subject the permittee to a fine or criminal or civil action; and may cause the permit to become null and void.

compliance. The applicant certifies by signing this permit that: 1) prior to undertaking any activities authorized by this
permit, the applicant will confer with appropriate local authorities to confirm that this project is consistent with the
local land use plan and all local ordinances, and 2) a written statement from the adjacent riparian property owner(s)
has been obtained, or proof of delivery of certified mail notification of the adjacent riparian property owner(s).
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certify that this project is consistent with the North Carolina Coastal Management Program.

Dear Ms. McPherson:
The enclosed application was delivered by certified mail and addressed to Mr. Mark
Saunders, ostensibly as an owner of property adjacent to the subject property. As a technical
matter, Mr. Saunders does not own any property adjacent to 683 Lagare Lane in Supply, so the
notice is defective. Moreover, the drawing included with the application does not show detail
such as lot lines, critical riparian corridors, or the location of the proposed construction relative
to neighboring amenities or improvements — all of which are necessary for evaluation of the
project.
Perhaps the notice was intended for Seascape at Holden Plantation, LLC ("Seascape"),
which is the owner of parcel 2320001118 that appears to be adjacent to the subject property. If
so, Seascape objects to the notice, objects to the project as currently drawn, and certainly does
not waive the setback requirement that would be applicable to its property and this project.
Thank you for your attention, and, if you have any questions, please do not hesitate to
contact the undersigned. We trust that appropriate consideration will be given to our objection.

As I just explained to Mr. Kepley, the adjacent landowner Seascape
at Holden Plantation, LLC now understands that the work to be done is
repair only - replacement of structures in the same location and size as had
been there.
With that info, Seascape can withdraw its objection previously
submitted, and please let me know how that can be accomplished with
CAMA.
Your email immediately below is a bit confusing, for Seascape is
not the HOA.

I am not sure if you received this information last week from Rick Nelson but wanted to send it again.
We are the contractor for which Travis Kepley has hired to rebuild his damaged dock and gazebo, back in
the same footprint as previously positioned. In order to receive the CAMA permit we are requesting the
HOA to sign the necessary riparian, I understand they requested this information which shows the current
riparian lines and the current location of Mr. Kepley's dock.
Is there any other information you would require?

I'm not sure what your position is for H5 Construction, but to save you and me a lot of headaches,
am not going to forward your site plan to the adjacent property owner's attorney. I've attached a copy
of what you sent me, labeled "GIPS for 683 Lagare", which is just a screenshot taken from Brunswick
County's GIS website, with the property lines high -lighted in green. I am confident that as an
employee of H5 Construction, a company whose main business is building docks, that you know
more about building docks than I do. However, it appears that what you don't know is that the final
dock location has nothing to do with the property lines. The dock location is determined by the
Riparian Corridor. I've attached a copy of a survey that was done for a dock that we had built
recently, within sight of Mr. Kepley's dock. The Riparian Corridor has to be identified, and the
setbacks run perpendicular to the Riparian Corridor to the property corners. This is the information
that Mrs. Jordan was asking you to provide her.

Rick,
If this was simply replacing a gazebo that had been previously
there, the application should have said so. I don't know if the
replacement is the same size or in the exact same location. The
application/sketch says "new".
Mark has explained that riparian corridors on the ICW don't always
follow just a property line extension, which is why we are requesting the
detailed plans, which I also understand are typical.
We are not trying to be difficult; just trying to have the owner (or
probably the contractor) submit only what is necessary. As an adjacent
property owner, we also want to make sure that we don't waive any
setback.
Not sure this reply is helpful, but Kepley may want to instruct his
contractor to give the appropriate info.

Good morning Elaine,
Travis Kepley is a homeowner in SeaScape. He owns a waterfront home with a dock at 683 Lagare
Lane. Last year a boat ran thru his dock and knocked the gazebo off, which he said literally floated
out to sea. He hired H5 to rebuild the dock and gazebo, which required a CAMA permit. He called
me this week, presumably because I was the one who gave him copies of the plans for the gazebo
after the accident. He told me that on behalf of the adjacent property owner, you had sent a
rejection letter to CAMA (copy attached). He explained that all that they are doing is replacing what
had previously been permitted and approved, and was previously there prior to the accident. I
wondered if you thought that this was a brand-new dock, which would require the detailed site plan
that you mentioned in your letter. Mr. Kepley asked men to do whatever I could to get this
resolved. Please let me know if you still want a detailed site plan, now that you know that this is just
a repair.
