This permit, issued on February 10, 2015 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Groins/Channel Stabilization
1) The authorized groins/channel stabilization shall adhere to the alignment depicted on the attached
workplan drawing.
2) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the
U.S. Coast Guard, through regulation or otherwise, on the authorized groins/channel stabilization. At
a minimum, permanent reflectors shall be attached to the structure in order to make it more visible
during hours of darkness or inclement weather.

This permit action may be appealed by the permittee or Signed by the authority of the Secretary of D

AIDIDITIONAL CONDITIONS
Shoreline Stabilization
3) Unless specifically altered herein, this permit authorizes only the construction of the riprap and bulkhead
that are expressly and specifically set forth in the permit application and workplan drawing.
4) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the
structure.
5) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal sheet piles or other
suitable materials approved by department personnel. No excavation landward of the authorized
alignment is permitted except for that which may be required for the construction of the bulkhead wall,
riprap, deadmen cables, etc.
6) The riprap material shall be free from loose dirt or any pollutant. It shall be of a size sufficient to
prevent its movement from the approved alignment by wave or current action.
7) The riprap material shall consist of clean rock or masonry materials such as but not limited to granite,
marl, or broken concrete.
8) All backfill material shall be clean and free of any pollutants except in trace quantities.
9) All backfill material shall be obtained from a high ground source and confined behind the permitted
bulkhead.
Channel Excavation
10) Unless specifically altered herein, the dimensions of the area to be excavated shall not exceed the area
that is expressly and specifically set forth in the attached permit application and workplan drawings.
Any proposal to change the area to be excavated shall require permit modification.
11) Excavation shall not exceed —6.5 feet below the normal water level. In no case shall the depth of
excavation exceed the depth of connecting waters.
12) In order to protect anadromous fish spawning, no excavation shall be permitted between February 15
and September 30 of any year without the prior approval of the Division of Coastal Management.
13) The temporary placement or double handling of excavated materials within waters or vegetated wetlands
is not authorized.
Spoil Disposal
14) All excavated materials shall be confined above normal high water and landward of regularly or
irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of
solids into any marsh or surrounding waters.

ADDITIONAL CONDITIONS
15) Any change in the spoil disposal area shall require additional authorization from the Division of Coastal
Management.
Sedimentation and Erosion Control
16) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
17) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence,
diversion swales or berms, etc.).
18) All disturbed areas shall be properly graded and provided a ground cover sufficient to restrain erosion
within thirty days of project completion.
General
19) The permittee understands and agrees that, if fixture operations by the United States requires the
removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause
unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon
due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions
caused thereby, without expense to the United States or the state of North Carolina. No claim shall be
made against the United States or the state of North Carolina on account of any such removal or
alteration.
20) No open water areas or vegetated wetlands shall be excavated or filled outside the area indicated in the
attached workplan drawing.
21) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
22) The permittee and/or contractor shall meet with a representative of the Division of Coastal Management
prior to project initiation in order to discuss the conditions set forth in this permit.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 946-6481 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal water level.
NOTE: The N.C. Division of Water Quality has assigned the proposed project DWQ Project No. 14-
1165.
NOTE: The U.S. Army Corps of Engineers has assigned the proposed project COE Action Id. No. SAW-
2014-02109.

Dear Sir or Madam:
The enclosed permit constitutes authorization under the Coastal Area Management Act, and where
applicable, the State Dredge and Fill Law, for you to proceed with your project proposal. The original (buff -
colored form) is retained by you and it must be available on site when the project is inspected for
compliance. Please sign both the original and the copy and return the copy to this office in the enclosed
envelope. Signing the permit and proceeding means you have waived your right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS
113A-121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter150B
with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, (919) 733-
2698 within twenty (20) days of this decision on your permit. You should also be aware that another
qualified party may submit an objection to the issuance of this permit within twenty (20) days.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work
must be carried out in accordance with your application. Modifications, time extensions, and future
maintenance requires additional approval. Please read your permit carefully prior to starting work and review
all project plans, as approved. If you are having the work done by a contractor, it would be to your benefit to
be sure that he fully understands all permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we
request that you complete and mail the enclosed Notice Card just prior to work initiation. However, if
questions arise concerning permit conditions, environmental safeguards, or problem areas, you may contact
Department personnel at any time for assistance. By working in accordance with the permit, you will be
helping to protect our vitally important coastal resources.

CAMA MAJOR DEVELOPMENT PERMIT
The Department of Environment and Natural Resources hereby gives public notice as
required by N.C.G.S. 113A-119(b) that an application for a development permit in an Area of
Environmental Concern as designated under the Coastal Area Management Act (CAMA) was
received on 5 November 2014. According to the said application submitted by Phillip Carawan,
applicant proposes to construct two rock jetties, expand and bulkhead an existing channel and
canal, and riprap the shoreline in the Albemarle Sound and a manmade basin near the Town of
Columbia in Tyrrell County, North Carolina
A copy of the entire application maybe examined or copied at the office of David W.
Moye, District Manager, Washington Regional Office, 943 Washington Square Mall,
Washington, NC, during normal business hours. Public comments received by 28 November
2014 will be considered. Later comments will be accepted and considered up to the time of

The NC Division of Coastal Management hereby acknowledges receipt of your application for
State approval for development of your property located off of Woodard Road off of SR 1218 in
the Town of Columbia in Tyrrell County, North Carolina It was received on 5 November 2014,
and appears to be adequate for processing at this time. The projected deadline for making a
decision is 20 January 2015. An additional 75-day review period is provided by law when such
time is necessary to complete the review. If you have not been notified of a final action by the
initial deadline stated above, you should consider the review period extended. Under those
circumstances, this letter will serve as your notice of an extended review. However, an additional
letter will be provided on or about the 75th day. Kevin Hart, Field Representative for the Division of
Coastal Management is responsible for processing your permit and he can be reached at 252-948-3936 or
via email at Kevin.Hart(ancdenr.gov if you have any questions.
If this agency does not render a permit decision within 70 days from the 5 November
2014, you may request a meeting with the Director of the Division of Coastal Management and
permit staff to discuss the status of your project. Such a meeting will be held within five
working days from the receipt of your written request and shall include the property owner,
developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which must
be posted at the property of your proposed development. You should post this notice at a
conspicuous point along your property where it can be observed from a public road. Some
examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-
way fronting your property, or at a point along the road right-of-way where a private road would
lead one into your property. Failure to post this notice could result in an incomplete application.

W ITNESSETH, that the Grantor, for valuable consideration paid by the Grantee, the receipt of
which is hereby acknowledged, has and by these presents does grant, bargain, sell and convey unto the
Grantee in fee simple, all of that certain lot or parcel of land situated in the Columbia Township, Tyrrell
County, North Carolina described as follows:
All that certain tract of land lying in Columbia Township, Tyrrell County, North Carolina ,
bounded on the East by state Route 1218, on the south by Reynolds, Brickhouse and Morris
(now or formerly), on the West by Chaplin, Snell and McDonald (now or formerly), on the
North by Albemarle Sound and more particularly shown on the plat prepared by Styons
Surveying Services entitled 'WOODARD PROPERTY IN TYRRELL COUNTY,
SURVEYED FOR SCUPPERNONG GROUP LLC", bearing the date of 5-29-03 and File No.
03-038, and being recorded in Plat Cabinet C, at Slide 114, in the Office of the Register of
Dads of Tyrrell County. The plat is incorporated herein by reference. This conveyance
includes the bottoms of all ditches, watercourses, creeks, canals and basins within the
boundaries described herein above.
All or a portion of the property herein conveyed does not include the primary residence of a grantor. RECEIVED

Title to the property hereinabove described was acquired by the Grantor by instrument recorded in
Book 232, Page 90, Tyrrell County Registry.
TO HAVE AND TO HOLD the aforesaid lot or parcel of land and all privileges and
appurtenances thereto belonging to the Grantee in fee simple.
Grantor covenants to and with Grantee that Grantor is seized of the premises in fee simple, has the
right to convey the same in fee simple, that title is marketable and free and clear of all encumbrances, and
that Grantor will warrant and defend the title against the lawful claims of all persons whomsoever, subject
to the exceptions hereinafter stated:
1. Ad valorem taxes for the year 2013 and subsequent years.
2. Easements of record.
3. Any local, county, state, or federal laws, ordinances, or regulations
relating to zoning, environment, subdivision, occupancy, use,
construction, or development of the subject property.
4. Restrictive covenants and the amendments thereto, if any, of record in
the aforesaid Public Registry.
