This permit, issued on February 16, 2022 , is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Anv violation
.,r tuese terms may De subject to tines, imprisonment or civil action; or may cause the permit to be null and void.
Docking Facility Expansion
1) This permit authorizes only the docks, pier extension, boat lift, and other structures and uses located
in or over the water that are expressly and specifically set forth in the permit.application. No other
structure, whether floating or stationary, shall become a permanent part of this docking facility
expansion without permit modification. No non -water dependent uses of structures shall be
conducted on, in or over Public Trust waters without permit modification.
2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
docking facility. Any sewage discharged at the docking facility shall be considered a violation of this
permit for which the permittee is responsible. This prohibition shall be applied and enforced
throughout the entire existence of the permitted structure.

qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2025

your project is consistent with the North Carolina Coastal
Management Program.

3) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
4) This permit authorizes one (1) additional formalized boat slip for a maximum of five (5) formalized boat
slips at this docking facility.
5) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
6) The authorized stricture and associated activity shall not cause an unacceptable interference with
navigation and shall not exceed the dimensions shown on the attached permit drawings.
7) The permittee is advised that a building permit from the Town of Morehead City shall be obtained prior
initiation of any construction activities.
Sedimentation and Erosion Control
8) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
9) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses or properties.
General
10) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
11) All construction debris associated with the removal or construction of the permitted development shall
be contained within the authorized project area and disposed of in an approved upland location.
12) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the project by way of Regional General Permit
197800056 (Action ID SAW-2022-00067).
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4497 and assigned the project DWR Project No. 2021-1832.

NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 808-2808 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high-water level.
NOTE: An application processing fee of $250 was received by DCM for this project.

SUBJECT: Comments and Recommendations - CAMA Major Permit -Charles R. Seagrave,
Morehead City, Carteret County
The following is my assessment and consequent recommendations of the above
referenced proposal: This proposal involves the addition of a fixed pier extension,
floating platform with gangway, finger pier and a fifth slip with boatlift within a
canal contiguous with Peletier Creek in Morehead City, Carteret County. The
development conforms to the guidelines set forth under 15A NCAC 07H .0208. The
waters of Peletier Creek are closed to shellfish harvest and is not designated as a
Primary Nursery Area. Assuming that state and federal agencies concur with the
proposal, the District recommends the project be authorized as proposed,
contingent upon the following conditions:
• All development shall be constructed as shown on plats accepted as complete by DCM on
10/12/2021 and 12/2/2021.
• No more than a total of 5 slips shall be authorized.
• The length of the additions shall be limited to a maximum distance of 41.5' waterward of
NHW due to the 166' wide canal.
No high ground development is authorized.

Consistency Determination: The request is consistent with/not in conflict with the Town of Morehead
City Land Use Plan certified by the CRC on September 28, 2007.
Overview: The subject property is located at 112 Riverside Ave., Morehead City, Carteret County, North
Carolina. The property is .58 acres (25,569 sf). The site is located along the east side of Peletier Creek.
The property shoreline is stabilized with riprap, has an elevation is 3' above NHW. The property has 191'
of shoreline and a canal width of 166'.
The applicant is proposing to construct a pier extension, floating platform with gangway, finger pier and
fifth slip area with boatlift to the existing four slip docking facility. There is currently a single family
residence with driveway, riprap and existing four slip docking facility. The canal has a width is 166' wide
along the property. The % rule would limit dock length to a maximum of 41.5' from NHW. The applicant is
proposing a 5' x 3 6' pier extension along the north side of the existing shore parallel pier. A 4' x 26' finger
pier would be constructed off of the pier extension and on the north side of existing slip #4. A 13 ' x 13'
boatlift is proposed forthe fifth slip area along the north side of the proposed finger pier. The final portion
is the placement of a shore perpendicular 8' x 20' floating platform at the north end of the proposed pier
extension which connects via gangway. All proposed development would be located a distance of
approximately 68' from the south riparian line and approximately 62' from the north riparian line.
AECs involved include: Public Trust Areas. Peletier Creek is classified a SA/HQW, there are no PNAs, and
the waters are closed to shellfishing. There is a 20' x 52' area of wetlands along the south east side of the
property which consists mostly of Smooth Cordgrass (Sp. Altemiflora). No SAV were observed within the
project area. There are no known historic or archaeological areas of value known within the project sites.
Anticipated Impacts: The development would shade 444 sf and incorporate 613 sf of shallow bottom

habitat. The proposed docking facility additions would not interfere with navigation and would meet the
width rule and not extend into the channel portion of the canal as long as they do not exceed a
maximum distance of 41.5' from NHW. No dredging is proposed at this time due to -4' nlw water depths
within the proposed slip area. There would be no impacts to wetlands, shellfish or SAV resources. A total
of five slips are proposed (4 existing and 1 new).
Basis for Determination:
The Town of Morehead City Future Land Use Map (FLUM) designates the site as "Medium Density
Residential".
The following LUP policies are applicable to this request:

The Division of Water Resources (DWR) has received a copy of your CAMA Major permit application
request dated December 2, 2021 and received by this office on December 17, 2021. The proposed
project is located within the waters of the Pelletier Creek which are class SB# waters by DWR.
In accordance with the attached General Certification #4497 (GC 4497), the impacts described in
your application do not require written authorization to utilize GC 4497. However, you are required
to follow the conditions listed in the attached certification.
You should also obtain and comply with any other federal, state and local requirements including
(but not limited to erosion and sedimentation control regulations and state stormwater
requirements before you proceed with your project). Also, the approval to proceed with your
proposed impacts to waters a depicted in your application shall expire upon expiration of the 404
or CAMA Permit.
This Certification can be contested as provided in Articles 3 and 4 of General Statute 150B by filing
a written petition for an administrative hearing to the Office of Administrative Hearings (hereby

The existing .58-acre (25569sf) tract is located at 112 Riverside Ave., Morehead City,
Carteret County. The site is found by following Highway 70 East into the Morehead City town
limits. Continue along Highway 70 through the 4-way lights at the intersection of Highway 24 and
Bridges Street Extension for approximately .91 miles and turn right onto Riverside Ave. (just past
Coral Bay Marina) and follow until the pavement ends. The site is at the end of Riverside Ave.

Resources and have been previously dredged within the canal area. There are no
nearby Primary Nursery Areas. According to the maps provided by the Shellfish
Sanitation Section of the NC Division of Marine Fisheries, the waters of Peletier
Creek are closed to shellfish harvesting adjacent to the proposed project. No SAV
were observed within the project area. There is no dredging proposed within
navigable waters and there are no known historic or archaeological areas of value
known within the project sites.
10. Proposed Project
The applicant is proposing a pier extension, finger pier, floating platform with
gangway and a fifth slip with boatlift. The canal has a width is 166' wide along the
property. The '/4 rule would limit dock length to a maximum of 41.5' from NHW.
The applicant is proposing a 5' x 36' pier extension along the north side of the
existing shore parallel pier. A 4' x 26' finger pier would be constructed off of the
pier extension and on the north side of existing slip #4. A 13' x 13' boatlift is
proposed for the fifth slip area along the north side of the proposed finger pier. The
final portion is the placement of a shore perpendicular 8' x 20' floating platform at
the north end of the proposed pier extension which connects via gangway. All
proposed development would be located a distance of approximately 68' from the
south riparian line and approximately 62' from the north riparian line.
11. Anticipated Impacts:
The development would shade 444 sf and incorporate 613 sf of shallow bottom
habitat. The proposed docking facility additions would not interfere with navigation
and would meet the '/4 width rule and not extend into the channel portion of the canal
as long as they do not exceed a maximum distance of 41.5' from NHW. No dredging
is proposed at this time due to 4' nlw water depths within the proposed slip area.
There would be no impacts to wetlands, shellfish or SAV resources. A total of five
slips are proposed (4 existing and 1 new).
