fishermen have to work every day. in a recreational setting, boats typically only
operate when conditions are acceptable to the particular boat as opposed to
commercial operations where in high seas or not, the boats will run and they
need a safe entrance into a fairly narrow cut such as this.
• We recently received a Water Quality Certification for a jetty at Kitty Hawk
Landing, a residential development on the Albemarle, for a jetty system without
dropdowns.
• The Alligator River Marina jetties do not have drop downs which is important to
that site for safety and reduction of maintenance.
• Aquatic life can go around the jetties and jetties such as this offer excellent
habitat for aquatic species.
3. Your current application sites CAMA Major Permit 38-96, issued in 1996 and modified in
1997, including (2) 150 foot wooden groins into the Albemarle Sound. Your current
application shows one 250 foot rip rap groin and one 257 foot rip rap groin. Please note
that is necessary to demonstrate avoidance and minimization of impacts for this project.
The additional 207 linear feet of impacts will require an evaluation of near shore
sediment transport and impacts the proposed project will have on sediment transport,
benthic community, and fish and wildlife resources in accordance with 15A NCAC 02H
.0506.
Quible Response: Sand movement occurs in this area from the shoreline to water
depths exceeding 6.5 ft or more relative to normal water level (NWL). This is evident
from aerial photograph inspection where bars and shoat formation and migration can be
followed. In order for this commercial marina to be successful, it is extremely important
to maintain a safe navigable channel of at least -6.5 it relative to (NWL), since many
boats draw at least 4.5 ft of water. This will require the jetties be built approximately 250
into the sound to avoid frequent dredging. Based on low wind tide events and/or rough
seas that affect wave trough effective depths by-2 ft on regular occasion, a baseline of -
6.5 in the channel is absolutely necessary since these fishermen need to work every
day. Constant shoaling and longshore sand movement is the primary need for these
jetties. While the fastest sand movement is in shallow water, sand movement clearly
does occur out to the naturally occurring project depth (-6.5 it) and greater. Without
channel protection jetties to this length, the outer channel will quickly shoal in and
require maintenance dredging. During the scoping meeting, the jetty footprint discussed
was up to 36ft wide. We have since been able to reduce the proposed jetty footprint to
an average avidth of 20 ft. This was done as an attempt to avoid and minimize the
bottom footprint of the rock structure.
TNs is a very expensive project ,material and labor) and Mr, Carawai, does not want to
build the jetties any further than needed, Giaase note -hat the Kitty Hawk. Landing jetties
that have recently received DWR approval are also about 250 ft long and the Alligator
River jetties are over 300 ft.

A North Carolina Division of Coastal Management (DCM) Fisheries Resource Specialist has reviewed the
subject permit application for proposed actions that impact fish and fish habitats. The -applicant proposes to
construct two 250ft riprap groins into the Albemarle Sound to stabilize an access channel for an upland
basin, expand an existing channel from 25ft by 225ft by -6ft below Normal Water Level (NWL) channel to
60ft by 250ft by -6.5ft below NWL, expand existing canal from 23ft by 300ft by -6ft below NWL to 60ft by
300ft by -6.5ft below NWL, build 300ft of bulkhead on the western side of the canal, and install 628ft of
riprap to the shoreline of the Albemarle Sound. Impacts from these activities include removal of 3,041ft2 of
vegetated wetlands, 15,000fl of sound and canal bottom, 1,443fe of uplands, and filling 28,470flof sound
bottom with riprap.
The impacts of this project, specifically the proposed riprap jetties extending 250ft into the sound, would be
significant. The shoreline in this area compromised mainly of sand and mud with abundant large woody
debris (LWD) has been shown to be important habitat for juvenile fishes such as striped bass, various
Alosids, spot, and croaker by NCDMF surveys at nearby locations. These jetties will disrupt the longshore
transport of larval fishes and cover foraging habitat.
Significant impacts to fish habitat could be reduced if the applicant shortens the proposed riprap jetties to
150ft as currently permitted and incorporates a dropdown gap at the midpoint of the jetty. Shortening the
jettywill minimize bottom impacts and the gap would help to facilitate longshore larval transport.
Additionally during construction any LWD not in the channel alignment or in the footprint of the riprap or
jetties should be left in place as it is valuable fish habitat.

PROJECT SETTING
Quible and Associates, P.C. has submitted a CAMA Major request for Phillip Carawan
to modify an existing commercial fishing manmade basin (formerly Woodards Marina) on the
Albemarle Sound. The 356 acre project site is located at the end of Woodard Road off of Deweys
Pier Road (SR 1218) in the Town of Columbia, Tyrrell County. There is an existing active Major
CAMA permit (38-96) that permitted a 25ft wide by 225ft long by -6ft below Normal Water Level
(NWL) access channel into a 23ft wide by 150ft long by -6ft below NWL canal. This permit was
modified in 1997 for two 150ft wooden groins (with a height not to exceed 6inches above NWL) to
stabilize and protect the access channel. These groins have not been constructed at this time. These
groins were permitted as a compromise between the former owner of the property and the resource
agencies after longer rip rap groins had been proposed. Currently the site includes 27 boat slips, a
fish house, gravel parking and driveways, and a boat ramp. Fishermen store their crab pots and other
commercial fishing gear onsite. The site is surrounded by agriculture to the south and forested
wetlands and agriculture to the west and east. Due to regular shoaling there has been routine
maintenance excavation at the mouth of the channel in 3 of the last 5 years (2014, 2013, and 2010).
These requests have been made to perform excavation during the Anadromous Fish Spawning Area
moratorium to allow safer navigation during the crab fishing season.
The Albemarle Sound at the project site is classified as SB by the Environmental
Commission. The Albemarle Sound is approximately 7.5 miles wide at this location.
PROJECTDESCRIPTION
The applicant proposes to construct two 250ft by 20ft (average base width) ripmp groins
into the Albemarle Sound. The top of the groins will be 3ft above Normal Water Level (NWL) with
a 2:1 slope. There will be a plateau at or near NWL to allow future maintenance work to be
performed from the groin. There will be riprap on top of the plateau that will be removed to perform
future maintenance work and then replaced once the work has been completed. The applicant has left
a 1 Oft buffer from the edge of the channel and the toe of the groin to minimi the base width of the
groins. Between the groins the applicant is requesting to expand the current 25ft by 225ft by -6ft
below NWL channel to 60ft by 250ft by -6.5ft below NWL. To reach these dimensions the applicant
will remove 1,667 cubic yards of the sound bottom. The applicant also requests to the expand the
23ft wide by 300ft long by -6ft below NWL canal to 60ft by 300ft by -6.5ft below NWL. In order to
expand the canal the applicant will remove 3,041sq ft of wooded wetlands and 414sq ft of upland.
The applicant is proposing to bulkhead 300ft along the canal. In the location of the wetlands the
bulkhead will be cantilevered (without tie backs and backfill). The applicant proposes to use 628ft of
nprap along the Albemarle Sound shoreline to protect the shoreline. The riprap will have a base
width of a max of loft not to exceed 2ft above NWL adjacent to the wetlands and not to exceed 3ft
above NWL adjacent to the uplands. There is no fill proposed landward of the shoreline stabilization.

Economic Benefits and Need for Improvements
Tyrrell County, along with other northeastern North Carolina counties, is considered a Tier 1
(distressed) County by NC Department of Commerce. In recent times, both agriculture and
manufacturing have declined sharply, and traditional manufacturing is virtually non-existent.
Tyrrell County is currently the least populated county the state and has suffered from a
population decrease of approximately 7% since 2010. Philip Carawan, owner of Captain Neill's
Seafood, one of the largest employers in the County, is involved in the seafood industry,
including processing, sales and commercial fishing. The Albemarle Region of eastern NC has
historically been recognized as a top seafood producer. With many coastal fish houses and
marinas in coastal NC having been shut down, in large part from change of use of the coastal
waterfront, it is important to identify and preserve key existing facilities. Mr. Carawan purchased
the subject property in 2013 for its' existing boat basin and commercial fishing port capabilities.
The nearest Albemarle Sound commercial fishing ports are Alligator River Marina (-15 miles
from Carawan's Marina) and Mackey's Marina (-24 miles from Carawan's Marina).
Captain Neill's Seafood is an extremely important part of the local economy which currently
employs approximately 150 people in the seafood processing operation and is directly
associated with approximately 45 fishing boats (private operations with 2 people per boat). In
addition to the approximately 240 person direct salary positive impacts associated with the
operation, there are extensive secondary positive impacts to the economy. The operation
affects nearly every business in Tyrell County, including utility companies, grocery stores, fuel
stations, etc. Most of this cannot be accurately quantified, but as an example, the monthly
water bill for the company is commonly over $10,000.
Background
The subject property is an approximately 356 acre tract of land in Tyrrell County, on the
Albemarle Sound, to the north of the Town of Columbia. The property is accessible from
Deweys Pier Road which leads to Woodard Road.
The property contains a man-made basin boat basin that is connected to The Albemarle Sound.
CAMA Major Permit 38-96 was originally issued in 1996 for the excavation of an upland basin in
high ground, maintenance excavation of an access channel in the Sound (to -6 ft NWL),
dockage structures and a boat ramp. The permit was modified in 1997 to include construction
of a bulkhead around the perimeter of the boat basin, construction of a bulkhead in each side of
the entrance canals and construction of (2) 150 ft wooden groins into the Albemarle Sound.
This work is permitted, but not yet built at this time.
In 2011, a wetland delineation was performed and confirmed by USACE on the northern
(waterward) 120 acres of the subject tract. The upland areas of the property consist of
agricultural fields and some wooded uplands. The wetland areas are primarily wooded. RECEIVED

Existing Environmental Conditions
The shallow water sound bottom consists of loose sand overlying clay beds in some areas. A
water depth survey and SAV analysis was performed in summer 2014 adjacent to the property
and also in the existing basin. No rooted SAV was observed in this area during this early June
survey. Based on conversations with representatives of NCDENR, this southern shore of the
Albemarle has not been known this to be an SAV area, likely from the high wave energy,
especially from NE wind events.
Shoaling has been a constant problem for maintaining an operable marina is this location.
Since original permit issuance, the marina can only operate by maintenance dredging every
year. And, the existence of the dredging moratorium in this area (beginning February 15°h of
each year) is problematic for marina operation due to the rapid shoaling that occurs after
February 15"' and before the start of crabbing season. In fact, in many years', the entrance to
the basin shoals in almost immediately after an expensive dredge operation. Sand movement
occurs in this area from the shoreline to water depths exceeding 8 ft or more. This is evident
from aerial photograph inspection where bars and shoal formation and migration can be
followed.
Proposed Work
1. Channel Widening: The purpose of the proposed dredging is to maintain adequate water
depths along the entrance to and within the existing man-made canal/basin and channel
connected to The Albemarle Sound so that there is safe ingress and egress for large scale
commercial fishing boast that draw 4.5 feet of water. The existing channel is permitted at 25
ft wide and -6 ft deep. This permit request is to widen the channel to 60 ft at -6.5 ft deep
(relative to NWL). In order for this commercial marina to be successful, it is extremely
important to maintain a safe navigable channel of at least -6.5 ft relative to normal water
level (NWL), since many boats that will draw at least 4.5 ft of water. Based on frequent low
wind tide events and/or rough seas that affect wave trough effective depths by 2 ft on
regular occasion, a baseline of -6.5 in the channel is absolutely necessary since these
fishermen need to work every day.
The excavation work will be performed with the use of a barge mounted and/or land based
(jetty based) long reach excavator using a clamshell bucket. The excavator will dig material
from the channel area onto a material (hopper) barge with sides. Use of a clamshell bucket
minimizes the amount of bottom disturbance, and when the bucket is fully loaded, the
amount of water transferred to the barge is minimal. The barge, when loaded, will be moved
inside the basin and the material will be transferred to soil stockpile areas in the adjacent
agriculture fields on the subject property. If excavation is from land Getty and/or beach) and
mats instead of barge, the full bucket of material will be directly transferred to a dump truck RECEIVED
and then it will be transferred to the same stockpile/disposal areas.

2. Channel Protection Jetties: Permitting of rock and concrete channel protection jetties was
the main topic of a July 9, 2014 interagency scoping meeting. The jetties proposed would
be on either side of the 60 ft wide channel and would extend 250 ft and 257 ft respectively in
to the sound, following the same angle as the existing permitted channel. These jetties
would be approximately 100 ft longer than the permitted (but not built) wooden groins (they
are permitted to 150 ft).
Constant shoaling and longshore sand movement is the primary need for these jetties.
While the fastest sand movement is in shallow water, sand movement clearly does occur out
to the naturally occurring project depth (-6.5 ft) and greater. Without channel protection
jetties, the channel quickly shoals in and requires maintenance dredging.
Rock and concrete is a much more permanent solution to the channel protection problem
than vertical sheet pining groins or jetties. This is an extremely high energy shoreline that
can quickly destroy sheetpile structures, both from wave energy and also from the battering
effect of trees, pilings and other items that ram into and tear out structures. This is a
commercial facility and needs to be armored as such. Mr. Carawan's idea is to adequately
armor this facility the first time. This will allow the livelihood of Captain Neill's Seafood and
and fishermen to proceed uninterruptedly. As we all have seen, North Carolina's
commercial fishing industry is fragile due to fishery conditions and imposed regulations to
help manage the system. What we need to ensure for the commercial fishermen is a way to
be able to work while following the protocol.
During the scoping meeting, the jetty footprint discussed was up to 36 ft wide. We have
since been able to reduce the proposed jetty footprint to an average width of 20 ft. This was
done as an attempt to avoid and minimize the bottom footprint of the rock structure.
Included on the CAMA Major Plan is a cross-section of the channel with jetties. Initially
(going in to the scoping meeting), the jetty would have been built at a 2:1 slope adjacent to
the edge of the channel. We have now separated the edge of the jetty from the channel
edge by at least 10 ft, allowing a reduction in the width. The width has been further reduced
by building the structures at a 2:1 slope from the substrate up to NWL. Instead of continuing
to build the wall up another 3 ft with a plateau on the top (for machine access down the
structure), the actual future work plateau will be at or near NWL. There will be a pile of rip -
rap on top of the plateau (up to 3 ft above NWL), but, this material will be removed for
machine access when maintenance to the jetty of channel is needed. When the
maintenance work is complete, the material will be put back in place.
For local comparison purposes, the jetty system at the Alligator River Marina appears to
extend about 300 ft into the river and is reportedly much wider than what we are proposing
herein.

wetlands and 1,443 sq.ft of uplands is proposed. The total volume of material to be
excavated in this area is 1,134 cu yds. The material will be dug from a land based
excavator, starting at the shoreline area closest to the Albemarle Sound and will work back
from there. When necessary, timber mats will be used in 404 areas to support the
excavator. Excavated material will be spread on upland agricultural areas, similarly to the
channel material.
Adjacent to wetlands, 300 lin.ft. of cantilevered bulkhead is proposed so that there would be
no bulkhead backfill in this area.
4. Shoreline Stabilization Rip -Rap: 628 of shoreline stabilization rip -rap (10 ft wide x 3 ft high)
is proposed to protect the natural shoreline from ongoing erosion at or near the existing
normal water line.
